(a)TheNewYorkStateEducationLawauthorizestheStateUniversitytoadoptandmakeapplicableto itscampusesanyandallprovisionsoftheVehicleandTrafficLaw.Further,theuniversitymaydevelop itsownrulestocoverspecialcampuscircumstances. (b)Anyviolationsofanystatuteorruleshallbepunishableasprovidedintheadoptedprovisions.That is,acampus-createdrulemightbeadministeredbytheinstitutionitself.Violationsofprovisionsofthe VehicleandTrafficLawmadeapplicabletothecampuswouldbeadjudicatedbythemagistrates'court havingterritorialjurisdictionoverthecampusand/orpersonaljurisdictionoverthedefendant. However,theuniversitymayalsoimposeacampuspenalty. (c)TransportationandParkingServicesisresponsibleforadministeringallparkingpermitsandparking violations.TransportationandParkingServicesenforcesalluniversityparkingregulationandvehicle laws.UniversityPolicemayenforceparkingregulations,alongwithvehicleandtrafficlaws. §566.1Universityregulations. Subdivision1(c)ofsection362oftheEducationLawempowerstheuniversitytodevelopitsownrules regardingtrafficandparkingnotinconsistentwiththeVehicleandTrafficLaw.Thesemayincludethe assessmentofanadministrativefineupontheowneroroperatorofvehiclesforeachinfraction. 1 Violationofuniversityregulationsisprejudicialtothecommoninterestofallwhooperatemotor vehiclesonthecampusandmayresultinfinesorinthelossofparkingordrivingoncampus.Theserules andregulationsreplaceallpriororderswhichestablishedtrafficregulationsonthegroundsofState UniversityofNewYorkatBinghamton,TownofVestalandBroomeCounty. §566.2Applicationofregulations. TherulesandregulationsadoptedandpromulgatedbytheStateUniversityatBinghamtoncounciland setforthinthisPartareeffectivethroughouttheyear,fromSeptember1sttoAugust31st,includingall recessandintersessionperiods.Theyapplytostudents,employees,facultyandstaffoftheuniversity, andallotherpersonswhooperateorparkorwhosevehiclesareoperatedorparkedatanytimeonthe groundsoftheuniversity,includingvisitors,officersandemployeesofotheragencieswhosevehiclesare operatedandparkedregularlyonthegroundsoftheuniversity.TheVehicleandTrafficLawshallapply uponsuchpremisesnotwithstandinganyreferencesinsuchlawtopublichighways,streets,roadsor sidewalks.Nopersonshalldriveavehicleonuniversitystreets,roadsorhighwaysataspeedgreater thanisreasonableandprudentundertheconditionsandhavingregardtotheactualandpotential hazardsthenexisting,butinnoeventshallapersondriveavehicleinexcessof20milesperhourunless adifferentspeedisauthorizedandindicatedbytheuniversity. §566.3Campusregistrationofmotorvehicles. (a)NovehiclemaybeoperatedorparkedonthegroundsoftheuniversitywithoutavalidState registrationandwithoutdisplayingacurrentcampusvehicleregistrationpermit,asprovidedinthis section,anduponpaymentofanannualvehicleregistrationfeeasapprovedbythechancellororhis designee,unlessthevehicleisnotsubjecttosuchregulations. (b)Prerequisitesforregistration. (1)TheapplicantmustbelegallyqualifiedtooperateamotorvehicleinNewYorkState. (2)ThevehiclemustberegisteredandinspectedinNewYorkStateorinsomeotherstateor jurisdictionthatqualifiesitforlegaloperationintheStateofNewYork. (3)Theownerofthevehiclemustbecoveredbyeffectivepublicliabilityinsurancein accordancewiththeminimumamountsrequiredbyNewYorkStatelaw.Suchinsurancemust coveranyliabilityincurredwhilethevehicleisdriveneitherbytheregistrantorbysomeone withtheregistrant'sexplicitorimplicitpermission. (4)Theremustbenounpaiduniversity-imposedparkingor trafficfinesoutstandingagainstthe applicantorthevehicletoberegistered. (c)Anapplicantmayregisteronlyavehiclebelongingtohimortoamemberofhisimmediatefamily. Thetermbelongingshallmeanowningoroperatingavehicleforone’sownbenefit. (d)Ifanyonewhohasregisteredavehicleacquiresanadditionalordifferentvehicle,hemustregisterit