AGENDA 1 July 16, 2012 – Public Hearing – Bylaw 1981 Page 2 OPENING STATEMENT OF PUBLIC HEARING PURPOSE AND CONDUCT This Public Hearing is for proposed “White Rock Zoning Bylaw 1999, No. 1591, Amendment (CD-37 – 15374 and 15382 Roper Avenue) Bylaw, 2012, No. 1981”. The purpose of Bylaw 1981 is to accommodate the development of a seven (7) unit strata townhouse project on a site of approximately 0.12 hectares (0.30 acres). At this Public Hearing the public shall be given a reasonable opportunity to be heard or to present written submissions respecting matters contained in bylaw. There is a speakers list available. Please print your name and address on this list in order to appear as a speaker before Council. Individuals will be called in the order that their name appears on the speakers list. The speaker will begin by clearly stating their name and address and then providing their comments concerning the proposal. The address of the speaker is permitted to be collected through Section 26c of the Freedom of Information and Protection of Privacy Act. If the speaker has any questions regarding the collection of their personal information, please contact the City Clerk at the City of White Rock. If you have a petition with you, please read out the information at the top of the petition and it may be submitted to the City Clerk. Anyone wishing to speak at this meeting must be acknowledged by the Chair. Each speaker will be given a maximum of five (5) minutes to speak. Decorum must be maintained at all times, this includes refraining from applause, booing or heckling. Members of Council may, if they wish, ask questions of you following your presentation. However, the main function of Council members this evening is to listen to the views of the public. It is not the function of Council at this Public Hearing to debate the merits of the proposed application with individual citizens. It is also not the time for the speaker to be asking questions of the administration regarding the application. Any person who wishes to present a written submission to Council may do so. All those submissions will be retained by the City Clerk and copies of submissions are be available from her on request following the meeting. The “White Rock Zoning Bylaw, 1999, No. 1591”, as amended is further amended: (1) (2) 2. by adding to Part 8 of the Table of Contents the words “837 CD-37”. by adding, after Section 836 “Comprehensive Development Zone CD-36” of Part 8, the attached Schedule “2” to this amending bylaw, as Section 837 “Comprehensive Development Zone CD-37”. Location of Permitted Uses The location of permitted use shall be in accordance with the Plans and as follows: (a) A townhouse use is permitted in one or more principal buildings on the lot; (b) An accessory home occupation use shall comply with the provisions of Section 404. 837.3 Number of Dwelling Units / Gross Floor Areas / Lot Coverage The maximum number of dwelling units and lot coverage of buildings and structures shall be in accordance with the following: (a) Maximum No. of dwelling units = seven (7) (b) Maximum Lot Coverage = 38.5% 837.4 Regulations for Size, Shape, and Siting of Buildings and Structures Reference to a Building refers to the building labelled that specific number on the Plans. As indicated on the Plans, principal buildings are identified as Building #1 and #2: (a) Maximum height of buildings, and property line setbacks follows: (i) Maximum height of building #1 = 11.5 metres (37.65 feet) (ii) Maximum height of building #2 = 12.2 metres (40.0 feet) (iii) Setback from front (north) lot line = 6.0 metres (19.7 feet) (iv) Setback from rear (south) lot line = 6.0 metres (19.7 feet) (v) Setback from interior (east) lot line = 1.5 metres (5.0 feet) (vi) Setback from interior (west) lot line = 1.5 metres (5.0 feet) (b) Maximum projections into the above property line setback requirements shall be as outlined in Section 403, except that: (i) An open deck or balcony may extend not more than 0.0.46 metres (1.6 feet) into an interior side yard; (ii) an open deck or balcony may extend not more than 1.83 metres (6.0 feet) into a front or rear setback.
