SHOW SECTORS
The 3rd edition of Singapore Contemporary will present four popular sectors: “Gallery Projects”, “Artist Dialogues”,
“Photo18 Singapore” and “Latin American Voices”.
GALLERY PROJECTS
Galleries and artist collectives that do not wish to apply for one of the special art projects are invited to apply for “Gallery Projects”. Applicants should be galleries with a minimum three-year track record of operating a gallery or virtual
exhibition space, and holding regular exhibits. If the applicant is an artist collective, the exhibit will be in the name of
the collective. A maximum of four artists can participate in the exhibit. All booths in this section are 24 – 64 square
meters in size.
ARTIST DIALOGUES
“Artist Dialogues” comprises a curated series of solo artist exhibits by a gallery or artist. This will provide the opportunity for collectors and art buyers to meet the artist, allowing for conversations that share insights and inspiration for
the works featured. Applicants can be a gallery or artist. The exhibited artist must be present at the Show during opening hours. All booths in this sector are 20 - 24 square meters in size.
PHOTO18 SINGAPORE
“Photo18 Singapore” presents a curated photography sector that will illustrate the growing importance of photography as an artistic medium and collectable art form. The main focus of “Photo18 Singapore” will be to reveal emerging
talents, both local and international, as well as present a selection of works by internationally renowned photographers and “new media” artists. The pavilion will showcase works in both gallery booths and wall space organised into
four diverse yet overlapping divisions: Documentary, Fine Art, Conceptual and Mixed Media Photography. All booths
in this sector are 12 – 24 square meters in size, with wall space from 3M up.
LATIN AMERICAN VOICES
“Latin American Voices” brings a taste of Latin American art to Singapore with a special exhibition spread across 400
square meters of curated space showcasing more than 30 artists from across Latin America, including Colombia,
Argentina, Peru, Cuba and Mexico, among others. This singular exhibition will offer viewers a glimpse into the unique
artistic traditions that colour the narratives of the region with magic, myth and realism. On show will be paintings and
sculpture by emerging, mid-career and established artists that capture the heart and soul of the Americas. All booths
in this sector are 24 – 64 square meters in size.
Applicants who wish to apply to “Photo18 Singapore” or “Latin American Voices” sectors should do using the dedicated application form for each sector.

SELECTION AND ADMISSION
Singapore Contemporary aims to achieve a high standard of quality, as well as an interesting diversity in the artworks
presented at the show. Exhibitors are admitted through a selection process defined by the Organizer, which incorporates guidance provided by a highly qualified Advisory Board. The Board comprises individuals with an outstanding
record of accomplishment and insight in the art world, and includes well-known local and international art collectors,
artists and officials at public art institutions.
In reviewing the biography and exhibit history of each proposed artist, the Selection Committee will also take into
consideration the combination of artists proposed and the number of artists to ensure exhibitors will have a compelling
and strong display. In preparing an application, the Selection Committee recommends applicants adhere to the following guideline on the number of artists to be presented in a booth:
•
•
•

TERMS AND CONDITIONS OF PARTICIPATION IN SINGAPORE CONTEMPORARY 2018
1. DEFINITIONS
1.1
In these Terms and Conditions, the following words will have the following meanings: “Application Form” refers to the form overleaf including these Terms; “Show” means the exhibition referred to overleaf; “Rate” means the aggregate amount to be paid by the Exhibitor to the
Organizer as shown on the Application Form; “Applicant” means the company, person, organization or other entity identified as the party
who expresses an interest to rent a booth at the Show and files the Application Form with Organizer. “Organizer” means Singapore
Contemporary Art Show Pte Ltd (hereafter “SCAS”) and its successors and assigns; “Exhibitor” means the company, person, organization
or other entity identified as the party who is admitted to rent a booth at the Show; “Exhibits” means the art works and or projects the
Exhibitor will display at the Show; “Exhibitor Manual” means the handbook produced by the Organizer containing such regulations as
may be deemed reasonable to the Organizer relating to the Show, the Venue and the Exhibitorʼs attendance and conduct at the Show;
“Booth” means the area of space at the Show licensed by the Organizer to the Exhibitor; “Terms” means these terms and conditions
together with the contents of the Exhibitor Manual and Application Form terms; “Venue” means the location where the Show takes place;
and “Venue Owner” means the owner of the venue where the Show takes place.
