INFORMATION REGARDI*
SOCIAL D A Y CARE AND ADULT D A Y HEALTH PROGRAMS
Social Dav Care (SDC) programs provide structured community settings for
persons w h o require daytime supervision due t o social/or emotional problems or
physical impairments. SDC is one of the services available t o clients in the State
Home Care Program w h i c h is administered b y the Executive Office of Elder Affairs
(EOEA) through contracts w i t h 2 7 Home Care Corporations (HCCrs). Participants
also m a y pay privately t o attend SDC.
Currently, SDC programs have no licensing requirements in Massachusetts.
However, SDC programs contracting w i t h any o f the HCCrs must adhere t o
standard contract requirements and service standards (Attachment A ) established
b y EOEA. The rate of reimbursement is negotiated between the SDC and t h e
HCC. The current minimum rate established b y EOEA is $ 2 0 . 0 0 per day.

The Executive Director may be able t o inform y o u of the need for the service as
well as contracting procedures for referring Home Care clients. For more

Adult Dav Health (ADH) programs provide an alternative t o long-term
institutional care through organized community programs o f health care and
supervision, restorative services, and socialization. Medicaid recipients w h o are 1 8
or over, w h o require skilled services or assistance w i t h Activities o f Daily Living,
m a y be eligible for A D H if they are willing t o attend a rr~inimumo f 2, full six-hour
days per week. HCC clients m a y also be eligible t o participate in the A D H
program. Participants may also pay privately.
A D H is regulated (see Attachment B for excerpts from these regulations) b y
t h e Division o f Medical Assistance under the Executive Office o f Health and Human
Services. The current Medicaid per diem rate is $32.41. A n A D H listing is

PROVIDER AGREEMENT
ATTACHMENT A
SOCIAL DAY CARE SERVICES provide individualized programs of
recreational and social activities, and support for elders who
require day time supervision and assistance with daily care
needs. This service includes assistance with mobility, grooming,
and mealtime activities.

Nutrition services provided by this program include a
minimum of~one(1)meal per day which is of suitable
quality and quantity, and supplies at least one-third
(1/3) of the daily nutritional requirements. Special
diets must be made available if indicated.

Social Day Care services are provided by trained,
supervised staff and the provider must comply with the
Social Day Care Standards issued by the Executive Office of
Elder ~ffairs. These standards are as follows:
SOCIAL DAY CARE STANDARDS
A. Operates the service in a site that meets all local
building codes;
B. Employs qualified staff to operate the program.
~ualifiedstaff includes:
1.
A Program Director responsible for supervising the
program (he/she may not have administrative
responsibility for the Center within which the Program
is located). Additional staff should be employed at a
ratio of one staff member for each eight participants
or portion thereof.
2.
The Prograc Director shall have a Master's degree in
social work or a related field, or shall have
comparable experience. In addition, he/she shall have
experience in geriatrics or gerontology, supervisory
skills, and transferring skills.
3.
Staff staff members shall have experience in working
with elders and/or special needs clients, and group
work or recreational skills.
4.
At least one staff person in each Social Day Care
program shall be CPR trained.
5.
Elder Service Corps enrollees and Senior Aides may be
used as available.
C. Has the capacity to provide individual and group activity
programs that offer social, recreational, and educational
events designed to meet the needs of participants;
D. Has the capacity to provide nutrition services, either
directly or as a site at which other agencies may provide
the service. Nutrition services must include a minimum of
one meal per day which is of suitable quality and quantity
and supplies at least one-third of the daily nutritional
requirements, special diets that may be indicated by a
client's home care service plan and morning and afternoon
snacks. Nutrition services at the Social Day Care Center
may be provided either:
1. Through the Title 111-C Nutrition Program if the Social
Day Care Center is a Title 111-C meal site.
2. By purchase by the Home Care Corporation from the home
care purchased service (home delivered meals) account
with the meals being delivered to the Social Day Care
center rather than to the client's home; or
3. As a direct service by the provider.
. Has
in place a procedure for action in case of emergency
(e.g. fire) on which staff is trained. Training must take
place within one week of employment. Follow-up training
must be held for all staff at a minimum of once every three
months.
F. Is open no later than 8:30 a.m. and closes no earlier
than 4:00 p.m.
G. Is handicapped accessible.

