Yourcontractfortravel,accommodationandotherservicesiswithAHLoderAdvisersLtdwhichis
registeredinEnglandandWaleswithregisteredno.7156568at34ParkStreetLondonW1K2JD.
1.YourAgreement
1.1)WhenyoumakeabookingyouconfirmthatyouaccepttheseConditionswhichshallapplytoyour
bookingtotheexclusionofallothertermsandconditions.
1.2)Whenmakingabooking,youmustsubmittousyoursignedbookingform.Thecontractbetweenus
willcomeintoexistenceoncewehaveissuedtoyouourconfirmationinvoiceforthetripforwhichyou
havebookedassetoutinCondition1.3below.TheContractshallcontinueuntiltheArctictriphasended
butsuchexpiryshallnotaffectaccruedrightsandliabilitiesofthepartiesandshallnotaffectany
continuingobligationsofthepartiesunderthecontract.
1.3)Ourconfirmationinvoicewillbeissuedwithin14daysofreceiptofyourcompletedandsigned
bookingformandtheregistrationfeeinclearedfunds.Pleasecheckthecontentscarefullyand,inthe
eventofanydiscrepancy,contactusimmediately.Anydiscrepancieswhicharenotnotifiedtouswithin
thetimescaleprescribedintheseConditionsmayleadtoyouincurringadditionalcostsandcharges.
1.4)Youconfirmthatthebookingformhasbeencompletedfullyandaccuratelyandyouwillinformusin
writingassoonaspossiblebeforethedateofdepartureoftheArctictrip(“DepartureDate”)ifanyofthe
detailsprovidedontheapplicationformhavechanged.
1.5)SubjecttotheUnfairContractTermsAct1977,allconditionsandtermsimpliedbystatuteor
commonlawareexcludedtothefullestextentpermittedbylaw.
1.6)TheArcticitineraryanddetailsarepreparedmanymonthsbeforethetripcommencesandalthough
everyeffortismadetoensurecompleteaccuracy,itisinevitablethatsomeofthepricesordetailsmay
havechangedsincetheArcticdocumentand/orwebsitecontainingtheArctictripdetailswere
printed/created.WewillinformyoupriortoenteringintothecontractofanychangestotheArctictrip
thatweareawareofatthattime.
1.7)Whereyouareundertheageof18yearsatthedatetheArctictripisbookedyourbookingformmust
becountersignedbyaparentorguardianonyourbehalfandyouwillonlybeacceptedifyouwillhave
reachedtheageof18yearsonorbeforetheDepartureDate.
2.SpecialRequestsandHealth
2.1)Ifyouhaveanyspecialrequests,youshouldinformusofsuchrequestsonthebookingform.Wewill
advisetherelevanttheteamofyourrequirementsbutwecannotguaranteethatsuchrequestswillbe
met.Furthermore,wehavenoliabilitytoyouifsuchrequestsarenotmet.Confirmationthataspecial
requesthasbeennotedorpassedontotheteamortheinclusionofthespecialrequestonyour
confirmationinvoiceoranyotherdocumentationisnotconfirmationthattherequestwillbemet.
2.2)Ifyouhaveanymedicalproblemordisability,pleasetellusbeforeyoumakeyourbookingsothatwe
canadviseastothesuitabilityoftheArctictrip.Ifanymedicalproblemsordisabilitiesaresufferedor
arisebetweenthebookingformbeingsubmittedandtheDepartureDateyoumustnotifyusimmediately.
