ThedelegateselectionprocessisgovernedbytheCharterandBylawsofthe DemocraticPartyoftheUnitedStates,theDelegateSelectionRulesforthe2016 DemocraticNationalConvention(“Rules”),theCallforthe2016DemocraticNational Convention(“Call”),theRegulationsoftheRulesandBylawsCommitteeforthe2016 DemocraticNationalConvention(“Regs.”),therulesoftheDemocraticPartyof KENTUCKY,theKENTUCKYelectioncode,andthisDelegateSelectionPlan.(CallII.A) 3. FollowingtheadoptionofthisDelegateSelectionPlanbytheStatePartyCommittee, itshallbesubmittedforreviewandapprovalbytheDNCRulesandBylaws Committee(“RBC”).TheStatePartyChairshallbeempoweredtomakeanytechnical revisionstothisdocumentasrequiredbytheRBCtocorrectanyomissionsand/or deficienciesasfoundbytheRBCtoensureitsfullcompliancewithPartyRules.The StatePartyChairshallmakesuchcorrectionsandthePlanresubmittedtotheRBC within30daysofreceiptofnoticeoftheRBC’sfindings.(Reg.2.5,Reg.2.6&Reg. 2.7) 4. OncethisPlanhasbeenfoundinCompliancebytheRBC,anyamendmenttothe PlanbytheStatePartywillbesubmittedtoandapprovedbytheRBCbeforeit becomeseffective.(Reg.2.9) B. DescriptionofDelegateSelectionProcess 1. KENTUCKYwilluseaproportionalrepresentationsystembasedontheresultsofthe PRIMARYforapportioningdelegatestothe2016DemocraticNationalConvention. 2. The“firstdeterminingstep”ofKENTUCKY’sdelegateselectionprocesswilloccuron May17,2016,withaprimary. 3. VoterParticipationinProcess a. ParticipationinKentucky’sdelegateselectionprocessisopentoallvoterswho wishtoparticipateasDemocrats.(Reg4.3) 2016KentuckyDelegateSelectionPlan July11,2015 2 a. AnypersonwishingtovoteintheKentuckyprimarymustbe: i.AUScitizenandaKentuckyresidentforatleast29days ii.Atleast18yearsofagebythenextgeneralelection iii.Notaconvictedfelon,or,ifso,havetheirrightsrestored iv.Notbejudgedmentallyincompetentinacourtoflaw v.NotclaimtherighttovoteanywhereoutsidetheCommonwealth ofKentucky b. InaccordancewithKRS116.045,apersoninterestedinvotingcanobtain avoterregistrationcardontheKentuckySecretaryofState’swebsiteat HTTP://ELECT.KY.GOV/REGISTERTOVOTE/PAGES/DEFAULT.ASPX,attheirlocalcounty clerksoffice,orvariousregistrationdrivesthroughoutthestate.Voter registrationcardsmustbereceivedbytheSecretaryofStatesofficeor thelocalcountyclerksofficenolaterthan30dayspriortotheelection date. c. AnyregisteredvotermayparticipateinKentucky’sdelegateselection processaslongasthevoterhasregisteredasaDemocratby29days priortotheprimary. d. TheKentuckyDemocraticPartystrivestoencouragenon-affiliatedand newvoterstochangepartyaffiliationorregisterbymakingvoter registrationcardsreadilyavailableatallpubliceventsandoffices throughouttheCommonwealth,includingbutnotlimitedtoDemocratic PartyHeadquartersandtheStateandlocalfairsandparades.(Rule2.C) f. Kentuckywillhostseveraltrainingopportunitiesforthoseinterestedin participatinginthedelegationselectionprocess,including,butnot limitedto,wellpublicizedtrainings,useofsocialmedia,presskits,and printedmaterial.(Rule2.I) b. AtnostageofKentucky’sdelegateselectionprocessshallanypersonbe required,directlyorindirectly,topayacostorfeeasaconditionfor participating.VoluntarycontributionstothePartymaybemade,butunderno circumstancesshallacontributionbemandatoryforparticipation.(Rule2.D& Reg.4.4) 2016KentuckyDelegateSelectionPlan July11,2015 3 c. Kentuckyhasaplantoassessandimproveparticipationwithrespectto presidentialpreferenceanddelegateselectioncontestsandprocedurewhich includesbutisnotlimitedto,providingopenandpublictrainingsonthe process,regularcommunicationwithlocalpartiesonprocedures,development ofeasytounderstanddocuments,andutilizingsocialmediatoincrease interestinparticipation. d. e. 4. Kentuckyisparticipatinginthestategovernment-runpresidentialpreference primarythatwillutilizegovernment-runvotingsystems.TheStatePartywilltake provablepositivestepsto: a. Promotetheacquisition,maintenanceandregularreplacementofaccessible precinctbasedopticalscansystems,whereverpossible.(Rule2.H.1) b. Seekenactmentoflegislation,rules,andpoliciesatthestateandlocallevelto ensurethatdirectrecordingelectronicsystemsincludeavoterverifiedpaper trail.