Background The Licensing Procedures Document is based upon The provisions of the Town Police Clauses Act 1847 (Sections 37-68), The Local Government Miscellaneous Provisions Act 1976 (Sections 45-80), Vehicles (Excise) Act 1971 (Section 19) and the Transport Act 1980 (Sections 64) Public Health Act 1936 (Sections 300 -302) Appeals process In these conditions the Isle of Anglesey County Council will hereafter be referred to as the “Council”, the Town Police Clauses Act 1847 will be referred to as the “1847 Act” and the Local Government Miscellaneous Provisions Act 1976 will be referred to as the “1976 Act” Vehicles (Excise) Act 1971 as the “1971 Act” and the Transport Act 1980 as the “1980 Act and the Public Health Act 1936 as the “1936 Act”. Under the terms of the above named Acts the following require a licence: Every vehicle which is to operate as a hackney carriage or private hire vehicle Every driver of a hackney carriage or private hire vehicle. Every operator of private hire vehicle(s). Guidance on the procedures to be followed by applicants for Taxi, Private Hire Vehicles, Driver’s and Operator’s are to be found attached in Appendix A. If you make application from 1st April, 2011 your application will be processed through a new procedure with the implementation of a Knowledge Test. The Test will be a precursor to the Licence Application and the cost included in the overall fee; however, if you fail your Knowledge Test you will be required to pay a re-sit fee in order to proceed with the Application. The new style knowledge test comprises of 4 sections; Basic English & Maths, Conditions, Legislation and Local Routes. Further guidance on these sections in Appendix G. Also from the 1st April, 2011 a new transparent, equitable Enforcement Policy will be in place involving a simple penalty points system (Appendix F). This will allow Drivers and Operators to be given advice and guidance in line with the Council’s adopted Enforcement Policy yet act an effective enforcement measure against repetitive minor offenders. It will also assist in raising the overall general standards and protect public safety through raising awareness of the standards expected 2. HACKNEY CARRIAGE VEHICLE LICENCE CONDITIONS 2.1 CONDITION OF THE VEHICLE The County Council requires the vehicle to be suitable in type, size and design for use as a hackney carriage. Hence all licensed vehicles will be: (a) White/ Silver in colour (b) Less than six years old from date of first registration on first application. NOTE: (i) Vehicles licenced with the Council may continue until eight years of age subject to the condition of the vehicle (tested every six months after six years of age). (ii) Purpose built vehicles e.g. “Black Cabs, Minibuses and vehicles approved under Vehicle Certification Agency Low Volume type approval as Taxi” may continue to be licenced up to 12 years of age subject to condition (tested every six months after 6 years of age). Vehicles undertaking contract work exclusively may extend the Licence period to 15 years of age tested every 6 months. (c) Of suitable cleanliness and appearance inside and out. The requirements which all vehicles must comply with are referred to in Appendix C which is attached to these conditions and if on any inspection the vehicle fails to meet those requirements the Council may suspend or revoke or refuse to renew a vehicle licence. Seating Arrangements - A clear passageway must be provided as a means of access and egress. The maximum number of passenger seats allowed is 8 and all should have direct access to a door without the need to climb over seats or parts of seats, or the need to lower the back of a seat. If a seat is to be removed to comply with this requirement, it shall be removed from the nearside of the vehicle from the row of seats which are situated behind the front passenger seat. Seating Plan - For vehicles with a seating capacity of more than 4 persons, a seating plan of the vehicle must be submitted to this authority with the licence application. A minimum seat width of 400mm (16 inches) per person is required for all seats in the vehicle. The proprietor of a hackney carriage licensed with the Council must present the vehicle for inspection in such place within the area of the Council as the Council may by notice reasonably require. The Council is entitled to require a proprietor to present the same hackney carriage for such inspection on up to three separate occasions during any one period of 12 months. All licensed vehicles must be registered with the DVLA as hackney carriage vehicles. In addition an authorised officer of the Council (or any constable) has the power at all reasonable times to inspect and test, for the purpose of ascertaining its fitness any hackney carriage vehicle licensed by the Council and any taxi-meter affixed to such a vehicle. If he is not satisfied as to the fitness of the vehicle or as to the accuracy of its taxi-meter he may by notice in writing require the proprietor of the vehicle to make it or the taxi-meter available for further inspection and testing at such reasonable time and place as may be specified in the notice. Further he may suspend the vehicle licence until such time as such authorised officer or constable is so satisfied as to the fitness of the vehicle or accuracy of the taxi-meter. 