Minutes of the 42nd PAB Meeting under ICPS held on 28th June 2012 to discuss the
financial proposal of Maharashtra
The 42nd PAB meeting was held under the Chairpersonship of Joint Secretary, Ministry of
Women & Child Development on 28th June 2012 to discuss the financial proposal for release
of grants for 2012-13 under ICPS for Maharashtra. The List of officials attending the PAB is
annexed.
2. At the outset, the Chairperson welcomed the officials present and requested the Principal
Secretary, Women and Child, Govt. of Maharashtra to present the progress of ICPS in the
State along with the financial proposal for ICPS. A copy of the presentation is at Annex-A.
The status of various interventions under ICPS was presented with respect to the projected
outcomes of the Scheme and the monitoring reports received from the State as under:
3. SERVICE DELIVERY STRUCTURES:
The State informed that all the service delivery structures i.e. SPSU, SCPS and SARA at
State level are in place and all of these are running from government building in Pune. The
State was advised to include representatives of NGOs, academicians etc as members in
SCPS. It was informed by the State that five staff has been recruited at SCPS, six at SPSU,
and two at SARA. The DCPUs though notified are yet to be made functional. It is expected
that staff will be recruited in five districts by August 2013 and in the remaining 30 by
September 2013. Data entry operators were called for interview but no one was selected.
Accounts Officers will be outsourced and the process of recruitment is in progress. The State
informed that the State Child Protection Committee is not formed and were asked to
constitute the same early.
INNOVATIVE PROJECTS: The State Government has proposed an innovative project for
developing a child tracking system at the SCPS and requested for Rs 23 lacs for the same.
State requested to be included in the pilot project of NIC i.e Child Track. The
State has
proposed funds for design and development of the software, for hardware and AMC of the
computer/server. The PAB informed that NIC is already in the process of developing
software and the computers are already being provided under the Nonrecurring grant for all
service delivery structures. Therefore, grant proposed by the State cannot be provided under
the innovative proposal. However, grant for data entry, as and when proposed by the State
can be considered in the Ministry.
The State reported that it has to organize the training for CWC and JJB members and other
functionaries of ICPS including the staff and superintendents of Homes, open shelters and
SAA. Chairperson suggested that the structured training module developed by NIPCCD
should be used for training in the local training institutes identified. There should be no
compromise on quality of the trainings delivered.
On Principal Secretary, Maharashtra’s request for an enhancement of staff salaries under
ICPS, they were advised to meet additional requirement from their own resources.
It was informed that the State has developed a Performa to make an assessment of the needs
of children at the Child Care institutions for the Superintendents who will send in their
proposal to the SCPS for release of funds. While appreciating the efforts it was suggested
that all proposals should be presented before the Project Sanctioning Committee of the State,
which has been constituted.
4. STATUTORY SUPPORT SERVICES:
The State informed that CWCs and JJBs have been constituted in all the 35 districts but data
entry operators are yet to be appointed in all CWCs and JJBs. The State was advised to
appoint the DEOs expeditiously, especially in the view of the Child Tracking System being
implemented under ICPS. All the CWCs and JJBs have been provided with necessary
furniture and equipments.
During the monitoring visit by MWCD team it was noted that the tenure of the CWCs is over
and the process of selection of the new CWCs is in progress. The earlier CWCs are still
functioning but without any formal order. State Government was advised to expedite the
selection and meanwhile, issue an order for continuation of the existing members. The State
also informed that the existing committee for selection of CWCs and JJBs is not headed by a
retired Judge. The process is carried out by the State Advisory Board. It was suggested that
the State should have a Selection Committee as per the JJ Act constituted at the earliest.
The Chairperson raised the issue of large number of pending cases at CWCs. The State
informed that this is mainly because of delay in getting a police escort for repatriation. This
issue needs to be tackled in the State.
It was noted by the monitoring team that there are no waiting rooms for children and parents
at the JJBs. The State assured this is being taken care and space is being organized where the
JJBs are located in the Homes.
The State also informed that Special Juvenile Police Units have been set up in all 35 districts
and each district has a designated Juvenile Welfare officer. The PAB suggested that the State
should also provide lists of Juvenile/Child welfare officers, fit institutions, and
