List of the members present during the meeting is attached separately. Opening Remarks by the Chairman: Chairman welcomed the members to the 50th SEAC-2 Meeting. Discussion Point: Project proponents who remained absent twice or more are delisted from the waiting / pending list of SEAC II as per OM issued by MoEF. However, PP, if interested, may submit online application with latest information of the project including Form 1 & 1A, layout plans, design and other applicable documents with latest environmental data. All concerned PPs are requested to take note of the above and do the needful accordingly. Consideration of projects for Environmental Clearance: Item No.1 Application for S.No.196/20, EC of our proposed 196,/21,196/12,196/7, construction 196/8, 196/9 project at at village Velholi, Shahpur, Thane PP was absent; hence the project is deferred. Item No.2 Application for EC for EL-25 project at TTC Industrial Area, MIDC, Navi Mumbai 400705 PP was absent; hence the project is deferred. Item No.3 Application for revalidation & amendment in EC for project “Super Specialty Apollo Hospital” at plot no.13, sector23, Uran Road, CBD Belapur, Navi Mumbai 400614 Representative of PP, Lalit Verma & Sachin Borse were present during the meeting. PP informed that they have received earlier EC vide letter dated 21/03/2009 for total built up area of 54,060 m2. Now proposal is for revalidation & amendment. It is noted that PP has undertaken construction after validity period of EC. However, local body has accorded Occupation Certificate to the project. Committee also noted the letter of Environment Department clearly stating that work should be completed as per EC & within its validity period. Considering above, Committee observed that PP has violated the conditions stipulated in the EC. PP stated that total plot area is 14,784 m2 & total construction area of the project is 60,724.59 m2. During discussion following points emerged: 1. PP to submit details of the construction undertaken after validity period of EC. 2. PP to submit detailed statement for construction completed as per approvals, earlier EC and proposed amendment/expansion. 3. Further, as per NGT order, Committee decided to refer the matter to Environment Department/SEIAA for action on alleged violation. Hence, Environment Department/SEIAA, after due verification, may initiate credible action for alleged violation under Environment (Protection) Act, 1986. Further, the proposal will be appraised after due examination and appropriate decision taken by the SEIAA /Environment Department on alleged violation. In view of above, the proposal is deferred and shall be considered afresh after the compliance of above observations submitted for reconsideration. Item No.4 Application for EC for Proposed Residential development at Plot No. 4, Sector-23, Kharghar, Navi Mumbai, District – Raigad, Maharashtra PP was absent; hence the project is deferred. PP informed that they have received earlier EC vide letter dated 26/12/2014 for total construction area of 1,38,220.548 m2 for phase-I. PP stated that ToR for the project was approved by SEAC II in its 12th meeting for the total plot area of 4,37,961 m2. Now, EIA is submitted for phase II. PP informed that they have completed construction admeasuring 43,263.74 m2 as per EC. Further, PP informed that EIA appraisal was done in 29th SEAC-2 meeting for total project and for construction work of phase-I comprises of 33,015 m2. After deducting, the development area of phase I, DP reservation of road, amenities etc., the plot area available for development is 2,74,957.51 m2 out of which PP desired to develop and carry out construction work on plot area of 34,132 m2 in phase II. The proposed construction in phase II, consists of one residential in phase II, consists of one residential building with 8 wings & 14 shops. The project proposal was discussed on the basis of presentation made and documents submitted by the proponent. PP submitted EIA report for phase II. Committee appraised project for phase II and cumulative studies of impacts of phase-I on the project area. All issues related to environment, including air, water, land, soil, ecology and biodiversity and social aspects were discussed. PP stated that total plot area is 4,04,946 m2 & total construction area of the project is 2,90,662.360 m2. Committee noted that the project under 8a (B1) category of EIA Notification, 2006. Proper design of storm water drainage considering all phases in the entire project area should be done to ensure that it should not overload outside storm water drain & submit along with storm water drainage calculations. 4. PP to submit cumulative impacts of phase-I and phase-II while developing EIA for third phase. 5. PP to achieve 10% energy savings through renewable component & submit revised energy calculations indicating the same. 6. PP to ensure that BOD of the treated water should be 5 mg/lit. PP informed that they have received IOD on –15th Nov 2010, 8th Feb 2011, 29th March 2014, and 29th March 2016 Rehab & Sale component respectively. PP informed that they have received earlier EC vide letter dated 17/01/2013 for total construction area of 1,34,021 m2. PP informed that they have received earlier EC vide letter dated 24/12/2014 for total construction area of 40,498 m2. PP informed that they have not initiated construction yet. Expansion is due to increase in eligible tenements. PP informed that they have received LOI dated 30/11/2012 for the proposed amendment from SRA. It is noted that validity of EC is already over. It appears that some construction have been completed after validity period. PP stated that total plot area is 32,070 m2 & total construction area of the project is 42,353.05 m2. Committee noted that the project under 8a (B2) category of EIA Notification, 2006. During discussion following points emerged: 1. PP to submit chronology of the permissions received from planning authority for completed construction. Also submit copies of the permissions. PP to submit revised water budget as calculations for recycling of waste water are not matching. 