Fleet Safety Program Section 1 – Management Policy Revised: February, 2006 To All Drivers In The Global Family: We want to improve your safety while operating a vehicle on our behalf. We fully recognize that you, as the driver, play a key part in our mutual effort to eliminate death, injuries and property damage. In order to help you, we are initiating an improved fleet safety program. It is designed to promote safety awareness and prevent accidents and injuries. Our goal is to attain more effective results through this renewed effort. As your Director of Risk Management, I will be assuming personal responsibility for the implementation of the improved fleet safety program. Each location will have an individual that is responsible for the day-to-day operation and oversight of the program. This individual will be available to help each of you in performing your job safely. We want to solicit your help with making this program successful and we want you to be constantly alert to the hazards while operating a vehicle. We welcome and encourage you to offer safety suggestions, and to bring forward any questions and/or concerns you may have to your supervisor or to me directly. Together a solution can be achieved. Fleet Safety Program Section 2 – Program Goals Revised: February, 2006 The primary goal of this program is to reduce motor vehicle accidents that involve our employees. There are many reasons why it is important to reduce the number of accidents and attempt to eliminate any serious injuries. One of our primary objectives is to minimize the personal suffering that can accompany an auto accident. All too often we find a serious injury could have been avoided with proper attention to safety and that’s the ultimate tragedy. Another goal is to provide an easy-to-use system that will help you avoid accidents and remain injury free. There are responsibilities for everyone in this process. We want you to know exactly what to expect. Each Core Company Shall: • • • • • • • • • • Assign an individual to oversee this program. Require all new employees who operate a vehicle during work, as well as new supervisors, to complete the on-line fleet safety test within ninety (90) days of their employment date. Require a supervisor to review the Fleet Safety Policy with each new employee before authorizing that employee to drive any vehicle during work. Supervisors will use the Fleet Safety Policy Review Checklist to document the review process. Take appropriate action to manage the Road Risk Reduction Program Investigate and document all accidents Offer or schedule additional training as required to ensure safe operation. Schedule a training session for an employee, who, while operating a vehicle during work, has been involved in a vehicle accident or received a traffic citation. Initiate appropriate action against employees who fail to comply with the Fleet Safety Policy. Initiate appropriate action against supervisors who fail to comply with the Fleet Safety Policy. Ensure that fleet vehicles owned or leased by the company are maintained in good, safe and operable condition. Global Imaging Systems, Inc. Fleet Safety Program Section 2 – Program Goals Revised: February, 2006 Employees shall: • • • • • • • • • • Maintain a valid driver’s license. Comply with all appropriate sections of this program, including reporting procedures. Participate in company sponsored activities or programs designed to improve driver safety. Operate their vehicle in a safe manner as outlined in the program. Report any changes in medical condition that may effect their driving. Report and document any and all vehicle defects promptly. Report all accidents and incidents to the appropriate parties promptly. Allow periodic reviews of their vehicles by a manager or supervisor as referenced in the Vehicle Inspection Report Fill out Vehicle Safety Self Assessment’s as requested by their manager or supervisor. Sign the Fleet Safety Acknowledgement Corporate Risk Management shall: • • • • • • Administer the insurance program for all auto accidents when either an owned vehicle is damaged or the company potentially may be held liable for the accident caused by an employee. Review each accident that involves an employee during the course of employment and each incident where an employee has been cited for a violation of the applicable Motor Vehicle law. Assist each location in the primary goal of this program. Develop new training, goals, or policies as requested by local management. Allocate vehicle accident costs to the respective core location for informational purposes only. Create and administer special incentives and programs. Global Imaging Systems, Inc. Fleet Safety Program Section 3 – New Driver Selection Revised: February, 2006 The selection of a new employee should always include a review of the driver’s license and the ordering of a Motor Vehicle Record (MVR). In states that do not allow the ordering of these reports the prospective employee will be responsible for providing it. Why order a MVR? Having a license may make it legal for one to drive, but it does not necessarily mean the driver is suitable to drive on company business. An applicant’s driving history is one of the best indicators as to future driving performance. Also, the Fair Credit Reporting Act requires employers to take certain steps before obtaining and using a Motor Vehicle Record for employment decisions. We must get the candidate’s written authorization to request the MVR. We must also communicate in writing that the employment