within48hoursofitsacquisition.Ifanewlicenseplatenumberisobtainedforanyvehicle,theParking ServicesOfficemustbenotifiedwithinfivedaysofthenewlicenseplatenumberbeingdisplayed. (e)Vehicleregistrationpermitsmustbepermanentlyandentirelyaffixedanddisplayedwhentheyare issuedandastheuniversityindicates.Thepersontowhomapermitisissuedisresponsibleforany parkingviolationsofthevehicle.Tapingandothertemporaryadhesionisnotpermitted.Ifthevehicleis 2 soldorifstudentand/oremployeestatuswithintheuniversityisterminated,itistheowner's responsibilitytoremovethepermit. (f)Facultyandstaffvehicles.Uponcompletionofthevehicleregistrationformandpaymentofthe requiredfees,avehicleregistrationpermitisissuedtofacultymembersandemployeesofthe university,includingbutnotlimitedtotheaffiliatesoftheResearchFoundation,SUNYFoundationand thosecompaniescontractedtoprovidefood,bookstore,vendingandchildcareserviceswhohave fulfilledtheconditionssetforthinthissubdivision. (1)Parking registration fees and/or parking permit fees,asapprovedbythechancellor,or designee,shallbechargedformotorvehiclesparkedwithindesignatedlots,consistentwith applicablecollectivebargainingagreementsandinaccordancewithguidelinesestablishedby thechancellorordesignee. (2)Suchguidelinesshallprovidethatthedeterminationoftheamountofthefeebebased substantiallyonananalysisofthecostsattributabletotheoperationandmaintenanceofthe parkingfacilitiesownedandoperatedbyBinghamtonUniversity. (g)Studentvehicles.Allstudentsarerequiredtoregistermotorvehiclesannuallywiththeuniversityand mustdosowithinthetimedesignatedforacademicregistrationatthebeginningofthefallterm. Studentswhoentertheuniversityatthebeginningofthespringorsummertermmustobtainacampus vehicleregistrationpermituponentering.Studentswhoreentertheuniversityafteraperiodofabsence mustobtainacampusvehicleregistrationpermituponreentering.Studentswhodonotown,maintainor operatemotorvehiclesthatmustberegisteredforacampusvehicleregistrationpermitatoneofthese times,butwholateracquireavehicleorotherwisebecomesubjecttocampusregistrationrequirements, mustcompletetheirvehicleregistrationwithin48hoursafterbecomingsosubject.Freshmenwhoreside inuniversityresidencehallsarenotpermittedtoregisterorparkavehicleoncampuswithoutpermission givenbytheParkingServicesDirector. (h) Veterans. Anyveteran,asdefinedinsection360oftheNewYorkStateEducationLaw,inattendance asastudentattheuniversityshallbeexemptfromparkingfees. Registration fees still apply.He/shemust beenrolledincoursesforthecurrentsemester,presentaDD-214andbehonorablydischarged. (i)Temporaryregistrationpermits,nottoexceed3timesperyear,maybeobtainedattheParking ServicesOffice,informationBoothorUniversityPoliceDepartmentdispatchoffice. (j)Fees.Vehicleregistrationpermitswillbeprovidedonlyaftertheappropriatefee,asapprovedbythe Chancellorordesigneehasbeenpaid.Thisfeeisapplicabletoallpermitsissuedduringtheyear (September1sttoAugust31st)bytheParkingServicesOffice.Therewillbeafeeforanyreplacement permit. §566.4Visitors. (a)Avisitorisanyindividualotherthanastudent,anemployeeofBinghamtonUniversity,theResearch Foundation,theBinghamtonUniversityFoundationorthosecompaniescontractedtoprovidefood, bookstore,vendingandchildcareservices. (b)Representativesofbusinessfirmsandservicecompanieswhooperatetheirvehiclesoncampusona regularbasismustobtainservice,registrationandparkingpermits. 