2.2 PLATES On granting a vehicle licence the Council will issue an appropriate plate bearing the same number as shall be designated to the relevant vehicle in the licence document itself and this must be exhibited on the vehicle by being affixed to the vehicle securely and in a prominent position, i.e. Outside the vehicle attached to or near the vehicle registration plates. Inside the vehicle displayed in a postion all customers and passengers can view. The Council at their discretion may grant certain category of vehicles and exemption from displaying plates on the outside of the vehicle On revocation or expiry of a vehicle licence the Council require the owner of that vehicle to return (within 7 days) to the Council the above mentioned plates. 2.3 CHANGE OF OWNER DETAILS Once a hackney carriage licence has been issued, any person named in that licence as having an interest in the vehicle shall, if he changes his home address, notify the Council in writing within 7 days of such change and produce to the Trading Standards Section the said licence so that the appropriate amendments can be noted on the licence and the Council’s register. 2.4 TRANSFER OF INTEREST Any person who has an interest in a hackney carriage and who transfers his interest other than to another proprietor referred to in the licence must notify the Council within 14 days of such transfer specifying the name and address of the person to whom he has transferred his interest. The proprietor of a hackney carriage must ensure any driver using the vehicle is properly licenced to drive by the Council and DVLA. A record of the licences held by the driver(s) using the vehicle must be kept by the proprietor of the hackney carriage, but only during the period the driver is in his employ. 2.5 ALTERATIONS TO A VEHICLE No alteration shall be made to the vehicle without the prior approval of the Council. If approved the Council must be notified forthwith when that alteration has been completed and the vehicle may be required to be submitted for testing before it resumes operation. If a vehicle is involved in an accident that requires a subtantial repair (greater than £200) the licencee must notify the Council in writing of the circumstances of the accident and nature of the subsequent repairs. The vehicle may be required to be submitted for testing before it resumes operation. If a licenced vehicle becomes temporarily inoperable due to a serious mechanical failure or accident then the plate may be transferred on a temporary licence to another appropriate vehicle for a period of up to 6 months. A full vehicle test and payment of a prorata fee will be required. 2.6 INSURANCE The vehicle shall not be operated at any time unless there exsists a fully valid third party liability insurance in force in respect of the vehicle. When requested by an authorised officer or constable the owner of a licenced vehicle must produce a valid insurance certificate for the vehicle within 1 working day of the request. 2.7 FEES No fare shall be levied in excess of that prescribed from time to time by the Council in its “Table of Fares” in Appendix 2. On granting a vehicle licence the County Council will issue a schedule of the prescribed fares and this must be exhibited within the vehicle by being affixed securely and in a prominent position. Failure to renew a licence within 14 days of the expiry date ensures any subsequest application will treated as a new application. 2.8 LICENCE PLATE NOT TRANSFERABLE The Vehicle is licensed by the Council and it is not lawful therefore to transfer the plate to another vehicle. A vehicle operating as a hackney carriage without a licence of its own but bearing a plate issued in respect of another vehicle will be operating without a licence and hence unlawfully. 2.9 FIRE EXTINGUISHER Every vehicle shall at all times carry in a conveniently accessible position, a suitable fire extinguisher, manufactured, tested and maintained according to the relevant British Standard. 2.10 FIRST AID KIT Every vehicle shall at all times carry a first aid kit according to the relevant British Standard. 2.11 CAPACITY AND SIGNS Every hackney carriage must exhibit a distinctive sign indicating that the vehicle is a hackney carriage and the number of people it seats as follows: "To carry............................persons". Seating capacity shall be in accordance with REGULATION 42 of the Road Vehicles (Registration and Licensing) Regulations 1977. The hackney carriage must not carry more passengers than that indicated on the plate. All hackney carriages licensed by the Council shall carry the word "TAXI" on a sign securely fixed to the roof of the vehicle., All hackney carriages must display on or near the front and rear registration plates a hackney carriage plate as supplied by the Council. An approved taxi meter must be fitted to the vehicle. 2.12 SUSPENSION AND REVOCATION OF LICENCE (Sections 60, 61 and 62 of the 1976 Act) Subject to rights of appeal may suspend, revoke or refuse to renew a hackney carriage vehicle licence on any of the following grounds:a. that the hackney carriage is unfit for use as a hackney carriage; b. any offence under, or non compliance with the provisions of the 1847 Act or of part II of the 1976 Act by the operator or driver; c. A beach of any of the above licence conditions; d. any other reasonable cause. Where the Council takes such action of suspension/revocation/refusal to renew, they must within 14 days of such action give written notice to the person concerned of their reasons for so doing and in each case there is a right of appeal to the County Council’s Appeals Committee and subsequently to the Magistrates Court. 