Executive Order No. 15-01
Rescinding Certain Executive Orders
WHEREAS, the executive power of the Governor of
Kansas has been exercised through the issuance of Executive Orders, Executive Directives, and Proclamations;
and
WHEREAS, the issuance of such documents is recognized as an inherent power vested in the chief executive
of this state; and
WHEREAS, several Executive Orders have contained
automatic rescissions or have been rescinded or superseded by subsequent Executive Orders, and are currently
of no force and effect; and
WHEREAS, many Executive Orders have been for a
limited duration, involve the creation of a task force for
a specific task, or are otherwise outdated; and
WHEREAS, periodic examination and evaluation of
the continuation of the force and effect of these Executive
Orders is necessary and proper.
NOW THEREFORE, pursuant to the authority vested
in me as Governor and chief executive of the State of Kansas, I hereby rescind the force and effect of the following
Executive Orders promulgated by the Governor of the
State of Kansas and abolish all councils, task forces, committees, boards, advisory councils, and commissions (if
any) created by such Executive Order:

Notice of Investment Rates
The following rates are published in accordance with
K.S.A. 75-4210. These rates and their uses are defined in
K.S.A. 2014 Supp. 12-1675(b)(c)(d) and K.S.A. 2014 Supp.
12-1675a(g).
WHEREAS, the State of Kansas is committed to employment practices which prevent discrimination based
on race, color, gender, religion, national origin, ancestry,
disability or age; and
WHEREAS, State of Kansas employers are expected to
provide opportunity to all individuals without discrimination, and will comply with applicable state and federal
law; and
WHEREAS, the State of Kansas is dedicated to the principle that veterans and individuals with physical, cognitive and mental disabilities bring valuable skills and perspectives to the Kansas employment system; and
WHEREAS, it is an additional principle that the State
of Kansas employ individuals that are vital to creating a
healthy and robust system of efficient business practices
and ensuring that all citizens of Kansas receive the support and services they need and to which they are entitled; and
WHEREAS, the State of Kansas recognizes the dedication and sacrifice members of the armed services and
veterans make to protect and provide for American and
Kansas values; and
WHEREAS, hiring and retaining diverse, highly qualified employees, including veterans and individuals with
physical, cognitive and mental disabilities, requires leadership support and attention. Given that State employees
make significant contributions to the State’s success, it
makes good business sense to treat employees, especially
veterans and individuals with physical, cognitive and
mental disabilities with dignity and respect.
NOW, THEREFORE, pursuant to the authority vested
in me as Governor of the State of Kansas, I hereby declare
that all state entities under my jurisdiction shall make
certain that each agency have employment management
practices which include outreach recruitment and hiring,
support, mentoring, development, rewards, and recognition for achievement. Recognizing the skills and perspective of veterans and individuals with physical, cognitive and mental disabilities, the employment
management practices should include a system which incorporates and acknowledges a preference in hiring, retention and promotion for veterans and individuals with
physical, cognitive and mental disabilities in accordance
with any guidelines issued by the Secretary of Administration.
This document shall be filed with the Secretary of State
as Executive Order No. 15-02 and shall become effective
immediately subject to guidelines issued by the Secretary
of Administration.

Request for Proposals
The Kansas Department for Children and Families
(DCF), Rehabilitation Services (RS) — Independent
Living Program, announces the release of a request for
proposals for a statewide network of centers for independent living to provide the core services (information
and referral services, independent living skills training,
peer counseling, individual and systems advocacy, transition or diversion of persons from institutions into the
community and transition services for youth into postsecondary life) and other allowable independent living (IL)
services to and on behalf of persons with a disability. This
request is ensure core IL service availability in all 105
Kansas counties. Community-based, private nonprofit,
nonresidential agencies or organizations are eligible to
submit proposals. Applicants must currently meet or
have plans to meet the assurances contained in Section
725(c)(1) of the Rehabilitation Act of 1973, as amended,
as well as 34 CFR 364.4(b) to be an eligible agency.

Request for Proposals
The Kansas Department for Children and Families
(DCF), Rehabilitation Services (RS) — Independent Living Program, announces the release of a request for proposals to provide a statewide mentoring, leadership and
development program for youth with disabilities. This
program is to provide both direct services and supports
to centers for independent living in their services for and
outreach to youth with disabilities. Community-based,
private nonprofit, nonresidential agencies or organizations with boards or project advisory panels with a composition of 50 percent or greater persons with disabilities
are eligible to submit proposals. Eligible applicants must
be willing to provide services in line with the 2014-2016
Kansas Statewide Plan for Independent Living and ensure that services are provided on a cross-disability basis
(regardless of disability or type of disability).

