Entry is free and open to all residents of Australia who are customers of Solcrest Pty Ltd (ACN 004 016 906), trading as Filter Sales Australia (“Promoter”) and are 18 years or over. 2.
Directors, management and employees of the Promoter and their immediate families are ineligible to enter. “Immediate family” means any of the following: a spouse, de-­‐facto spouse, parent, child or sibling (whether natural or by marriage or adoption) of a person who is an employee of the Promoter. How to Enter 3.
Lottery entrants must purchase minimum of $500.00* of Sakura filters from Filter Sales Australia in the period 1 January 2015 to 31 March 2015, inclusive (the Promotion Period). 4. For every $500.00* purchase, you will be eligible for one (1) entry into this promotion (the “Lucky Draw”). *Purchase amount excludes freight cost charged and GST. 4.
The Lucky Draw is a game of chance and not skill and will be conducted randomly by barrel draw. 5.
To be eligible to enter, entrants must visit www.fsafilters.com.au; and follow the links to the Promotion Entry Page and successfully complete all elements to the entry form reproduced there (Entry Form). 6.
Rules on how to enter the Lucky Draw form part of these Terms and Conditions of entry. By entering the Lucky Draw or accepting the Prize, entrants agree to be bound by these Terms and Conditions. 7. Entry to the Lucky Draw will be refused or disqualified if an entrant does not comply with these Terms and Conditions. The promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering, or attempting to tamper, with the entry process. Prize 8. The Lucky Draw prize is 1 x Holden Cruze Equipe Sedan 1.8L Petrol Automatic with RRP $23,672 and includes one year’s registration (registered in the winner’s State or Territory of residence), compulsory third party insurance, stamp duty, GST (if applicable) and dealer delivery charges (which may vary State by State) (the Prize). Additional insurance, options, petrol and all other ancillary costs are the responsibility of, and will be at the cost of, the winner. The winner must collect the Prize from the authorised Holden dealership specified by the Promoter, in the winner’s nearest capital city. There is only one Prize winner in this Lucky Draw promotion. 9. The Prize value is correct as at Wednesday, 12 November 2014 and is reflective of the recommended retail price and is in Australian dollars. The Promoter takes no responsibility for any variation in the Prize values. 10. If the Prize (or any part of the Prize) is unavailable for any reason, the Promoter will, in its absolute discretion, substitute alternative goods or services of no lesser retail value and/or specification, subject to the approval of the authorities that have issued permits for the conduct of the Promotion. The Promoter accepts no other responsibility for any loss incurred by a Winner of any other party if the Prize (or any part of the Prize) is unavailable for any reason. 11. The Prize cannot be refunded or exchanged and, except as expressly permitted by these Terms and Conditions cannot be taken as a monetary payment. 12. Once the Prize has left the Promoter’s/Supplier’s premises, the Promoter will not be responsible for any delay in delivery or loss or damage to that Prize. 13. The Prize will be awarded to the person named in the winning entry. The Prize winner agrees to have their name and photographs published in a range of media to publicise the event. 14. The winner must, if requested, provide the Promoter with certified copies of all documentation as required by the Promoter before the Prize is awarded. As a condition of accepting the Prize, the winner must sign legal documentation as and in the form required by the Promoter and/or Prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity. Entry and Participation 15. Entrants must ensure that their entries are received by the Promoter during the Promotion Period. 16. An entry is deemed to have been received at the time of its receipt by the Promoter and not at the time of transmission by the entrant. An Entrant’s entry must not be: late; incomplete; incomprehensible; unlawful; obscene; defamatory; libellous; threatening; pornographic; harassing; hateful; racially or ethnically offensive; capable of encouraging conduct that would be considered a criminal offence; capable of violating any law; and/or capable of giving rise to civil liability. 17. Entry to the Lucky Draw constitutes acceptance of these Terms and Conditions. By entering the Lucky Draw, Entrants accept and acknowledge full responsibility for their decision to participate in the Lucky Draw and to take the Prize if they are a Winner. These Terms and Conditions can be downloaded from www.fsafilters.com.au 18. All entries to the Lucky Draw may be subject to verification by the Promoter. An Entrant must, within 7 days of being asked, at the Promoter’s cost, allow the Promoter to inspect and copy any documents the Promoter may request establishing eligibility to enter the Lucky Draw, including but not limited to evidence of age, residence and/or identity. 19. The Promoter may decide in its sole discretion which documents are considered suitable for establishing eligibility to enter or win. In the event that a Winner cannot provide suitable proof of eligibility, they will forfeit their Prize in whole and no substitute or compensation will be offered. 20. Any entry that is made on behalf of an Entrant by a third party, or otherwise by proxy, will be invalid. 21. The Promoter may, as its absolute discretion, declare any or all entries made by an Entrant to be invalid if the Entrant: (a) fails to establish their entitlement to win the Lucky Draw to the Promoter’s satisfaction; or (b) fails to produce items as required for verification by the Promoter or produces items that appear to be illegible, stolen, forged, reconstructed, altered, incomplete or tampered with in any way; or (c) appears, to the Promoter, to have tampered with, or benefited from tampering with, the entry process; or (d) has submitted an entry that is not in accordance with these Terms and Conditions. 