3. PRIVATE HIRE VEHICLE LICENCE CONDITIONS 3.1 CONDITION OF THE VEHICLE The County Council require the vehicle to be suitable in type, size and design for use as a private hire vehicle. The vehicle must clearly NOT be confused with a hackney carriage vehicle. Hence all licensed vehicles will be: (a) Any colour other than white or silver; (b) Less than six years old from date of first registration on first application. NOTE (i) Vehicles licenced with the Council may continue until eight years of age subject to the condition of the vehicle (tested every six months after six years of age). (ii) Purpose built vehicles e.g. Minibuses and vehicles approved under Vehicle Certification Agency Low Volume type approval as Taxi, may continue to be licenced up to 12 years of age subject to condition (tested every six months after 6 years of age). All private hire vehicles must display on or near to the front and rear vehicle registration number plates, private hire licence plates as supplied by the Council. Every vehicle must exhibit a distinctive sign indicating that the vehicle the number of people it seats as follows: "To carry... persons". is a private hire vehicle and Seating capacity shall be in accordance with REGULATION 42 of the Road Vehicles Registration and Licensing) Regulations 1977. The private hire vehicle must not carry more passengers than that indicated on the plate. 3.11 PLYING FOR HIRE PROHIBITED It is an offence to use a private hire vehicle to ply for hire in a street, railway station or railway premises, as a private hire vehicle is not licensed to operate as a hackney carriage. 3.12 HACKNEY CARRIAGE STANDS No private hire vehicles shall stand at a hackney carriage stand so appointed by the Council. 3.13 FEES Failure to renew a licence within 14 days of the expiry date ensures any subsequent application will treated as a new application. 3.14 SUSPENSION AND REVOCATION OF LICENCE (Sections 60, 61 and 62 of the 1976 Act) Subject to rights of appeal to the Magistrates Court the Council may suspend, revoke or refuse to renew a private hire vehicle licence on any of the following grounds:a. that the vehicle is unfit for use as a private hire vehicle; b. any offence under, or non compliance with the provisions of the 1847 Act or of part II of the 1976 Act by the operator or driver; c. STRETCHED LIMOUSINES USED AS PRIVATE HIRE VEHICLES These conditions made under the Local Government (Miscellaneous Provisions) Act 1976 are specific to a vehicle adapted by lengthening the wheelbase of a standard, factory built vehicle. The purpose of these conditions is to protect public safety. They apply in addition to the Authority’s standard conditions for private hire vehicles and take account of the fact that stretched limousines will: i) ii) iii) iv) v) Travel generally at slower speeds than normal taxis Not normally overtake other vehicles be easily recognisable by the hirer be heavier and considerably longer than standard cars Be adapted or converted by someone other than the original manufacturer. 4.1 GENERAL An “American stretched limousine” is a stretched limousine imported from the USA and typically will have been manufactured originally by Lincoln (Ford) or Cadillac. A maximum passenger accommodation of eight. For the purposes of calculating the seating capacity of a vehicle the minimum width of a passenger seat is 400mm (16 inches). 4.2 CONDITIONS A stretched Limousine shall in the first instance, meet with the standard conditions relating to Private Hire Vehicle. In the case of a stretched limousine, or American stretched limousine, originals of the following documentation will be required by the Council before an initial application for a vehicle license can be considered: (a) (b) (c) (d) (f) (g) Single Vehicle approval (SVA) certificate. DVLA Registration Document (V5). Valid Certificate of Insurance, with cover for hire and reward. Current MOT certificate issued by an approved Testing Station. Valid Road Vehicle Excise license disc. Evidence of the date of manufacture date. The Vehicle shall comply with the following: (a) (b) (c) (d) (e) Must be constructed through an approved converter, such as QVM or CMC. No front passenger seat to be fitted. Be equipped with tyres designed and manufactured to support the maximum permitted axle weight for the axle when the vehicle is driven at the maximum speed. Seat belts, where fitted, must be fitted in accordance with the current Road Vehicle (Construction and Use) Regulations. The maximum length of the stretch conversion (measured between the rear edge of the front door and the front edge of the rear door) shall not exceed (f) 3048mm/120” for salon type vehicles. And 3302mm/130” for the ford Excursion. Tinted glass shall conform to the legal requirements of the current Road Vehicle (Construction and Use) Regulations. All blackened and tinted glass must be fitted as standard at point of manufacture, Any modifications from standard will not be acceptable. Vehicles licensed with the Council may continue until 12 years of age subject to the condition of the vehicle (tested every six months after six years of age). 