offer is contingent upon a MVR being satisfactory to local management. If a prospective employee has been in your state less than one (1) year please make sure to see a MVR under the old license number and from the old state. Recommended Acceptability Criteria for New Applicants The following recommended guidelines indicate those drivers who would usually be deemed unacceptable to drive a fleet vehicle or to drive a personal vehicle on company business. The final decision will be the responsibility of your company president. Major Violations: • • • • • • • • • A conviction of DWI/DUI/OUI/OWI, or a Reckless Driving that was originally an alcohol or drug related charge, within the last five (5) years from the date of the conviction to the date of employment. A second conviction of this type removes any time limit. Refusal to Submit to Breath/Blood Test or Suspension for same Reckless Driving (Get the reason as some states use this freely) Driving with an open container – Operator Manslaughter using a motor vehicle Aggravated assault with a motor vehicle Illegal passing of a school bus Resisting arrest A revocation or suspension of license due to Motor Vehicle Points within a three (3) years from the date of revocation/suspension to the date of employment. The suspension should be related to driving. Global Imaging Systems, Inc. Fleet Safety Program Section 3 – New Driver Selection Revised: February, 2006 Minor Violations: • Any combination of three or more violations in the past three (3) years: o o o o o o o o o Speeding Improper lane change Failure to obey traffic signal or device Failure to yield Careless driving Driving too fast for conditions Following too close Improper backing At-Fault Accident (Note: An at-fault accident with a corresponding citation should be considered one event. Compare the dates.) Note: Check the citation date to make sure multiple tickets were not issued. If so, count as one incident. Global Imaging Systems, Inc. Fleet Safety Program Section 4 – Insurance Requirements Revised: February, 2006 This section refers to Non-Company Owned Vehicles Used for Business. An example of this type of vehicle would be your personal vehicle used for business. Please note that Global Imaging Systems, Inc. does not provide coverage for your personal auto used in conducting your company job assignment. To make sure you have the proper personal liability protection, you must contact your local insurance agent. Employees who drive non-company owned vehicles, as a necessity in conducting their company job assignment, are subject to all the provisions and standards of this program. • • • • • • • An employee must maintain automobile liability insurance limits of at least $100,000 per individual/$300,000 per accident for bodily injury (BI) and $50,000 property damage (PD). Note: These insurance requirements were set by Global Imaging Systems, Inc.’s Risk Management Department and do not imply that they are adequate for your individual personal needs. Your local agent is best suited to determine that. Evidence of insurance will be required from all drivers at each renewal. A declaration page illustrating the coverage amounts will be necessary. An insurance card is not acceptable as proof of the required limits. Mileage reimbursement may cease 30 days after the due date for the declaration page and will not re-start until it is received Failure to maintain the insurance limits indicated above will subject the driving employee to disciplinary action, up to and including removal from their current job assignment and possible termination. You must notify your company’s Human Resources if you change insurance companies or limits. Providing false proof of insurance or canceling coverage without notifying the proper company personnel could lead to disciplinary action including termination. Global Imaging Systems, Inc. Fleet Safety Program Section 5 – Vehicle Accidents Revised: February, 2006 REPORTING REQUIREMENTS It is the responsibility of vehicle operators to report all accidents while on company business, regardless of damage. If you are in an accident 1. Get medical attention immediately, if needed. 2. Do not leave the scene. If the car is creating a safety hazard or if you are concerned with your personal safety, move to a safer place. 3. Call the police and follow their instructions. A police report is required for every business related automobile accident. 4. Contact your manager or Human Resources. 5. Do not disclose the limits of your insurance policy. 6. Do not discuss who is at fault at the accident scene. 7. Complete as much of the Accident Report Form as possible. 8. Give the Accident Report Form to your manager as soon as possible. Supervising Manager’s Responsibility: 1. Discuss the accident with the driver 2. Investigate the accident and report it on the Accident Report Form. 3. Send the completed Accident Report Form to your company’s Human Resources 4. Determine what training is necessary to prevent future loss 5. Schedule the employee for the proper training At-Fault Accident The status of the accident will be based on the insurance company’s investigation and final determination of fault. 