DayStudents DaystudentsareanintegralpartoftheStoneleigh-Burnhamcommunityandareencouragedto participateinasmuchoftheSchool’slifeaspossible.Whiledaystudentsliveathome,byaccepting admissiontoStoneleigh-BurnhamSchool,theyacknowledgethattheyareexpectedtoparticipateinall Schooleventsincluding,butnotlimitedto:formaldinners,performances,openingweekendevents, graduationweekeventsandoccasionalscheduledeventssuchasthePoetryFestival. Non-Harassment/Anti-HazingPolicy Stoneleigh-BurnhamSchoolsupportsanenvironmentofmutualtrustandpromotestherecognitionand protectionoftherightsandsensitivitiesofitsmembers.Concomitantly,Stoneleigh-BurnhamSchoolhas astrictpolicyprohibitingharassmentofitsstudents,staffmembers,teachers,administratorsand trustees(hereinaftercollectivelyreferredtoas“members”),includingimpliedorexpressedformsof sexualharassment.Sexualharassment,likeanyotherformofharassment,ismembermisconductand cannotbetolerated.Suchconducthasthepurposeoreffectofsubstantiallyinterferingwithindividuals’ work,academicperformancesorextracurricularparticipationandcreates,defacto,anintimidating, hostileoroffensiveworkingorlearningenvironment. Asusedhere,harassmentmeansanyverbal,written,visualorphysicalactthatisoffensive,intimidating, unwelcomeorwhatmightbeperceivedtobeobjectionableinnature.Becauseeachofushasdifferent sensibilitiesaboutwhatisacceptableandunacceptablebehavior,allmembersoftheSchoolcommunity areurgedtobemindfulofthisfactandavoidanyactionorstatementwhichcouldbeperceivedas harassment. Abuseofthedignityofanyonethroughethnic,racistorsexualslursorcommentsorthroughanyother derogatoryorobjectionableconductisoffensivebehaviorandwillresultindisciplinaryactionuptoand includingseparationfromSchool.Offensivebehavioralsoincludesphysicaladvancesorintimations, sexualorotherwise,anduninvitedsuggestiveremarks.Anymemberwhojoinsinorcondones harassmentorabuseofanotherisalsosubjecttodisciplinaryaction. Stoneleigh-BurnhamSchoolstrictlyforbidsanyactionorbehaviorthatconstituteshazingasdefinedby theMassachusettsAnti-HazingLaw.Thetermhazingisdefinedbylawas“anyconductormethodof initiationintoanystudentorganization,whetheronpublicorprivateproperty,whichwillfullyor recklesslyendangersthephysicalormentalhealthofanystudentorotherperson.Suchconductshall 39 includewhipping,beating,branding,forcedcalisthenics,exposuretoweather,forcedconsumptionof food,liquor,beverage,drugorothersubstanceoranybrutaltreatmentorforcedphysicalactivitywhich islikelytoadverselyaffectthephysicalhealthorsafetyofanysuchstudentorotherperson,orwhich subjectssuchstudentorotherpersontoextremementalstress,includingextendeddeprivationofsleep orrestorextendedisolation.” Anystudentwhofeelsthatshehasbeensubjectedtoharassmentorhazingofanytypebyanymember oftheSchoolcommunityshould,withoutfear,reporttheincidentpromptlytotheappropriateteacher, departmenthead,deanorHeadofSchoolascircumstancesdictate.Allcomplaintswillbeinvestigatedin astrictlyconfidentialmannerandwhereinvestigationsupportsanallegation,promptcorrectiveaction willbetakenbytheHeadofSchool.Innocaseshallthenameofthereportingpartybeusedwithouthis orherpermission. StatutoryRape Stoneleigh-BurnhamSchoolisrequiredbylawtonotifyallstudentsthattheyaresubjecttothestatutes oftheMassachusettsStatutoryRapelaw.Statutoryrapeoccursifapersonhassexualintercourseor “unnatural”sexualintercoursewithachild,whethermaleorfemale,whoisunder16.Unlikeordinary rapewherethevictimmustnothaveconsentedtointercourse,instatutoryrapetheminor’sconsentto thesexualactisirrelevant. ● BeHonest. InkeepingwiththetenetsoftheHonorCode,theSchoolconsidershonestytobeafundamentalvalue. StudentswhohavebeenfoundtobedishonestwillbeconsideredtobeinviolationofaMajor CommunityRuleandwillbereferredtotheDisciplinaryReviewBoard. Academicdishonestyislikewiseaserioustransgression;atitsmostbasiclevel,academicdishonestyis consideredtobecheatingorotherwiserepresentingtheworkofsomeoneelseasone’sown.Pleasesee page36forafulldescriptionoftheSchool’sPlagiarismPolicy. ● RespectPersonalandSchoolProperty. Theft,vandalismandabuseofanotherperson’spropertyareunacceptableandthereforeprohibited. TheSchoolconsidersthefttobetheunauthorizedacquisitionofsomethingthatbelongstoanother personororganization.Thisincludestheftorvandalismofpropertyoncampus,whileonaSchoolsanctionedoff-campusexcursion,unauthorizeduseofanotherperson’sproperty(includingcellphone andcomputer)oruseofanotherperson’swirelessaccess. ● BeSafe. 40 Studentswhoengageinbehaviorsthatjeopardizetheirownsafetyand/orthesafetyofthecommunity asawholeareconsideredtobeinviolationofaMajorCommunityRule.Examplesofthistypeof behaviorinclude,butarenotlimitedto: • Possessionoruseofflammablematerials,includingmatches,lighters,candles,etc.on Schoolgrounds • Tamperingwithfirealarms,smokedetectors,firedoorsorothersafetyequipment;this includesexitingthroughfiredoorsforreasonsotherthananemergency • Climbingoutofwindowsorbeingontheroof • Drivingavehicleunsafelyoncampusroads. ● BeAwareofYourPermissions. Allstudents,atthebeginningoftheyear,receivepermissionfromtheirparentsorguardiansfor circumstancesunderwhichtheymayleavecampus.Itistheresponsibilityofthestudenttomakesure herpermissionsareaccurateandtoabidebythem. TheSchoolmaintainsprotocolsforstudentswhowishtoleavecampusoneveningsandweekends,and itistheresponsibilityofthestudenttofollowtheseprocedures.Studentswhodonotfollowproper sign-outprocedures,wholeavecampuswithoutpermissionorwhoarefoundtohavesignedouttoone locationandgonetoanotherwillbereferredtotheDisciplinaryReviewBoard. BullyingPreventionandInterventionPlan I.Introduction ThemissionstatementofStoneleigh-BurnhamSchooldescribescreatingacommunitythat“inspiresgirls topursuemeaningfullivesbasedonhonor,respectandintellectualcuriosity.Eachstudentischallenged todiscoverherbestselfandgraduatewiththeconfidencetothinkindependentlyandactethically, secureintheknowledgethathervoicewillbeheard.”TheHonorCodefurtherencouragesandexpects ourstudentstobeguidedbythefollowing:“Respectforothersinallmywords,expressionsandactions. Iwillbekindandpoliteandwillrefrainfromhurtfulremarksaboutappearance,race,religion,family, intelligenceandsexuality.”Insum,Stoneleigh-BurnhamSchoolisacommunitythatrequiresits studentstotreatoneanotherwithrespectandcivility. ItistheSchool’spolicytoprovideandmaintainalearningenvironmentthatisfreeofbullying–face-tofaceorelectronic-andanyotherverbalorphysicalmisconductthatdisruptsthelearningandliving environmentbymakingitunsafe.Beingasmallboardinganddayschoolforgirlsaffordsusalearning environmentthatisconstant,whetherintheclassrooms,ontheathleticfields,duringextracurricular activitiesorinthedormitories.Theenvironmentitselfhelpsstudentslearnmoreabouteachotherina