The below signed parties, CRAVEN COUNTY, through the CRAVEN COUNTY RECREATION & PARKS
DEPARTMENT (Lessor) and the ___________________ (Lessee) do hereby enter into agreement where
the Lessee will operate a concession stand at Creekside Park/West Craven Park. The term of this
contract will be _____________, 20___ through December 31, 20___. The Lessee further agrees to
operate the concession stand in good faith and in accordance with the conditions listed below:
1.
Obtain the proper permits and pay the fee required by the Craven County Health Department
and meet all requirements as set forth by the Craven County Health Department for Limited
Foodservice Establishments. It is the responsibility of the Lessee to insure that the facility meets the
guidelines for Limited Food Service Establishments.
2.
The Lessee must obtain and provide the County with a certificate of liability insurance naming
Craven County as additionally insured. (minimum $1,000,000.00)

The Lessee agrees to pay the Lessor $500.00 per year to operate the concession stand. Payment
must be received no later than 30 days following the first day of operation. Failure to do so will result
in termination of agreement. The Lessor agrees to provide all available utilities including power, water
and sewer at no charge to the Lessee for the duration of the agreement.

Lessee agrees to accept all responsibility and liability regarding the Foodservice operation. This
responsibility includes but is not limited to, proper cleaning and sanitizing of the concession stand and
all utensils, as well as, properly preparing, handling and storing all food items so as not to propose a
health risk to the general public. Lessee will also agree to keep the restroom areas clean and stocked
during times the concession stand is in operation.

Concession Stand Lease
5.
Lessee has the right to operate the concession stand for the term of the lease but does not
have the right to provide concessions for all events. In such cases, a third party may use the concession
stand for a particular event or tournament with Lessee’s written permission and would work under
Lessee’s permit. All arrangements between the two parties (use of equipment, products, entry to
building, etc.) will be handled by the two parties. The third party would still have to adhere to all rules
under this agreement. The Lessee has the right to refuse any request by third parties.
6.
Lessee will not hold the County of Craven, or any of its employees responsible in the event of
injuries to persons who operate the concession stand.
7.
Lessee will hold the County of Craven harmless for any and all loses or damages to equipment
and supplies that occur at the concession stand as a result of theft, vandalism, or by any other means;
as well as any person raising a claim against the County for reasons associated with the concession
operation.
OSHA / FIRE DEPARTMENT REQUIREMENTS
1. Lessee/operator must provide a proper fire extinguisher that will be checked monthly by the
Recreation Department. Any yearly inspection fees or repairs will be paid by the Lessee.
2. Operator must provide material safety data sheets (MSDS) for all cleaning or cooking chemicals
or products that may contain hazardous materials
3. Extension cords cannot be used as permanent power, nor can they used in a way that could
constitute a trip hazard.
4. Boxes or any other items may not be stored on or block hot water heaters.
5. Electrical panels and fire extinguishers must have a minimum of 3 foot clearance.
6. All objects must maintain 24 inch clearance from ceiling.
By signing below, both parties indicate that they have read and agree to abide by the terms listed
above to the best of their abilities. If the Lessee fails to operate the concession stand by the terms of
this agreement, the Lessor reserves the right to terminate this agreement. This agreement will
become null and void with written consent by both parties.
