A full-time employee whose non-working day or RDO falls on a
public holiday shall receive by mutual agreement either:

Payment of an additional day’s wages, or

The addition of one day to their annual holidays; or

Another day off with pay within 28 days after the public holiday
falls, or during the week prior to the public holiday.

Casual employees do not receive a benefit for a public holiday on
which they are not rostered and do not work.
Your Agreement provides that work after 6.00pm on the Thursday
before Good Friday is voluntary, subject to certain conditions being
met. The conditions are:

Full-time and part-time employees need to advise Woolworths at
least four weeks prior to the Thursday before Good Friday that
they do not wish to work after 6.00pm on that day;

Woolworths will then seek volunteers to work these times at least
14 days before the day to finalise rosters, and advise employees
at least seven days before the day;

If Woolworths cannot get enough volunteers to work, they can
require employees to work their normal roster; and

Where an employee’s request not to work is granted, the
hours need to be made up as provided in your Agreement
(subclause 4.10).
The SDA has worked hard over many years to ensure
that our members get time off work to spend with their
families on special occasions, such as over Easter.
This leaflet explains the public holiday entitlements
that apply to you over the 2017 Easter period and
on Anzac Day.

& Trading Hours
IN NEW SOUTH WALES
Part-time employees will receive the benefit of a public holiday
for a non-rostered day if they work an average of 20 starts per
four-week cycle, or if they work an alternating roster and the public
holiday falls on a day on which they work in any week of their roster
cycle.

This leaflet explains the public holiday entitlements and trading hour
arrangements specifically for Woolworths Supermarkets employees
working in New South Wales over Easter and on Anzac Day.
GOOD FRIDAY
Good Friday is a public holiday and a restricted trading day in New
South Wales.
Woolworths Supermarkets has informed the SDA that they will not be
trading on Good Friday. Permanent employees who would have been
rostered to work on Good Friday will be given the day off with pay at
the ordinary single hourly rate.
EASTER SATURDAY
Easter Saturday is a public holiday. Work on the day is voluntary, and
any work performed will be paid at the public holiday rate of pay.
EASTER SUNDAY
Easter Sunday is a public holiday and a restricted trading day in NSW.
Permanent employees who would have ordinarily been rostered
to work on Easter Sunday will be given the day off with pay at the
ordinary (not the Sunday) single hourly rate of pay.
Woolworths Supermarkets can only trade on Easter Sunday if they
have a restricted trading exemption. Without an exemption, your store
must close on Easter Sunday.
If your store can open, work on the day is voluntary, and any work
performed will be paid at the public holiday rate of pay.
EASTER MONDAY
Easter Monday is a public holiday. Work on the day is voluntary, and
any work performed will be paid at the public holiday rate of pay.
ANZAC DAY
Anzac Day is a public holiday. Anzac Day is also a restricted trading
day prior to 1.00pm. Woolworths has informed the SDA that all
supermarkets will be closed for trade prior to 1.00pm.
Work on the day is voluntary, and any work performed will be paid at
the public holiday rate of pay.
TRADING HOURS
NSW legislation operates to place certain restrictions on shop trading
hours over Easter and on Anzac Day. Restrictions apply on Good
Friday, Easter Sunday and prior to 1.00pm on Anzac Day.
Woolworths has informed the SDA that all supermarkets will be closed
for trade on Good Friday and prior to 1.00pm on Anzac Day.
If your supermarket is granted an exemption to trade on Easter Sunday,
it is a condition of the exemption that the supermarket must be staffed
by employees who have freely elected to work on that day. The Retail
Trading Act provides that there must be no coercion, harassment, threat
or intimidation by or on behalf of your manager.
There are no restrictions on shop trading hours on Easter Saturday,
Easter Monday or after 1.00pm on Anzac Day.
WHAT DO I GET PAID IF I WORK ON A PUBLIC HOLIDAY?
Your Agreement provides that all work performed on a public holiday is
paid at the rate of double-time-and-a-half. All work performed on a public
holiday must be for a minimum payment for three hours of work.
DO I HAVE TO WORK ON A PUBLIC HOLIDAY?
Your Agreement provides that all work performed on a public holiday is
voluntary. Full-time and part-time employees who are rostered on but
exercise their right not to work receive the benefit of the public holiday by
having the day off and being paid for the day based upon their ordinary
single hourly rate of pay for the hours normally rostered to work.
CAN MY EMPLOYER CHANGE MY ROSTER
TO AVOID PAYING ME A PUBLIC HOLIDAY BENEFIT?
No. Clause 7.17 of your Agreement provides that an employee’s roster
cannot be changed simply to avoid the payment of a penalty or other
applicable benefit.
If your roster is changed to your detriment over Easter/Anzac Day, or if
you are not paid correctly, you should contact the Union immediately.
If you are rostered to work a set number of hours on a public holiday
but you are sent home early without your consent, it is the Union’s
position that you must still be paid for the total number of hours that
you agreed to work. This applies even to casuals.
If you are sent home early and not paid for the full hours you are
contracted to work, you should contact the Union without delay.
DO I GET PAID IF A PUBLIC HOLIDAY
FALLS ON MY NON-ROSTERED DAY?
Your Agreement provides that all full-time and part-time employees
who work an average of five starts per week are entitled to receive the
benefit of a public holiday that falls on their non-rostered day.
However, as determined by the original public holidays test case, Easter
Saturday and Anzac Day are exceptions.
This means that if you are not rostered to work on Easter Saturday or
Anzac Day, you will not be entitled to the benefit of the public holiday on
those days.
Woolworths has confirmed that it will observe the non-working-day
benefit for the following days: Good Friday, Easter Sunday and Easter
Monday.
