BACKGROUND
Council, at its meeting of 5 November 2007, resolved (following verbal submissions) that an item
on the Traffic Committee Minutes of 11 September 2007 (Proposed ‘No parking’ Restriction in front
of Jonah’s Restaurant) be referred back to the Traffic Committee for consideration following
consultation with objectors to unapproved work on the nature strip carried out by Jonahs.
A copy of the previous report to the Traffic Committee is attached.
ISSUES
• All letters received in response to the report to the meeting of 11 September 2007 supported
the provision of no parking restrictions, but objected to Council allowing the unapproved works
to remain.
• All respondents have been advised that the matter is to again be presented to this meeting and
have been invited to address the Committee in respect to the No parking proposal. They have
been advised that the issue of unapproved work on the nature strip will not be discussed or
considered by the Committee as it is not a traffic related issue.
• Based on the above, that the original resident consultation complied with Council’s standard
procedures and the advice from the Palm Beach & Whale Beach Association that they
considered Council’s consultation to be appropriate, no further consultation was undertaken.
• The Palm Beach & Whale Beach Association supported the proposed No parking restriction.
• The resolution of the Committee at the meeting of 11 September 2007 was that the proposed
No parking restriction be supported.
STAFF RECOMMENDATION
1.
That the proposed parking restriction in Bynya Road was previously considered by the
Traffic Committee on 11 September 2007.
2.
That the matter has been referred back to the Traffic Committee by Council resolution of 5
November 2007.
3.
That the Traffic Committee is only able to consider traffic matters that require Council to
exercise the authority delegated to it by the RTA.
4.
That the Traffic Committee supports the implementation of ‘No parking’ restrictions
(approximately 7m) between the driveways to Jonahs (No 69 Bynya Road) to the north of
the existing 90o parking area, as shown on Council’s Plan 29 TC -07 (attached to copy of
previous report).

BACKGROUND

Jonahs Restaurant (No 69 Bynya Road) has requested Council permit an area of sealed road
reserve adjacent to the road carriageway for use by buses, less than 6m in length, to
undertake a U-turn. These buses collect and drop off customers at the Palm Beach shops
carpark (via Pacific Road and Palm Beach Road) to reduce traffic volume and on-street
parking demands in Bynya Road in the vicinity of the restaurant.
Bynya Road is restricted to buses less than 6m in length in the section near Jonahs.

For buses to be able to turn, the area must be kept clear of any parked vehicles by the
provision of ‘No Parking’ restrictions.
Following consultation with the adjacent residents and the Palm Beach and Whale Beach
Association (the majority of residents and the Association agreed with the proposed use of the
road reserve), Council granted permission for buses to turn, subject to conditions.
The principal conditions were that the area be signposted as ‘No Parking’ and that bollards
separate the turning area from an area for pedestrians (see plan attached).
STAFF RECOMMENDATION
That the Traffic Committee supports the implementation of ‘No Parking’ restrictions (approximately
7m) between the driveways to Jonahs (No 69 Bynya Road) to the north of the 90o parking areas as
shown in Plan number 29-TC-2007.
