Short Title This bylaw may be referred to as the Waipa District Council Speed Limits Bylaw 2016 and, except for those parts declared to be limited or extended in their operation; it shall apply to the whole of the Waipa District as from time to time constituted. 2. Definitions For the purposes of this Bylaw the following definitions shall apply: 3. Term Definition Council the Waipa District Council. Designated Location has the same meaning as in Section 4.1(2) of the Rule. Road has the same meaning as in Part 2 of the Rule. Rule means the Land Transport Rule: Setting of Speed Limits 2003 Rule 54001; relevant sections detailed in Appendix 1 of this Bylaw. Speed Limit has the same meaning as in Part 2 of the Rule. Urban Traffic Area has the same meaning as in Part 2 of the Rule Vehicle has the same meaning as in Section 2(1) of the Land Transport Act 1998. Application of this Bylaw This Bylaw applies to all roads under the control and/or management of the Council. 4. Bylaw Speed Limits (a) The Council may, by resolution, set speed limits or designate urban traffic areas for any roads under the Council's control and/or management. (b) The Council may, by resolution, set speed limits for roads in any designated location under the Council's control and/or management. (c) In setting speed limits under Clauses 4(a) or 4(b) the Council may only set speed limits of 20, 30, 40, 50, 60, 70, 80,100 km/h in a variable speed limit in a school zone. (d) The Council may amend or revoke a resolution made under Clauses 4(a) or 4(b) at any time. Waipa District Council Speed Limits Bylaw 2016 Page 3 of 27 16014754 5. 6. Consultation (a) Subject to Clause 5(b), before passing a resolution under Clause 4(a) or amending or revoking such a resolution under Clause 4(d), the Council shall undertake the consultation process prescribed in Section 7.1 of the Rule. (b) Clause 5(a) shall not apply if the Council is passing a resolution in accordance with Section 10 of the Rule. (c) Before passing a resolution under Clause 4(b) or amending or revoking such a resolution under Clause 4(d) the Council shall undertake the consultation process prescribed in Section 4.1(4) of the Rule. Speed Limits Signs Where a speed limit is set or amended the Council must mark such areas to which the speed limit applies by signs as required by the Rule. 7. Register of Speed Limits The Council shall maintain a register of speed limits that records all speed limits, except temporary speed limits, for the roads under its jurisdiction as required by Section 7.3 of the Rule. Waipa District Council Speed Limits Bylaw 2016 9. (b) The Council shall, by resolution, validate all speed limits as required by Section 10.1(2) of the Rule. (c) The Council may amend or revoke any resolution made under Clauses 8(a) or 8(b) at any time as if it had been made under Clauses 5(a) or 5(b) respectively. Offences and Penalties Every person commits an offence against this bylaw who operates a vehicle in contravention of any speed limit set under this Bylaw or by the Rule unless otherwise authorised to do so. Every person who commits an offence against this Bylaw shall be liable to an infringement fee in accordance with Part II Speeding Offences scale of fees from the Second Schedule (Infringement Offences and Fees) of the Land Transport Act 1998 or on summary conviction to a maximum fine of $20,000.00 pursuant to Section 242(4) of the Local Government Act 2002. 10. Fees and Charges Fees and charges for the issue of any approvals or permits under this Bylaw may be amended from time to time by Council resolution in accordance with section 150 of the Local Government Act 2002. 11. Payment Fees for the issue of an approvals or permits under this Bylaw are set out in Council’s Schedule of Fees and Charges 12. Exemption This Bylaw does not apply to roads included on the New Zealand Transport Agency (NZTA) state highway network as the NZTA Speed Limit Bylaw covers the management of speed on these roads. 13. Revocations The Waipa District Speed Limits Bylaw 2012 is hereby revoked and replaced by the Waipa District Speed Limits Bylaw 2016. 14. Mayor Jim Mylchreest Page 6 of 27 16014754 …………………………………………… Chief Executive Garry Dyet Waipa District Council Speed Limits Bylaw 2016 Appendix 1: Land Transport Rule Setting of Speed Limits 2003 (Rule 54001) Land Transport Rule: Setting Speed Limits 2003 (the Rule) The Land Transport Rule: Setting Speed Limits (2003) brings together the requirements relating to the setting of speed limits form on New Zealand roads as set out in the Land Transport Act 1998. The principal Rule establishes procedures whereby road controlling authorities may set enforceable speed limits on roads within their jurisdictions. “Section 2.6 - Role of road controlling authorities in reviewing and setting speed limits A road controlling authority, for roads under its jurisdiction: (a) must consider the safe and appropriate speed limit for a road with regard to the function, nature and use of the road, its environment, land use patterns and whether the road is in an urban traffic area or a rural area; (b) must review speed limits in accordance with this rule; (c) must set speed limits in accordance with this rule; (d) may set speed limits for designated locations, as specified in section 4.” “Section 3.1 - Calculation of speed limits A road controlling authority must apply Speed Limits New Zealand to determine the calculated speed limit when reviewing or setting a permanent or holiday speed limit and when reviewing or designating an urban traffic area, unless the relevant road is in a location to which