3 (1)Allconstructionvehiclesandcontractorsworkingoncampusmustobservealltraffic regulations. Suchvehiclesarerequiredtoberegistered,evenifthevehicleisgoingtobestaged inanapprovedstagingarea. Constructionvehiclesandworkersthatparkoutsidethestaging areaarerequiredtoberegistered. Parkinglocationsforconstructionvehicleswillbedetermined bytheParkingServicesDirectorforeachproject. Anychangestothisregulationwillbemadeby theParkingServicesDirector. (c)Nocarswillbeallowedtoenterthecampusbetweenthehoursof12midnightand5a.m.withouta currentcampusvehicleregistrationpermitand/orparkingpermit.Apermitmaybepickedupatthe informationboothonBartleDrivebetween12midnightand5a.m. (d)Visitorparkingmayberestrictedtospecificlotsasdeterminedbythechancellorordesignee.Any visitorwhoparksavehicleoncampusmustmakeproperreimbursementtotheuniversityatarateas approvedbythechiefadministrativeofficerordesignee. §566.5Parkingregulations. (a)Vehiclesmaybeparkedonthecampusonlywhendisplayingacurrentuniversityparkingpermit,as providedintheserulesandregulationsandonpaymentofauniversityparkingfee,approvedasto amount,bytheChancellor,oradesignee,unlessthevehicleisnotsubjecttosuchregulationsand,if parked,isinapaidlot,atparkingmetersorintheparkinggarage. (b)Novehicleshallbeabandonedonanyportionofthegroundsorpropertiesoftheuniversity. (c)Vehicularlivingquarters, such as motorhomes and trailers,shallnotbeparkedonanygroundsor propertiesoftheuniversityatanytimewithoutthepermissionofParkingServicesDirectorora designee. (d)Parkinginthefollowingplacesisprohibitedatalltimes:onasidewalkorcrosswalk,onthegrassor lawn,infrontofadriveway,doorwayorsteps,withinanintersection,ontheroadwaysideofany vehiclewhichisstoppedorparkedattheedgeorcurbofastreetorroadwaywhetheritisparallelorat anangletothecurboredge,inallareaswhicharemarkedrestricted,andinallservicedriveways, loadingzonesandassociatedturn-aroundareasunlessspecialarrangementhasbeenmadethroughthe ParkingServicesOffice.Parkingisprohibitedoutsidetheconfinesofanyspecificallylinedordesignated spaceintheparkinglot.Parkingisnotpermittedatanyareadesignatedbyyellowcurbsand/oryellow diagonalhashmarksonthepavement.Also,nopersonshallparkhisvehicleonthegroundsofthe universityinsuchamannerastointerferewiththeuseofafirehydrant,firelanedesignatedbyyellow curband/orpermanentmarkings,orotheremergencyzone,createanyotherhazard,orunreasonably interferewiththefreeandproperuseoftheroadway. (e)Universityparkingpermitsmustbedisplayedastheuniversityindicatesinvehiclesparkedon campus.Thepersontowhomaparkingpermitisissuedisresponsibleforanyparkingviolations attributedtotheparkingpermit.Thereisafeeforanyreplacementparkingpermit.Ownershipofthe parkingpermitisnottransferable. (f)Specialparkingzones. (1)Infirmarylot.Thislotisreservedatalltimesforemergencyvehicles,patientsandphysicians employedbythehealthservice. 4 (2)VisitorsandEventparking.Visitor/Eventparkingmayberestrictedtospecificlotsas determinedbytheParkingServicesDirectorordesignee. (3)Motorcycleandmopedparking.Motorcycleparkingisdesignatedbyclearsignageand locatedinvariouslotsoncampus. (4)AspecialpaidparkinglotislocatedsouthoftheMainLibraryandWestDrive.Nopersonmay parkavehicleinthepaidlotwithoutmakingproperreimbursementtotheuniversityatarateas approvedbytheChancellor,ordesignee. (5)ThefollowinglotsarereservedforcommutersonlyMondaythroughFriday,5a.m.to midnighteveryday. Noparkingfrommidnightto5a.m.Commutersincludeallregistered campusvehiclesexceptresidents. (h)AcompletelistofcampusrulesandregulationsconsistentwiththeVehicleandTrafficLawrelatingto parking,vehicularandpedestriantraffic,andsafetyisonfilewiththeOfficeoftheSecretaryofState,the officeoftheclerkoftheTownofVestal,andintheofficeoftheParkingServicesDirector.Thelistmaybe reviewedwithinthenormalbusinesshoursoftheseoffices. §566.6Motorcycles,mopeds,motorscooters,motorbikes. (a)Registration.Allsuchvehiclesmustberegisteredinthesamewayasisanyothermotorvehicle,see