1. After one “at-fault” accident involving a fleet vehicle or non-company owned auto used for business, the driver must complete an on-line driver improvement course and successfully pass an exam within one month. Because the safety of all employees is the primary concern the employee will have the option of discussing the incident at the next department meeting. Special attention should be given to why the loss took place and how the employee will prevent it in the future. If the employee declines to discuss the incident it becomes the responsibility of the department manager. Global Imaging Systems, Inc. Fleet Safety Program Section 5 – Vehicle Accidents Revised: February, 2006 2. After a second “at-fault” accident within 36 months the driver is to complete all steps for one “at-fault” accident and take a AAA Defensive Driving Course at his or her own expense. 3. After a third “at-fault” accident within 36 months the driver is to complete all steps for one and two “at-fault” accidents. The driver is ineligible to drive a company owned vehicle for 12 months. Any further “at-fault” accidents or driving citations must be reviewed by the local president to determine the appropriate action. Immediate Suspension of Privilege to Drive In the event of an accident, driving privileges may be immediately suspended. If the accident involves a serious criminal violation, appropriate discipline not excluding termination, will be determined by company management. A charge for driving under the influence of alcohol or drugs, vehicular homicide, or charge punishable as a felony are examples of what will be considered a serious criminal violation. Fleet Safety Program Section 6 – Annual MVR Review Revised: February, 2006 Each year Global Imaging Systems Risk Management will coordinate the review of MVR’s for all employees that drive on company business. In those states that do not allow on-line purchase of a MVR, the employee will be responsible for submitting the MVR. A driver can be terminated, removed from a driving position, or placed in the Road Risk Reduction program if the following are present: • • A conviction of DWI/DUI/OUI/OWI, or a Reckless Driving that was originally an alcohol or drug related charge, within the last three (3) years from the date of the conviction to the date of employment. Any Suspension/Revocation/Conviction that deals with the Refusal to Submit within the last three (3) years from the date of the conviction to the date of employment. A driver can be placed in the Road Risk Reduction Program if the MVR indicates one or more of the following conditions: Major Violations: • Reckless Driving (Get the reason as some states use this freely) • Driving with an open container – Operator • Manslaughter using a motor vehicle • Aggravated assault with a motor vehicle • Illegal passing of a school bus • A revocation or suspension of license due to Motor Vehicle Points within a three (3) years from the date of revocation/suspension to the date of employment. Minor Violations: • Any combination of three or more violations in the past three (3) years: o Speeding o Improper lane change o Failure to obey traffic signal or device o Failure to yield o Careless driving o Driving too fast for conditions o Following too close o Improper backing o At-Fault Accident Note: Count multiple incidents with the same incident date as one. Fleet Safety Program Section 7 – Road Risk Reduction Revised: February, 2006 It is the intent of the fleet safety policy that every employee, supervisor, and manager follows the guidelines as outlined. It may become necessary that an employee, either because of their driving record or management discretion, undertake specialized training to re-enforce the ideas found in the fleet safety policy. Even though there are several ways an employee may be placed into this program, an unsatisfactory motor vehicle driving record, accident frequency, or at management’s discretion are the primary reasons. There are four levels of Road Risk Reduction and should be employed in escalating increments. Level One – An on-line safety video and test are available. Several different subjects are available. The employee must pass the test with a score acceptable to local management. Level Two – Our current insurance carrier provides basic defensive driving classes in your area. The class ranges from 2-4 hours. This should be for a poor motor vehicle record or an accident frequency concern. Level Three – AAA offers a comprehensive defensive driving program in most areas. If not, another business will offer the same type of training. This should be for two atfault accidents, a combination of minor motor vehicle incidents and 1 at-fault accident, or 1 major conviction. Level Four – Management discretion can call for all previous levels and/or other specialized training. In any event, once placed in this level the accident record and motor vehicle record must remain clear for a period of 24 months from the date of the last incident conviction date. Global Imaging Systems, Inc. Fleet Safety Program Section 8 – Operator Responsibilities Revised: February, 2006 OPERATOR’S RESPONSIBILITIES 1. 2. 3. 4. 5. 6. Driver’s License – You must possess and carry a valid Driver License or while operating a vehicle on company business. 2. Seat Belts – Wear seat belts anytime you are in a vehicle. And require all passengers to wear seat belts. This is a MANDATORY safety requirement. Any violation of this requirement will result in a memo to the personnel file and immediate placement in the Road Risk Reduction program. 3. Vehicle Operation – Operate vehicles in a safe and courteous manner. Obey all State and Local traffic laws. Abide by all operating procedures stated in this policy manual. 