The Arr Qualtty Stage 4 Revlew and Assessment for the London Borough of
Barnet has hrghhghted that thrs area currently experlences or is llkely to
expenence exceedances of Government set health-based alr qualrty standards'
A lrst of possible options for mitigatrng poor air quallty rs as follows: 1) Use of
passtve or actrve air conditlonlng; 2) use of acoustic ventilators; 3) Altering lay
out - habrtable rooms away from source of poor air quatity; 4) Non resldentral
usage of lower floors; 5) Altering footprlnt - settlng further away from source of
poor arr quality.
For developments that requtre an Air Quallty report; the report should have
regard to the arr qualtty predlctlons and monitorlng results from the Stage Four
of the Authority's Review and Assessment avallable from the LPA web slte and
the London Air Quahty Network' The report should be wrltten in accordance wlth
the following guidance: 1) Envrronmental protectlon UK Guidance: Development
Control' Plannrng for Atr Quallty (Updated 2010) 2) Envrronment Act 1995 Alr

"Affordable Housing Provider" means a Regtstered Provider or (tf
approved by the LPA pursuant to paragraph 2.1O or 3.11 of Schedule
2A of the S106 Agreement) an alternatrve registered provrder of socral
housrng for the purposes of section 80(2) of the Housing and
Regeneratron Act 2008;
"Affordable Housing Review" means a revtew of erther (as the case

of the DSF suitable for providing a range of servtces for children and

"CHP" means the new scheme-wrde combined heat and power plant to
be constructed with a maximum output of 16MWe (sublect to
Conditions 35.5 and 35,6 of thrs Permrsston) to be provtded in the
Statlon Quarter Zone in accordance with paragraphs 2.54-2.62 and 5.55
(and Table 8) of the DSF as shown on Parameter Plan 0lO and
approxrmately as shown on Zonal Parameter Plan 022 and In the vlctnty
of Plot 59 shown on the Indtcative Phastng Parameter Plan (and In Table

"Cycle Hire Club" means the organisation to be procured or established

the S106 Agreement to provide, operate and manage the hire of cycles
across the Development;
"Cycle Parking Spaces" means the provision of secure cycle storage
that should as a minimum support the bike and, in public areas, allow for
frame and both wheels to be locked to a fixture. Provision for Cycle
Parking Spaces should be made in accordance with latest Mayor of
London and/or TfL and/or LPA cycle parking standard as contained within

'Matrix and Transport Reports schedul€" means the Matrlx and
Transport Reports Schedule contalned in the S106 Agreement as

accordance with Condition 37 of thls Permission prior to the
commencement of the Development rn any Phase

Phase Transport Report to be prepared in accordance with the Matrx and
Transport Report Schedule and comply with the relevant Transport
Report Scope and Speclficatlon Approval;
"Planning Agreement' means an Agreement made under sectlon 106
or 1064 of the 1990 Act (tncludlng the 5106 Agreement made as the
basis of the grant of thrs Permisslon and any deed of modlfication thereto
In accordance wth claus€ 13 of the s106 Agreement) and any such
agreement completed in relation to any Reserved Matters Approval or
any Other Matters Approval under this Permission or in relation to any
Additional Plannrng Permisston

Further thrs Permrssion;
"Flanning Application" means the planning appltcation to carry out the
Development submitted to the LPA on 11 October 2013 and given
reference number F / 04687 l t3 i
*Planning Obligation" shall mean any planning obligatron contatned in
any Plannrng Agreement;
"Plot" means a buildtng plot(s) as shown on the Indicative phasing
Parameter Plan and reference to a Plot followed by a number shall mean
the Plot as so numbered on the Indicattve Phasing Parameter Plan or its
nearest equrvalent on the Indrcattve Phasing Parameter Plan;
"Plot Development" means such development as may be included in or
related to any Reserved Matters Appltcatton or included in any Other
Matters Applicatron made by the developer of the Northern Development
or Southern Development (as the case may be) in accordance wth this
Permission In relatton to any spectfic Plot or Plots after Conditions 1.2
and/or 1.3 of this Permrssion shall have been complied wlth;
"Practical Completion" means the followtng as the case may require:
(a)
in respect of any Butldings (save and except those to whtch the
Occupatton Finrsh Standard apphes), the rssue of a certtficate of
practrcal completlon by the architect or engineer for the relevant
Plot Development certifying that the respective buildtng(s) have
been built to the shell and core stage whereby the building(s) are
sutable for fitting out; and
(b)
In relation to Cntrcal Infrastructure (including any burldings) as
referred to In the defintion of "Occupation Finish Standard",
completed to the Occupation Finrsh Standard in accordance with the
relevant Necessary Consents; and
(c)
In relatron to any other Cnttcal Infrastructure (including the creatton
construction improvement or alteration of any new or extsting
hrghways, junctrons, cycleways, pedestnan routes railways or railrelated structures or apparatus, Bridge Structures or any Pnnctpal
Open Space) insofar as the Occupation Ftnish Standard does not
apply, the term "Practlcal Completion" shall mean
practlcal
comDletion In accordance wlth the terms of the relevant Necessary
Consents,
and the terms "Practically Complet€" and "Practically Completed"
shall be construed accordlngly;
"Pre-Commenc€ment Reserv€d Mattcrs APplications" means any
applications for Pre-Commencement Reserved Matter Approvals;
"Pre-Commenc€ment R€served Matters APprovals" means one or
more of the following (as the case may be):

