96 10 GEO. V.] Melbourne and Metropolitan Tramways. [No. 3023 No. 3023. An Act to amend Division 8 of Part III. of the Melbourne and Metropolitan Tramways Act 1918. [16th December, 1919.] Preamble. "TTTHEREAS by the Melbourne and Metropolitan TramV V ways Act 1918 provision is made for the determination of the total amount of each municipality's contribution thereunder to The Melbourne and Metropolitan Municipal Loans Redemption Fund to be established in the Treasury as provided in the said Act": And whereas it is farther provided that the first such determination shall be made as soon as practicable after the passing of the said Act and that for the purposes of the said first determination the cable tramways surplus as defined in the said Act shall be deemed to be Eight hundred and twenty-seven thousand pounds : And whereas provision is also made by the said Act for the total amount of each municipality's contribution to the said Redemption Fund being again determined when it appears to the Governor in Council that the said cable tramways surplus has been paid into or is available for payment into the said Redemption Fund and that the amount of the said cable tramways surplus is or will be substantially greater or less than Eight hundred and twenty-seven thousand pounds : And whereas the said first determination has been made as provided by the said A c t : And whereas it now appears that the said cable tramways surplus will be less than Eight hundred and twenty-seven thousand pounds: And whereas it is expedient to provide that (instead of the total amount of each municipality's contribution to the said Redemption Fund being again determined as provided by the said Act) the said total amount of each municipality's contribution to the said Redemption Fund shall be the amount determined on the said first determination thereof and that the Board constituted under the said Act shall as hereinafter provided pay out of the revenues from its tramway undertakings into the said Redemption Fund a sum equal to the difference between the amount of the said cable tramways surplus and Eight hundred and twenty-seven thousand pounds and that the said Act be amended as hereinafter provided 10 GEO. [No. 3023 97 provided: Be it therefore enacted by the King's Most Excellent Majesty by and with the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows (that is to say) :— 1 . This Act may be cited as the Melbourne and Metro- ^hortttlfcle politan Tramivays Act 1919 and shall be read and construed and citation as one with the Melbourne and Metropolitan Tra?mvays Act No*20951918 (hereinafter called the Principal Act) which Act and this Act may be cited together as the Melbourne and Metropolitan 'Pramways Acts. 2 . Notwithstanding anything in the Principal Act— mSitol)e tramways (1) the Board constituted under the Principal Act gedeS°tt shall out of the revenues from its tramway :Fundundertakings pay into The Melbourne and Metropolitan Municipal Loans I redemption Fund within twelve months after the commencement of this Act a sum equal to the difference between the amount of the cable tramways surplus and Eight hundred and twenty-seven thousand pounds; ( 2 ) the sum to be so paid shall be charged upon the said revenues ; (3) the total amount of each municipality's contribn- contributiona tion to the said Fund shall be the amount municipalities , to Redemption determined on the first determination thereof Fund to bo in , , , i i - accordance with and the hall-yearly instalments payable into the rust •' ^ • > • . . . determination. the said Fund by the several municipalities shall be and continue to be so payable in accordance with the said first determination ; and the provisions of the Principal Act shall be read and construed and take effect accordingly. 3 . V.] Melbourne and Metropolitan Tramways. [No. 3023 SCHKDULK. A M E N D M E N T S OF T H E MELBOURNE AND METROPOLITAN TRAMWAYS ACT 19IS. I n paragraph (d) of sub-section (2) of section seventy-three for the word " a n y " there shall be substituted the word " the."' In sub-section (2) of section seventy-four'for the words " Municipalities' Loans Redemption Act" there sliall be and from the passing of the Principal Act be deemed to have been substituted the words " Municipalities' Loans Extension Act." Section seventy-six shall be amended as follows:— (a) I n paragraph (a) of sub-section (1) for the words " Municipalities' Loans Redemption Act" there shall be and from the passing of the Principal Act be deemed to have been substituted the words " Municipalities' Loans Extension Act": and in paragraph (i) of sub-section (2) for the word " t r a m w a y " there shall be and as from the passing of the Principal Act be deemed to have been substituted the word " t r a m w a y s . " (&) I n paragraph (c) of sub-section (1) for the words " shall continue to be payable unless and until a further determination is made as hereinafter provided"' there shall be substituted the words "shall be and continue to be payable as so determined." (c) Sub-section (5) shall be repealed. Sub-section (3) and sub-section (4) (except the proviso therein) of section seventy-eight shall be repealed. I n sub-section (3) of section eighty t h e words " Tf the amount of any municipality's total contribution to the Redemption Fund is decreased on a further determination thereof as hereinbefore provided, and also " shall be repealed.