4.3 REGULATED ENTERTAINMENT Alcoholic drinks provided in the vehicle: (a) (b) (c) Shall be under the terms of an appropriate license relating to the sale or supply of alcohol. For bookings for groups of passengers under 18 years the supply of alcohol is prohibited. Only plastic glasses and bottles to be used whilst in motion. Glasses and bottles must be locked away prior to the commencement of the journey. Bookings for vehicle(s) which are solely for use of children under the age of 16 years must be accompanied by either a parent/guardian or a Criminal Records Bureau (CRB) checked escort. A declaration, to be completed by the parent/guardian responsible for the journey, prior to the commencement of the journey providing details of the persons travelling and the name and contact details of the person responsible for the booking. A copy of the form must be carried by the driver. The only form of regulated entertainment allowed within the vehicle is recorded music and TV/Video/DVD. 5. DRIVER LICENCE RULES AND CONDITIONS 5.1 PASSENGERS The driver shall not convey or permit to be conveyed in a hackney or private hire vehicle a greater number of persons than that prescribed in the licence for the vehicle. The driver shall not allow to be conveyed in the front of a hackney or private hire vehicle: (a) any child below 1.35 metres in height or less than 12 years old. (b) more than one person above that age. 5.2 BEHAVIOUR OF DRIVERS Drivers must: (a) Afford all reasonable assistance with passengers luggage. (b) At all times be clean and respectable in his/her dress and person and behave in a civil and orderly manner. (c) Take all reasonable steps to ensure the safety of passengers conveyed in, entering or alighting from the vehicle driven by him/her (d) Not without the express consent of the hirer smoke, drink or eat in the vehicle. (e) Not without the express consent of the hirer play any radio or sound reproducing instrument or equipment in the vehicle other than for the purpose of sending or receiving messages in connection with the operation of the vehicle. (f) At no time cause or permit the noise emitted by any radio or other previously mentioned equipment in the vehicle which he/she is driving to be a source of nuisance or annoyance to any person, whether inside or outside the vehicle. The driver, when hired to drive to any particular destination, shall subject to any directions given by the hirer proceed to that destination by the shortest practicable route. The driver shall immediately after the termination of any hiring or as soon as practicable thereafter carefully search the vehicle for any property which may have been accidentally left there. A driver shall at all times when driving a hackney or private hire vehicle wear, in a conspicuous position, the driver's badge issued to him/her by the Council. The driver shall upon expiry, revocation or suspension of his/her licence return forthwith to the Council the driver's badge issued to him/her by the Council when granting this licence. The driver shall if requested by the hirer of a private hire vehicle provide him with a written receipt for the fare paid. The driver shall at all times when driving a hackney or private hire vehicle carry with him/her a copy of the conditions and make it available for inspection by the hirer or any other passenger or authorised officer on request. 5.3 CARE OF VEHICLE All drivers should: (a) Always keep their vehicle clean inside and out. (b) Check vehicle before the start of a shift i.e. Road Tax, First Aid Kit, Fire Extinguisher, lights, cleanliness and general working condition of the vehicle . 5.4 NOTIFICATION OF CHANGE OF DETAILS The driver shall notify the Council in writing of any change of his address during the period of the licence within 7 days of such change taking place. The driver shall within 7 days of any conviction, caution etc. disclose to the Council in writing details of any conviction imposed on him during the period of the licence. 5.5 BOOKING PRIVATE HIRE VEHICLES A Private Hire Vehicle must be booked in advance i.e. ADVANCE BOOKINGS ONLY. Bookings can only be made by the customer in one of two ways: (a) Personal visit to Booking Office (b) By telephone to the Booking Office To pick up a passenger that has not booked in advance is likely to mean that the driver commits a criminal offence i.e. illegally “Plying for Hire”. 5.6 HACKNEY CARRIAGES - PLYING FOR HIRE The driver of a Hackney Carriage shall, when plying for hire in any street and not actually hired, (a) proceed with reasonable speed to one of the stands fixed by the byelaw i.e. go to a rank; (b) if a taxi stand or rank, at the time of his arrival is occupied by the full number of hackney carriages authorised to occupy it, proceed to another stand or rank. A proprietor or driver of a Hackney Carriage, when standing or plying for hire shall not by calling out or otherwise, importune any person to hire such carriage and shall not make use of the services of any other person for this purpose. 5.7 FEES Failure to renew a licence within 14 days of the expiry date ensures any subsequent application will treated as a new application. 5.8 SUSPENSION AND REVOCATION OF LICENCE (Sections 60, 61 and 62 of the 1976 Act) Subject to rights of appeal to the Magistrates Court the Council may suspend, revoke or refuse to renew a driver licence on any of the following grounds:a. that the driver is an unfit person to hold a licence; b. any offence under, or non compliance with the provisions of the 1847 Act or of part II of the 1976 Act by the driver; c. A beach of any of the above licence conditions; d. any other reasonable cause. Where the Council takes such action of suspension/revocation/refusal to renew, they must within 14 days of such action give written notice to the person concerned of their reasons for so doing and in each case there is a right of appeal to the County Council’s Appeals Committee and subsequently to the Magistrates Court. 