morecaring,understandingway. TheBullyingPreventionandInterventionPlan,asdescribedbelow,supportstheSchool’smissionto promotealearningenvironmentandpreventanybehaviorsthatcouldimpedetheeducational experience.Thisplanisconsistentwiththenon-harassment/anti-hazingpolicythatappearsinthe 41 CommunityHandbook.ItisthroughthispublicationthatthePlaniscommunicatedtoallmembersof theSchoolcommunity. TheHeadofSchoolandtheDeanofStudentsareresponsiblefortheimplementationand administrationofthePlan.Questionsand/orconcernsrelatedtothisPlancanbemadedirectlytothe HeadofSchooland/ortheDeanofStudents. DefinitionsundertheLaw:ThefollowingdefinitionsaredrawnfromtheMassachusettslawagainst bullying(M.G.L.c.71,§370andChapter86oftheActsof2014). Bullying:therepeatedusebyoneormorestudentsorbyamemberofaschoolstaffincludingbynot limitedto,aneducator,administrator,schoolnurse,cafeteriaworker,custodian,busdriver,athletic coach,advisortoanextracurricularactivityorparaprofessionalofawritten,verbalorelectronic expressionoraphysicalactorgestureoranycombinationthereof,directedatatargetthat: • • • • • Causesphysicaloremotionalharmtothetargetordamagetothetarget’sproperty; Placesthetargetinreasonablefearofharmtoherselforofdamagetoherproperty; Createsahostileenvironmentattheschoolforthetarget; Infringesontherightsofthetargetatschool; Materiallyandsubstantiallydisruptstheeducationalprocessororderlyoperationofaschool. Cyber-bullying:bullyingthroughtheuseoftechnologyorelectronicdevicessuchastelephones,cell phones,computers,andtheInternet.Itincludes,butisnotlimitedto,email,instantmessages,text messages,andInternetpostings. HostileEnvironment:asituationinwhichbullyingcausestheschoolenvironmenttobepermeatedwith intimidation,ridicule,orinsultthatissufficientlysevereorpervasivetoaltertheconditionsofa student’seducation. Retaliation:anyformofintimidation,reprisal,orharassmentdirectedtowardapersonwhoreports bullying,providesinformationduringaninvestigationofbullying,orwitnessesorhasreliable informationaboutbullying. Target:theindividualagainstwhombullying,cyber-bullyingorretaliationhasbeenperpetrated. Perpetrator:astudentoramemberofaschoolstaffincludingbynotlimitedto,aneducator, administrator,schoolnurse,cafeteriaworker,custodian,busdriver,athleticcoach,advisortoan extracurricularactivityorparaprofessionalwhoengagesinbullyingorretaliation. II.PolicyagainstBullying,Cyber-Bullying,andRetaliation TheSchoolwillnottolerateanyformofbullyingorcyber-bullying,norwillittolerateretaliationagainst anypersonwhoreportsbullying,providesinformationduringaninvestigationofbullyingorcyberbullying,orwitnessesorhasreliableinformationaboutbullying. Bullyingandcyber-bullyingareprohibitedontheSchool’scampus;atallschool-relatedactivities,both onandoffcampus;andinanyvehicleusedforschool-relatedtransportation.Bullyingandcyber-bullying arealsoprohibitedthroughtheuseoftechnologyoranyelectronicdeviceschool-owned,school-leased orusedattheSchool. 