educational/vocational training institutes to the CWCs and JJBs.
5. INSTITUTIONAL CARE:
The State has undertaken an exercise for rationalization of Homes and numbers of Homes
have been reduced. Inspections have also been done by the SCPCR, SAB and MSW students.
Most of the Institutions that were run like hostels are in the process of being handed over to
the Education department. In 2011-12 the State has also closed down 60 institutions after
inspections.
It was observed by the PAB that facilities for children in need of care and protection and
Juveniles in conflict with the law in the Homes are combined. It was suggested that as per the
JJ Model Rules 2007, the Homes for juveniles in conflict with law and children in need of
care and protection should be clearly segregated, even if they are in the same campus.
The State has requested grants for 32 Children cum Observation Homes, 2 Observations cum
Special Homes and 1 After Care Home run by the Govt. for which grants had been provided
in 2011-12.
For NGO run Homes, the State has requested grants for 49 Children cum
Observation Homes, 2 Special Homes and 1 Aftercare Home. Grants have been requested for
5 additional Aftercare Homes. Regarding the request for Aftercare Homes, PAB felt that the
Aftercare program should now run as per the Guidelines issued by the Ministry. State was,
therefore, advised to plan the program accordingly from the after care fund provided for each
district. To enable some transition period grants were approved to the two Aftercare Homes
already being supported for a period of one year only, i.e upto March’13.
The PAB also advised the State to develop linkages with the Corporate Social Responsibility
programs as well as vocational training institutes providing training through the Labour
department and other Govt. Departments such as Tribal Affairs, so that market driven
training followed by a certificate can be provided.
The State has also requested grants for up gradation of 22 homes. The Up gradation grant
was agreed to by the PAB in principle subject to the State providing details for the changes,
repair etc along with the PWD estimates.
As many of the Homes are underutilized still, the Chairperson advised the State to propose
clusters of Homes or integrated campus with separate facilities for children in need of care
and protection and juveniles in conflict with the law keeping in view the anticipated
utilization.
6. OPEN SHELTERS:
The State has requested grants for 9 open shelters including 2 which have received grants in
the previous year. It was informed that the 2 other shelters that were supported last year have
not been proposed for current year due to some legal issues. The PAB while according in
principle approval for the additional 7 shelters advised the State government to undertake a
need assessment, identify NGO partners and the locations for setting up Open shelters. The
proposal for these 7 new Open shelters will be considered in the Ministry after the said
exercise is completed by the State.
The monitoring reports submitted by the State had indicated that there are many children of
below 5 years of age at the Open Shelters. The State was advised to make an assessment of
the family details of such children, and if found without families, the State may initiate action
to shift them to the SAAs.
7. NON INSTITUTIONAL CARE:
The State requested grants for 17 NGO run SAAs. No grant have been requested for 23
RIPAs. There are 34 more adoption agencies which are at present being assessed. CARA
informed that 12 NGOs are not updating data on CARINGS. State was requested to take up
this issue with them. The PAB was informed that many children living in SAAs have never
being produced before CWCs. The State was asked to produce all children staying at SAAs,
including those who came to the SAA before the formation of CWCs, before the CWCs to
obtain further orders for children who are now 8 to 10 years of age and are not going for
adoption. Such children may be shifted to Children’s homes.
The State has requested for Sponsorship grant for 35 districts under the DCPU.
8. BALANCE/UNSPENT AMOUNT:
It was reported that 1036.60 lacs were spent from the grant received in the year2011-12. The
unspent amount is 138.40 lacs. The State has made a provision of Rs 136 crore in the budget
for year 2012-13. PAB requested the State to formally convey the State Share approved by
the State government to the Ministry.
9. DECISIONS TAKEN BY PAB: The following decisions were taken and approvals
granted by PAB:9.1 SERVICE DELIVERY STRUCTURES:

11 months for Staff of SPSU, SCPS and SARA i.e from May 2012.

8 months for 5 DCPU i.e from August 2012.

7 months for 30 DCPU ie. from September 2012 subject to the appointment of the
staff. Grant for DCPU would include Sponsorship and Aftercare funds as well as
After care fund.
9.2 STATUTORY SUPPORT SERVICES:
Recurring grant for all 35 CWCs and JJBs was approved for complete year.
9.3 INSTITUTIONAL CARE:
were approved for following Homes (As per list A attached) for complete year as
per ICPS norms.





In principle approval was accorded for provision for data entry when specific demand is sent
by the State.
