The Navajo Nation Division of Transportation (DOT) is soliciting proposals and sealed bids for
the “Asphalt Paving of the Window Rock Fairgrounds & Zoo Parking Lots”. The project locations
are in Window Rock, AZ.

Additional proposal requirements are that, the mailed packet, proposal, and bid form(s) be in
separate, sealed envelopes with the proposer’s name, return address, bid number, and project
description: ‘Asphalt Paving of the Window Rock Fairgrounds & Zoo Parking Lots’, written on
all envelopes. Failure to comply will make the proposal invalid.

INFORMATION ONLY – NO RESPONSE TO THIS SECTION IS REQUIRED
ADDENDUM OR SUPPLEMENT TO THIS REQUEST FOR PROPOSALS: In the event it
becomes necessary to revise any part of this RFP, an addendum(s) will be issued. Any respondents
that already submitted a proposal will be notified.
PROPOSALS SUBMISSION: Proposal must be received on or before 12:00 p.m. on August 29,
2016. Respondents who are mailing their proposals should allow sufficient time for mail delivery
to ensure receipt by the time specified. If mailed, it is recommended that proposals be sent by
certified mail to the address indicated on Page 2 of this RFP.
Please submit an Original and four (4) copies of proposals.
The proposer agrees that the Navajo DOT will not be responsible for any errors, omissions,
inaccuracies, or incomplete statements in this proposal.
The Navajo Nation Office of the Controller (OOC) and the Navajo DOT reserve the right to reject
any or all submittals, or to withhold the award for any reason it may determine.
RESPONSE MATERIAL OWNERSHIP: All material submitted in reference to this RFP shall
become the property of the Navajo Nation and will not be returned to the respondent. Responses
received will be retained by the Navajo DOT and may be reviewed by any person(s) after the final
selection has been made.
INCURRING COSTS: The Navajo DOT is not liable for any cost incurred by the respondent prior
to issuance of service contract or a purchase order.
Navajo DOT will not pay for any Pay Adjustment Factors greater than the contract bid price.
AWARD OF BID: Upon selection, an EJCDC Construction Contract will be prepared in the name
of the successful respondent and the contents of the proposal submitted by the respondent will
become part of the contract.
TERM: The term of the EJCDC Construction Contract will be a period of one year from the date
of the award to the completion of the project, with an option to renew the contract for continued
services, which will be based upon the availability of funds. Renewal of the contract will be made
only upon mutual agreement of both parties.
COMPLIANCE WITH THE NAVAJO NATION OPPORTUNITY ACT: Proposal will be
opened and evaluated in compliance with the Navajo Nation’s Business Opportunity Act, 5
N.N.C., Chapter 2, Subsection 201 – 215 and the Navajo Nation Procurement Rules and
Regulations.
INSURANCE: The contractor shall procure and maintain adequate and sufficient insurance for
potential liabilities for the duration of performance under this contract.
BONDING: The contractor shall provide a Performance Bond and a Payment Bond underwritten
and executed by a surety company, equal to one hundred percent (100%) of the contract amount.
LICENSE & REGISTRATION: The contractor shall a current and valid license from an
appropriate State Licensing Board or Agency for the type of work to be performed under this
contract. The contractor shall be registered to do business with the State in which the project is
located.
TAXES: Contractor acknowledges and agrees that all work performed and services provided
within the territorial jurisdiction of the Navajo Nation is subject to the five percent (5%) Navajo
Sales Tax.
The Navajo Nation Business Opportunity Act and the Navajo Preference in Employment Act
shall apply to this project.
Navajo Nation Fairgrounds and Zoo Parking Lots, Window Rock, Arizona
Statement of work:
The work to be performed under this contract shall consist of furnishing all labor, equipment,
and materials necessary to perform asphalt paving of the Navajo Nation Fairgrounds and Zoo
Parking Lots as describe below. The Navajo DOT will prepare and compact the subgrade prior
to starting the paving operation. The location of the parking lots are in Window Rock, Arizona
just off State Route 264 and are within one mile of each other.
The first parking lot is located on the Navajo Nation Fairgrounds directly east of the Navajo
Nation Sports Center. The proposed paving area is 153,300 square feet and shall be placed with
a final thickness of 3 inches.
The second parking lot is located directly south of the Navajo Nation Zoo. The proposed paving
