Preamble WHEREAS by an Order in Council dated the ninth day of December One thousand eight hundred and sixty-one certain land known as the Melbourne Cricket Ground was pursuant to the provisions of an Act of the Parliament of Victoria numbered CXVII permanently reserved as a metropolitan cricket ground: AND WHEREAS by a Crown grant bearing date the seventeenth day of June One thousand eight hundred and sixty-two and enrolled in the Office of the Registrar of the Supreme Court of the Colony of Victoria in the Register of Miscellaneous Grants number 2 folium 12, in order to promote the recreation and amusement of the people and in order to provide a site or place for playing at cricket within the city of Melbourne the said land was granted to the persons named therein upon trust inter alia that the said land and the buildings thereon be at all times maintained and used as and for a place for playing at cricket and for conveniences connected therewith under and in accordance with such regulations as to the admission of the public and otherwise as therein appears: 1 Government Gazette 10.12.1861 p. 2394 No. 1117. AND WHEREAS by an Order in Council dated the ninth day of June One thousand eight hundred and seventy-three certain lands were pursuant to the Land Act 1869 permanently reserved as a site for a public park: AND WHEREAS by a Crown grant bearing date the thirteenth day of June One thousand eight hundred and seventy-three and entered in the register book of the Office of Titles volume 600 folium 119902 the said lands and the buildings for the time being thereon were granted to the Board of Land and Works and the mayor aldermen councillors and citizens of the city of Melbourne upon trust to be at all times thereafter maintained and used as and for a public park and offices and conveniences connected therewith and for no other purpose whatsoever: No. 4149. AND WHEREAS certain adjustments to the boundaries of the hereinbefore recited lands were made by the Melbourne Cricket Ground Act 1933: AND WHEREAS certain further provision with respect to the use and management of the said Melbourne Cricket Ground was made by the said Act: AND WHEREAS the accommodation provided for the public at the said ground is not adequate and in order to provide adequate accommodation for the public it is expedient to make further adjustments to the boundaries of the hereinbefore recited lands and to make other provision as hereinafter enacted: BE IT THEREFORE ENACTED by the King's Most Excellent Majesty by and with the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows (that is to say): 2 Melbourne Cricket Ground Act 1951 Act No. 5614/1951 Victorian Legislation and Parliamentary Documents 1. Short title, construction and citation This Act may be cited as the Melbourne Cricket Ground Act 1951 and shall be read and construed as one with the Melbourne Cricket Ground Act 1933 (hereinafter called the Principal Act) which Act and this Act may be cited together as the Melbourne Cricket Ground Acts. 2. Power to Trustees to prepare plans for additional accommodation (1) The Trustees are hereby authorized to prepare and submit to the Commissioner of Crown Lands and Survey plans for the provision of additional accommodation at the Melbourne Cricket Ground involving the use of land contiguous to the said Ground. (2) The plans so submitted by the Trustees to the Commissioner of Crown Lands and Survey shall be prepared by qualified architects and shall be accompanied by a plan of survey prepared by a licensed surveyor showing the land required for the purposes of such plans and the area of such land. (3) If the Commissioner of Crown Lands and Survey is satisfied that the land required for such additional accommodation is substantially the land described in the Schedule to this Act and does not involve the use of more than two acres of such contiguous land he may recommend to the Governor in Council that such land be made available for the purpose of providing such additional accommodation. 3 s. 1 Melbourne Cricket Ground Act 1951 Victorian Legislation and Parliamentary Documents s. 3 Act No. 5614/1951 3. Power to Governor in Council to revoke as to part Order in Council and Crown grants relating to park land (1) The Governor in Council may on receiving such recommendation by proclamation published in the Government Gazette so far only as relates to so much of the land described in the Second Schedule to the Principal Act as is required for such additional accommodation revoke and make null and void— (a) the hereinbefore recited Order in Council of the ninth day of June One thousand eight hundred and seventy-three; and (b) the hereinbefore recited Crown grant bearing date the thirteenth day of June One thousand eight hundred and seventy-three. (2) As from the date of such proclamation the lands described therein shall be revested in His Majesty freed and discharged from all encumbrances trusts limitations and restrictions whatsoever and shall be deemed and be dealt with as unalienated land of the Crown. 4. Re-definition of land in Fifth Schedule to the Principal Act Government Gazettes 24.1.34 p. 114; 28.2.34 p. 531. It is hereby declared that the Order in Council of the twentieth day of February One thousand nine hundred and thirty-four and the Crown grant dated the fourth day of December One thousand nine hundred and thirty-three and entered in the register book in the Office of Titles volume 5925 folium 1184828 shall be deemed and taken for all purposes to relate also to the land described in any proclamation made under this Act. 4 Melbourne Cricket Ground Act 1951 Act No. 5614/1951 Victorian Legislation and Parliamentary Documents 5. Authority and direction to Registrar of Titles to make necessary cancellations and entries The Registrar of Titles is hereby authorized and directed to make all such cancellations of or entries upon any Crown grant or duplicate Crown grant or other document as may be necessary or expedient in consequence of this Act and the holder of any such duplicate Crown grant or other document shall produce the same to the Registrar of Titles for such purpose. 6. No liability to attach to Crown No person or body of persons corporate or unincorporate shall be entitled to receive or shall receive from His Majesty any money or consideration or compensation in respect of or in any manner whatsoever arising out of any act matter or thing under this Act. __________________ 5 s. 5 Melbourne Cricket Ground Act 1951 Sch.