6. PRIVATE HIRE OPERATORS CONDITIONS 6.1 . RECORDS A licensed Operator must keep records as the Council require (Appendix 2) and shall enter on a register before the commencement of each journey particulars of every booking of a private hire vehicle invited or accepted by him whether by accepting the booking from the hirer or by undertaking it at the request of another operator. The licencee shall produce such records on request to any authorised officer of the Council or to any constable for inspection. The Operator must also keep particulars of any private hire vehicles operated by him. This includes make, model, colour, registration, insurance and test certificates along with the relevant licences issued by the Council. All records must be kept for a period of three years. 6.2 INSURANCES The Operators vehicle shall not be operated at any time unless there exists a valid third party liability insurance in respect of the vehicle. When requested, by an authorised officer or constable, the owner of a licensed vehicle must produce a valid insurance certificate for the vehicle within 1 working day of the request. 6.3 FEES Failure to renew a licence within 14 days of the expiry date ensures any subsequent application will treated as a new application. 6.4 SUSPENSION AND REVOCATION OF LICENCE (Sections 60, 61 and 62 of the 1976 Act) Subject to rights of appeal to the Magistrates Court the Council may suspend, revoke or refuse to renew a private hire operator licence on any of the following grounds:a. that the Operator is an unfit person to hold a licence; b. any offence under, or non compliance with the provisions of the 1847 Act or of part II of the 1976 Act by the operator; c. A beach of any of the above licence conditions; d. any other reasonable cause. Where the Council takes such action of suspension/revocation/refusal to renew, they must within 14 days of such action give written notice to the person concerned of their reasons for so doing and in each case there is a right of appeal to the County Council’s Appeals Committee and subsequently to the Magistrates Court. 7. Additional Information The applicant must complete the relevant Application form obtained from the Licensing Section, Trading Standards Department, Planning & Environmental Services, The Isle of Anglesey County Council, Council Offices, Llangefni LL77 7TW. Once fully completed it should be returned to the above address along with the required documentation and fee detailed on the application form. No person shall act as the driver of any licensed vehicle without first obtaining a licence from the County Council. Unless suspended or revoked the lifespan of a Licence will be as follows: Vehicle Licence Operators Licence Driver's Licence 12 months 12 months 24 months. APPENDIX A APPLICATION FOR A DRIVERS LICENCE Forms to be accompanied by the following items: (1) Your DVLA Driving Licence (original - not a photocopy) showing your current address. (2) Your passport or birth certificate (3) 2 colour passport type photographs taken within the last month. (4) Medical Examination certificate. (5)Criminal Records Bureau form(see below if not UK resident or have lived abroad for over 6 months) (6) The fee - payment can be made at the Trading Standards Section by cheque or cash. Before issuing a licence the Authority must be satisfied that the applicant is a "fit and proper person" to hold such a licence and will require references/medical evidence to support this. A search will be conducted by the authority with the Criminal Records Bureau (CRB) on all initial applications to ascertain whether the applicant has any relevant criminal convictions. (See attached Appendix 1 for information on previous convictions). Due to the length of time required for the checks with the CRB to be completed applications may take up to 6 weeks to be approved. If you were born outside the United Kingdom, you must provide a current criminal record check from your Country of origin and any other countries in which you have been resident. If you have live outside the UK for a period of at least six months you must provide a current criminal record check from each country in which you have been resident. Criminal record checks must be provided with your application. All criminal record checks must be translated into English and must be verified by the relevant UK based Embassy or High Commission. All original documentation will be photocopied by the Licensing Authority and returned to you. All applicants for the grant of a taxi driver’s licence must provide evidence of their right to work in the UK before an application can be accepted. If you are a British citizen or an EU national, please provide your passport with your application. If you are not a British Citizen of an EU national, please provide your passport and residence permit confirming your immigration status and right to work in the UK. All original documentation will be photocopied by the Licensing Authority on receipt of your application and returned to you. Any relevant documentation will be forwarded to the UK Border Agency. If your application is for the renewal of a taxi driver’s licence, the Licensing Authority may consult with the UK Border Agency in regard to your immigration status and right