22. No responsibility will be accepted by the Promoter for late, lost or misdirected entries. Incomplete or indecipherable entries will be deemed invalid. Promotion Dates 23. The Lucky Draw commences on Tuesday, 1st of January 2015 at 08:00AM AEDST and ends Tuesday, 31st of March 2015, at 08:00AM AEDST (Promotion Period). Prize Drawing Dates 24. One winner will be drawn at 1PM AEDST on Wednesday, 1st April 2015. Winning entries will be drawn manually at Filter Sales Australia’s premises at 11 George Young Street, Auburn, NSW 2144 and scrutinised by an independent scrutineer. 25. The Promoter's decision is final and no correspondence will be entered into. Notification of Winners 26. The prize winner name will be announced in Filter Sales Australia’s newsletter at www.fsafilters.com.au and/or published in The Australian on Thursday, 2nd of April 2015. The Promoter will use its best endeavours to notify the winner of the Lucky Draw by phone and/or email and the winner will have up to 3 months to claim the prize. 27. If the prize remains unclaimed after this timeframe, it will be redrawn at 1PM AEDST on Wednesday, 1st July 2015 at Filter Sales Australia’s premises on 11 George Young Street, Auburn, NSW 2144. 28. The redrawn winner will be notified via phone and/or email. All unsuccessful lottery entries will not be notified. 29. The Promoter may conduct a redraw if an entrant does not comply with or satisfy these Terms and Conditions or forfeits or rejects the Prize, or is unable to accept or enjoy the prize in accordance with its terms. This redraw will take place two weeks after the Promoter contacts the first draw winner. Any second draw winner will be notified by email within 2 days and have their name published on the Promoters website www.fsafilters.com.au 30. The Promoter's decision is final and no correspondence will be entered into. General 31. The Promoter reserves the right to take any action necessary in its sole discretion at any time, subject to any direction given under State lottery permit regulations. 32. To the full extent permitted by the law, the Promoter will not be liable for any loss, damage, claim, cost, expense or personal injury suffered or sustained (including, but not limited to, that caused by any person’s negligence) by any Entrant in connection with the Promotion or the Prize, including any indirect, economic or consequential loss or loss profits; any loss arising from the negligence of the Promoter, orany liability for personal injury or death. 33. If, for any reason, the Lucky Draw is not capable of running as planned, including without limitation, due to computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, or any other causes beyond the control of the Promoter that corrupt or affect the administration, security, fairness or integrity, or proper conduct of the Lucky Draw, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process of take any other action, including to cancel, terminate, modify, or suspend the Lucky Draw subject to any direction given under the relevant State/Territory lottery permit regulations. 34. The Winner acknowledges that the Prize may be subject to additional Terms and Conditions imposed by third parties, including, but not limited to, the insurer proving the required CTP insurance. The Winner must become acquainted with any such additional Terms and Conditions prior to taking the Prize. The Promoter does not accept any responsibility and is not liable for any additional conditions imposed on the taking of a Prize, or for the breach of those conditions by any person. 35. Except for any liability which cannot be excluded by the law, the Promoter is not responsible for: (a) any problems or technical malfunction with any telephone network or line, computer online systems, servers or providers, computer equipment, or software, or any technical problems or traffic congestion on any computer system or at any website, or any combination thereof, including (but not limited to) any injury or damage to participants or any other person’s property related to or resulting from participation in the Lucky Draw; (b) any incorrect or inaccurate information, caused either by users, by any of the equipment or programming associated with or used in connection with the Promotion, or by any technical error that may occur in the course of the Lucky Draw; or (c) any error, omission, interruption, deletion, defect, delay in operation or transmission, communication line failure, theft, or destruction or unauthorised access to, or alteration of, entries or Entrants’ details. 36. Any attempt to cause damage to any website or the information on any website associated with the Lucky Draw or to otherwise undermine the fair and legitimate operation of the Lucky Draw may be a violation of criminal and civil laws. The Promoter reserves the right to seek damages in the fullest extent permitted by law in the event that any such attempt is made, whether or not that attempt results in any such damage, interference or undermining. 37. If any act or omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms and Conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligations and the Promoter reserves the right (subject to applicable law) to cancel, terminate or modify or suspend the Lucky Draw. 38. These rules are Terms and Conditions and constitute the entire terms and conditions between the Entrant and the Promoter with respect to the Promotion and cannot be altered, modified, or amended. 39. All entries become the property of the Promoter. 40. The Promoter may vary these terms and conditions at its discretion, subject to state government legislation. 41. This Lucky Draw is authorised under NSW Permit No. LTPS/14/09916; ACT Permit No. TP 14/04374; VIC Permit No. 14/5973; SA Permit No. T14/2345. Consent 42.