5. PP informed that rain holding water harvesting tanks have half day storage capacity only. The proposal was discussed on the basis of the draft ToR as presented by the PP. PP to ensure that tenement size of rental component should be 320 ft2 or as decided by govt. And accordingly environmental parameters shall be worked out. 2. NA order of entire project should be submitted at the time of EIA presentation. 3. Thick plantation as buffer zone around old national highway and railway line should be proposed. 4. PP to carry out survey of existing storm water and sewer lines and its connectivity to the proposed project. 5. PP to retain existing trees. 6. Cumulative impacts of all phases should be considered while preparing EIA, EMP & DMP. 7. It is observed that there is no sewer line & no storm water drainage lines constructed up to the project site. Therefore, PP to ensure that no possession shall be given before completion of the sewer lines & storm water drainage line and permission for the connection to the same by the competent authority. Local body to ensure the same. 8. PP to submit letter of commitment for drinking water to the project from Municipal Corporation. 9. Further, PP informed that entire treated water should be reused / recycled in the project itself to ensure the zero discharge outside the project boundary. PP to submit details accordingly. PP to submit detailed water budget indicating fool proof mechanism achieving zero discharge. 10. PP to ensure that BOD of treated water should be less than 5 mg/lit. PP to present appropriate treatment technology to achieve the same. 11. Proper design of storm water drainage considering all phases in the entire project area should be done to ensure that it should not overload outside storm water drain & submit along with storm water drainage calculations. Item No.54 Application for EC for Slum Rehabilitation Scheme “Ambewadi CHS” at village Hariyali on CTS No.14A Part, 16, 17B Part & 23 Part Vikhroli (W), Mumbai, State – Maharashtra PP stated that total plot area is 22,658.40 m2 & total construction area of the project is 1,49,080.98 m2. During discussion following points emerged: 1. It is observed that there are no CFO permissions, approval for plans, Water NOC, Sewage and storm water NOC. PP to submit any one of the above approval. 2. Sindhudurg PP, Rajiv Kulkarni was present during the meeting along with environmental consultant M/s Ultratech. PP informed that name of project has been changed from “Fussion” to “60 miles Goa” PP informed that Phanasgaon is listed in eco sensitive area as per HLWG report. Further, PP informed that the site is an open land having some mango and cashew cultivation. There is one old farm structure on site. Project site is approved for the Special Township. PP also stated that they have received Locational Clearance from Government of Maharashtra. Further, PP informed that project is proposed to be developed in 10 phases in 10 years timeframe. The project proposal was discussed on the basis of presentation made and documents submitted by the proponent. It was noted that the proposal was earlier considered in the 58th meeting of SEAC I held in June 2012 & further in 45th SEAC II meeting. Committee also noted site visit report dated 21/05/2016. All issues related to environment, including air, water, land, soil, ecology and biodiversity and social aspects were discussed. PP further stated that total plot area is 4,64,290 m2 & total construction area of the project is 1,02,109.63 m2. Committee appraised the project under 8a (B2) category of EIA Notification, 2006. Consolidated statements, form 1, 1A, presentation & plans submitted are taken on the record. During discussion following points emerged: 1. PP submitted copy of LOI dated 02/09/2016. 2. PP to submit revised biodiversity studies since it is not complying with the observations of site visit and conditions stipulated regarding ecosystem services of the existing flora, fauna, impacts of the proposed activities on ecology & ecosystem services and restoration measures. 3. PP to submit revised water budget since the calculations submitted are not matching with total water requirements, output & intended use. 4. PP to justify how project is going to be zero discharge project during monsoon season with detailed water budget calculations & proposed mechanism. 6. PP to submit revised hydrological studies considering rational methods, time series, contour maps etc. since calculations indicate insufficient capacity to store storm water. 8. Proper design of storm water drainage considering all phases in the entire project area should be done to ensure that it should not overload outside storm water drain & submit along with storm water drainage calculations. 9. PP to undertake wind mapping in case wind mills are proposed to be installed and submit. 10. PP to provide vermi-composting units for municipal solid waste. 11. It is observed that DMP is not linked with hydrological and ecosystem studies. PP to revise same accordingly. 12. Landscape plan was not prepared properly as mentioned in site visit report. It was indicated that existing tree cover should be mapped and superimposed on proposed project layout to ensure the density of existing and proposed trees. 