Notice of Hearing on Proposed
Administrative Regulation
A public hearing will be conducted at 10 a.m. Tuesday,
April 21, in Suite 804, Jayhawk Tower, 700 S.W. Jackson,
Topeka, to consider the adoption of K.A.R. 117-7-1.
This 60-day notice of public hearing shall constitute a
public comment period for the purpose of receiving written public comments on the proposed regulation. All interested parties may submit written comments prior to
the hearing to the Kansas Real Estate Appraisal Board,
Suite 804, Jayhawk Tower, 700 S.W. Jackson, Topeka,
66603. All interested parties will be given a reasonable
opportunity to present their views orally on the adoption
of the proposed regulation during the hearing. In order
to give all parties an opportunity to present their views,
it may be necessary to request each participant to limit
any oral presentation to five minutes.
Any individual with a disability may request accommodation in order to participate in the public hearing and

The proposed regulation amendments are for adoption
on a permanent basis. A summary of the proposed
amendments to the regulation and the economic impact
follows:
117-7-1. Fees. This regulation is being amended to decrease the original license/certification and renewal of license/certification fees from $200 to $150.
The economic impact to appraisers will be a savings of
$50 annually. The economic impact to the Real Estate Appraisal Board will be a decrease in revenues of approximately $46,296 and to the state general fund of $5,144.
There is no economic impact to other state agencies or to
the public.

Notice of Meeting on the 2015
Weatherization State Plan
The Kansas Housing Resources Corporation will conduct an informal public meeting to provide an opportunity for citizens and stakeholders to provide suggestions
for the development of the 2015 Weatherization State
Plan. The public discussion will begin at 10 a.m. Monday,
February 23, at the KHRC office, 611 S. Kansas Ave., Suite
300, Topeka.
The 2015 State of Kansas Weatherization State Plan will
be drafted off of last year’s approved plan, which can be
found on KHRC’s website at www.kshousingcorp.org/
weatherization.aspx. Limited hard copies will be available at the public meeting site and upon request. Written
comments must be received by 5 p.m. February 23. A final
public hearing will be announced and advertised upon
the completion of the draft plan.
Parking is available along Kansas Avenue, and the
meeting will be less than the two-hour limit. Persons in
need of a sign language interpreter, an assistive listening
device, large print or other material for accommodation
to attend this meeting should notify the KHRC at least

an Existing New Motor Vehicle Dealer
Notice has been received from Triumph Motorcycles
America of its intent to establish the Triumph franchise
to the RNKC LLC, dba Indian Motorcycle of Kansas City,
location at 800 N. Rogers Road, Olathe, Kansas.
Pursuant to K.S.A. 8-2430(a)(5), any existing new motor
vehicle dealer may protest the proposed addition of the
new franchise of Triumph if that existing new motor vehicle dealer has a franchise agreement for the same linemake vehicle as that which is to be sold or offered for sale
by RNKC LLC, dba Indian Motorcycle of Kansas City, at
800 N. Rogers Road, Olathe, Kansas, and provided that
the existing new motor vehicle dealer is physically located such that its relevant market area, as defined in
K.S.A. 8-2430(e), includes the location where the new Triumph dealership will be located.

Notice to Fiber Optic Companies
The Kansas Department of Transportation is seeking to
develop its right-of-way assets with installation of fiber
optic infrastructure along the U.S. 169 corridor from the
Oklahoma border to I-35 in Olathe, Kansas (approximately 147 miles), and/or along U.S. 69 and Alt. U.S. 69
(with U.S. 400) from the Oklahoma border to I-35 in Lenexa, Kansas (approximately 146 miles). The U.S. 169 corridor and U.S. 69 corridor map may be seen at the following link:

State highways experience recurring and nonrecurring
congestion, incidents, construction and maintenance activities. Installation of KDOT-owned fiber optic facilities
on state highways such as U.S. 169 and U.S. 69 will allow
KDOT to implement Intelligent Transportation Systems
(ITS) applications that provide system and transportation
managers with timely information on current travel and
roadway conditions, and tools for controlling traffic flow,
congestion construction management and maintenance
activities, traffic incidents and events.
Dissemination of travel information by ITS systems
such as travel times and incident information allow the
traveling public to make better informed decisions regarding their travel choices. In addition, KDOT-owned
fiber optic facilities can be used to link with other state
governmental agencies and facilities for public welfare
and safety. KDOT has identified the U.S. 169 and U.S. 69
corridors as a route for which installation of commercial
fiber optic infrastructure (as a pilot) with a private telecommunication entity would benefit the state of Kansas.
To develop a fiber optic infrastructure to meet KDOT’s
long-term ITS communications needs, KDOT is considering the nonexclusive use of its right-of-way along the
U.S. 169 and U.S. 69 (either or both) corridors to allow a
company in fiber optic business to install fiber optic cable
along the right-of-way under a permitting relationship
with KDOT. The permit would be given by KDOT in
exchange for furnishing dedicated fiber optic infrastructure to KDOT. KDOT does not intend to pay for the installation, maintenance, any necessary future relocations
or provisions of services and fiber optic infrastructure.

A public hearing will be conducted at 10 a.m. Tuesday,
April 21, in Room 115 of the Kansas Department of Agriculture, 1320 Research Park Drive, Manhattan, to consider the adoption of an amendment to an existing rule
and regulation on a permanent basis.
Individuals wishing to participate by teleconference

K.A.R. 5-22-7. Safe yield. The proposed amendments
to the regulation will establish a maximum rate of diversion for a small use exemption permit to a maximum of
50 gallons per minute within the boundaries of Equus
Beds Groundwater Management District No. 2.
Economic Impact: There will be no fiscal impact to the
agency and governmental agencies. The amendment will
have a positive fiscal impact to businesses and individuals allowing them to obtain a small use permit for their
economic benefit.
This 60-day notice of the public hearing shall constitute
a public comment period for the purpose of receiving
written public comments on the proposed amendment to
the rule and regulation. All interested parties may submit
written comments prior to the hearing to the chief engineer, Division of Water Resources, Department of Agriculture, 1320 Research Park Drive, Manhattan, 66502, or

Administrative Regulations
The Kansas State Board of Examiners in Optometry
will conduct a public hearing at 9 a.m. Thursday, April
23, at the Hilton Garden Inn, Little Apple Boardroom, 410
S. 3rd St., Manhattan, to consider adoption of proposed
regulations K.A.R. 65-5-6, 65-5-10, 65-5-11 and 65-5-13.
These regulations are being proposed as permanent regulations. A summary of the proposed regulations and the
estimated economic impact follows:
Summary of Regulations:
K.A.R. 65-5-6. Continuing education. K.A.R. 65-5-6 is
an amended permanent regulation establishing the continuing education requirements for licensed optometrists.
K.A.R. 65-5-10. Glaucoma licenses. K.A.R. 65-5-11. Biennial renewal. K.A.R. 65-5-10 and 65-5-11 are being revoked.
K.A.R. 65-5-13. Professional liability insurance.
K.A.R. 65-5-13 is a new permanent regulation that requires each person licensed by the board to obtain and
maintain professional liability insurance coverage of at
least $1,000,000 for each claim.
Economic Impact: The adoption of these regulations is
not anticipated to have an economic impact on the Kansas
State Board of Examiners in Optometry, any other government entity, the general public or licensees. There is
no environmental impact.
The time period between publication of this notice and
the scheduled hearing serves as the required public comment period of at least 60 days for the purpose of receiving written public comments on the proposed regulations. At any time during the public comment period
interested parties may submit written comments to Jan

A public hearing will be conducted at 9 a.m. Thursday,

on the proposal for the KDFA to issue its Agricultural
Development Revenue Bonds for the projects numbered
below in the respective maximum principal amounts. The
bonds will be issued to assist the borrowers named below
(who will be the owner and operator of the project) to

typically purchased by a lender bank who then, through

owner/operator for farming purposes. The project is being

is located at the North Half of the Southeast Quarter of
Section 3, Township 6, Range 11, Pottawatomie County,
Kansas, approximately 4.5 miles north of Onaga on Onaga
Road.
The bonds, when issued, will be a limited obligation of
the KDFA and will not constitute a general obligation or
indebtedness of the state of Kansas or any political subdivision thereof, including the KDFA, nor will they be an
indebtedness for which the faith and credit and taxing
powers of the state of Kansas are pledged. The bonds will
be payable solely from amounts received from the respective borrower, the obligation of which will be sufficient to pay the principal of, interest and redemption premium, if any, on the bonds when they become due.

