OR GUARDIAN. IT IS YOUR RESPONSIBILITY TO PROVIDE THE COURT WITH A CORRECT MAILING ADDRESS.
NOTICE OF OBLIGATION FOR CHILD/PARENT
YOU ARE HEREBY NOTIFIED THAT YOU (CHILD/AND OR PARENT ARE REQUIRED TO NOTIFY THE COURT OF ANY CHANGE OF ADDRESS
WITHIN 7 DAYS AFTER CHANGING ADDRESS. IF YOU FAIL TO DO SO WITHIN THE TIME PERIOD YOU MAY BE SUBJECT TO ARREST AND IS A
CLASS C MISDEMEANOR WITH A FINE UP TO $500.00.
Code of Criminal Procedure: Article 45.057 Section (h) and (i)
(h) A child and parent required to appear before the court have an obligation to provide the court in writing with the current address and residence of the child. The
obligation does not end when the child reaches age 17. On or before the seventh day after the date the child or parent changes residence, the child or parent shall notify
the court of the current address in the manner directed by the court. A violation of this subsection may result in arrest and is a Class C misdemeanor. The obligation to
provide notice terminates on discharge and satisfaction of the judgment or final disposition not requiring a finding of guilt.
(i) If an appellant court accepts an appeal for a trial de novo, the child and parent shall provide the notice under Subsection (h) to the appellate court.
PAYMENTS: If you wish to enter a plea of Guilty/No contest, and pay the fine, please indicate on the Plea form (reverse side) and
return with your full payment. Plea of Guilty/No Contest means that you waive your right to a jury trial. If you cannot pay the fine,
you are required to contact the court (in person) for an extension to pay the fine or to request a payment plan ($25.00 time payment fee
is required). The Judge/Court Clerk is the only one that can grant an extension or payment plan.
DEFERRED DISPOSITION: YOU MUST REQUEST IN PERSON!! You must enter a Plea of Guilty/No Contest and request
probation from the court. If probation is granted, you will be assessed the fine amount plus a $35.00 fee. You will be given a (90)
day probationary period in most cases. If the probationary period is successfully completed, your citation will be dismissed. Effective
9/2005, Defendants under the age of 25 who are requesting Deferred Disposition are required to also complete a Driving Safety
Course. (CCP, 45.051) (Commercial DL not eligible).
DRIVING SAFETY COURSE: You must request (in person) on or before your court appearance date in order to take Driving
Safety course to dismiss citation.
Requirements: (Texas Residents Only)









You must have a valid Texas driver’s license (Commercial DL not eligible).
Your violation must have been a moving violation.
Speeding violations must have been less than 25 miles over posted speed.
Must not have completed course in the past 12 months.
You must have proof of liability insurance in your name.
Enter a plea of No Contest/Guilty.
Pay the Court $109.10 court cost fee ($134.10 for school zone).
Obtain your driving record (Type 3A) from the State. Driver Records from DPS can now be ordered delivered and printed online. To
complete an online Driver Record request, the requestor must have a current DL/ID card, a valid credit card, the last four digits of their
Social Security Number, Adobe Reader and a working printer. The Driver Record must be printed at the end of the transaction. Records
ordered online will no longer be mailed. Go to the DPS website at www.txdps.state.tx.us, choose the TX Driver License page and click on
“Request Driver Record.”
Complete your Driving Safety Course and return certificate of completion and driving record (Type 3A) back to the Court within 90 days
of appearance date (extensions are not granted).
Deferred Disposition or Driving Safety Course must be successfully completed before the charge will be dismissed.
Failure of completion will result in conviction of charges and payment of original citation fine.
DISMISSALS: Violations such as expired drivers’ license, expired motor vehicle inspection or registration may be eligible to have
the citation dismissed if you meet all of the following:



Expired less than 60 days (no exceptions).
Violation corrected within 10 days of issuance of citation.
Provide proof and pay a $20.00 dismissal fee to the court (Proof must be acceptable by court).
NO INSURANCE: Failure to maintain financial responsibility may be dismissed by bringing proof in person with no dismissal fee. If
you did not have current insurance at the time the citation was issued, you are not eligible for dismissal.
COURT APPEARANCES: If you choose to enter a Plea of Not Guilty, you must appear in person on your appearance date and time
to enter your plea in open court.
If you FAIL TO APPEAR in court for the prosecution of the offense or FAIL TO PAY or satisfy a judgement ordering the payment
of a fine and cost in the manner ordered by the court, you may be denied renewal of your driver license. This court participates in the
Omnibase Program.
