BEFORE THE BOARD OF COUNTY COMMISSIONERS MARTIN COUNTY, FLORIDA ORDINANCE NUMBER 151 A ZONING ORDINANCE AMENDING CHAPTER 33 OF THE CODE OF LAWS AND ORDINANCES OF MARTIN COUNTY, FLORIDA, BY AMENDING THE HR-2, HR-2A, R-3, R-3A, R-3B, R-4, HB-1A AND HB-1AA ZONING DISTRICTS TO REQUIRE SERVICES AND CAPITAL IMPROVEMENTS TO ACHIEVE A MAXIMUM DENSITY OF FIFTEEN (15) UNITS PER GROSS ACRE AND DELETING RZFERENCES TO STRUCTURES IN EXCESS OF FOUR (4) STORIES IN THOSE DISTRICTS; PROVIDING FOR CONFLICTING PROVISIONS, SEVERABILITY, APPLICABILITY, FILING WITH THE DEPARTMENT OF STATE AND COMMUNITY AFFAIRS, EFFECTIVE DATE, PENALTIES AND CODIFICATION. WHEREAS, this Board has authority pursuant to Chapter 125, Florida Statutes, and Chapter 61-2466 (Special Acts), Florida Statutes, to provide and enforce .zoning regulations in Martin County; and, WHEREAS, this Board, based on the information and arguments presented, requires that naximum densities in certaine zoning districts should be achieved by providing services and capital improvements and the references to structures in excess of four (4) stories should be amended. NOW THEREFORE BE IT ORDAINED BY TBE BOARD OF COUNTY C0:WISSIONERS OF MARTIN COUNTY, FLORIDA, THAT: PART ONE: CHAPTER 33 OF THE CODE OF LAWS AI~DORDINANCES OF MARTIN COUNTY, FLORIDA, BE AND HEREBY IS AMENDED AS FOLLOWS: (HR-2) SECTION 33-243. BUILDING SITE AREA REGULATIONS. (a) For single-family structures, the same as required in the HR-1 Single-Family Residential District. (b) For two-family structures to four-family structures inclusive, the minimum building site shall not be less than fifteen-thousand (15,000) square feet with a minimum width of one hundred (100) feet measured at the front building line. (c) For each additional apartment unit, two-thousand six hundred (2,600) square feet of property shall be added to the required building site. A maximum density of fifteen (15) apartment units sha33 may be permitted per gross acre depending on available community services and capital improvements. (2) Two-family structures: The minimum lot size shall be seven thousand five hundred (7,500) square feet with a minimum width of seventy-five (75) feet and a minimum of eight hundred (800) square feet of living area per two-family structure shall be required, exclusive of carports, breezeways and utility rooms. (3) Apartment buildings: The minimum site shall be fifteen thousand (15,000) square feet with a minimum width of one hundred (100) feet measured at the building line for the first four (4) apartment units.