section566.3ofthisPart,andtheyaresubjecttothesamerestrictions. (b)Licensing.Thelawconcerningmotorcyclesincludesmotorbikesandmotorscootersandprovidesthat anyNewYorkStatedriver'slicense--whetherneworrenewal--issuedafterOctober1,1964,musthavea specialmotorcycleendorsementifthedriveroperatesamotorcycleorclassAmoped,andavaliddriver’s licenseifaclassBorCmoped. (c)Enforcement.Anyonedrivingamotorcycleanddoesnothaveamotorcycleendorsementontheir licenseoraclassBorCmopedwithavaliddriver’slicensemaybearrestedasanunlicenseddriver. Anyonewhoallowstheuseoftheirmotorcyclebyadriverwhodoesnothaveamotorcycle endorsementmaybearrestedforpermittingunlicensedoperationofthevehicle.Snowmobilesandall- terrainvehiclesmaynotbeoperatedonuniversitygroundswithoutspecificpermissionfromthe UniversityPoliceDepartment. §566.7Enforcementandpenalties. (a)AcomplaintregardinganyviolationoftheVehicleandTrafficLaw,oranytrafficordinanceapplicable onsuchpremisesshallbeprocessedinaccordancewiththerequirementsofapplicablelawandcampus rulesandregulations.AviolationofanysectionoftheVehicleandTrafficLawshallbeamisdemeanoror trafficinfractionasdesignatedinsuchlaw,andshallbepunishableasthereinprovided.Suchlaws adoptedbyStateUniversityofNewYorkaboveshallbeenforcedinanycourthavingjurisdiction. 6 (b)Movingandparkedvehicleswillbemonitoredforcompliancewithtraffic,registration,inspectionand parkingrulesandsafeconduct. Campusfinesandpenaltiesforinfractionsorunsafeconductas authorizedbytheChancellororcampusdesigneewillbeaccessed. Personsmaybedeniedtheprivilege todriveorparkoncampusoncampusroadsorproperty. (c)Violationsofcampusvehicleregistrationpermits. (1)Violationsoftheprovisionsoftheuniversityrulesandregulationsrelatingtothedisplayof currentcampusvehicleregistrationpermitswhichleadtoasummonsaresubjecttothe followingschedulesoffinesandpenaltiesasapprovedbytheChancellorordesignee: (i)Thefirstticketissuedfor certain violationscanbewaivedifthevehicleisregistered atParkingServiceswithinfivecalendardaysofissuanceoftheticket. (ii)Vehiclesmaybetowedawayatowner'sexpense.(Ifavehicleistowedtoanother locationoncampusacurrentvaliddriver'slicenseandinsurancecardmustbechecked byParkingServicesorUniversityPoliceDepartmentbeforevehiclemaybeclaimed.) (2)Tamperingwith,fraudulentuseof,orcounterfeitingofcampusvehicleregistrationpermitor anyotherunauthorizeduseofpermits,orobtainingapermitbygivingfalseinformation: (i)TheuniversitymayrescindcampusvehicleprivilegesinaccordancewithSUNYBoard ofTrusteespolicy. (ii)Individualsmaybesubjecttouniversitydisciplinaryactionand/orarrest. (iii)AfineinanamountapprovedbytheChancellorordesigneemaybeleviedin conformitywithsection560.3ofthisTitle. (3)Thoseenteringthecampusconfinesbetweenthehoursof12midnightand5a.m.withouta currentcampusvehicleregistrationpermitmaybesubjecttoprosecutionfortrespass. (d)Violationsofparkingregulations.ViolationsoftheprovisionsofthisPartrelatingtotheparkingof vehiclesonthegroundsoftheuniversity(exceptviolationsoftheNewYorkVehicleandTrafficLaw whichapplytoparking)whichleadtoacomplaintissuedbytheParkingServicesandreturnableas specifiedonthecomplaint,aresubjecttofinesandpenaltiesapprovedbytheChancellorordesignee and published by Transportation and Parking Services at www.binghamton.edu/parking-services: (1)Parkinginatow-awayzone (2)Parkinginafiresafetyzone (3)Parkinginadisabledzone (4)Parkingonthegrass (5)Overtimeparking (6)Parkinginarestrictedarea (7)Parkinginarestrictedarea 7 (8) Parking in more than one parking space with one vehicle. (f)Unpaidfines.Theuniversitymaywithholdunpaidfinesfromemployees'pay-checks.Parkingprivileges mayberevokedfornon-paymentofoutstandingfines.Unpaidfinesshallbedeductedfromthesalaryof