February 2017 Hello from the City of Evanston Farmers’ Market Office. Thank you for expressing interest in the 2017 Downtown Evanston Farmers’ Market. I am looking forward to meeting all the farmers and vendors and having an exciting summer market here in Evanston. I am in the process of receiving all the agreements from our returning vendors and will be making all the adjustments to the market spaces. Open spaces for new vendors will be very limited for the 2017 season. We currently have 3 spaces available but I am still waiting for a few vendors to hand in their paperwork. We have two sizes of spaces available: a small space 16 X 20 which is large enough for a 10 X 10 tent and a medium space 32 X 20. We may also have an option for a vendor to share a space (every other week) in one of the smaller spaces. I would highly recommend that you take a look at our list of vendors from last year on line to see who we currently have in the market. I have attached our agreement to invite you to apply for the 2017 Evanston Farmers’ Market. I know that your involvement in the market will enrich our market and I hope being in our market will enrich your business. Attached are all the forms that you will need at this point. We wanted to pass on as much information on to you regarding laws, city ordinances requirements, etc. so you would have all the necessary information to complete this agreement process. The Farmers’ Market packet consists of: 

2017 Downtown Evanston Farmers’ Market Value Added or Producer/Grower agreement form and attachments City of Evanston Farmers’ Market City Ordinance (pending for new language) City of Evanston Vendor Registration Form Federal W‐9 Tax Form Illinois Department of Public Health Technical Bulletin Tent and Weight Policy The City of Evanston has a Health Department that handles all health code issues. They also have a separate licensing fee that you need to consider when deciding to apply for the market but please do not apply for it until you have been accepted in the market. The Health Department forms and fee structure can be found at cityofevanston.org and click on the Health Department tab. When all new vendor agreements are in (deadline March 3, 2017) I will set up a meeting with our board (Friends of the Evanston Markets) to vote. Please include with your agreement pictures of your products, your set up, any packaging and a list of items that you are thinking of selling at the market. I will be setting up visual boards so that each board member can see what you are all about. Please send whatever represents you and your products. If you would like to drop off samples for the board members to try, that would be fine also. I do not have the exact date for the selection meeting yet. Farmers are prohibited from refilling containers provide by customers or containers
initially purchases from a producer/grower and returned for refilling from a bulk
container.

Market Operating Rules and Regulations
Producers- (Definition) A grower or producer is any person offering for sale articles for
human consumption, such as fruits, vegetables, edible grains, nuts and berries, apiary
products, maple sugar, syrups and /or non-edible articles, such as cut or potted flowers and
plants, which have been grown or prepared by the grower or producer.
Value-Added Items- (Definition) Involves taking any product from one level to the next.
Cooperative Farmer- (Definition) A farmer that shares land, or farm as neighbors, or farm
together in a community or region.
Cottage Food Operation- (Definition) A person who produces or packages non-potentially
hazardous food in a kitchen of that person’s primary domestic residence for direct sale by
the owner or a family member, stored in the residence where the food is made.
Enforcement of Rules- Occupants of spaces at the Evanston Farmers’ Market must
conform to ALL Market rules. The Market Manager has full authority to enforce all rules and
any occupants failing to comply therewith will have their space declared vacant with no
refund.
Time and Hours of Operation-The Evanston Farmers’ Market will be open from May 6,
2017 through November 4, 2017 from 7:30 a.m. to 1:00 p.m.
Vehicles- All vehicles must be in place no later than 7:00 a.m. Large trucks will not be
allowed to remain in the market area. Space will be provided on East Railroad Ave., in the
Maple Garage or behind the garage. Small vehicles may stay in your space only if they fit
within the boundaries of the assigned space and are approved by the Market Manager.
Only pedestrian traffic will be allowed in the market area after 7:00 a.m.
A vendor failing to arrive by 7:00 a.m. will forfeit their space for the day. Vehicles are not
allowed back into the market until the close of the market at 1:00 pm. Violators will be fined!
Displaying and Selling Goods-Producers must furnish their own tables, chairs, or other
display arrangements. In case of rain, producers must furnish their own protections, as the
Market is exposed to the elements with no shelter provided (tents/signage must be
secured at all time with weights). Please make sure that you follow the new Tent Weight
and Weather Policy which is attached to this agreement.
All walkways must be free of obstacles that would impede the flow of customer traffic. Signs
and displays outside of the vendor’s assigned space must be approved by the Market
Manager.
All producers shall post within its allocated space signs stating vendor’s legal name and
location (city and state). If you have co-op produce at your stand, you must have signs
stating what farm those items were grown at.
Vendors must have signs stating prices for products being sold at all times.
Clean Up- All refuse must be removed by the vendors at the close of the Market each week.
Your assigned area must be free of all garbage. All garbage/recycling carts must be
returned to the back of the garage area. Leaving any litter or garbage is in violation of the
Market rules.
Any use of grills must be discussed and approved by the Market Manager. Ashes cannot
be disposed of in the carts provided or any other area in or by the market.
The Evanston Downtown Farmers’ Market is a smoke-free environment. Vendors are only
allowed to smoke behind the garage.
A port a potty will be provided behind the garage for vendors. Please be respectful and
keep it clean. NO smoking in the port a potty!
Vendors are prohibited from refilling containers provided by customers or containers initially
purchased from a farmer and returned for refilling from a bulk container.
All vendors approved to sell eggs at our market must have an egg license issued by the
State of Illinois and must attach a copy with this agreement.
Vendors that are required to have a City of Evanston Health Department Farmers’ Market
License must have a paid valid 2017 license prior to the start of the market (May 6, 2017).
All health department forms should be sent directly to the City of Evanston Health
Department. Please do not include any health department information (including health
department fees) with this agreement.
All City of Evanston Health Department and State of Illinois Department of Health
requirements must be followed at all times while at the market.
The Market Manager and Health Department Inspectors shall have the right to conduct an
inspection of the vendor’s booth and products without prior notification.
Any vendor requiring a generator must contact the Market Manager for approval and
guidelines per the Evanston Fire Department.
Testing of scales will be conducted periodically at the Evanston Farmers’ Market.
All rental space fees must be paid in full by April 1st or your space will be assigned to
another vendor.
Local/locally is defined as a Midwestern state as defined by the United States Census
Bureau: specifically, the States of Illinois, Indiana, Iowa, Kansas, Michigan, Missouri, North
Dakota, Ohio, South Dakota and Wisconsin.
The Market Master may, in his/her sole discretion, revoke the vending space of any vendor
or special-event space holder for violations of the City of Evanston City Ordinance # 3-25-1,
irrespective of the severity, number, or duration of said violations.
An applicant for a vending space at a farmers' market shall submit to the market master,
along with the required fee, an agreement containing all of the following information:
1. Name and address of applicant;
2. Products for which vending space is sought;
3. Affidavit certifying that articles offered for sale are locally grown, cultivated, created, produced or
prepared;
4. Affidavit certifying that articles offered for sale are: (a) of the vendor's own growing, cultivation,
creation, production, or preparation; or (b) from the actual raiser, cultivator, creator, producer, or preparer
and that the applying vendor is authorized sell such products, with full disclosure to the consumer of their
source;