Wereservetherighttodeclineorcancelabookingwithouthavingtopayanycompensationif:
2.2.1)Anymedicalproblemsordisabilityisdisclosedtousonthemedicalquestionnaire;
2.2.2)Anymedicalproblemordisabilityisdisclosedtousafterthebookingformissubmittedtousbut
beforetheDepartureDate;or
2.2.3)Anymedicalproblemordisabilityisnotdisclosedtous;
2.3)Ifitislaterdiscoveredthatamedicalproblemordisabilitywasnotdeclaredtous,andsuchproblem
ordisabilitywould,ifwehadknowledgeofit,haveledtoourrefusaltoacceptortocancelyourbooking,
wereservetherighttorequestorseekconfirmationfromamedicalexpertapprovedbyusthatyouarefit

totraveland/orwithdrawyoufromtheArctictripwithoutanyrefundorrecompense.Insuchevent,you
shallreimbursetousanyreasonablecosts,lossesorexpenseswhichweincurorsufferasaresult.Inthe
eventofyoubeingwithdrawnfromtheArctictrip,norefundswillbegivenandwewillnotberesponsible
for(andyouagreetoindemnifyusagainst)anycosts,claims,lossesandexpensesarisingincludingcosts
ofrepatriatione.g.flightsandlegalexpenses.
.4)Bysigningthedeclarationonthebookingformyouconfirmthatyouappreciatetherisksinvolvedin
theArctictripandthatyoudonotsuffer(orhaveeversuffered)fromanypre-existingmedicalcondition
thatmayactivelypreventyoufromactivelyparticipatingintheArctictripotherthanthosethathave
beendeclaredtous.
2.5)Itisyourresponsibilitytoensurethatyouaremedicallyandphysicallyfitenoughtoundertakethe
Arctictripandtoensurethatyouhavereceivedthenecessaryinoculationsandmedications(andtaken
themasprescribedbyyourdoctor)relevanttothedestinationcountriesofNorwayandSweden.Unless
informedotherwiseinwritingwewillassumethatyouareingoodhealthandarenotawareofany
reasonwhyyoumaybeunsuitedtotakingpartintheArctictrip.Werecommendthatyouconsultyour
Doctorbeforemakingabookingtoensurethatyouaremedicallyfitandarefullyawareregardingthe
immunizationsandmedicalissuesrelatedtoyourdestinationcountry
2.6)ByagreeingtotheseConditions,youprovideyourconsenttousandourinsurersobtainingyour
medicalrecordsshouldweconsideritnecessary.Youwillberesponsibleforanychargesforthe
provisionoftheinformation.
2.7)Iftheinformationprovidedbyyouisincorrectandwediscoverthatthecorrectinformationaffects
yoursuitabilitytotakepartintheArctictrip,wemayterminatetheContractandwithdrawyoufromthe
Arctictripwithoutrefundorrecompense,includingduringtheArctictrip.Insuchevent,youshall
reimbursetousanyreasonablecosts,lossesorexpenseswhichweincurorsufferasaresult.Intheevent
ofyoubeingwithdrawnfromtheArctictrip,norefundswillbegivenandwewillnotberesponsiblefor
(andyouagreetoindemnifyusagainst)anycostsclaimslossesandexpensesarisingincludingcostsof
repatriatione.g.flightsandlegalexpenses.
2.8)YouagreeandacknowledgethatcertainactivitiesundertakenwhilstyouareontheArctictripmay
beinherentlyhazardousandhaverisksassociatedwiththem.Youagreetoabidebyallinstructionsgiven
toyoubytheleaderoftheArctictriporanyoneelseappointedbyuswhilstyouareontheArctictripand
youacknowledgethatwecannotbeheldresponsibleforanyinjuriesthatmayariseasaresultofyou
failingtocomplywithsuchinstructions.
3.YourResponsibilities
3.1)Bysigningthebookingformyouconfirmthatyouareawareof,understandandconsenttothelikely
physicaldemandsoftheArctictrip.Youconfirmthatyouareawareofthepossibleeffectsofsuchthings
as,butnotrestrictedto,coldandotherinhospitableenvironmentsanddeclareyourselftobesufficiently
physicallyfitandmedicallyhealthytoparticipatesafely.Youconfirmthatyouaccepttheauthorityofthe
leaderoftheArctictrip(SandyLoder).
3.2)Whilstwemayofferguidanceandgeneraladviceingoodfaithabouthowtostayhealthywhileon
theArctictrip,wewillsuggestfurthersourcesofinformationwhichyoushouldfamiliariseyourselfwith.