13. Item No.56 Proposed S.R.Scheme on Plot bearing CTS No.1(pt) of village Ghatkopar (East), Mumbai for Hanuman Nagar Vikas Mandal. Representative of PP, Gururaj Mirjee & Architect Sujata Patil were present during the meeting along with environmental consultant M/s Fine Enviro. The project proposal was discussed on the basis of presentation made and documents submitted by the project proponent. PP stated that total plot area is 64,219.67 m2 & total construction area of the project is 5,14,870.37 m2. Ground coverage of the project is 50.71%. Committee appraised the project under 8a (B1) category of EIA Notification, 2006. PP submitted compliance of all 23 points raised by Committee in 33rd SEAC II meeting. Committee noted compliance submitted by PP and taken on record. It was noted that there are 9 m drive ways around the project site. Project has 4 entry & exit points at the time for evacuation of all the vehicles would be 20-27 minutes. Detailed traffic analysis, transportation study and trip generation are undertaken. Upper hill has higher slope (approximately 1V:1.5H). It has exposed rock at many locations Soil cover exists to a depth of 1m to 2m. Full of trees with some of those being quite old: indicating the slopes being stable for long time in history. Lower part is relatively flatter (< 1V:3H slope). The construction site is further on lower side of this part. Fill soil to a shallow depth ranging from 1.5 to 3 m. Soil below is of good quality (medium stiff to hard clay), with its depth ranging from 4 to 14 m Site is on eastern side of hill, opposite to the direction of Minutes of the 50th meeting of the SEAC - 2 (MMR) held on 6th, 7th, 8th & 9th September 2016 Page 94 of 110 regards to impacts on stability & ecology. The study should cover the entire hill and not only any specific portion limited to project area. PP to obtain prior permission of the competent authority for hill cutting, if any, in the project area. 4 PP to submit project specific Disaster Management Plan with SOPs, especially response plan and SOPs for each hazard & Environmental Management Plan along with item wise costing. 5 Detailed biodiversity validated/reviewed by should be submitted. 6 study, expert, PP, if applicable, to obtain NOC from Wild Life Board in terms of OM of MoEF dated 30/03/2015. Further, it is informed that project falls within 4 kms of SGNP. PP & concerned Municipal Corporation to ensure the compliance of the NGT order dated 03/12/2015 in the application MA.No.125/2014 before issuing commencement certificate for further construction permissions in the area 7 PP, if applicable, to leave clear cut side margin of 6 m from the boundary of the plot and open space and non-paved RG area should be on ground as per the orders of monsoon: less susceptible to rain induced issues. Western side of hill has a number of high rise constructions next to big hill cuts without any signs of distress. Drainage pattern analysis is used to design storm water drainage system on site. A hired environmental agency reported that the impact on ecology is negligible (Impact only during construction phase that too in the form of dust) if the cutting is limited within the actual project site. This claim appears reasonable looking at the current conditions on the site and the requirements of cuttings being mainly for placing the foundations within the actual site. Foundation of the building is being placed at depth of 4 to 14 m below existing ground level at different locations. Local excavation required for foundations is in a large region of milder slope (< 1V:3H slope): no significant effect on stability of hill slope. The excavation for foundations will exist only during the construction period. It will be filled back to the finish level after construction. Buildings are placed 15 meters to 20 meters away from the site boundary. Hence, any local distress during excavation will remain within the site during construction. Terraced construction methodology with minimum possible excavation in rest of the area The stability analysis of the hill slope is performed with due consideration to the cutting/filling on the site and building loads. It is found that the hill slope is quite stable with no significant impact from proposed construction. Project specific DMP with revised SOPs, Response plan and EMP along with item wise costing is submitted. We have submitted our application along with detailed biodiversity report to the Scientist in charge of Zoological survey of India for reviewed and validation. We have applied for clearance from Forest /wildlife vide letter dated on 03-8-2015. Further the site visit by Chief conservation of Forest (S.G.N.P) was conducted on 2nd December 2015 and the matter is under process. However As per Annexure-II of draft notification published by MOEFCC u/no. S.O.229(E) dated 22/01/2016 , the plot under reference falls outside proposed eco-sensitive zone . Open space and non –paved Rg area is on ground as per the order of Hon’ble Supreme Court (Civil Apeal No. 11150 of 2013 and SLP (civil) No. 33402/2012) dated 17h December 2013 and clear cut side margin of 6 mtr is kept from the boundary of the plot. (ii) Submit development strategy, phasing of the project along with infrastructure and facilities / utilities. Detailed total station map indication plot boundary, construction area boundary, green area boundary, etc. (iii) Submit excavation details, quantity of excavated material, top soil quantity and its preservation. (iv) Examine in detail the site with reference to impact on infrastructure covering water supply, storm water drainage, sewerage, power, etc., and the disposal of treated/raw wastes from the complex on land/water body and into sewerage system. (v) Examine in detail the carrying capacity of existing sewer line, drains etc. (vi) Examine details of land use around 2 km radius of the project site. Analysis should be made based on latest satellite imagery for land use with raw images. (vii) Study and submit details of environmentally sensitive places, rehabilitation of communities and present status of such activities. (viii) Examine baseline environmental quality along with projected incremental load due to the project. Environmental data to be considered