to work in the UK. An applicant must have held a DVLA drivers licence for at least 12 months and be at least 21 years of age. Medical evidence is required on first application and subsequently every 4 years. The Authority may also require an examination by their own medical authority. APPENDIX A (continued) Guidelines for the determination of Hackney Carriage/Private Hire Drivers Licences (a) Minor Traffic offences Convictions for minor traffic offences e.g. obstruction, waiting in a restricted area/street, speeding etc. should not of themselves prevent a person from proceeding with an application. The number of offences or the frequency of the offence and their circumstances may, however, be a consideration. (b) Major Traffic Offences An isolated conviction for reckless driving or driving without due care and attention etc. should normally merit a warning as to future driving and advice on the standard expected of Hackney Carriage and Private Hire Vehicle Drivers. More than one conviction for this type of offence within the last three years should merit refusal and no further applications should be considered until a period of one to three years free from conviction have elapsed. (c) Drunkenness (i) With Motor Vehicle Serious views should be taken of convictions or driving or being in charge of a vehicle whilst under the influence of drink. An isolated incident should not necessarily debar an applicant but strict warning should be given as to future behaviour. More than one conviction for these offences should raise grave doubts as to the applicant's fitness to hold a licence. At least three years should elapse after the restoration of the driving licence before the applicant is considered for a licence. This should apply to both an isolated incident or multiple offences for drunkenness in charge of a motor Vehicle. If there was any suggestion that the applicant is an alcoholic, a special medical examination should be arranged before the application is entertained. If the applicant is found to be an alcoholic, a period of five years should elapse (after treatment is complete) before a further licence is considered. (ii) Not in Motor Vehicle An isolated conviction need not debar an applicant from gaining a licence. However, a number of convictions for drunkenness could indicate a medical problem necessitating the critical examination. In some cases however, a warning may be sufficient. (d) Drugs An applicant with a conviction for drug related offences should be required to show a period of at least three years free of convictions before an application is entertained, or five (after detoxification treatment) if he/she was an addict. The seriousness of the offence may affect the length of time required of the application to be free of convictions. (e) Indecency Offences As Hackney Carriage and Private Hire Drivers often carry unaccompanied passengers, applicants with convictions for indecent exposure, indecent assault, importuning or any of the more serious sexual offences should be refused until they can show a substantial period free of such offences. More than one conviction of this kind should preclude consideration for at least five years in either case and if a licence is granted a strict warning as to future conduct should be issued. (f) Violence As Hackney Carriage and Private Hire Drivers maintain close contact with the public, a firm line should be taken with applicants who have convictions for grievous bodily harm, wounding or assault. At least three years free of such convictions should be shown before an application is entertained and even then a strict warning should be administered. (g) Dishonesty Hackney Carriage and Private Hire Vehicle Drivers are expected to be persons of trust. The widespread practice of delivering unaccompanied property is indicative of the trust that business people place on drivers. Moreover. it is comparatively easy for a dishonest driver to defraud the public by demanding more than the legal fare etc.. Overseas visitors and elderly customers can be confused by the currency and become an easy target for an unscrupulous driver. For these reasons, a serious view should be taken of any conviction involving dishonesty. In general, a period of at least three years free of convictions should be required before entertaining an application. HOME OFFICE GUIDELINES REF 13/92 DISCLOSURE OF CRIMINAL RECORDS APPLICANTS FOR HACKNEY CARRIAGE AND PRIVATE HIRE DRIVERS LICENCE APPENDIX B STATEMENT OF POLICY - RELEVANT PREVIOUS CONVICTIONS When submitting an application for a licence to drive a Hackney Carriage/Private Hire Vehicle, you are requested to declare all convictions. The information you give will be treated in the strictest confidence and will only be taken into account in relation to your application. You should be aware that the council is empowered in law to check with the police for the existence and content of any criminal record held in the name of the applicant. Information received from the police will be kept in strict confidence whilst the licensing process takes its course and will be retained for no longer than is necessary. The disclosure of a criminal record or other information will not debar you from gaining a licence unless the Council considers that the conviction renders you unsuitable. In making this decision the Council will consider the nature of the offence, how long ago and what age you were when it was committed and any other factors that may