1. Validity of Rates
Note:
1. The Tenderer must be submitted the bifurcation of their quoted rates & required taxes (if any),
otherwise their quotation may be rejected.
2. If working agency is a Samiti/ Partnership Firm, then he must be submitted his valid Bailaj
(ckbZykWt)/ registered Deed.
3. The experienced tenderer must be filled the Performa enclosed herewith & submitted filled
Performa in the Ist part of the tender. If desired Performa found incomplete or not filled, in that
case IInd part not to be opened at any cost.
4. As per Sl. No. 45 of Indian Safety Rules 1956 Tenderer must be registered as a Class “A”
Contractor from Directorate of Electrical safety, U.P. Govt. If any Applied for Contractor will be
lowest after opening of Part-IInd, then he should be registered as a Class “A” Contractor from
Directorate of Electrical safety within 15 days from the date of opening Part-IInd, otherwise in
interest of Electrical Safety his quotation not to be entertained.

Special terms & Conditions:
1. The contactor will engage qualified ITI (Electrician/Wireman Trade) labourer having sufficient experience for
maintain of H.T./L.T./33 K.V. Lines & disconnection work of concerned Division & connected T/fs as detailed
in technical specification.
2. Concerning Executive Engineer authorized to depute or change the destination of any operating staff
provided by the outside agency from any S/s to another S/s under his Division.
3. The labour engaged by the contractor shall follow instructions of the concern EE/SDO/JE in respect of
proper operation & minor maintenance of Sub-stations, maintenance of records, registers etc.
3. The contractor shall fulfill the conditions as stipulated in letter no. 189 dated 3.2.2007 issued by
Chairman UPPCL (part of the contract).
4. The contractor shall essentially pay the wages as per minimum wages Act-1948 of labour department
act. of U.P. and should be registered with Labour commissioner in accordance with form-05. Name and
address of all engaged laborers will mention in registration. If the contractor fails to get license within
stipulated time, the contract shall be terminated.
5. Contractor will deduct EPF from the salary of labour as per sheet enclosed and will deposit such
deduction in the office of EPF commissioner on monthly basis. Contractor in the office of concerned
Executive Engineer shall submit photocopy of receipt of such deposits.
6. All charges/compensation because of damage, loss, theft or accident to be paid as per factory act shall
be born by the contractor and Contractor shall be solely responsible for making payments to claimants.
For meeting such eventuality, Contractor will provide sufficient insurance cover to its employees. MVVNL
in no way shall be responsible for any compensation in case of accident.
7. The contractor will submit to the department an affidavit in writing from all skilled/un-skilled labours
stating that the labourer so engaged neither will claim service in the MVVNL/UPPCL nor will file any case
for appointment in service in MVVNL/UPPCL in any court in future. Contractor shall make sure to present
all affidavits with in 15 days from the date of LOI/ Work Contract.
8. The contractor will ensure payment of minimum wages to labour as fixed by DM/Labour department and
will follow the orders of minimum wages issued by DM/Labour department. Any violation to this effect
may be result is cancellation of the contract.
9. The contractor will submit age proof certificate of each employee provide by him. Age of labour engaged
by the contractor should be 18-50 years to concerned Executive Engineer.
10. The contractor will submit character certificate and medical certificate in respect of each Employee
provide by him to concerned Executive Engineer and will be responsible for any mischief committed by
any of his labour.
11. The engagement of skilled/unskilled labours for above work will be done from the date of agreement to
twelve months.
12. The contractor will adhere to all the terms & conditions of the labour Act strictly.
13. The wages of skilled/unskilled labour will be paid by the contractor in the first week of every month
through cheque in the presence of Sub-Divisional officer concerned, who will certify that the payment of
wages has been made by the contractor in his presence, if the contractor fails to make the payment of
wages to his labour in time, the department reserve the right to disburse the same directly to the labours
deployed by the contractor form pending bills or the security deposits of the contractor, shall also be
ensured that the payment to the deployed labour shall be done by opening an account in the bank so as
to ensure the payment to the labours.
14. Any officer of the UPPCL/MVVNL will issue no experience certificate to any employee of the contractor.
15. It shall be sole responsibility of the contractor to ensure compliance of all labour, industrial and other
enactments, rules and orders in force regarding conditions of labour safety of goods, safety and security
of people and property etc.
16. The contractor shall ensure that workers engaged by him possess identity card, entry pass duly signed by
the authority designated by concerned Executive Engineer.
17. The contractor shall be responsible for the execution of contract (work) in accordance with the terms and
conditions of form ‘A’ prescribed by the UPPCL.
18. The contractor shall arrange proper tools and plants, required to complete the work at his cost.
19. The contractor shall be required to satisfy the Executive Engineer in respect of arrangements safety
reasons and security of tools, equipments etc arranged by him. He shall follow forthwith the instructions
issued in these matters by the Engineer of Contract/Director Electricity Safety.