theoffendingemployeeattheconclusionofeachsemester.Allunpaidandun-appealedstudentparking violationsareenteredonadelinquencylisteightcalendardaysafterissuance.Grades,transcripts,and permissiontoregisterincoursesmaybewithhelduntilfinesarepaid.Allotherviolatorsmayhave parkingprivilegesrevoked.Inallcases,avehicularwheelimmobilizedmaybeappliedtorenderthe vehicleinoperable.Thewheelimmobilizerwillnotberemoveduntilunpaidviolationsandaservice chargeinanamountasdeterminedbytheChancellorordesigneearepaid. (g)Enforcementandappeals. (1)Acomplaintregardinganyviolationofacampusruleshallbeinwriting,recitingthetimeand placeoftheviolationandthetitle,numberofsubstanceoftheapplicablerule. (i)Thecomplaintmustbesubscribedbythepersonwitnessingtheviolationandserved upontheviolatororattachedtothevehicleinvolved. (ii)Thecomplaintshallindicatetheamountofthefineassessablefortheviolation,and advisethatifthepersonchargeddoesnotdisputetheviolation,finesnotpaidwithin30 daysofreceiptofviolationaresubjecttodoubling. (iii)Thecomplaintrecitesthatanappealonadisputedviolationmayberequested,in writing,within14daysafterserviceofthechargesbyobtaininganappealsformfrom theParkingServicesOfficeG-8,AdministrationBuilding,orsuchotherplaceasmaybe designatedbythecouncil.Writtenappealsofparkingticket(s)submittedinpersonto theParkingServicesOfficewithin14calendardaysofticketissuancewillnotbeplaced onthedelinquencylistunlesstheyaredisapprovedbytheParkingAppealsBoard. (2)The Vice President of Student Affairsshalldesignateahearingofficerorboardnottoexceed threepersonstohearcomplaintsforviolationofcampustrafficandparkingregulations enforceableoncampus.Suchhearingofficerorboardshallnotbeboundbytherulesof 8 evidence,butmayhearorreceiveanytestimonyorevidencedirectlyrelevantandmaterialto theissuespresented. (3)Attheconclusionofthehearingornotlaterthanfivedaysthereafter,suchhearingofficeror boardshallfileareport.Anoticeofthedecisionshallbepromptlytransmittedtotheviolator. Thereportshallinclude: (i)Thenameandaddressoftheallegedviolator; (ii)Thetimeandplacewhenthecomplaintwasissued; (iii)Thecampusruleviolated; (iv)Aconcisestatementofthefactsestablishedonthehearingbaseduponthe testimonyorotherevidenceoffered; (v)Thetimeandplaceofthehearing; (vi)Thenamesofallwitnesses; (vii)Eachadjournment,statinguponwhoseapplicationandtowhattimeandplaceit wasmade; (viii)Thedecision(guiltyornotguilty)approvedordisapprovedofthehearingofficeror board. (h)Freshmenwhoresideinuniversityresidencehallsandwhoillegallyparkavehicleoncampusmaybe finedinanamountapprovedbytheChancellorordesignee. (i)Trafficcontrolsignsforspeedlimitandstoppingforpedestriansinacrosswalkareimportantsafety controls. Thecampuswillimposeapenaltyforeachviolationpayabletotheuniversity. (j)Ticketing.ParkingenforcementofficersandUniversityPoliceofficersareempoweredtoissue summonses(“tickets”)tovehiclesfoundinviolationofanyparking,trafficorvehicleregulation. Tickets areissuedinaccordancewithsubsection(a)and(b)ofthissection. Officersareempoweredtoissue adjunctionsummonseswhenappropriateduetotheseriousnessoftheticket. Otherpersonnel,when designatedandauthorizedbytheParkingServicesDirectorinconsultationwithHumanResourcesmay issueuniversitysummonsestovehiclesfoundparkedinviolationoftheseregulations. §566.8Appeals. (a)Parkingappealsmustbemadeinwritingtotheparkingappealsboardwithin14daysofthenoticeof violation;afterthattimeappealsarenotaccepted.Formsmaybeobtainedforthispurposeatthe ParkingServicesOfficeoronline.Anoticeofthedecisionoftheparkingappealsboardistransmittedto theappellant. (b)Towingappeals:uponrequestandonlythroughpersonalappearancebeforetheparkingappeals board.RequestmustbemadetotheParkingServicesOfficewithin14daysofthetow.