be relevant. Any applicant refused a drivers licence on the grounds that he or she is not a 'fit and proper person' to hold such a licence has the right of appeal to the County Council’s Appeals Committee and subsequently to the Court. EXPLANATORY NOTES ON THE REHABILITATION OF OFFENDERS ACT 1974 This Act provides that after a certain length of time convictions for criminal offences are to be regarded as "spent" for certain purposes. However, all criminal convictions are relevant for Hackney Carriage and Private Hire licensing purposes and must be declared. The Council will consider the offence committed and the time elapsed since conviction for that offence. Sentences of imprisonment exceeding 30 months duration can never be treated as spent and must be disclosed however long ago they were imposed. The periods of time which must elapse in other cases before the conviction becomes spent are as follows: Sentence Rehabilitation Period 1. Over 6 months imprisonment but under 30 months 10 years 2. Under 6 months imprisonment 7 years 3. A fine 5 years 4. Conditional discharge, bound over, 1 year 5. Absolute discharge 6 months 6. Cashiering, discharge from H.M service 10 years 7. Disqualification, disability or probation Period of disqualification, disability or probation or penalty The periods of time which must elapse in other cases before the conviction becomes spent vary considerably according to the nature of the offence and other circumstances. The rehabilitation period may, for example, be extended by the commission of a further offence during the rehabilitation period. APPLICANTS SHOULD NOTE THAT TO MAKE A FALSE DECLARATION IS A SERIOUS CRIMINAL OFFENCE, PUNISHABLE UPON CONVICTION BY IMPRISONMENT FOR A TERM NOT EXCEEDING TWO YEARS OR TO A FINE TO BE DECIDED BY THE COURT OR BOTH. APPENDIX C LICENCED VEHICLES SPECIFICATION The provisions of the Town Police Clauses Act 1847 (Sections 37-68), The Local Government Miscellaneous Provisions Act 1976 (Sections 45-80), Vehicles (Excise) Act 1971 (Section 19) and the Transport Act 1980 (Sections 64) apply to their operation. APPLICATION FOR A LICENCE The applicant must complete the relevant Application form obtained from: Trading Standards Section, Planning & Environmental Services, Isle of Anglesey County Council, Council Offices, Llangefni LL77 7TW. Once fully completed it should be returned to the above address along with the required documentation detailed on the application form. A Private Hire Operators Licence is required in order to be able to accept bookings for Private Hire Vehicles. If you are a vehicle proprietor you may work for any existing Operator. However, if you wish to apply for your own licence to operate from premises which will be used as a booking office, you need to obtain Planning Permission from the Council's Planning Services Section allowing use of the building. A Certificate of Public Liability Insurance is required where the public have access to the premises i.e. waiting room etc.. However, where no public access or waiting facilities are provided or if you wish to operate your own vehicle from home, this insurance is not necessary. Before issuing a licence the Authority must be satisfied that the applicant is a "fit and proper person" to hold such a licence and will require references/medical evidence to support this. Where it is decided that the use of the penalty points system is appropriate, the points will be issued in accordance with this appendix. If this appendix allows a range of points for the particular incident, the Enforcing Officer will determine the appropriate number of points proportionate to the offence. 2 Before penalty points are issued, there must be sufficient evidence to prove the offence or breach of licensing requirements. If the licence holder disputes the offence or breach of licensing requirements, the matter will be resolved by reverting to the procedures detailed in this Policy. 3 A maximum of twelve penalty points will be issued on any one occasion. This means that if on any occasion when it is proposed to impose penalty points, a licence holder has committed more than one offence or breach of licence conditions, no more than twelve points will be imposed. 4 Points issued to either a proprietor or driver will be confirmed in writing within ten working days from the discovery of the contravention. 5 When issued, the penalty points will remain "live" for a period of two years from the date they are imposed so that only points accumulated in a rolling twenty four months period will be taken into account. If a driver, proprietor or operator accumulates twelve or more points within a period of two years from the date they are imposed, he will be required to attend a disciplinary meeting with a Licensing Sub-Committee, for the appropriate action to be taken in accordance with this Policy. 6 Where a driver is brought before a Licensing Sub-Committee, the options available to them will include suspension or revocation of the driver's licence, where appropriate. If the Licensing Sub-Committee does not feel that the matter warrants suspension or revocation of the licence, they may extend the period for which the points are to remain "live" or instruct that a written warning to the driver is issued as to his future conduct. 7 Periods of suspension of a licence will be dependant on the nature of the breaches of the legislation or the requirements of this Policy and the compliance history of the licence holder. 