1.2
References to Clauses shall be to Clauses of these Terms.
2. PERMITTED EXHIBITS
2.1
The primary criterion for the admission of Exhibits is the quality of the proposed art works or projects for the Show (or specific exhibition
sections of the Show, if applicable). The Exhibits intended for exhibition must be listed in the supporting material accompanying the
Application Form and the Organizer shall have the right to obtain detailed information on the individual Exhibits the Exhibitor intends to
present.
2.2
Only those Exhibits approved by the Organizer in writing may be exhibited. The Exhibitor is not permitted to display Exhibits not approved
by the Organizer at any time during the Show.
2.3
Any later changes of the proposed Exhibits before the Showʼs opening must be communicated to the Organizer at least three (3) weeks
before the Showʼs opening. Such changes shall not be effective unless approved by the Organizer in writing. The Organizer is entitled to
remove, at the Exhibitorʼs expense, Exhibits which were not approved or which restrict access in the area surrounding the said Exhibit.
2.4
It is the Exhibitorʼs responsibility to supply accurate specifications, such as measurements, weights and other technical information (e.g.
electrical wiring, media properties, etc.) in respect of the Exhibits and their display. The Exhibitor shall be solely responsible for any
consequences resulting from inaccurate information concerning an Exhibitʼs specifications and liable for any resulting ancillary costs, in
particular those incurred by the Organizer and/or the Venue Owner.
3. AGREEMENT
These Terms shall govern the application of Applicant, admission and subsequent provision of the Booth by the Organizer to the Exhibitor
3.1
to the exclusion of any other terms and conditions. A binding contract is formed between the Applicant/Exhibitor and the Organizer
immediately upon signing by the Applicant of the Application Form.
3.2 Except as otherwise stated herein, these Terms should not be modified unless in writing and signed by the Exhibitor and Organizer.
3.3 The Applicant and Exhibitor agrees that data pertaining to his participation may be processed by the Organizer and/or by third parties
engaged by the Organizer and that said data may be forwarded by the Organizer to third parties commissioned by the Organizer to
enable such parties to supply services required for the show.
4. RATES
4.1
The Exhibitor shall promptly pay the Booth rental Rate in full, following the deadlines in the Application Form.
4.2 The Exhibitor shall in addition to the Rate promptly pay any additional charges relating to the Exhibitorʼs participation in the Show in
accordance with the Exhibitor Manual or in respect of all goods and services supplied at the request of the Exhibitor.
4.3 The Rate is payable without any deduction, withholding or set-off whatsoever. If the Rate is not paid when due in accordance with the
Application Form, then the Exhibitor will forfeit all payments received to date and his Booth may be cancelled.
5. CANCELLATIONS
Subject to this Clause, the Exhibitor may, by notice in writing delivered to the Organizer by recorded delivery to the Organizer (the
5.1
“Cancellation Notice”), cancel its booking and reduce the Fee in accordance with the schedule set forth in Clause 5.2 below. The parties
agree that Organizer is irreparably harmed by cancellations and may incur printerʼs fees, problems with catalogs, loss of pre-payments
and contractual commitments for venue space and to Show contractors, loss of revenue, mitigation costs and loss of prestige by cancellations. Exhibitor acknowledges that Organizer “curates” the entire Show to try to ensure a diversity of offerings to make each Exhibitorʼs
experience valuable, so finding suitable replacements is difficult. Since such damages are difficult to calculate, the parties agree that the
schedule set forth in Clause 5.2 is a reasonable measure of such damages and is fair.