this agreement for permit is true and complete to the best of his/her knowledge.
Applicant further agrees to perform all obligations, which may be required under
applicable laws, ordinances, rules and regulations and under all contracts or
agreements, which may be annexed hereto.
Applicant hereby agrees to reimburse the City of Evanston for any expense of
providing labor, equipment and facilities, cleaning up or restoring and repairing the
premises occasioned by any use or activity carried on by the applicant or those
authorized under applicant’s permit.

I further understand that the undersigned, for himself and, if different, for the person
or organization on behalf of whom this agreement is submitted, hereby covenants to
indemnify the City of Evanston, and its officers, agents, employees and assigns, and
to hold them harmless, from any liability for personal injury, loss of life and or
property damage arising out of the use of the premises associated with this
application, and for any contractual or quasi-contractual obligations to third parties
in connection with the activity, event use or occurrence.

Tent Weights and Weather Policy at
Evanston Farmers’ Markets
Wind blown tents, canopies and umbrellas are the number one cause of injuries and
insurance claims at Farmers Markets, but nearly all of this damage can be prevented. In
order to protect our producers and customers during times of unexpected weather
situations, the following measures are required to set up at the Evanston Farmers
Market:
Tents/Canopies/Umbrellas/Signs
We require that every tent, canopy, umbrella and/or signage used at any Evanston
Farmers’ Market must be attached to an approved weight. All tents, canopies, umbrellas,
signs and other forms of stall covers must be sufficiently and safely secured to the
ground from the moment the stall cover is erected at the start of the Market day to the
moment immediately before it is taken down at the end of the Market. Tents and
canopies are considered sufficiently secured with at least 50 pounds per leg and at least
50 pounds for umbrellas. Weights for signs will vary depending on the size of the
signage. The Market Manager will make the final decision on the appropriate weight for
signs.
Some notes regarding weights:
 Weights should be secured in a manner that does not create its own safety
hazard.
 Weights should not cause a tripping hazard.
 Weights should be tethered with lines that are clearly visible.
 Weights should have soft edges to avoid causing cuts and scrapes.
 Weights should be securely attached.
 Weights should be as close to the ground as possible. Hanging weights are not
considered best practice and will not be approved.
If tents, canopies, umbrellas or signs are NOT adequately secured, Market Management
will require the Vendor to take them down and sell without them. If these items need to
be taken down in the middle of the Market, the Vendors are expected to direct
customers to a safe place so they will not be injured. If vendor does not comply fines and
penalties will occur.
Examples of sufficient and safe weights include:
 Filling an empty 5 gallon bucket with cement and securing this to each corner of
the tent with a rope or bungee. It is NOT sufficient to place the bucket on the feet
of the tent without it being attached in some additional way.
 Filling containers with sand/cement that can be anchored or secured with a rope
or bungee; these include canvas bags or containers that have a handle through
which a rope or bungee can be secured.
Examples of NOT sufficient or safe weights include:
 Gallon water jugs- these are not heavy enough for large gusts of wind.
 Tying tents, canopies or umbrellas to tables, coolers or vehicles.
 Sandbags that cannot be set upright and securely tied to the tent or canopy
should not be used.