3.3)Bysigningthebookingformyouconfirmthatyouareawarethatoverseasstandardsofhealthand
hygienevaryfromcountrytocountry,andareseldomashighastheyareintheUK.TheArctictripmaybe
challengingandincludevisitstoremoteareas.
3.4)YouareresponsibleforyourownequipmentandbelongingsduringtheArctictripandbearthesole
responsibilityforwearandtearandincidentaloraccidentaldamagetoyourownequipment.We
recommendthatyoutakeoutadequateinsurancetocoveryourequipment.Youwillbeprovidedwitha
listofallequipmentrequiredtobringontotheArctictripanditisyourresponsibilitytoensurethatsuch
equipmentisprovidedbyyouandfitforpurposepriortotheDepartureDateandforthedurationofthe
Arctictrip.Shouldyoufailtobringwithyouallitemsofequipmentspecifiedonthelist,wereservethe
righttoexcludeyoufromtheArctictrip.IntheeventofyoubeingexcludedfromtheArctictripunderthe
provisionsofthisCondition3.4,norefundswillbegivenandwewillnotberesponsiblefor,andyouagree
toindemnifyusagainst,anycostsarisingincludingcostsofrepatriatione.g.flights,lossesorexpenses.

3.5)YoumustatalltimesthroughouttheArctictripabidebythelawsandcustomsofthecountries
visitedandbehaveinarespectfulandconsideratemannertolocalpeopleandtoothermembersofthe
Arctictrip.
3.6)YourbehaviourduringtheArctictripmustnotprejudicethesafetyandwellbeingofanymemberof
theArctictrip(includingyourself),oritssatisfactoryprogress.Youagreetowearanysafetyclothingor
equipmentdeemednecessarybytheCompanyoritsserviceproviders.
3.7)AnyarrangementswhichyoumakeindependentlywhichdonotformpartofthepublishedArctic
tripitineraryareentirelyatyourownriskandweshallhavenoliabilityorresponsibilitytoyouforsuch
arrangementsoryourparticipationinthem.
3.8)WewillprovideequipmentfortheArctictrip,includingbutnotlimitedto,clothingandweare
responsibleforthemaintenanceofsuchequipment.Whereyoudeliberatelyorrecklesslycausedamage
toanysuchequipment,duringtheArctictripyoushallindemnifyusandkeepusindemnifiedfromall
lossesarisingfromanysuchwilfulorrecklessdamagesocausedincludinglegalcostsofmakinga
recoveryagainstyou.
3.9)YouwillberesponsibleforarrangingtransferstoyourdepartureairportfortheArctictripandfrom
yourarrivalairportuponyourreturnfromtheArctictrip.Youwillberesponsibleforflights,airporttaxes
andothercostsoftravellingtoandfromtheArctictripbutnotthetransferfromtheairportatTromsoto
thehoteland/orfromtheairportatKirunatothekennelsandviceversaattheendofthetrip.
4.YourArctictripprice
4.1)WereservetherighttoalterthepriceoftheArctictripatanytime.
4.2)WhenyoumakeyourbookingyoumustpaythefeeassetoutintheArcticdocumentonreceiptof
theinvoice.
4.3)Changesintransportationcosts,includingthecostoffuel,taxes,dutiesorfeeschargeablefor
servicessuchaslandingtaxesorembarkationordisembarkationfeesatportsandairportsand
fluctuationinexchangeratesmeanthatthepriceofyourArctictripmaychangeafteryouhavebooked.
Therewillbenochangewithin30daysofyourDepartureDate.
5.IfYouChangeYourBooking
5.1)Westarttoincurcostsfromthemomentyoumakeyourbooking.If,afterourconfirmationhasbeen
issued,youwishtochangeyourArctictripinanyway,wewilldoourutmosttomakethesechangesbutit
maynotalwaysbepossible.Anyrequestforchangestobemademustbeinwriting/emailfromyou.You
willbeaskedtopayanadministrationchargeofseventyfivepounds(£75.00)andanyfurthercostwe
incurinmakingthisalteration(an“AmendmentCharge”).Youshouldbeawarethatthesecostscould
increasetheclosertotheDepartureDatethatchangesaremadeandyoushouldcontactusassoonas
possibleifyouneedtoamendthebooking.