106 CHR 404.--401 INTRODUCTION
In an effort to provide high-quality alternatives to institutional care,
the Department has elected to pay for adult day health services under the
Medical Assistance Program, subject to the conditions and limitations set
forth in these regulations.
The following definitions apply when used in these regulations.
(A) Adult
- any
person aged 18 or older.

all services provided by adult day health
(B) Adult Day Health Services
programs approved for operation by the Ikpartment that meet the conditions set forth in the regulations in this Chapter 404.000 and whose
general goal is to provide an alternative to 24-hour long-term institutional care through an organized program of health care and supervision, restorative services, and socialization.
(C)
Attendance Day -- any day during which a participant attends the adult
day health program for a minimum of six hours.

ELIGIBLE RECIPIENTS
(A)
Hedical Assistance Reci~ients
The Department pays for services provided to adult Hedical Assistance
recipients (categories of assistance 00, 01, 02, 03, 05, 06, 07, and
08) vho require services in a structured adult day health setting and
vho meet the three eligibility requirements belov.
(1) The recipient must have a medical or mental dysfunction that
involves one or more physiological systems and requires nursing
care. (The dysfunction does not have to be one that can be
stabilized).
(2)
The recipient must require one or both of the folloving:
(a) skilled services; or
(b) assistance in activities of daily living.
(3) Recipients referred to the program must be villing to attend the
program a minimum of tvo full six-hour days per veek, unless a
recipient's physician completes a vritten justification explaining vhy the recipient should attend less often. This vritten
justification must be approved by the Department.

PROVIDER ELIGIBILITY
(A)
In order to-be eligible for Hedical Assistance Program payment for'
adult day health services, a provider must:
.
(1) 'be enrolled as a participating provider in the Hedical Assistance
Program ;
(2) meet the Nassachusetts Department of Public Health Determination
of Need -requirements necessary for adult day health programs
based in nursing homes or off-campus hospital-affiliated health
centers and clinics; and
(3) meet the kiassachusetts Department of Public Safety and local fire
department requirements specified in Subsection 415(B).
(B) Groups or individuals that operate specialized day programs primarily
for persons who are developmentally disabled, blind, deaf, or acutely
mentally ill are not eligible to become adult day health providers.
(C) Adult day health programs operating outside of Hassachusetts are not
eligible to become adult day health providers.

Restorative Services
Adult day h e a l t h programs must provide o r coordinate r e s t o r a t i v e services
as needed f o r each p a r t i c i p a n t , when recommended by t h e r a p i s t s and
prescribed by a physician. Restorative s e n r i c e s must include occupat i o n a l , physical, and speech therapy. The provider must e s t a b l i s h
w r i t t e n agreements v i t h individual physical, speech, and occupational
t h e r a p i s t s (unless they a r e employed as staff members), o r must establ i s h agreements f o r t h e serpices of such t h e r a p i s t s with hospitals,
clinics, o r V i s i t i n g Nurse Associations, t o provide consultant services
t o t h e program and, i f necessary, t o provide direct therapeutic s e r v i c e s
t o a participant. Therapists must provide direct therapeutic treatment
t o a p a r t i c i p a n t o w - if such treatment is r e f e r r e d by a p a r t i c i p a n t ' s

designed t o improve each p a r t i c i p a n t ' s self-awareness and level of

i n d i v i d u a l p a r t i c i p a n t s must be considered in t h e development of
a c t i v i t y programs.

The provider must f u r n i s h s p e c i a l d i e t s , i f required by a p a r t i c i p a n t
and prescribed by h i s physician.
In a d d i t i o n , program s t a f f members,