20. The contractor shall be obliged to discharge his liabilities under the contract most diligently and
effectively. In case he fails, the MVVNL shall be free to take decision in this regard including assigning the
task to some other person/agency. The contactor shall be responsible to bear the consequence of the
same including any financial liability.
21. The MVVNL shall have the right to recover from the contractor the cost of any damage to the
equipment/property of MVVNL while carrying out the job. If the contractor fails to do the needful the
MVVNL shall be at liberty to recover the cost of damage/loss in the manner deemed fit.
22. No claim shall be entertained for the labours rendered idle due to stoppage of suspension of work or
delay in payment for any reason whatsoever.

23. In case of any dispute, arising between the parties concerned Chief Engineer (D), Bareilly shall be the
sole arbitrator and his decision shall be final and binding on both parties.
24. The contactor will have to provide the certificate of ITI electrician trade holder of the workers to be
engaged for the work duly attested before execution of agreement to the Executive Engineer of the
concerned division.
25. Apart from above, the contractor shall also be required to get registered with the concerning authorities
for central excise duty and service tax in respect of his aforesaid labour.
26. The contractor will also make the payment of Ex-gratia to his labour, if it is found payable as per Labour
act rules.
27. The skilled/unskilled labour being engaged by the contractor shall, in no case, be entitled for regular
service of the corporation.
28. The contractor will register himself with EPF commissioner and such registration will be valid at least for
the contract period. In case he fails to register with EPF Commissioner, his contract is liable to be
cancelled without any notice.
29. Material/spares required for attending minor maintenance/ the department shall supply breakdowns
and the contractor shall give the account of their consumption to the engineer in charge of the Division.
30. Income tax/other deductions as per UPPCL/MVVNL rules shall be deducted from the contractor’s bills as
per Central/State government rates prevailing in the department.
31. The contractor shall be solely responsible for payment of any type of compensation to his labours in case
of electrical accident. In any circumstances. The compensation owing to accident/incident during
execution of work shall be paid by the contractor at his own without any reference to UPPCL/MVVNL and
conditional obligation for such compensation shall be sole responsibility of the contractor, The damage, If
any, caused to the department/work/T&P by the contractor himself or his staff shall be recovered in full
from the pending bill(s)/liability of the contractor.
32. Concerned Executive Engineer shall be the Engineer-In charge of the contract. The work shall be got
carried out as per rules by the contractor in strict supervision and to entire satisfaction of Engineer-In
charge of the Division.
33. The dispute arising, if any, taken into court, shall be within the jurisdiction of Shahjahanpur.
34. Service Tax or any other tax, if applicable, shall be paid extra after producing such documentary evidence
in the Divisional Office as per rules.
35. In engaging skilled labour, preference will give to such ITI Holders who have completed apprenticeship in
the department for operation and maintenance of the sub-station equipment. Skilled labours deployed
for maintain of H.T./L.T./33 K.V. Lines shall be got trained by concerned JE/SDO.
36. The skilled/Unskilled labour shall be deployed as earlier on the 33/11 K.V. Sub stations. Any person
deployed by him if found or has been involved in extracting money from consumers shall not be taken on
job.
37. Concerning Executive Engineer authorized to change the destination of any operating staff as per
requirement provided by the outside agency from any S/s to another S/s under his Division.
Instructions to the Tenderers
Tender Sp. No. 75(Work)/EDCS/2014-2015
Sealed tenders against Tender Sp. No. 75(Work)/EDCS/2014-2015 for maintain of H.T./L.T./33 K.V.
Lines & operation of 33/11 K.V. S/s Amaria & Jahanabad in EDD-Pilibhit Detail mentioned on the attached Price
Schedule (Tender Form) shall be received by the Superintending Engineer, E.D.C., Spn. Up to 16.00 hrs on dated
23-09-14 which shall be publicly opened on dated 23-09-2014 at 15-30 hrs in the presence of the
tenderers/auth. Representatives who may wish to be present. If this day happens to be holiday, tender shall be
received and opened on the nest working day on the same time.
1. Submission of Tender: Tenders shall be received in two separate parts. Each part shall be in separate
enveloping duly covering as follows.
(A)
Earnest Money of Rs. 20000.00 in acceptable form in a sealed cover part- Ist subscribed
earnest money against Tender Sp. No. 75(Work)/EDCS/14-15 due on dated 23-09-14
(B)
Tender bid containing the offer covering evidence of his fulfilling prequalifying conditions,
general information etc. The sealed cover containing the bid shall be subscribed tender bid
against Specification No. 75(Work)/EDCS/2014-2015 due on dated 23-09-2014 both
envelops then be sealed in other envelope subscribed on the top of the envelope Tender Sp.
No. 75(Work)/EDCS/2014-2015.
2. Preparation of Tender: Tender must be submitted on the attached form. Cutting or other changes should
only be made over the signature of the tenderer. Tendered price must be filled both in words & figures. In
case of discrepancies between unit price & amount, lower of the will be govern.