section 4 applies, in which case a road controlling authority may apply Speed Limits New Zealand.” “Section 3.2(8) - Discretion to review speed limits A road controlling authority may review a speed limit if: (a) it decides to do so; or (b) it receives a written request to do so from a person, organisation or road user group affected by that speed limit, including: (i) a road controlling authority that is responsible for roads that join, or are near, roads under the jurisdiction of the road controlling authority to which the request is directed; (ii) a territorial authority that is affected by the existing speed limit; (iii) the Commissioner” “Section 4.1 - Setting a permanent speed limit for a road in a designated location 4.1(4) A road controlling authority must, before setting a speed limit for a road in a designated location, consult with the [Agency], the Commissioner and other persons who the road Waipa District Council Speed Limits Bylaw 2016 Page 7 of 27 16014754 controlling authority considers to be affected by the proposed speed limit and give them a reasonable time to make submissions on the proposal.” “Section 7.1 - Consultation 7.1(1) Before setting a speed limit, or designating or changing an urban traffic area, a road controlling authority must consult with persons that may be affected by the proposed speed limit, in accordance with this section, unless section 4, section 5 or section 10 applies. 7.1(2) The persons that must be consulted in accordance with 7.1(1) are: (a) road controlling authorities that are responsible for roads that join, or are near, the road on which the speed limit is to be set or changed; and (b) a territorial authority that is affected by the existing or proposed speed limit; and (c) any local community that the road controlling authority considers to be affected by the proposed speed limit; and (d) the Commissioner; and (e) the Chief Executive Officer of the New Zealand Automobile Association Incorporated; and (f) the Chief Executive Officer of the Road Transport Forum New Zealand; and any other organisation or road user group that the road controlling authority considers to be affected by the proposed speed limit; and (g) 7.1(3) the Director. A road controlling authority must consult by writing to the persons in 7.1(2) advising them of the proposed speed limit and giving them a reasonable time, which must be specified in the letter, to make submissions on the proposal.” “Section 7.2 - Decision-making procedures and notification of set speed limits 7.2(1) A road controlling authority that is empowered by an enactment to make bylaws must set a speed limit under this rule by making a bylaw in accordance with that enactment, unless section 5 applies.” “Section 7.3 - Registration of all speed limits except temporary speed limits 7.3(1) 7.3(2) A road controlling authority must establish and maintain a register of speed limits that records all speed limits, except temporary speed limits, for the roads under its jurisdiction, including: (a) speed limits set under this rule; and (b) urban traffic areas designated under this rule; and (c) speed limits saved under section 4 of the Transport Amendment Act 1997 that have been validated under this rule in accordance with section 10. Information recorded in the register of speed limits must include: Page 8 of 27 16014754 Waipa District Council Speed Limits Bylaw 2016 (a) a full description of the roads or area to which the speed limit applies, including references to details of maps or other documents as appropriate; and (b) the speed limit; and (c) for a variable speed limit, the conditions under which the speed limit changes; and (d) the date on which the speed limit came into force; and (e) a record of the decision-making procedures of the road controlling authority carried out in accordance with 7.2(1); and (f) for an urban traffic area in 10.1(1) or a saved speed limit in 10.1(2) that has been designated or validated in accordance with 10.1(3), a reference to the previous enactment under which the speed limit was set. 7.3(3) A road controlling authority must make the register of speed limits available for inspection by members of the public, at reasonable times, on request. 7.3(4) Details of a speed limit that has been superseded by a new speed limit under this rule must be retained on the register of speed limits for at least seven years from the date on which the new speed limit came into force.” “Section 10.1 Designating urban traffic areas and validating saved speed limits 10.1(1) A road controlling authority must designate an area in which roads are subject to a 50-km/h speed limit, saved under section 4 of the Transport Amendment Act 1997, as an urban traffic area. 10.1(2) A road controlling authority must validate all speed limits saved under section 4 of the Transport Amendment Act 1997 other than: (a) 50-km/h speed limits on roads within a designated urban traffic area in 10.1(1); and (b) 100-km/h speed limits on roads within a rural area.” Waipa District Council Speed Limits Bylaw 2016 Page 9 of 27 16014754 Appendix 2: Register of Speed Limits in Waipa District Schedule 1: Roads with an Urban Traffic Areas Speed Limit of 50km/h The roads or areas described in this Schedule or as shown on a map referenced in this schedule are declared to be Urban Traffic Areas that have a speed limit of 50 km/h except for those roads or areas that are: (a) Described as having a different speed limit in the appropriate Schedule of this Bylaw; or (b) Shown on a map as having a different speed limit, as referenced in the appropriate Schedule of this Bylaw.