5.2 Upon cancellation in accordance with Clause 5.1, the cancellation fee payable by the Exhibitor to the Organizer will be as follows: On or
before October 1st, 2017 50% of the Rate; After October 1st, 2017 100% of the contracted Booth Rate.
5.3
Upon accepting the Cancellation Notice, the Organizer may resell or re-allocate the cancelled Booth, without any obligation to refund any
cancellation fees to the Exhibitor for the income from reselling or re-allocating the cancelled Booth.
6. OCCUPATION OF BOOTH SPACE
Exhibitor shall occupy the whole of its allocated Booth at the commencement of the Show and for the entire duration of the opening hours
of the Show. No Exhibitor may share or sublet a Booth either partially or entirely without written permission of SCAS. Decisions regarding
the approval of shared Booths rest solely with SCAS. Exhibitors sharing Booths will be joint and severally liable to SCAS. The Exhibitor
shall occupy the Booth as Organizerʼs licensee, shall obtain no right of exclusive possession or occupation, and shall obtain no proprietary
interest in the Booth. The Exhibitorʼs Booth shall be decorated and presented in accordance with regulations set out in the Exhibitor
Manual. The location of the contracted Booth shall be provisional and subject to change prior to the Show. The Organizer will take reasonable efforts not to make changes to the Exhibitorʼs allocated Booth, but shall be entitled to relocate the Exhibitorʼs Booth at any time prior
to the Show.
7. EXHIBITORʼS OBLIGATIONS
The Exhibitor shall not supply from the Booth or elsewhere at the Show any food, drink or tobacco. At the Show the Exhibitor shall only
conduct its business from the Booth and may not display or distribute its promotional publication or article of any kind other than from the
Booth. The Exhibitor shall observe and comply with the Exhibitor Manual at all times. The Exhibitor shall comply with and observe all laws
12/13
and regulations relevant to its use of the Booth during the Show, including but not limited to the house rules of the Venue and intellectual
property laws. The Exhibitor indemnifies the Organizer and holds the Organizer harmless against all loss, damages, claim and costs,
including reasonable attorneys fees resulting from the Exhibitorʼs use of the Booth and the acts and omissions committed by the Exhibitor
and its agents, servants and invitees.
8. LIABILITIES AND INSURANCE
Subject to Clause 8.3, the Organizer shall not be responsible for: 8.1.1 the theft, damage and safety of all goods, decorations and other
8.1
items brought into the Venue by the Exhibitor, its agents, employees or sub-contractors; or 8.1.2 the supply to the Exhibitor of any goods
or services from any third parties at the Show, including the operator and owner of the Venue, designated contractors and the
Organizerʼs contractors.
8.2 Although all reasonable precautions shall be taken, subject to Clause 8.3 the Organizerʼs liability shall be limited as follows: 8.2.1 the
Organizerʼs maximum aggregate liability under or in connection with these Terms shall not exceed the total amount of the Rate actually
paid by the Exhibitor; and 8.2.2 the Organizer shall not be liable for any loss of income or profits, loss of contracts or for any indirect
or consequential loss or damage of any kind howsoever arising.
8.3 Nothing in these Terms shall exclude or in any way limit the liability of the Organizer in a manner contrary to law.
8.4 The Organizer shall not be liable for any delay or cancellation of the Exhibition, or loss caused by any act of God, terrorist activity,
political unrest, riot, typhoon or other inclement weather conditions or other event, fact or circumstance beyond the Organizerʼs
reasonable control.
8.5 The Exhibitor shall take out and maintain adequate insurance, which shall not entitle the insurers to exercise any subrogation rights
against the Organizer, and the Exhibitor shall on demand provide sufficient evidence of such insurance to the Organizer. Without
prejudice to the foregoing provisions in this Clause 8, in the event of the Organizer having any liability, the claimant shall first of all
recover or procure to be recovered the money payable by the insurers under the insurance policies between the insurers and/or all
relevant parties relating to the subject matter or event from which the Organizerʼs liability arises and the claimantʼs claim against the
Organizer is limited to the extent that the money paid and/or payable by the insurer under such insurance policies is not sufficient to
reasonably compensate the claimant.
