5th Amendment
The government must use fair
proceedings.
Prohibits the national government from
acting in an unfair or arbitrary manner.
Substantive due process of law
14th Amendment
The laws under which the
government acts must be
constitutional.
Prohibits state and local
governments from acting
in an unfair or arbitrary manner.
