AN ORDINANCE ANNEXING CERTAIN LANDS PARTICULARLY DESCRIBED IN SECTION 2
OF THIS ORDINANCE OF THE CITY OF MOSCOW, IDAHO; PROVIDING THAT THE CITY
MAP AND THE COMPREHENSIVE PLAN OF THE CITY OF MOSCOW, IDAHO, BE A MENDED
ACCORDINGLY AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE OF THIS
ORDINANCE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF MOSCOW, IDAHO:
WHEREAS, the land described in Section 2 of this Ordinance is land
lying adjacent to the City of Moscow, Idaho; and whereas said land is intended and can reasonably be assumed to be used for the orderly development
of the City of Moscow, Idaho; and whereas the owners of said land have requested in writing of the Council of the City of Moscow, Idaho, that said
land be annexed to the City of Moscow, Idaho:
SECTION 1.
ANNEXATION.
That the land described in Section 2 of this
Ordinance be and the same hereby is annexed to the City of Moscow, Idaho,
and that said land be and the same hereby is declared a part of the City of
Moscow, Idaho.
SECTION 2.
DESCRIPTIONS.
That the land annexed to and declared to be
a part of the City of Moscow, Idaho, by this Ordinance is situated in Latah
County, State of Idaho, and is more particularly described as follows, totofit:
A parcel of land located in the NW 1/4 of Section 9, T 39 N, R S W,
Boise Meridian, said tract being also Lot "C'' of Schumacher's Addition
to Latah County, Idaho.
This tract contains 19.9 acres.
And also:
A parcel of land located in the NW 1/4 of Section 9, T 39 N, R S W,
Boise Meridian, being that portion of Lot "D" of Schumacher's Addition
to Latah County, Idaho more particularly described as follows:
Beginning at a point which is 43S.68 feet South and 70S feet
S 89° 20' E of the Northwest corner of Section 9, T 39 N, R S W,
Boise Meridian, said point being also the Northeast corner of
Lot 10 of the Cosner Addition; thence S 89° 20' E 12S feet to
a point which is also the Northeast corner of the tract deeded to
James G. Bosse in Book of Deeds 1S8, page 619 of records of Latah
County; thence South, on the east line of said tract, 100 feet to
the South line of Lot "D" of Schumacher's Addition to Latah County;
thence S 89° 20' E 820 feet to the Southeast corner of said Lot "D"'
thence North, on said East line of said Lot "D'', 267. OS feet to the
Northeast corner of said Lot "D", thence N 89° 20' W 840 feet to a
point which is also the Northeast corner of the tract deeded to
Edward A. Broemme1ing in Book of Deeds 162, page 310 of records of
Latah County, thence South, on the east line of said tract, 117.S4
feet; thence N 89° 20' W 10S feet; thence South SO feet to the
point of beginning. This tract contains 1S.54 acres, more or less.
And also:
A parcel of land located in the NW 1/4 of Section 9, T 39 N, R 5 W,
Boise Meridian, being that portion of Lot "D" of Schumacher's Addition
to Latah County, Idaho more particularly described as follows:
Beginning at a point which is 385.68 feet South and 660.00 feet
S 89° 20' E of the Northwest corner of Section 9, T 39 N, R 5 West,
Boise Meridian; thence North 117.54 feet, thence S 89° 20' E 50. 0
feet; thence South 117.54 feet; thence N 89° 20' W 50.0 feet to
the point of beginning. This parcel contains 0.134 acres.
SECTION 3.
The City Engineer of the City of Moscow, Idaho, be and is
hereby ordered and directed to make the necessary amendments to the Official
Zoning Map and Comprehensive Plan of the City of Moscow, Idaho, which map
and plan are on file at the City Hall at the City of Moscow, Idaho, to provide
that said area is to be henceforth a part of the City of Moscow, Idaho.
SECTION 4.
PUBLICATION.
That this Ordinance shall be published in one
(1) issue of the official newspaper of the City of Moscow, Idaho.
SECTION 5.
EFFECTIVE DATE:
That this Ordinance shall be effective
from and after the date of its passage and approval and the publication thereof
in the aforesaid official newspaper of the City of Moscow, Idaho.