3. Tender Performa: Tenderers are required to furnish their tender on the Performa by filling all the
replies/conditions. No Tender shall be entertained which is not filled on the prescribed tender form sold
by the S.E., E.D.C., Spn.
4. Qualification of the Tender: Only Such tenderers need tender who can produced satisfactory evidence
that they have necessary resources & organizations to under take the supply/work to the satisfaction of
purchaser.

5. Earnest Money: Each Tender must be accompanied by an earnest money amounting Rs. 20000/- in
shape of FDR/CDR /TDR is issued from any scheduled bank of India/Post Office and pledged in favor of
S.E., E.D.C., Spn. Tender without earnest money shall be rejected.
6. Opening of Tender: Envelope of earnest money (Part-Ist) shall be opened first and if earnest is found in
order, the second envelope (Part-IInd) i.e. rates, terms and conditions shall be opened otherwise second
part of the tender, envelope shall not be opened and outright rejected.
7. Modification prior to date of opening of tender: Modification in the specification if required will be made
by amendment copy of which shall be furnishing to those who have purchase the tender specification.
8. Prices: The price mentioned on the price schedule hereof will be remained firm and firm in all respect.
9. Tender Rates & Taxes: The tenderer are required to quote their rate F.O.R. destination. As per rule
income tax & other required taxes shall be deducted from the bill of the contractor at the time of
payment.
10. Safety of Staff, Labour & Depatt. Equipments: Tenderer shall provide all arrangements for safety of staff,
labour & Departmental Equipments. Corporation shall not be responsible for any mishap/theft of the
Departmental material at Site or accident to any person at site of work or any damages arising there
form. The insurance charges of staff if any shall be borne by the tenderer. Department shall not be paid
extra for this act.
11. Payment: 100% payment will be made after depositing 10% security of the total tendered amount in this
office with in 01 month from the date of signing contract/ LOI whichever is earlier otherwise 90% will be
made against running bill on availability of funds & balance 10% will be released by concerning division
after completion of total tendered work in satisfactory condition.
12. Rules & Regulations: The tenderer have to follow all labour rules, regulations and procedure laid down in
the act from time to time. The Department shall make no extra payment towards idle labour charges etc.
All disputes out or related to the subject matter of this agreement shall be subject to the jurisdiction of
Local Court/High Court. All other terms & conditions of Form “A” of UPPCL and their amendments made
time to time shall also be applicable to the tenderers.
13. Department will bear no claim for any accident during the work.
14. The contractor shall exercise all possible care to avoid damage to public utility services i.e. water/sewage
pipe line, telephone, telecommunication and power cable already laid under the ground. If any accidental
damage occurs to these during work, the contractor shall inform Corporation representative about the
damages. The contractor will have to repair/replace free of cost all the damages occurred during
execution of works in the shortest possible time.
15. The contractor shall arrange at his own end labour, all the proper tools & equipment etc. and balance
material required necessarily to complete the work.
16. The contractor shall be solely responsible for any losses/theft/damages/accident to the persons working
with/under him and shall have to pay due compensation in accordance with the prevailing
rules/regulation of Govt. Contractor shall arrange to have group insurance for labours engaged by him
and shall have to pay due compensation in accordance with the same. The Corporation will bear no
responsibility whatsoever may be for the compensation to his labour in case of any accident. He will also
be required to produce License for engagement of the labours from the Labour Department, U.P.
Government.
17. No compensation for idle labours shall be admissible to the contractor on account of stopping of due to
non-availability of any material/fund/shutdown/permission from PTCC/Railway/Govt. Deptt. or any other
force major conditions beyond the control of the Corporation. However, the contractor shall be given
necessary extension in completion period accordingly.
18. All charges on account of damages/losses/claims/theft etc. involved under the conditions laid down
above shall be borne by the contractor, if paid by the Corporation shall be recovered from the contractor’s
bills/security deposit.
19. Engineer of the Contract: The Engineer of the contract shall be concern Executive Engineer.
20. Any damage or loss of, public property/Board’s material shall have to be borne by the contractor.
21. ARBITRATION/SETTLEMENT OF DISPUTE: In case of any dispute between the contractor and the
engineer, the decision of Chief Engineer (Distribution), Bareilly will be final and binding on both.
22. TERMINATION OF AGREEMENT: The Engineer of the contract can terminate the agreement at any time by
giving one-week notice in the event of unsatisfactory performance of the contractor. This is however
without prejudice to the offer and terms and conditions of the agreement.
23. As per Hon’ble High Court, Allahabad decision on dated 22.03.2005, the stamp duty on security against
execution of agreement of works contract is to be got done under Article 57(B) schedule I.B. of act 1899
as amended up to date in its application to Uttar Pradesh. Therefore the rate contract has been executed
on a stamp paper of Rs. 100/- only
24. The contractor shall also be responsible to pay compensation in case of any accident is occurred due to
his fault or laps of safety rules, if any.
25. In addition to the above other terms & conditions as given in the prescribe form ‘A’ of UPPCL shall also be
applicable and the contractor shall be fully bound by them.