5.2)Wemay,atourdiscretion,allowyoutotransferyourbookingtoanotherpersonprovidedthatsuch
otherpersonindicatestheiracceptanceoftheseTermsandConditions.Intheeventofsuchatransferan
AmendmentChargeshallbepayablebyyoutocoverthecostsincurredbyusinmakingthisalteration.
Weacceptnoliabilitytoyouifwerefusetotransferyourbookingtoanotherpersonforanyreason.
6.IfYouCancelYourArctictrip
6.1)YoumaycancelyourArctictripatanytime.Yourwrittennotificationmustbesenttoouroffice.
SinceweincurcostsincancellingyourArctictrip,youwillhavetopaytheapplicablecancellationcharges
uptothemaximumshownbelow.Werecommendthatyourtravelinsuranceprovidesforyour
reimbursementintheeventofacancellation.Youwillremainliableforanylossesarisingfromyour
breachoftheConditionsoftheContract.

between90and60dayspriortoDepartureDate:Lossof50%ofArctictripcost.Cancellationwithin60
daysofDepartureDate:Lossof100%ofArctictripcost.

6.3)Note:Ifthereasonforyourcancellationiscoveredunderthetermsofyourinsurancepolicy,you
maybeabletoreclaimthesechargesbutitisyoursoleresponsibilitytodosoandweacceptnoliability
foranyactsoromissionsofyourinsurancecompany.
7.IfWeChangeorCancelYourArctictrip
7.1)ItisunlikelythatwewillneedtomakeanychangestoyourArctictrip,butwehavebeenplanning
thisArctictripmanymonthsinadvance.Occasionally,wemayhavetomakechangesandwereservethe
righttodosoatanytime.Mostofthesechangeswillbeminorandwewilladviseyouofthematthe
earliestpossibledate.WealsoreservetherightinanycircumstancestocancelyourArctictrip.For
example,iftheminimumnumberofclientsrequiredforaparticularArctictripisnotreached,wemay
havetocancelit.However,wewillnotcancelyourArctictriplessthan42daysbeforeyourDeparture
Date,exceptforreasonsofForceMajeureorfailurebyyoutopaythefinalbalance.Ifweareunableto
providetheArctictrip,youcaneitherhavearefundofallmoniespaidoracceptanofferofanalternative
Arctictripofcomparablestandardfromusifavailable(wewillrefundanypricedifferenceifthe
alternativeisofalowervalue).IfitisnecessarytocancelyourArctictripforreasonsotherthanForce
Majeure,wewillpaytoyoucompensationassetoutinthetableoverCondition6.2.IfwecanceltheArctic
tripwewillnotbeliableforanyindirectorconsequentiallosssufferedbyyousuchas,butnotlimitedto,
priororsubsequenttravelarrangements,toursorflightarrangements.
7.2)IfwemakeamajorchangetoyourArctictrip,wewillinformyouassoonasreasonablypossibleif
thereistimebeforeyourDepartureDate.Youwillhavethechoiceofeitheracceptingthechangeof
arrangements,acceptinganofferofanalternativeArctictripofcomparablestandardfromusifavailable
(wewillrefundanypricedifferenceifthealternativeisofalowerprice),orcancellingyourArctictrip
andreceivingafullrefundofallmoniespaid.

Ifwemakeamajorchangetoorcancelyourtrip
7.3)ForceMajeure:Thismeansthatwewillnotpaycompensationifwehavetocancelorchangeyour
Arctictripinanywaybecauseofunusualorunforeseeablecircumstancesbeyondourcontrol.Thesecan
include,forexample,war,riot,industrialdispute,terroristactivityanditsconsequences,naturalor
nucleardisaster,fire,epidemicsorhealthrisks,closedorcongestedairports,portsorstations,poorlocal
infrastructure,changesimposedbyre-schedulingorcancellationoftransportbythetransportsupplier
suchasflightsbyairlinesormaincharterer,thealterationoftransportortransporttypes,adverse
weatherconditions(actualorthreatened),avalancheandtechnicalfailurewithtransport,Foreignand
CommonwealthOfficeadvicechangingandadvisingagainsttraveltotheArctictripdestination.
