NOTICE OF CONSULTATION ON GUIDELINES AND RULES UNDER THE PLANNING ACT 2016 ,
SECTIONS 17, 36, 37, 116 and 117 MINISTER’S GUIDELINES AND RULES
I, the Honourable Jackie Trad MP, Deputy Premier, Minister for Transport and Minister for
Infrastructure and Planning, do hereby notify that pursuant to sections 17, 36 and 37 of the
Planning Act 2016 (the Act) I have prepared draft guidelines and rules to be called the ‘Minister’s
Guidelines and Rules’. I have also prepared draft guidelines under chapter 4, part 2, sections 116
and 117 of the Act, which are contained within the Minister’s Guidelines and Rules.
Copies of the draft guidelines and rules are available for inspection and collection free of charge
from the Department of Infrastructure, Local Government and Planning at 1 William Street,
Brisbane or online at www.dilgp.qld.gov.au/planning-reform.
Any person may make a written submission about any aspect of the draft guidelines and rules.
The submission must be a properly made submission under the Act to be accepted.
A properly made submission must:
• be made to the Minister
• be received on or before 9 May 2017
• be in writing and, unless the submission is made electronically, is signed by each person
who made the submission
• state the name and residential or business address of each person who made the submission
• state the grounds of the submission and the facts and circumstances relied on in support
of the grounds.
Electronic submissions may be made provided they include the full name and email address (or
other address) of the submitter and online at www.dilgp.qld.gov.au/planning-reform.

NOTICE OF ADOPTION OF TEMPORARY LOCAL PLANNING
INSTRUMENT 01/17 PROTECTION OF THE BUILDING KNOWN AS
BRASCH’S SERVICE STATION, 108 BREAKFAST CREEK ROAD,
NEWSTEAD (TLPI 01/17)
At its meeting on 7 March, 2017 Brisbane City Council adopted
TLPI 01/17 which will commence with immediate effect and
cease to have effect at the end of 7 March, 2018 (unless
repealed at an earlier date).
Purpose and General Effect
Further Information
Copies of Temporary Local Planning Instrument 01/17 are
available for inspection and purchase from the Brisbane City
Council Library and Customer Service Centre, Level 1, North
Quay Podium, Brisbane Square, 266 George Street, Brisbane.
TLPI 01/17 can also be viewed by searching for ‘Temporary
Local Planning Instrument 01/17’ at www.brisbane.qld.gov.au
For more information please either visit the Council Customer
Service Centre or telephone Council on 3403 8888.
The purpose of TLPI 01/17 is to protect the cultural heritage
significance of the Brasch’s Service Station building. TLPI 01/17
facilitates assessment of the suitability of development or re-use
of land at 108 Breakfast Creek Road, Newstead or on adjoining
land.

TLPI 01/17 will implement policies in the Strategic framework
of the Brisbane City Plan 2014 (the City Plan), in particular
Theme 2: Brisbane’s outstanding lifestyle and Element 2.1 –
Brisbane’s identity.
TLPI 01/17 applies to:
(a) development on land involving the building known as
Brasch’s Service Station at 108 Breakfast Creek Road,
Newstead, and described as Lot 2 on RP192253. This lot is
deemed to be contained in the Heritage overlay and
identified on the Heritage overlay map in the Local heritage
place sub-category of the City Plan;
(b) development on the adjoining land at 104 Breakfast Creek
Road, Newstead, described as Lots 1 to 6 on BUP104411.
These lots are to be contained in the Heritage overlay and
identified on the Heritage overlay map in the Area
adjoining heritage sub-category of the City Plan.
This TLPI applies assessment provisions to development of
Brasch’s Service Station and nominated adjoining land and
applies in addition to the current provisions of the Brisbane City
Plan 2014.

over the Local Government roads described in the schedule is
hereby declared as a Common Area.
