Act No. 39, 1940.
An Act to provide for the postponement of certain elections of aldermen and councillors of
municipalities and shires and of aldermen of
the City of Sydney; to validate certain
matters; to amend the Local Government
Act, 1919, the Sydney Corporation Act,
1932-1940, and certain other Acts in certain
respects; and for purposes connected therewith. [Assented to, 29th November, 1940.]

E it enacted by the King's Most Excellent Majesty,
by and with the advice and consent of the Legislative Council and Legislative Assembly of New South
Wales in Parliament assembled, and by the authority of
the same, as follows :—

PRELIMINARY.
1 . (1) This Act may be cited as the "Local Government (Elections) Act, 1940."

2. (1) This P a r t shall be r e a d a n d c o n s t r u e d with the
Local G o v e r n m e n t Act, 1919, as a m e n d e d by subsequent
Acts.
(2) T h e Local G o v e r n m e n t Act, 1919, as so
amended, is in t h i s P a r t r e f e r r e d to a s the P r i n c i p a l Act.
3. (1) N o t w i t h s t a n d i n g a n y t h i n g contained in the
P r i n c i p a l A c t the o r d i n a r y election of a l d e r m e n a n d
councillors directed b y section t h i r t y - e i g h t a n d p a r a ­
g r a p h (b) of section thirty-nine of t h a t A c t to be held on
t h e first S a t u r d a y in December, one t h o u s a n d nine
h u n d r e d a n d forty, is h e r e b y p o s t p o n e d until the first
S a t u r d a y in December, one t h o u s a n d nine h u n d r e d a n d
forty-one.
( 2 ) T h e P r i n c i p a l A c t is a m e n d e d by omitting
p a r a g r a p h s ( a ) a n d (b) of section t h i r t y - n i n e a n d by
i n s e r t i n g in lieu thereof the following p a r a g r a p h s —
( a ) for the o r d i n a r y election in the y e a r one
t h o u s a n d nine h u n d r e d a n d forty-one—the first
S a t u r d a y in D e c e m b e r ;
(b) for o r d i n a r y elections a f t e r the y e a r one
t h o u s a n d nine h u n d r e d a n d forty-one—the first
S a t u r d a y in December one t h o u s a n d nine
h u n d r e d a n d forty-four a n d the same d a y in
every t h i r d y e a r t h e r e a f t e r .

(3) N o t w i t h s t a n d i n g the p o s t p o n e m e n t by this
P a r t of this A c t of the o r d i n a r y election of a l d e r m e n
a n d councillors, a n o r d i n a r y election of m a y o r or p r e s i ­
d e n t shall be held in each a r e a d u r i n g the m o n t h of
December, one t h o u s a n d nine h u n d r e d a n d forty.

AMENDMENTS OF SYDNEY CORPORATION A C T ,
1932-1940.
4. T h i s P a r t shall be r e a d a n d construed w i t h the
S y d n e y C o r p o r a t i o n Act, 1932-1940.
5 . (1) N o t w i t h s t a n d i n g a n y t h i n g contained in the
Sydney C o r p o r a t i o n Act, 1932-1940, the election of
a l d e r m e n of the city directed b y section nineteen of
t h a t A c t to be held on the first M o n d a y in December, one
t h o u s a n d nine h u n d r e d a n d forty, is h e r e b y p o s t p o n e d
u n t i l the first M o n d a y in December, one t h o u s a n d nine
h u n d r e d a n d forty-one.
(2) T h e S y d n e y C o r p o r a t i o n Act, 1932-1940, is
a m e n d e d by o m i t t i n g from subsection one of section
nineteen the w o r d " t h i r t y - f o u r " a n d by i n s e r t i n g in
lieu thereof t h e w o r d " f o r t y - o n e . "
(3) T h e a l d e r m e n in office a t the commencement
of this A c t m a y , subject to t h e p r o v i s i o n s of the S y d n e y
C o r p o r a t i o n Act, 1932-1940, as a m e n d e d b y this P a r t of
this Act, r e m a i n in office u n t i l the election of a l d e r m e n
on t h e first M o n d a y in December one t h o u s a n d nine
h u n d r e d a n d forty-one is held.

(4) (a) The operation of P a r t IV of the Sydney
Corporation Act, 1932-1940, is suspended during the year
one thousand nine hundred and forty.
(b) This subsection shall be deemed to have
commenced upon the thirtieth day of April, one thousand
nine hundred and forty.
(5) The Gas and Electricity Act, 1935-1936 as
amended by subsequent Acts is amended by omitting
from subsection two of section forty-five the figures
"1932-1934" and by inserting in lieu thereof the figures
and words "1932-1940 or any Act amending or replacing
that Act."
