theuseofpremises,facilities,equipment,services,activitiesorproducts(“UseOfBlackLabSportspremisesorservices”)
ofBlackLabSportsLLC.,itssubsidiariesandaffiliates,andalloftheiremployees,contractors,officers,directors,agents,
representatives,sponsors,volunteersandanyotherentityorpersonactingforthem,andalloftheirsuccessorsandassigns
(collectively“BlackLabSports”).Risksmayincludebutarenotlimitedtoslips,trips,collisions,falls,inlossoffootingor
balance,including“slipandfalls”andfallsfromrockclimbingstructuresorfitnessequipment,equipmentfailure,
malfunctionormisuse;propertytheft,lossordamage,includingfromlockersorvehicles;andotheraccidents.Injuries
mayincludebutarenotlimitedtomajororminorpersonal,physical,bodily,emotional,mental,economic,propertyor
othertypesofinjuriesanddamages.IunderstandthatRiskandInjuriesintheuseofBlackLabSportsPremisesand
Services(collectively“RisksofInjury”)maybecausedinwholeorinpart,bytheNEGLIGENCEOFBLACKLABSPORTS,me,
anyadditionalguestsincludingmyspouse/partnerorchildren/wards(“AdditionalGuests”),BlackLabSportsmembers
includinganysponsoringmember(“Members”)and/orotherpersonsincludingotherguestswerevendors(“Others”).I
FULLYUNDERSTAND,ANDVOLUNTARILYANDWILLINGLYASSUME,THERISKSOFINJURY.
WAIVEROFLIABILITY,DEFENSEANDINDEMNIFICATION.Onbehalfofmyselfandmyspouse/partner,children/,wards
AdditionalGuests,parents,guardians,heirs,nextofkin,personalrepresentatives,heirsandassigns,Iherebyvoluntarilyand
foreverreleaseanddischargeBlackLabSportsfrom,covenantandagreenottosueBlackLabSportsfor,andwaiveany
claims,demands,actions,causesofaction,debts,damages,losses,costs,fees,expenses,oranyotherallegedliabilitiesor
obligationsofanykindornature,whetherknownorunknown(collectively,“Claims”)foranyinjuriestomeinany
AdditionalGuestsintheuseofBlackLabSportsPremisesandServiceswhichariseoutof,resultfrom,orcausedbyany
NEGLIGENCEOFBLACKLABSPORTS,me,additionalguests,membersand/orothers.
IfI,onmyownbehalforonbehalfofanother(includinganestate),assertaNegligenceClaimagainstBlackLabSportsand/or
breachmyagreementnottosueBlackLabSports,Iwillpayallreasonablefees(includingattorneysfees),costsand
expensesincurredbyBlackLabSports(“BlackLabSportsFeesandCosts”)todefend(1)theNegligenceClaimsand(2)
allotherClaimsbasedonthesamefactsistheNegligenceClaim(s).Ialsoagreedtodefend,indemnifyandholdBlackLab
SportsharmlesstothefullestextentpermittedbylawfromandagainstanyClaim(includinganyNegligenceClaims)
assertedagainstBlackLabSportsbyanyotherpersonarisingoutof,resultingfrom,orcausedbytheUseofBlackLab
SportsPremisesandServicesbymeormyAdditionalGuests.MyagreementtodefendBlackLabSportsmeansthatIwillpay
allofBlackLabSportsFeesandCostsincurredtodefendaClaimfromthedatetheClaimisasserted.Myagreementto
indemnifyandholdBlackLabSportsharmlessmeansthatIwillpayanysettlement,judgment,orotherdamages,feesor
costsofanytypeincurredbyBlackLabSportstoresolvetheclaim.