"Preferred Affordable Housing Provider(s)'. means the
Affordable
Housing Provider or Affordable Houstng provtders selected by the
developer of the Northern Development or Southern Development ( (as
the case may be) in consultatron with the LpA and on the list approved by
the LPA In accordance wtth paragraph 2.1O or 9,11 (as the case may
be) of Schedule 2A of the 5106 Agreement who are to be invited to
tender or brd for the Affordable Housing In the Southern Development or
Northern Development (as the case may be) of a given phase or SubPhase (or alternatively the rndividual Affordable Housing provtder
approved by the LPA under paragraph 2.10.1 or 3,ll.t of that
Schedule to the 5106 Agreement);
"Pr€f€rred Site" means the site of the extsttng Hendon Waste Transfer
Station site shown on Parameter Ptan 016 being the preferred locatton for
the Constructlon Consoltdation Centre wthin the Southern DevetoDmenr
(with such addttional land as may be found to be necessary and Feasible
In the CCC Feasibility Study);
"Preparatory Works" means any minor operattons or items of work of
or connected wfth or ancrllary to archaeological and/or contamtnatton
Investigations, stte surveys, and construction set up to be carried out
pursuant to thrs Permtssion provided that such works are unlikely to have
any srgnificant adverse envtronmental effects beyond those assessed by
the EIA Process carned out in relation to the planning Appticatton;
"Primary Development Delivery Programme" means
a
detailed
delvery programme relating to Crttical InfTastructure in the whore or anv
part of the Primary Development package (phase 1) to be approved
under Condition 5.1 of this Permisston and any subsequent variattons
approved in accordance with the relevant Condttion of thts permission;
"Primary Developm€nt Package' means those elements of
the
Development ldentified rn Parameter Plan 019 and descnbed in Section 6
(and paragraphs 6.26 to 6.31 In particular) of the DSF and those plots

Plot 46 in the Brent Terrace Zone and to replace the existing Claremont
Pnmary School and to be provlded as an Exemplar Butldtng in accordance
wlth paragraphs 2.33, 2.34a and 2.54 and Table 8 of the DSF;
'R€placement Secondary School" means the replacement secondary
school of up to 15,232 m2 gross external floorspace and capable of
provrdrng a total of up to 1,200 places at any one ttme for pupils (on the
basis set out in paragraph 5.1.2 of Schedule 2 to the 5106
Agreement) located approximately on Plot 27 as shown on the Indlcatrve
Phasing Parameter Plan In the Eastern Lands Zone and whlch is to
replace the existtng Whttefields School and to be provrded in accordance
wth paragraphs 2.33, 2.34 and 2.34b of the DSF;
"Replacement Sp€cial Nc€ds School" means replacement special
needs school of up to 4,394 m2 gross external floorspace (on the basts
set out in paragraph 5,1.3 of Schedule 2 to the 5106 Agreement) to
be provided in the Eastern l"ands Zone approximately as shown on plot
65 on the Indtcative Phasing Parameter Plan in accordance
wtth
paragraphs 2.33, 2.34 and 2.34c of the DSF and In the general vtctnty of
the locatron marked "E1" on the Indrcattve Phastng parameter plan and
which wrll be capable of providing up to 112 places at any one time for
11 to 18 years olds (on the basis set out in paragraph 5.1.3 of
Schedule 2 to the 5106 Agreement)in order to replace the extstrng
Mapledown Special Needs School;

"Reserved Matters Application" means any applicatron comprtstng
detarls to be submrtted in accordance wrth the DMPO in relation to all or
one of layout, scale, external appearance of buildings or bndge
structures, means of access or hard and soft landscaping to be carried
out as part of the Development;
"Res€rv€d Mafters Approval" means the LPA'S or Secretary of State's
formal wntten approval in accordance wth the DMPO of details approved
pursuant to a Reserved Matters Applrcatron;
"R€s€rv€d Matters Transport Report" means a Transport Report
relating to any Reserved Matters Applicatrons In relation to the whole or
part of a Phase Sub-Phase or Plot to be submitted and approved In
accordance with Condition 37 of this Permission and In accordance wrth
the arrangements and methodology described in the Matrix and
Transport Reports Schedule and which provrdes the informatton required
by the relevant approved Transport Report Scope and
Spectficatton
Approval;
"Residential Relocation Strategy" means a scheme settrng out the
following (subject to paragraph 3.1.3A of Schedule 2A of the 5106
Agreement)::
(a)
the strategy and arrangements for the satisfactory relocatron of
resrdents in the sheltered housrng in the Rosa Freedman Centre for
the purposes of the developer of the Northern Development
constructrng Claremont Avenue and from the first 60 of the
Whitefield Estate Existing Unts on the Whrtefield Estate (for the
purposes of accommodatrng the landing of the Bndge Structure 87
(Lrving Bridge) on land to the South of the 4406 (together
compnsrng
the Whitefi€ld Estate Existrng Unrts (Part 1) to the
Whtefield Estate Replacement Unrts (Part 1) (including the ttme
penod or periods for whrch any of the whtefield Estate
Replacement Units wrll be offered to, saved for and made available