The Kansas Department of Health and Environment is
soliciting comments regarding a proposed air quality operating permit. Tallgrass Interstate Gas Transmission,
LLC has applied for a Class I operating permit renewal
in accordance with the provisions of K.A.R. 28-19-510 et
al. The purpose of a Class I permit is to identify the
sources and types of regulated air pollutants emitted
from the facility; the emission limitations, standards and
requirements applicable to each source; and the monitoring, record keeping and reporting requirements applicable to each source as of the effective date of permit issuance.
Tallgrass Interstate Gas Transmission, LLC, 370 Van

The U.S. Environmental Protection Agency has a 45day review period, which will start concurrently with the
public comment period, within which to object to the proposed permit. If the EPA has not objected in writing to
the issuance of the permit within the 45-day review period, any person may petition the administrator of the
EPA to review the permit. The 60-day public petition period will directly follow the EPA’s 45-day review period.
Interested parties may contact KDHE to determine if the
EPA’s 45-day review period has been waived.
Any such petition shall be based only on objections to
the permit that were raised with reasonable specificity
during the public comment period provided for in this

Facility Description: The proposed action is to reissue permits for five
existing Class III salt solution-mining wells. The permittee is authorized to inject fluids consisting of fresh water and unsaturated
brine. Injection is into the Hutchinson Salt member of the Wellington
formation. The top of the cavity shall be no shallower than 250 feet
below land surface and mining shall not extend into the upper 40
feet of the salt deposit. The maximum operational injection pressure
is not to exceed 130 pounds per square inch at the wellhead. All
construction, monitoring and operation of these wells shall meet the
requirements that apply to Class III injection wells under K.A.R. 2843-1 through 28-43-11 and K.A.R. 28-46-1 through 28-46-44, and
other requirements of KDHE.
Persons wishing to comment on the draft documents
and/or permit applications must submit their comments
in writing to the Kansas Department of Health and Environment if they wish to have the comments considered
in the decision-making process. Comments should be
submitted to the attention of the Livestock Waste Management Section for agricultural-related draft documents
or applications, or to the Technical Services Section for all
other permits, at the Kansas Department of Health and
Environment, Division of Environment, Bureau of Water,
1000 S.W. Jackson, Suite 420, Topeka, 66612-1367.
All comments regarding the draft documents or application notices received on or before March 21 will be considered in the formulation of the final determinations regarding this public notice. Please refer to the appropriate

permittee when preparing comments.
After review of any comments received during the
public notice period, the secretary of health and environment will issue a determination regarding final agency
action on each draft document/application. If response to
any draft document/application indicates significant public interest, a public hearing may be held in conformance
with K.A.R. 28-16-61 (28-46-21 for UIC).

Notice of Hearing
The Kansas Department of Health and Environment is
proposing a State Implementation Plan (SIP) Revision to
Modify the Allocations for Kansas Utilities under the Environmental Protection Agency’s Cross-State Air Pollution Rule
(CSAPR). If requested, a public hearing for this action will
be held at 10 a.m. Tuesday, March 24, in the Flint Hills
Conference Room, third floor, Curtis State Office Building, 1000 S.W. Jackson, Topeka. To request a hearing, contact Pat Gibbs at [email protected] or 785-291-3278, or

hearing is received by noon March 20, the tentatively
scheduled hearing will be cancelled and announced on

This SIP revision is proposed in accordance with Section 110(a)(1) of the federal Clean Air Act Amendments
(CAAA) of 1990 that requires each state to submit a plan
for the implementation, maintenance and enforcement of
the National Ambient Air Quality Standards (NAAQS) to
the administrator of the U.S. Environmental Protection
Agency. It also satisfies CAA Section 110(a)(2)(D)(i)(I)
‘‘good neighbor’’ provisions, requiring that SIPs contain
adequate provisions to prohibit emissions that will significantly contribute to a nonattainment of a NAAQS or
interfere with maintenance of a NAAQS in a downwind
state.
Kansas is exercising an option in the Cross-State Rule
to reallocate otherwise lost allocations. Except for Westar
Energy, Kansas utilities will receive increases for their nitrogen oxide (NOx) emission allowance allocations for
2016. Within this SIP revision, KDHE proposes that 2,800
annual NOx tons be divided proportionally among all
Kansas utilities subject to CSAPR for calendar year 2016.