8 Once the matter has been dealt with, the points will be removed if a suspension or revocation is imposed. If the “live” period is extended or a written warning given, however, the points will remain "live" for the normal two-year period, or for such extended period as imposed by the sub committee. 9 A driver will retain the right to be represented at any meeting with the Licensing SubCommittee, either legally or otherwise, and to state any mitigating circumstances he/she deems necessary. 10 Even though penalty points have been issued by an Authorised Officer of the Council, if it is subsequently found that the driver has previously been issued with penalty points, or has been formally cautioned, for similar offences, the Council reserve the right to cancel the penalty points and deal with the matter in accordance with the Council’s Enforcement Policy. 11 The penalty points system will operate without prejudice to the Council’s ability to take other action under appropriate legislation or as provided for by this Policy. Council’s licensing policy 6 where such a breach of policy requirements is not otherwise specified herein Operating a vehicle which is not maintained in a sound and roadworthy condition 3 Failure to carry an approved fire extinguisher 3 Failure to carry an approved first aid kit 3 Operating a vehicle which is not maintained in a clean and/or safe condition 3 internally or externally Modifying a vehicle without the consent of the Council 4 Failure to display or maintain external licence plates as issued by the Council 3 Hackney carriage vehicle signage not in accordance with the Council’s requirements 3 Affixing or displaying a roof sign on a private hire vehicle 3 Displaying a sign or advertisement on a licensed vehicle that does not satisfy the 4 Policy requirements or has not been approved by the Council Taxi-meter does not conform to the Council’s requirements 4 Trailer does not comply with the Council’s requirements 3 Operating an LPG vehicle which does not comply with the Council’s LPG vehicle 3 Requirements Operating a vehicle which does not comply with the Council’s requirements in 4 relation to tinted windows Driving with no insurance or inadequate insurance for the vehicle 6 Allowing a vehicle to be used for hire by a person who does not hold a current 4 driver’s licence Permitting the vehicle to be used for any illegal or immoral purposes 3 Failure of a private hire operator to provide a prompt, efficient and reliable service 3 Failure of a private hire operator to ensure that office staff act in a civil and courteous 2 manner at all times Failure of a private hire operator to ensure that vehicles attend bookings punctually 3 Failure of a private hire operator to keep the operating premises in accordance with 3 the Council’s requirements Failure of a private hire operator to ensure that all vehicles operated by him are 6 adequately insured Failure of a private hire operator to keep and display public liability insurance for 3 the operating premises if the public are allowed access Failure of a private hire operator to ensure that every driver employed by him has 4 a private hire licence and badge Failure of a private hire operator to keep a copy of the Council’s Hackney Carriage 2 and Private Hire Licensing Policy to be made available for inspection by passengers upon request Any other cause not covered by above 4 APPENDIX G New Pre-Application & Test Procedure If you make application after 1st April, 2011 your application will be processed through a new procedure with the implementation of a Knowledge Test. The Test will be a precursor to the application and be included in the overall fee; however, if you fail your Knowledge Test you will be required to pay a re-sit fee of £25.00 in order to proceed with the Application. The new style knowledge test comprises of 4 sections; Basic English & Maths, Conditions, Legislation and Routes. Below is some guidance on each section: Basic English/Maths Section This part of the test will comprise of listening and reading exercises where you will be required to provide the best answer, comprehension questions and basic mathematical questions. e.g Provide a written receipt and correct change at the end of a typical fare Please note, if you have any difficulties with reading and writing such as dyslexia please notify a member of the Licensing Team prior to sitting the test. Conditions & Legislation This part of the test will comprise of the Isle of Anglesey licensing conditions relating to the Hackney Carriage/Private Hire Driver’s, Private Hire Vehicle, Hackney Carriage and Operators Licence. Legislation This part of the test will comprise of legislation. You will be asked questions relating to general driving practices and road signs/markings similar to a DVLA driver theory test. Routes This part of the test will comprise of questions that ask you to provide the most direct route from one place to another. In order to pass this part of the test you will need to have detailed knowledge of the Isle of Anglesey area. You will need to know popular landmarks such as places of interest, prominent buildings, the location of public houses, hospitals, hotels and train stations. e.g “Describe the most direct route from The Ferry Terminal at Holyhead to RAF Valley Camp” Please note that this section of the test will include one ‘out of area’ route question which will require you to give the most direct route to a place outside of the Island