8.OurLiabilitytoYou
8.1)OurobligationsandthoseofoursuppliersprovidinganyserviceorfacilityincludedinyourArctic
triparetotakereasonableskillandcaretoarrangefortheprovisionofsuchservicesandfacilitiesand
whereweoroursupplierisactuallyprovidingtheserviceorfacility,toprovidethemandtodosowith
reasonableskillandcare.
8.2)Youshouldbeawarethatstandardsincludingsafetyandhygienemaybelowerthanyouwould
expectintheUK.TheservicesprovidedaspartoftheContractwehavewithyouwillbedeemedtobe
providedwithreasonableskillandcareiftheycomplywiththelocal(incountry)standardswherethe
serviceisdelivered.
8.3)Wedonotacceptanyliabilityorresponsibilityforanypersonalpossessions(includingbutnot
limitedtocameras,jewellery,valuablesandmoney)whichiscarriedonorinourvehicles,carriedon
publictransportortransportsuppliedbyindependentsubcontractors,leftinaccommodationprovided
byusoroursuppliersduringtheArctictriporleftinourcareduringtheArctictrip;suchitemsare
carriedand/orleftatyourownrisk.
9.Passport,Visa,ImmigrationRequirementsandLocalLawsandRegulations
9.1)Yourspecificpassportandvisarequirements,andotherimmigrationrequirementsareyour
responsibilityandyoushouldconfirmthesewiththerelevantEmbassiesand/orConsulates.Wedonot
acceptanyresponsibilityandshallnotbeliableifyoucannottravelorcannotparticipateinanypartof
theArctictripbecauseyouhavenotcompliedwithanypassport,visaorimmigrationrequirements.For

fullinformationonanypassportorvisarequirements,seetheUKPassportOfficewebsiteat
www.passport.gov.uk
9.2)Youareresponsibleforobtainingandhavingavailablethenecessarydocuments(includingbutnot
limitedtofull,currentpassportwithenoughblankpagestocompletetheArctictripandvalidforatleast
6monthsfromthelastdayoftheArctictripandvisasforallperiods,countriesandterritorieswithinthe
Arctictrip)enablingyoutoparticipateintheArctictripandshallcomplywithalllocallegislationand
regulationsofthecountriesinwhichtheArctictriptakesplace(includingimmigrationrequirements,
customsregulationsandcurrencyexchange).Youshallindemnifyusagainstanylossorexpensethatwe
mayincurorsufferasaresultofbreachofthisConditionbyyou.
10.Excursions
10.1)ExcursionsorothertoursthatyoumaychoosetobookorpayforwhilstyouareonArctictripare
notpartofyourArctictriparrangementsprovidedbyus.Foranyexcursionorothertourthatyoubook,
yourcontractwillbewiththeoperatoroftheexcursionortourandnotwithus.Wearenotresponsible
fortheprovisionoftheexcursionortourorforanythingthathappensduringthecourseofitsprovision
bytheoperator.
11.Behaviour
11.1)WhilsttheArctictripisinprogressyouwillactatalltimesinaccordancewithallreasonable
instructionsfromusand/ortheArctictripLeader.
11.2)WemayexcludeyoufromtheArctictriporanypartthereofatanytimeifweareoftheopinionthat
youarelikelytoprejudicethegoodorder,disciplineorsafetyoftheArctictrip,includingasaresultof
youfailingtocomplywiththeArctictripLeader’sinstructions,breakinganylaworregulationofany
countrywheretheArctictriptakesplaceoryoufailtoadheretotheArctictripCodeofConduct,provided
thatweexerciseourdiscretionreasonablyinthisregard.Insuchevent,youshallreimbursetousany
reasonablecosts,lossesorexpenseswhichweincurorsufferasaresultofourdecisiontoexcludeyou.
