Māori Land Court A GUIDE TO OUR MINUTE BOOK ABBREVIATIONS This factsheet provides information about, and a summary of, abbreviations used for minute books of the Māori Land Court and Māori Appellate Court Auckland, the Bay of Islands, Kaikohe, Kaitaia and Whangārei. Introduction In the 150 year history of the Māori Land Court evidence and decisions have been recorded in a local (and more recently) national minute book series. This fact sheet provides a guide to minute book: • naming conventions • series types • syntax • hints and tips • abbreviations. Naming Conventions Series types Early minute book series dealt with land investigations for a regional location. As the role of the Department (Native and Māori Affairs) evolved, the type of minute books also evolved to include a wider range of activities. These activities differed depending on legislation in force at the time and varied depending on the registry. In general however, the following types of minute books were kept: • Historically each registry office was responsible for the creation and maintenance of their minute book series. Historically judicial officers and their support staff travelled to different locations across New Zealand to hear and determine applications. In a pre-digital context, it wasn’t practical to have one minute book series for a district or the court as a whole; rather it made more sense to have multiple minute books so these could travel with the associated judicial officer or, for larger districts, a minute book series based in major cities. The Māori Land Court had support staff located at many offices of the Department of Māori Affairs who maintained minute book series for judicial officers and/or bodies working in those areas or for specific departmental or land board activities. As an example, in the Taitokerau District of the Māori Land Court, minute books were maintained for Geographic: Usually a hearing venue had its own minute book which dealt with all applications in the surrounding geographic. • Adoptions: Dealt specifically with adoptions between 1909 and 1962. • Consolidation: Recorded title consolidations undertaken as part of a consolidation scheme initiated by the local District Māori Land Boards. Minute books also recorded succession to interests that were subject to consolidation up until final allocation of new titles was made. • Alienation: Some offices kept specific series relating to the lease and sale of Māori Land which required confirmation of the local District Māori Land Board • Judicial: In some cases, early judicial officers would maintain their own minute book series for specific investigations or because they would be away from a regional centre for long periods of time Māori Land Court Minute Book Guide – 01/07/2016. For example: Syntax In 1999 the Court launched its Māori land Information System (MLIS) as its central case management, land registry and document management system. As part of development of that system, a syntax and abbreviation standard was developed to enable all minute book series to be accessible through the MLIS. Between 2001 and 2002, the court captured the majority of its historical minutes in the MLIS, making them available to court staff and members of the public. This standard syntax style is used by the Māori Land Court to locate its historical minute books. Please note: This syntax differs from the Legal style guide for referencing a decision of the Māori Land Court or Māori Appellate Court. 51 Opotiki MB 67 translates to 51 OPO 67 Opotiki 51/67 translates to 51 OPO 67 5 Northern Waiapu Consolidation Scheme 94-99 translates to 5 CNNWP 94-99 5 Rotorua Appellate Court MB 100 translates to 5 APRO 100 CHIEF JUDGE REFERENCE SYNTAX The syntax for the Chief Judge series differs depending on the date of the decision. For decisions made between 1922 and 1964: NN CJ PP or NN CJ A-Z Where: • NN = The minute book number (ranging from 1 to 10) • CJ = The abbreviation for the Chief Judge minute book series • PP = The folio(s) or page(s) • A-Z = Is used in place of the folio or page numbers to indicate a search for the index pages associated with the particular minute book. In 2001, an electronic register was created but is only available to staff in Wellington. For example: 1967 Chief Judges MB 100 translates to 1967CJ 100 1971 CJMB 100 translates to 1971 CJ 100 2010 Chief Judge’s MB 99-100 translates to 2010 CJ 99-100 CJMB 1981/203 translates to 1981 CJ 203 The regionally based Chief Judge minute book series are as follows: District Taitokerau WaikatoMaiapoto CHIEF JUDGE INTERAL REFERENCE SYNTAX Since 1965 the court administration also maintained an internal historical register of applications to the Chief Judge. These manual registers, held in Wellington, list applications received between 1965 and 2001. You may see applications referred to as: Waiariki CJ YYYY/NN Where: • CJ = prefix to indicate the application is one Tairāwhiti Tākitimu Aotea made to the Chief Judge • YYYY = year in which the application was received (starts from 1965-) • NN = A sequential number which is incremented as a new application is received. All Chief Judge enquiries should be directed to National Office in Wellington • Appellate Court decisions prior to 1993 should be directed to the Māori Land Court office in which the application was heard • All other Appellate Court enquiries should be directed to National Office in Wellington. Hints and Tips • Court staff can’t search for a minute or judgment based on subject. You need to have an application number (post 1999) and/or a proper minute book reference • Where possible – always express your requests COPY FEES Please note: The Māori Land Court Fees Regulations 2013 set the following fees for copying records (regardless of whether or not it is supplied electronically or as a hard copy): • 20c per black and white page • 40c per colour page using the minute book syntax and its abbreviation. If you have your syntax correct, staff can simply enter the reference into the records system and retrieve the minute or judgment • There is limited discretion to reduce or waive this fee, however this is considered on a case by case basis and large requests, or those that require significant research, may incur a fee.