accordance wrth the reouirements of Schedule 2A of the 5106
Agreement); and

for the strategy for the developer of the

Estate to the Whrtefield Estate Replacement Units (Part 2)

relocatrng from the Whrtefield Estate Extsting Units In accordance
wrth the requirements of Sch€dule 2A of the 5106 Agreement),
wth the parameters and pnnctples contatned rn paragraphs
2.91 to 2.93 tn the DSF, the parameters and princtples contatned in
Schedule 24 to the 5106 Agreement and the Indtcative Constructton
Programme or if approved the Primary Development Delivery Programme
pursuant to the Overarchtng Delivery Obhgattons and provided that

resrdents in the accommodatton contatned in the Rosa Freedman C€ntre
may be moved by the Councrl (or by persons other than the developer(s))
to other locatrons and such strategy rs to be submrtted to and approved
pursuant to Condition 1.1O of thrs Permissron and paragraph I of
Sch€dul€ 2 to the 5106 Agreement;
"Residential Unit" means single residential dwelltng (includlng any
Affordable Housing Unit or Market Houstng Unit, but excludtng the
Whitefield Estate Replacement Untts) to be constructed pursuant to this
permissron for use as a dwelling (including a house flat or maisonette)
within Class C3 of the Town and Country Plannrng (Use Classes) Order
1987 (or any equivalent replacement provisron);
'Reyised Energy Stratogy" means the stte-wtde strategy to be
approved under Condition 35.6 of thts Permission setting out the
developer(s) of the Northern Development and / or Southern

"Secr€tary of State" means the Secretary of State for Communities
and Local Government or hts statutory successor with responsibillty for
plannrng and related matters arising under thrs Permission and Includes
the Planning Inspectorate In the case of an appeal;
*Servicing and Delivery Strat€gy" means the servlcing and Dellvery
Strategy which sets out on a Phase or Sub-Phase basrs how the
parameters and pnnciples ln the agreed Framework Servlclng and
Delivery Strategy wtlt be delivered for the partlcular Phase or Sub-Phase
and how the Phase or Sub-Phase Servtcing and Delivery Strategy wlll
operate rn conjunctton with adjointng Phases or Sub-Phases In
accordance wrth Condition 1.22 of this Permlssion;
"Shared Equity" means Intermedlate Housrng provided on
a
part
equity/sale basis whereby an initial share In the property may be sold to
a purchaser at up to 650/0 of Open Market Value and the unsold equrty ls
held by an Affordable Housrng Provider or the LPA (but for the avoidance
of doubt there shall be no drrect or indirect requirement or obligation that
equity must be held by or transferred to the LPA (as opposed to berng
held by an Affordable Housing Provider) and upon sale of any such equity
the proceeds are re-applred to Affordable Housing within the London

requrred prior to the construchon of any Bridge Structure or any Buildtng
on any Plot or Plots wthrn any Phase or Sub-Phase;
"Site Specitic Remediation Stlategy" (SSRS) means the Site Spectftc
Remediatron Strategy In accordance the parameters and pnnctples set
out In the Global Remediation Strategy to be submtted and approved in
accordance with Condition 31.2 of this Permtsston with such variations
or modificatlons whrch may be approved from time to ttme in accordance
with Condition 31.3 of this Permission;
"Site Waste Management Plans" (SWMP) means a plan
which
individual princtpal contractors and developers will be required to prepare
and lmplement In accordance with the Demolltion and Site Waste
Management Strategy, the Code of Construction Practice and the
requirements of the Envrronment Agency and which is to be approved In
accordance wrth Condition 28.2 of this Permission;
'Skills Developm€nt Method Statement"
means a statement (as part
of an Employment and Skills Action Plan) to be submitted and approved
in accordance wth Condition 1(,.1 of thts Permission contatntng
measures designed to maximtse local lob opportunities created as a
result of the Northern Development or Southern Development (as the
case may be) including demoltion and construction work and measures
designed to provide appropriate traintng employment advtce and/or other
programmes and/or initiatives for residents wtthtn the local area to
enable them to obtain the requisite knowledge skill expenence confidence
and opportunity to be employed in jobs created as a result of the
Northem Development or Southern Development (as the case may be);
-Social Rented Housing" means housing provrded by an Affordable
Housing Provider for whrch guidellne Target Rents are determined
through the national rent regime (or if appltcable any London variations
or replacements) or such amended formula or regtme publtshed through