4. Controlled Substances - No controlled substances, un-prescribed or illegal drugs, or alcoholic beverages are permitted in owned or non-owned vehicles. The operator must be free of any controlled substances including un-prescribed or illegal drugs, alcohol, or any prescribed drug, which may adversely affect the operator’s ability to operate the vehicle safely. It is to be understood that refusal to abide by this company rule may lead to immediate dismissal. 5. Traffic Citations – You are responsible for all traffic citations issued to you by a law enforcement agency. Report all citations to your supervisor. Parking violations are not to be considered traffic citations. 6. Security and Theft – As the operator, you are responsible for the security of your vehicle and the business inventory. Close windows and lock all doors when your vehicle will be out of sight. Remove keys from the vehicle anytime the vehicle is unattended. Global Imaging Systems, Inc. Fleet Safety Program Section 9– Vehicle Inspections Revised: February, 2006 The goal of the vehicle inspection program is to make sure that all vehicles that are used for company business are maintained to an acceptable level of safety and that basic devices are in operating condition. The program will include the following items: • • • • • Tires Glass Lights Inventory Position Seat Belt Each vehicle that is used for company business will have no less than two inspections per year. The department manager or designate will perform the inspection. This report is based solely on the visual observation of the vehicle. It is not a qualified mechanical opinion. It is strongly suggested that you follow the recommended service guidelines detailed by the manufacturer and that a qualified automotive service mechanic provide the service. The results of each review will be detailed on the Vehicle Inspection Report. The report is to be maintained in Human Resources for any part of 2 fiscal years and be available for review. Fleet Safety Program Section 10– Cell Phone Use Revised: February, 2006 Global Imaging Systems, Inc. encourages the safe use of cellular telephones by employees who use them to conduct business. Proper Use of Hand-Held Phones Employees who use hand-held cellular phones while on company business should refrain from making or receiving business calls while driving. If an employee needs to make or receive a business phone call while driving, the employee should make sure the vehicle is stopped and that he or she is parked in a proper parking area for the call. Managers and supervisors have an obligation to ask if the employee is driving. If so, they must ask the driver to pull over. Dialing in to automated systems must be done while the vehicle is not in motion. Proper Use of "Hands-Free" Phones Employees using hands-free telephones must keep business conversations brief while driving, and must stop the vehicle and park in a proper parking area if the conversation becomes involved, traffic is heavy, or road conditions are poor. Special Situations Employees who are faced with an emergency, such as a traffic accident or car trouble, may find it necessary to make a phone call while driving. Discipline Any employee that repeatedly violates this policy shall be placed in the Road Risk Reduction program. Repeated violations of this section shall include additional action, not excluding termination, based on the department manager’s discretion. Global Imaging Systems, Inc. Fleet Safety Program Section 11– Seat Belt Usage Revised: February, 2006 YOU MUST WEAR YOUR SEAT BELT ANYTIME YOU ARE OPERATING OR RIDING IN A VEHICLE ON COMPANY BUSINESS. Introduction. Because seat belts are the best protection against injury or death in a crash, Global Imaging Systems, Inc.’s seat belt use policy is extremely important and mandatory. The simple act of buckling up reduces the chance of serious injury or death. Policy. Global Imaging Systems, Inc. recognizes that seat belts are extremely effective in preventing injuries and loss of life. We care about our employees, and want to make sure that no one is injured or killed in a tragedy that could have been prevented by the use of seat belts. Therefore it will be company policy that both drivers and passengers while traveling on official company business shall always use seat belts. Employees are strongly encouraged to use their seat belts off the job as well. The purpose of this policy is to establish mandatory belt use as an organizational priority and designate responsibility for implementation and enforcement. Who Must Follow It. The seat belt use policy applies to all employees and occupants of any vehicle driven by employees, including rentals and personal vehicles when used on official company business. Responsibility. Managers and supervisors must demonstrate their commitment to this policy by communicating it to their employees, monitoring compliance, evaluating effectiveness and taking disciplinary action against violations. Enforcement. Seat belt use is such a common, healthy practice that the need to actively enforce this policy should be rare. However, the policy will be enforced the same as other rules, and employees who violate it will be subject to disciplinary action. Managers and supervisors have an obligation to encourage and routinely monitor usage and shall be accountable for enforcing this policy. The driver of the vehicle is responsible for enforcing seat belt use by all occupants. Global Imaging Systems, Inc. Fleet Safety Program Section 12– Management Duties Revised: February, 2006 The authorization to drive a vehicle on company business will be the responsibility of the employee’s manager.