Administrative Regulations
A public hearing will be conducted at 9 a.m. Friday,
April 24, in Room 900-N of the Landon State Office Building, 900 S.W. Jackson, Topeka, to consider proposed new
permanent regulations K.A.R. 129-5-10 through 129-5-21
concerning the implementation of the KanCare prompt
payment act, K.S.A. 39-709f.
This 60-day notice of the public hearing shall constitute
a public comment period for the proposed regulations as
stated in K.S.A. 2014 Supp. 77-421(a)(3). All interested
parties may submit written comments before the hearing
to Kim Tjelmeland, KDHE, Division of Health Care
Finance, Room 900-N, Landon State Office Building,

HB 2552, passed in the 2014 session of the Legislature,
signed by the governor, and now codified in statute at
K.S.A. 39-709f, requires the KanCare MCOs to pay claims
promptly or be subject to a lawsuit for interest on unpaid
claims brought by providers. The statute expressly provides that KDHE will promulgate regulations that will
implement the statute. These regulations are intended to
fulfill this statutory requirement.
A brief summary of these regulations and the economic
impact follows:

Hearing/Notices
129-5-10. This regulation contains the definitions that
apply to these regulations.
129-5-11. This regulation designates that the statute applies only to claims after the effective date of the statute,
which was July 1, 2014.
129-5-12. This regulation specifies that the act applies
to claims submitted in paper and electronic format.
129-5-13. This regulation specifies that a claim is
deemed to be received by the MCO within three days
after it is mailed by the provider, or within 24 hours after
it is submitted electronically by the provider.
129-5-14. This regulation specifies the contents of a notice of denial or a request for additional information. This
regulation also addresses the suspension of the time period while providers provide additional information, and
the MCOs’ responsibilities once the additional information is received.
129-5-15. This regulation specifies that claims subject to
a bona fide dispute will not be subject to the act.
129-5-16. This regulation specifies that the provisions
of the act apply only to the unpaid portion of claims.
129-5-17. This regulation specifies that the prompt payment period begins on the date of resubmission of a corrected claim when the provider submits the corrected
claim before the MCO requests additional information.
129-5-18. This regulation specifies that a claim is
deemed to be paid by the MCO on the date a check is
issued for the claim, or on the date an electronic notice of
payment is sent by the MCO to the provider.
129-5-19. This regulation specifies that interest shall be
applied only to the unpaid claim, and that interest will
not be compounded. This regulation also requires the
MCOs to maintain sufficient records.
129-5-20. This regulation specifies that the act does not
apply to retroactive rates or policy changes.
129-5-21. This regulation provides that a request for
payment is not deemed a claim until the MCO is notified
that the claimant is eligible for Medicaid.
Federal Mandate: There are no federal mandates.
Economic Impact: These regulations are expected to
have no economic impact on the state. The economic impact on providers and MCOs will depend on the timeliness of the MCOs’ payments to providers. Based on the
timeliness reporting provided by the MCOs, using actuals data available for calendar year 2014, it is estimated
that the interest on the late payment of claims would be
approximately $51,000 per year.
Bearer of Costs: KanCare managed care organizations
(MCOs).
Affected Parties: KanCare MCOs; providers who have
entered into participating provider agreements with the
MCOs.
Other Methods: As these regulations are required by
state statute (K.S.A. 39-709f), there are no other appropriate methods for the desired outcome.

On July 1, 2014, Kansas implemented a new set of services called Health Homes for Medicaid beneficiaries with
serious mental illness (SMI). The SMI Health Home includes six services that are provided through a partnership between KanCare managed care organizations
(MCOs) and community providers (health home partners
— HHP) and are designed to more closely and effectively
coordinate care. The six Health Home services are provided in addition to other Medicaid services beneficiaries
are eligible.
Effective January 1, 2015, Health Homes for individuals
with SMI will be added to the Alternative Benefit Plan
(ABP), which authorizes Work Opportunities Reward Kansans (WORK).

Payment of Principal and Interest