42 Bullyingandcyber-bullyingareadditionallyprohibitedunderanynon-school-relatedcircumstancesif theactivitycreatesahostileenvironmentatschoolforatargetedstudentorstudents,infringesonthe rightsofsuchstudentorstudentsatschool,orsubstantiallydisruptstheeducationalprocessororderly operationoftheSchool.Forexample,astudentmaynotassumeprotectionwhenusingacomputerat homeforpurposesrelatedtobullying;thisincludesbeingtheperpetratorofacyber-bullyingmessage and/orbeingtheindividualwhopassesonealong. Werecognizethatcertainstudentsmaybemorevulnerabletobecomingtargetsofbullying, harassment,orteasingbasedonactualorperceivedcharacteristics,includingrace,color,religion, ancestry,nationalorigin,sex,socioeconomicstatus,homelessness,academicstatus,genderidentity orexpression,physicalappearanceordisability,orbyassociationwithapersonwhohasoris perceivedtohaveoneormoreofthesecharacteristics.Theschoolwillidentifyspecificstepsitwill taketocreateasafe,supportiveenvironmentforvulnerablepopulationsintheschoolcommunityand provideallstudentswiththeskills,knowledge,andstrategiestopreventorrespondtobullying, harassment,orteasing. LegalDefinitionsandSchoolPolicy ItisimportanttobearinmindthatstricterstandardsofbehaviormayapplyunderStoneleighBurnham’spoliciesinorderthatwemaypreventinappropriateverbalandphysicalconductbeforea studenthasbeensubjecttobullyingasitisdefinedunderthelaw.Forexample,althoughthelaw definesbullyingas“repeateduse”ofcertainexpressions,actsand/orgestures,theSchoolreservesthe righttoapplydisciplinarymeasuresandothercorrectiveactioninacaseofasingleexpression,act and/orgestureiftheSchooldeterminesthatitisofsufficientseveritytowarrantdisciplinaryorother remedialactionorthattherepetitionofthatexpression,actorgesturemightreasonablyresultin bullyingasdefinedbythelaw. III.Prevention Aswitheverythinginvolvingadolescents,bullyingpreventionstartswithworkingtobuildstrong relationshipswithandamongthestudents.Thiscanhappenintheclassroom,inadvisory,onthe residentialhallways,duringathletics,whileperformingcommunityservice,andanywhereelseSBS adultshavethechancetointeractwiththestudents. Studentgroupsoncampusareactiveinhelpingdevelopunderstandingsamongcommunitymembersat theschool.Thesegroupshaverecentlyworkedwithgoalssuchasbuildingstrengthindiversity;raising consciousnessaroundthedifficultiesexperiencedbygay,lesbianandtransgenderedstudents; identifyingissuesofraceandracialidentity;andintroducingtraditionsandholidaysofworldcultures andreligionstothecommunity. Inaddition,thereareseveralspecificprogramsthataddresstheissuesofbullyingandrelatedtopics throughouttheacademicyear. Orientation LargergroupworkfortheentireMiddleSchool(grades7&8)beginsduringOrientation,continues duringanearlyfalltrip,andmayberevisitedasneededduringweeklyMOCA(StudentGovernment) meetings.Similarly,eachclassintheUpperSchoolhasa“bondingtrip”duringOrientation.Eachis designedtohelptheclassworktogetherinordertofindcommonalitiesthatwilltakethestudents 43 throughtheyeartogether.Asfollow-up,classmeetingsoccurweeklyintheUpperSchool,duringwhich anyemergingissuesmayalsobeaddressed. LifeSkillsDevelopment TheSchoolCounselorworksactivelywiththeMiddleSchoolDeantoplanaseriesofactivitieswiththe 7thgraders.Shemeetswiththemtwiceamonththroughouttheyear.Theseactivitiestypicallyfocuson buildinghealthyfriendshipsandnegotiatingconflict,withsubtopicsinthelatterareaincludingrelational aggression,I-statements,activelistening,learninghowtoagreetodisagree,quellinggossip,andmore. Topicsvarymonth-to-monthandyear-to-year,dependingontheneedsofaspecificgroupofstudents. TheSchoolCounseloralsoworksactivelywith8thgraders,meetingonceamonthtocontinuebuilding