C6e Commontocaltl) of Massachusetts; In the Year One Thousand Nine Hundred and Fifty-Five. An Act authorizing off-street parking facilities in THE CITY Of PITTSFIELD. Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: Section 1. For the purposes of constructing and 1 2 operating public parking areas, including original pave-3 ment thereof, the cost of demolition of buildings and 4 other structures and the clearing of said areas for such 5 pavement, as well as the construction and operation of 6 structures, garages and facilities for off-street public 7 parking, including purchase and installation of parking 8 meters, lighting, sewer and drainage facilities therefor, 9 the city of Pittsfield may acquire by purchase or other-10 wise, or take by eminent domain under the provisions 11 of chapter seventy-nine or eighty Aof the General Laws, 12 lands and buildings located on such streets in said city 13 as the city council of said city may determine. 1 Section 2. Said city may, for the purposes of this 2 act, borrow from time to time such sums as may be 3 necessary, not exceeding in the aggregate one million 4 two hundred thousand dollars, and may issue bonds or 5 notes therefor which shall bear on their face the words, 6 City of Pittsfield Off-Street Parking Facilities Loan, 7 Act of Nineteen Hundred and Fifty-five. Each author- SENATE > No. 828. [July 8 ized issue shall constitute a separate loan, and such 9 loans shall be payable in not more than twenty years 10 from their dates. Indebtedness incurred under this act 11 shall be in excess of the statutory debt limit, but shall, 12 except as herein provided, be subject to chapter forty-13 four of the General Laws, exclusive of the limitations 14 contained in the first paragraph of section seven thereof. Section 3. The city may install parking meters in 1 2 said off-street parking areas, structures, garages and 3 facilities and make a charge for the use of space therein, 4 and the receipts thereof, together with the receipts from 5 all other parking meters installed by said city, shall be 6 applied annually, first, to annual payments on account 7 of the above mentioned loan or loans, and secondly, 8 for any of the purposes for which parking meter receipts 9 may be used under sections twenty-two A, twenty-two B 10 and twenty-two C of chapter forty of the General Laws. 1 Section 4. In the event that the city determines to 2 construct and operate any off-street public parking areas, 3 structures, garages or facilities, said city shall, by 4 ordinance, establish rules and regulations for the opera-5 tion thereof. 1 Section 5. Upon liquidation of the loan authorized 2 by section two, the receipts from said parking meters, 3 structures, garages or facilities may be used for the 4 purposes prescribed by said sections twenty-two A, 5 twenty-two B and twenty-two C of said chapter forty 6 of the General Laws, and the receipts from all other 7 parking units installed by the said city may be used by 8 the city as provided by said sections. Section 6. Said city may acquire said parking meters 2 in the manner provided by section twenty-two A of said 3 chapter forty. Section 8. This act shall take effect upon its ac1 -2 ceptance by the city council of the city of Pittsfield, but 3 not otherwise.