11.3)IntheeventofyoubeingexcludedfromanArctictripundertheprovisionsofthisCondition,no
refundswillbegivenandwewillnotberesponsibleforandyouagreetoindemnifyusagainstanycosts
arisingincludingcostsofrepatriatione.g.flightsandlossesorexpenses.
12.Insurance
12.1)Youmustbecoveredbypersonaltravelinsurance.Thismustcoveryoufullyagainstthecostof
cancellationbyyou,medicalcareandrepatriationshouldyoubecometooilltocontinueandmustabove
allcoveryouagainstthecostofairorotherformsofevacuationand/orrepatriationshouldsicknessor
injurynecessitatesuchacourseofaction.Weofferaninsuranceschemeunderwhichyoumaypurchasea
policyofinsurancetocoveryoutakingpartintheArctictrip(thepremiumforwhichwillbeadvisedto
youonrequestandmustbepaidinaccordancewithCondition1.2).
12.2)IfyouchoosenottotaketheinsurancereferredtoinCondition14.1,itisyourresponsibilityto
ensurethatyourpolicyofinsurancecoversyoufullyforalloftheactivitieswhichmaytakeplaceduring
theArctictrip.Whilstwetakenoresponsibilityforthecontentsofanypolicyofinsurancethatyou
choosetotakeout,wereservetherighttoinspectsuchinsurancepolicyandtorefusetoallowyouto
embarkontheArctictriportoobligeyoutoobtainfurtherinsuranceifwebelievethatyourcoveris
inadequateand/ordoesnotsatisfytherequirementsofthisCondition14.1.Pleasereadyourpolicy
detailscarefullyandtakethemwithyouwhenyoutravel.
13.DataProtection
13.1)Weshallensurethatappropriatesecuritymeasuresareinplacetoprotectyourpersonaldata(as
definedintheDataProtectionAct1998).Whenyoumakeabooking,youconsenttoalltheinformation
youprovidebeingpassedontooursuppliers,agents,sub-contractors,employeesorvolunteerswhether
basedinsideoroutsidetheEuropeanEconomicAreaforthepurposesofourprovidingyouwiththe
Arctictrip.

14PromotionalMaterials
14.1)ByagreeingtotheseConditions,youconsenttoourstafftakingphotographsandorvideofootage
ofyouduringtheArctictripandthattheseimagesmaybeusedbyusforpublicityandtrainingpurposes
including,butnotlimitedto,inArcticdocuments,websites,marketingmaterialandinthemedia.
15.General
15.1)WeshallbeentitledtonovateorassigntheContractoranypartofittoanythirdparty.Youshall
notbeentitledtoassigntheContractoranypartofit.
15.2)ThisContractismadeonthetermsoftheseConditions,whicharegovernedbyEnglishLaw,and
youagreetotheexclusivejurisdictionoftheEnglishCourts.
15.3)IfanyoftheseConditionsisfoundbyanyCourtorothercompetentauthoritytobewhollyorpartly
unfairorunenforceablethevalidityoftherestoftheBookingConditionsandtherestoftheConditionin
questionshallnotbeaffectedandshallremainvalidandenforceabletotheextentpermittedbylaw.
15.4)AreferenceintheseConditionstoastatute,conventionorregulationshallbeasareferencetothat
statuteconventionorregulationasamended,re-enactedorextendedattherelevanttime.
15.5)TheheadingsintheseConditionsareforconvenienceonlyandshallnotaffecttheirinterpretation.
15.6)Wherethecontextotherwiserequires,wordsimportingthesingularmeaningshallincludethe
pluralmeaningandviceversaandwordsdenotingthemasculinegendershallincludethefeminineand
neutergenders.
15.7)Wherethecontextsoadmits,wordsdenotingpersonsshallincludenaturalpersons,companies,
corporations,firms,partnerships,limitedliabilitypartnerships,jointevents,trusts,voluntary
associationsandotherincorporatedand/orunincorporatedbodiesorotherentities(ineachcase,
