OFFICIAL CONTEST RULES (“Official Contest Rules”)
NO PURCHASE, BANK OR CREDIT CARD ACCOUNT, OR BANK OR CREDIT
CARD TRANSACTION NECESSARY TO ENTER OR WIN IN THE BANK OF
HAWAII “Million MyBankoh Points Giveaway Contest” (“Contest”). VOID WHERE
PROHIBITED OR RESTRICTED BY LAW. CONTEST IS SUBJECT TO ALL
APPLICABLE FEDERAL, STATE OF HAWAII, AND LOCAL REGULATIONS. A
purchase, bank or credit card account, or bank transaction will not improve your
chance of winning.
ELIGIBILITY: The contest is only open to persons who are 18 years of age or older and
either (1) a resident of the state of Hawaii or Guam; or (2) a Bank of Hawaii account
holder at the time of entry. Employees of Sponsor, its parent, affiliates and subsidiaries
along with members of their immediate family and/or those living in the same household
are not eligible. Void where prohibited or otherwise restricted by law. The Sponsor is
solely responsible for all aspects of the Contest and for determination of eligibility. All
entry information must be complete and accurate. Sponsor will not award a prize to
anyone not meeting eligibility requirements at the time of entry. Sponsor reserves the
right to disqualify any entrant if these Official Contest Rules are not followed. By
entering this Contest you agree to the terms and conditions of these Official Contest
Rules and make all of the Representations and Warranties as provided below.
HOW TO PARTICIPATE: The Contest entry period begins at 12:00 a.m. HST on June
20, 2016 (“Start Date”) and ends at 11:59 p.m. HST on August 07, 2016 (“End Date”),
but may be extended at Sponsor’s sole discretion (the “Entry Period”). All times in these
Official Contest Rules refer to Hawaiian Standard Time/HST and Sponsor’s computer
shall be the official timekeeper for matters related to this Contest.
To enter the Contest, during the Entry Period, please submit the following via submission
form following the instructions at boh.com/MBRmillionpoints (“Entry”)
1. A written description not to exceed 3000 characters on how you would use one
million (1,000,000) MyBankoh Rewards points (the “Essay”).
2. You must include your first and last name, complete physical address, email
address, telephone number (including area code) and indicate whether you have a
MyBankoh Rewards credit card.
By submitting an Entry to boh.com/MBRmillionpoints, you are agreeing to all the terms
of these Official Contest Rules.
Limited one entry per email address, per person. If you submit multiple Entries with the
same email address, only the first Entry submitted will be eligible. Any subsequent
Entries from the same email address will be void. Sponsor reserves the right to disqualify
any Entry it deems inappropriate or abusive. All Entries become the property of Bank of
Hawaii and will not be acknowledged or returned.
ENTRY GUIDELINES: Entry must include a true and original (written by entrant) Essay
submitted in English language. You must obtain the permission of any person you name,
identify or otherwise refer to in the Essay. By entering the Contest, the entrant grants
Sponsor a royalty-free and irrevocable right to use in any manner, reproduce, publish, copy,
display, distribute, translate, adapt, modify any Essay, in whole or in part, and to
incorporate the Essay, in whole or in part, in other works in any and all markets and media
worldwide in perpetuity. The entrant warrants that he/she has the sole and exclusive right
to grant such rights to Sponsor and that Sponsor’s use, reproduction, publishing, displaying,
and/or other use of the Essay will not infringe on any rights of third parties, including, but
not limited to, privacy, copyright, trademark, or publicity, nor create claims for defamation,
false light, ideas, misappropriation, intentional or negligent infliction of emotional distress,
or breach of contract. Essays may not contain any confidential, obscene, threatening,
defamatory, fraudulent, or offensive material, and Sponsor reserves the right in its sole
discretion to disqualify any such Entries. Entries may contain a photo, but it is not required.
If a photo is submitted (“Photo”), it must have been taken by entrant and entrant must have
written permission (see Representations and Warranties below) of any person in the Photo.
Professional photos and/or photos with watermarks are not eligible and any Entry
containing such photos will be void. No commercial or corporate advertising or logos
outside of the Sponsor may be present in the Photo. A Photo must be a jpeg or gif file not
to exceed 2MB in size.
Sponsor is under no obligation to copy, publish, display or otherwise use all or any part of
the Essay or Photo.
REPRESENTATIONS AND WARRANTIES:
By submitting an Entry and participating in the Contest, you represent and warrant that (1)
your Entry is a true and original and otherwise unpublished and if Entry contains a photo,
you own all rights, title and interest in the photo and that by submitting the Entry and
uploading the photo you are not in violation of or infringement of any intellectual property
rights; (2) if your Entry contains a photo that includes another person besides yourself, you
have obtained a written consent from each such person (such consent/release must be from
a parent or legal guardian if person is a minor) present in your photo Entry and their
agreement to the terms of these Official Contest Rules, and the use of the photo as provided
in these Official Contest Rules; and (4) you consent to the publication/reproduction by
Sponsor of all or any part of the Entry.