9. TERMINATIONS
9.1 The Organizer may terminate the Application From forthwith by notice in writing to the Exhibitor or exclude the Exhibitor from the Show,
if the Exhibitor: 9.1.1 commits a material or persistent breach(es) of any of these Terms and, having received from the Organizer a notice
giving full particulars of the breach(es) and requesting that the same be remedied, has failed to remedy such breach(es); 9.1.2 becomes
insolvent, enters into liquidation or bankruptcy, passes a resolution for its winding up, has a receiver or administrator appointed over the
whole or any part of its assets, makes any composition or arrangement with its creditors or takes or suffers any similar action in
consequence of its debt; or 9.1.3 ceases, or threatens to cease, to carry on business; and 9.1.4 in the course of preparation for the Show
or during the Show, acts in violation of law, including but not limited to performing any act or committing any omission which is or is likely
to be in violation of the intellectual property rights of third parties.
9.2 In the event that the Organizer exercises its right to terminate this agreement, the license by the Exhibitor over the Booth will cease and
the Exhibitor shall pay to the Organizer liquidated damages (and not as penalty) as follows: On or before October 1st, 2017 50% of
the Rate; After October 1st, 2017 100% of the Rate.
9.3 The Organizer shall be entitled to remove any person or thing or exclude the Exhibitor from the Venue in the event that the Organizer
considers such removal or exclusion to be in the interests of the Show, the Venue or the other exhibitors or visitors at the Show. In such
event, the Rate shall be forfeited to the Organizer as liquidated damages (and not as penalty).
10. COMPLIANCE WITH LAWS AND REGULATIONS
10.1 The Exhibitor shall comply with all applicable laws, regulations and codes of practice relating to the Show and the Exhibitorʼs attendance
at the Show, including without limitation, all local laws and fire and safety regulations, the rules and regulations set out in the Exhibitor
Manual and any additional rules imposed by the operator or owner of the Venue or the government.
10.2 All materials used in presenting the Booth or forming part of the Booth must be inflammable. No explosives, detonating or fulminating
compounds or other dangerous materials shall be brought into the Show by or on behalf of the Exhibitor.
11. LAW AND JURISDICTION
These Terms shall be governed in all respects by the laws of the Republic of Singapore and the courts of Singapore shall have excusive
jurisdiction to deliberate any disputes between the Applicant/Exhibitor and Organizer.
12. NOTICES
All notices and other communications served pursuant to these Terms shall be sent by email to the address as specified in the Application
Form for each party or to such other address as either party may notify for such purpose.
13. GENERAL
13.1 The failure of either party to enforce any terms of or right arising pursuant to these Terms does not constitute a waiver of such term or
right and shall in no way affect that partyʼs right later to enforce or exercise the term or right. The invalidity or unenforceability of any
term of or right arising pursuant to these Terms shall not adversely affect the validity or enforceability of the remaining terms and rights.
13.2 These Terms and Application Form constitutes the entire agreement between the parties with respect to its subject matter and supersedes
any prior agreement, or arrangement between the parties, whether oral or in writing, with respect to the same. No representation,
undertaking or promise whether, without limitation, relating to location of the Booth, visitor or exhibitor attendance figures or otherwise,
shall be taken to have been given or be implied from anything said or written in communications between the parties prior to these Terms,
except as set out herein.
13.3 Subject to the definition of “Organizer”, nothing in these Terms shall confer on any third party any benefit or right to enforce any of the
Terms whether pursuant to any statute or otherwise.
13.4 Should any provision of the Terms be held invalid or unenforceable for any reason or to any extent, such invalidity or enforceability shall
not in any manner affect or render invalid or unenforceable the remaining provisions of the Terms, and the application of that provision
shall be enforced to the extent permitted by law.