area is approximately 17,900 square feet and shall be placed with a final thickness of 2.5 inches.
The following assumptions shall be made:
The subgrade will be graded and compacted by Navajo DOT and ready for asphalt
paving activities.
The limits of paving and quantities given below are estimated. The actual paving limits
will be based on the final design layout and as staked in the field by the Navajo DOT.
The paving schedule is from August 31 to September 6, 2016 with the following dates
being strictly enforced. Any Contractor delays beyond these dates shall be subject to
liquidated damages.
o The Fairgrounds parking lot paving shall be complete and available for use on
September 3, 2016.
o The Zoo parking lot paving shall be complete and available for use on
September 6, 2016.
The asphalt mat for the Fairgrounds parking lot will be 3 inches thick and will be
approximately 2,907 tons.
The asphalt mat for the Zoo parking lot will be 2.5 inches thick and will be
approximately 283 tons.
Asphaltic Concrete Mix:
The supplier/vendor shall furnish Hot Mix Asphalt Pavement meeting the requirements of the
Standard Specifications for Construction of Roads and Bridges on Federal Highway Projects FP14 Section 403 – Asphalt Concrete, Type I in the following quantities and locations:
Window Rock, Arizona, Fairgrounds Lot: 2907 tons
Window Rock, Arizona, Zoo Lot: 283 tons
(tonnage based on a mix unit weight of 4075 lbs/cy)
The mix shall be delivered using covered END DUMP trucks, the delivery quantities and dates
shall be coordinated with the Navajo DOT Construction Manager. The production, transporting,
delivery and placement method shall be in accordance with the specifications herein. A
Certification of Compliance and Mix design shall be delivered to the Construction Manager for
review and approval before the material is delivered to the project.
Any delays caused by the vendor, except for delays caused by the Navajo DOT, may result in
rejection of the amounts of materials ordered for that day and no payment shall be made. The
vendor will have to dispose of the materials at his own expense off the Navajo Nation property in
approved recycle facilities.
PART II - FORMAT AND ORGANIZATION
Requirements: This section of the RFP specifies the format and organization of the proposal (not
listed in priority or in any order).
A. NUMBER OF COPIES: Submit an Original and four (4) copies of proposal.
B. PROPOSAL FORMAT: Appearance of the proposal is important and professionalism in
the proposal presentation should not be neglected. The proposal standards are as follows:
a. The proposal may not exceed 5 single-side pages (maximum 8 1/2” x 11”) with a
minimum of 12 point type. Proposal submitted exceeding the 5-page limit will be
considered non-responsive and will be un-rated.
C. LETTER OF INTEREST: Letter of Interest on Company letterhead should be included,
The Letter of Interest does count toward the 5-page limit of the proposal.
D. OVERVIEW OF COMPANY: Provide a brief overview of your company and its goals
and services. Include any other information about your business to provide a
comprehensive perspective about the services provided.
E. REFERENCES: List references for last 3 projects of similar nature. Acknowledge consent
in proposal that Navajo DOT may contact references for performance appraisals of the
Company. Negative appraisals may be grounds for rejection of Company’s proposal.
F. PROOF OF CERTIFICATE OF INSURANCE: Provide proof of Certificate of Insurance.
The certificate of insurance will not count towards the 5-page limit.
G. CERTIFIED NAVAJO BUSINESS: Provide proof that business is currently certified by
the Navajo Nation - Business Regulatory Department and prioritized under Navajo Nation
Council Resolution CAP-37-02 and also under the Section 204 (A) (1) and (2) of the
revised Navajo Nation Business Opportunity Act. This information will not count towards
the 5-page limit.

Bidder acknowledges that (1) each Bid Unit Price includes an amount considered by Respondent
to be adequate to cover Contractor’s overhead, profit, permit fees, and expenses for each separately
identified item, and (2) estimated quantities are not guaranteed, and are solely for the purpose of
comparison of Bids, and final payment for all unit price Bid items will be based on actual
quantities, determined as submitted by the final haul ticket quantity.
Bidder hereby acknowledges and agrees that said bid constitutes the full and adequate
consideration for all work fully and satisfactorily performed, for all applicable taxes, permit fees,
licensing fees, registration fees, bonding and surety costs, insurance or any other expenses
necessary or convenient for the contractor to perform under this contract.