WINNER SELECTION: On or about August 07, 2016, a panel of one (1) or more judges
selected solely by Sponsor (the “Judges”) will review all eligible Entries and select one (1)
potentially winning Entry and rank 5 alternates (“Finalists”). Judging will be based on the
following criteria: compelling story (60%); originality (20%); understanding of the specific
MyBankoh Rewards program features (10%); and understanding of how MyBankoh
Rewards points are redeemed/utilized (10%). In the event of a tie, the Entry with the
higher compelling story score will be selected. If a tie continues to exist, the Entry with the
higher originality score will be selected. The decisions of the Judge(s) are final on all
matters relating to the Contest and Sponsor reserves the right to disqualify anyone who
disputes any decision made by Sponsor. Sponsor reserves the right to verify the facts and
statements contained in the Essay.
One or more of the Finalists will be notified via email and/or telephone on or after August
07, 2016 and requested to arrange for an in person or telephone interview. The email will
also contain the required documentation. If a notified Finalist does not respond to the
notification within two (2) business days, he/she will be disqualified and additional
Finalists will be notified if necessary. A notified Finalist must complete a Declaration of
Eligibility, Assignment of Rights in the Entry, Liability Release, Publicity Release
(“Declaration”) and W9 by the date specified in the notification in order to be eligible to
receive a prize. If a notified Finalist does not return the signed Declaration by the date
specified, then he/she will be disqualified.
ONE PRIZE will be awarded on or after August 07, 2016. The winner will receive
1,000,000 MyBankoh Rewards points credited to their MyBankoh Rewards credit card
account or a check in the amount of $10,000 in the event the winner does not have a
MyBankoh Rewards card. (Approximate retail value of prize is $10,000)
CONDITIONS AND RELEASE OF LIABILITY: By entering this Contest, each entrant
agrees for him/herself and his/her heirs, executors, administrators and successors (a) to
release and hold harmless Sponsor and its parent and affiliated companies and their
respective officers, directors and employees (“Released Parties”) from any liability for any
injury, loss, illness, litigation or damage that may occur directly or indirectly and whether
caused by negligence or not from entrant’s participation in the Contest or acceptance,
possession, or use or misuse of the prize or any portion thereof; (b) to indemnify Released
Parties from any and all liability for copyright, trademark or other intellectual property
infringement claim or any claim that a photo was published without the consent of any
person in the photo, as well as any other liability resulting or arising from the Contest; (c)
to hereby acknowledge that Released Parties have neither made nor are responsible in any
manner or liable for any warranty, representation, or guarantee relative to the prize; (d) that
if selected as the prize winner, to the posting of such entrant’s name on Sponsor’s website
and the use by Released Parties of such entrant’s name, photograph, voice, image, and/or
likeness and any statement made, for publicity, promotional, and advertising purposes in
any and all media now or hereafter known, throughout the world in perpetuity, without
additional consideration, notification, permission or approval; and (e) to be bound by these
Official Contest Rules and to waive any right to claim any ambiguity or error therein or in
the Contest itself, and to be bound by all decisions of Sponsor which are binding and final.
The prize winner will be required to irrevocably transfer and assign all rights title and
interest in and to the winning Entry and if applicable submitted photo, including but not
limited to the rights to sublicense, to use, copy, modify, reproduce, market, publish,
distribute, sell and otherwise exploit for any purpose whatsoever, including without
limitation, modifying, copying, improving a photo, making derivative works thereto,
reproducing and distributing a photo. In addition, winner must provide and assign all
applicable consents/waivers to persons appearing in a photo.
GENERAL: Sponsor has the sole power and absolute discretion to terminate or modify
the Contest at any time, without cause or prior notice, and to interpret these Official
Contest Rules and make decisions regarding the interpretation of these Official Contest
Rules and amend or clarify these Official Contest Rules at any time in its sole and
absolute discretion. If we do amend or clarify these Official Contest Rules, we will post
the amended rules on our website at boh.com/MBRmillionpoints. All decisions of
Sponsor in respect to this Contest and interpretation of these Official Contest Rules are
final and legally binding and conclusive in all matters. No participant or winner shall
have any right to challenge or contest any decision of Sponsor concerning the Contest, its
rules, interpretations, determinations, eligibility, verification, timeliness, winners, prizes
or any other matter. All federal, state of Hawaii and local laws and regulations apply.
Taxes are winner’s sole responsibility. In addition to the required transfers and
assignments, the prize winner will be required to complete the Declaration. The prize
winner is also required to complete a W9 form, if not completed the prize winner will be
disqualified. All documents must be returned within the time specified in the notification
to Finalist/Winner. If documents are not returned within the time period specified, the
prize winner will be disqualified and the alternate with the next highest ranking will be
selected. The prize winner may be required to execute additional releases. No transfer or
assignment of any prize is permitted. No advertising or promotion agencies, nor any
service providers are responsible for incorrect or inaccurate transcription of entry
information, or for any human error, technical malfunctions, lost/delayed data
transmission, omission, interruption, deletion, defect, line failures of any telephone
network, computer equipment, software, inability to access any service, or any other error
or malfunction, or for late, stolen, lost, postage due, illegible or misdirected entries or
mail, or for transactions that are processed late or incorrectly. Entry materials that have
been tampered with or altered are void. Activity deemed abusive or improper by
Sponsor, in its sole discretion, will result in disqualification from Contest. Sponsor
reserves the right to substitute a prize of comparable value at its discretion. By entering
this Contest, each entrant accepts and agrees to be bound by these Official Rules. Bank

WINNER’S NAME: For name of Winner, send a stamped, self-addressed envelope to:

of Hawaii’s Credit Card Department.