in relation to the community development would be (a) land, (b) groundwater, (c) surface water, (d) air, (e) biodiversity, (f) noise due to the traffic, (g) socio economic and health etc. (ix) Study the socio-economic situation of the project area and its surroundings and their impact on the project design and operation. Socio impact Assessment studies (SIA) shall be carried out specific to the project area. PP shall take into confidence / consent people residing in the project and surrounding area and objections / suggestions if any received may be submitted to SEIAA / SEAC-II. (x) Examine topography rainfall pattern, soil characteristics, and soil erosion. (xi) Study the hydrological and geo-hydrological conditions of the project area. Including a contour plan indicating slopes and showing drainage pattern and outfall. Examine in detail the carrying capacity of existing storm water drainage line. Possibility of flooding in and around the project site. (xii) Storm water drainage and outfall may be described through contour map and slopes of the project area and its surroundings. Rain water harvesting proposals should be made with due safeguards for ground water quality, aquifer level, soil permeability, justification for suitable / appropriate rain water harvesting method and details of the selected option indicating locations on the project map. Solid Waste Management (xviii) Examine details of Solid waste generation, type and quantity, treatment and its disposal. (xix) Common facilities for waste collection, treatment, recycling and disposal (all effluent, emission and refuse including MSW.) (xx) Examine the location of solid waste treatment and disposal sites. Flora and fauna (xxi) Study the existing flora and fauna of the area and the impact of the project on them. Energy (xxii) Since the project is a building construction and area developmental activities, examine electrical load, energy conservation measures etc. and saving in energy. (xxiii) Examine and submit details of use of solar energy and alternative source of energy to reduce the energy consumption. (xxiv) DG sets are likely to be used during construction and operational phase of the project. Emissions from DG sets must be taken into consideration while estimating the impacts on air environment. Examine and submit details. (xxv) Provide for conservation of resources, energy efficiency and use of renewable sources of energy in the light of ECBC code. Application of renewable energy/alternate energy, such as solar energy, wind energy may be described with detailed analysis and exploring the possibility of such installations. Traffic and transportation (xxvi) A detailed traffic and transportation study should be made for existing and projected passenger and commercial traffic as the project is a mixed development including residential and commercial development. (xxvii) Examine the details of transport of materials for construction which should include source and availability. (xxviii)The evaluation of impacts should be analyzed depending upon the nature (positive and negative), duration (short term and long term) reversibility, and magnitude (negligible, low, medium, high), etc. of the impacts based the objective assessments. (xxix) Examine road/rail connectivity to the project site and impact on the traffic due to the proposed project. Present and future traffic and transport facilities for the region should be analysed with measures for preventing traffic congestion and providing faster trouble free system to reach different destinations in the city. (xxx) Traffic management plan including parking areas may be described. Traffic survey should be carried out on week days and week end. (xxxii) Examine and submit the details of Noise modelling studies and mitigative measures. (xxxiii) Examine noise levels - present and future with noise abatement measures. (xxxiv)Noise pollution has always been a major concern for developmental projects during the construction and operational phase. It is suggested that noise monitoring should be carried out at critical locations at the surrounding areas may be incorporated in environmental monitoring programme during the whole operational phase of the project. (xxxv) Natural and artificial noise barriers may be considered for critical locations. (xxxvi)A thick green belt should be planned all around the project site to mitigate noise and vibrations to the nearby settlements. The identification of species/plants should be made based on the botanical studies. (xxxvii) Landscape plan, green belts and open spaces may be described. (xxxviii) Examine the details of afforestation measures indicating land and financial outlay. Building materials (xxxix) Use of local building materials should be described. The provisions of fly ash notification should be kept in view. Disaster Management Plan (xl) Risk assessment and disaster management plan should also include Fire, Earthquake, local floods, and any other natural disaster. Environmental Management and monitoring Plan (xli) Environmental Management Plan should be accompanied with Environmental Monitoring Plan and environmental cost and benefit assessment. Examine separately the details for construction and operation phases both for Environmental Management Plan and Environmental Monitoring Plan. (xlii) Make assessment of any regulatory measure in view of the environmental and social impacts of the project (such as unauthorized development in and around the area). Corporate Social Responsibility (xliii) Submit the details of CSR activities. Provisions shall be made for education, health and vocational training programs. Other details as indicated in Appendix III of EIA Notification 2006 should also be attended. A detailed draft EIA/EMP report should be prepared as per the ToR and should be submitted to the SEIAA /SEAC, MMR as per the Notification.