(Rule2.H.2) c. Seekenactmentoflegislation,rulesandpoliciesatthestateandlocallevelto ensurethatbothopticalscananddirectrecordingelectronicsystemsinclude recognizedsecuritymeasures.Thesemeasuresincludeautomaticroutine manualauditscomparingpaperrecordstoelectronicrecordsfollowingevery electionandpriortocertificationorresultswherepossible;paralleltestingon electionday;physicalandelectronicsecurityforequipment;banninguseof wirelesscomponentsandconnectionsexceptwhererequiredtoprovidea voterwithadisabilityasecureandapprovedmeanstoaccessvotingmaterials andexercisetherighttovote;publicdisclosureofsoftwaredesign;useof transparentandrandomselectionforallauditingprocedures;andeffective proceduresforaddressingevidenceoffraudorerror.(Rule2.H.3) 5. Theseprovablepositivestepshaveincludedconsistentpublicsupportforaverified paperaudittrailanduseofopticalscanmachines.TheKentuckyDemocraticParty hasencouragedcountyclerkstoutilizemachinesthathavetheseoptions.100%of Kentucky’s120countiescurrentlyuseopticalscanmachineswithaverifiablepaper Nopersonshallparticipateorvoteinthenominatingprocessforthe Democraticpresidentialcandidatewhoalsoparticipatesinthenominating processofanyotherpartyforthecorrespondingelections.(Rule2.E) Nopersonshallvoteinmorethanone(1)meeting,whichisthefirstmeetingin thedelegateselectionprocess.(Rule3.E&Reg.4.6) 2016KentuckyDelegateSelectionPlan July11,2015 4 trail.Inaddition,theschedulingofmeetingsshallconsideranyreligious observationsthatcouldsignificantlyaffectparticipation. 6. Accordingly,delegateandalternatepositionsshallbeallocatedsoasto fairlyreflecttheexpressedpresidential(oruncommitted)preferenceof 2016KentuckyDelegateSelectionPlan July11,2015 10 theprimaryvotersineachdistrict.TheNationalConventiondelegates andalternatesselectedatthedistrict-levelshallbeallocatedin proportiontothepercentageoftheprimaryvotewoninthatdistrictby eachpreference,exceptthatpreferencesfallingbelowa15%threshold shallnotbeawardedanydelegatesoralternates. b. Withinadistrict,ifnopresidentialpreferencereachesa15%threshold,the thresholdshallbethepercentageofthevotereceivedinthatdistrictbythe front-runnerminus10%.(Rule13.F) c. OnJune4,2016,countyorlegislativedistrictdelegateswillmeetatthe2016 CongressionalDistrictConventionsat10:00amattheKentuckyFairGrounds, LouisvilleKY,toelectdistrictdelegates. a. FollowingthepresidentialpreferenceprimaryonMay17,2016,delegate andalternatepositionsforeachcongressionaldistrictwillbe proportionatelyallocatedtopresidentialcandidates(including uncommitted)basedonvotetotalsineachdistrict.(Rule12.G) b. EachdistrictconventionwillbepresidedoverbyaDistrictChairwhowill beappointedbytheStateChair.TheDistrictChairwillconductthe conventionandwillruleonanyquestionofprocedure. c. Oncetheconventioniscalledtoorder,theDistrictChairwilldesignate areasofcaucusinwhichthedelegatesofeachpresidential(or uncommitted)preferencewillelectthepersontofillthenationaldistrict delegatepositions. d. Onlythosewhohaveproperlyfiledadeclarationofcandidacywiththe KentuckyDemocraticPartybyMay9,2016willbeplacedontheballot. e. Adulyauthorizedrepresentativeofthecandidatewillchaireach preferencecaucusor,ifthereisnosuchrepresentative,theDistrictChair willappointatemporaryPreferenceCaucusChairtoconductanelection todetermineapermanentpreferenceCaucusChair. f. ThePreferenceCaucusChairwillappointaPreferenceCaucusSecretary andtwo(2)tabulatorswhoshallrecordtheresultsofthepreference caucus g. Thecaucuswillthenvoteonthecandidatesfordelegate.Thecaucusfor eachpresidentialpreferenceshallconsistonlyofthosepersonswhohave signedstatementsofsupportforthatpreference 2016KentuckyDelegateSelectionPlan July11,2015 11 h. Theballotwillcontainthenamesofcandidatesfordelegatesforthe appropriatepreferenceandthecountyinwhichthevoterresides. i. TheSecretaryandtwo(2)tabulatorswillthendeterminethenumberof votescastforeachcandidatefordelegate. 7. EqualDivisionofDistrict-LevelDelegatesandAlternates a. Inordertoensurethedistrict-leveldelegatesareequallydividedbetweenmen andwomen,delegatepositionswithineachdistrictwillbedesignatedby presidentialpreferencebeginningwiththehighestvote-gettingpresidential preference.Thisassignmentofdelegatepositions,alternatingbysexas mathematicallypracticable,willcontinuewiththenexthighestvote-getting preferencesindescendingorderuntilthegenderofeachpositionhasbeen assigned.(Rule6.C.1&Reg.4.8) b. Thedelegatepositionsarepre-designatedsothatthegenderofthefirstposition tobefilledbythewinningpresidentialcandidateispredeterminedtobemale. Oncetheallocationofdistrictdelegatesamongpresidentialpreferencehasbeen calculated,theremainingdelegatepositionscanbeassignedtothepresidential preference,inorderofvotewon,alternatingbygender. 8.