positivegroupdynamics,self-awareness,andleadershipskills. OnceastudententerstheUpperSchool(grades9-12),sheisenrolledintheForumprogram,alifeskills developmentcurriculum,onceaweek.AteverylevelthereisaunitonInternetsafetyaswellasoneon buildingmulti-culturalunderstandings.Inaddition,Ninthgradersareassignedaresearchprojectin whichtheyresearchbullyinganddeveloppresentationstomakebeforeanaudience. OtherFormats Convocationtakesplaceonthefirstdayofclasses.InthisceremonyeachmemberoftheSchoolsignsa copyoftheHonorCodeasanindicationofher/hiscommitmenttothetenetsofthatdocument.Itis thenframedandhungpubliclyasareminderofthosevalueshereattheSchool. Additionally,individualclassroomteachersandresidentfacultywatchforissuesingroupdynamics,and trytomovequicklytohandlethembeforetheydevelopintodeeper,morecomplexissues.These concernstypicallygothroughthestudent’sfacultyadvisor.SocialteammeetingsintheMiddleSchool, facultymeetingsintheUpperSchool,andResidentTeammeetingsforbothdivisionsprovidean opportunitytotakethepulseoftheschoolandtodevelopasneededplanstoencouragepositivegroup dynamicsusingavarietyofmethods.ThesemeetingsmayalsoservetoinspiretopicsfortheSchool Counselor(MiddleSchool)andForumteachers(UpperSchool).Finally,theDutyNotesfolderallows houseparentstoinformotherteammembersaboutwhatishappeningonthehallway. Thecurriculum,especiallyintheHumanities,lendsitselfonoccasiontofrankdiscussionaboutissues relatedtobullyingandmeannessaswell.Buildingcross-culturalunderstandingswithinaninternational curriculumaffordsusmultipleopportunitiestodrawoutdifferingstudentviewpointsandsharethemin asafespace.Itisnotuncommontohearourstudentssharingwhatisconsidered“thenorm”intheir respectivecultures,thusleadingtodeeperunderstandingofdifference. Professionaldevelopmentopportunitiesforfacultyandstaff,whethersendingthemoffcampusto conferencesordoinginformalworkhere,arealsoscheduled. Throughtheseactivities,andthroughadvisors’communicationwithparents,weworktomaintainahigh levelofawarenessofwhatishappeningintheMiddleandUpperSchools,buildpositivegroup dynamics,andquicklyrespondtopotentialissuesbeforetheyhaveachancetospiralintosomething larger. 44 StudentLeadership:Trainingatthestartoftheyear Asapartofbefore-schooltraining,allResidentAssistants(juniorsandseniors)learntheir responsibilitiesinthedorms;thisincludesanunderstandingoftheirroleindeterringbullyingbehaviors andinreportinganyegregiousbehaviorswitnessed.Similarly,membersoftheStudentCouncil(Upper School)understandtheirparttoactasrolemodelsandhelpcreateanenvironmentinwhichbullyingis nottolerated. InternationalStudents/Mid-YearStudentEnrollments Internationalstudentsmeetfrequentlyatthestartofeachyearinordertoensuregirlsfromoutsidethe U.S.learnaboutAmericanand,specifically,Stoneleigh-BurnhamSchoolcultureassoonaspossible. IncludedinthesemeetingsisconversationtoexplaintheSchoolrulesandpoliciesingreatdetail. InJanuarytheSchoolreviewstheSchool’spolicies(includingthatregardingbullying)throughadvisory groupssothatanynewlyenrolledstudentmayhaveaclearsenseoftheSchool’sstanceonissuessuch asbullying,andmore. AssessingNeedsandResources: Atleastonceeveryfouryears,beginninginthe2015-2016schoolyear,theSchoolwilladministera state-designedsurveytoassessschoolclimateandtheprevalence,natureandseverityofbullyingin ourSchool.Additionally,theSchoolwillannuallyreportbullyingincidentstotheMassachusetts DepartmentofElementaryandSecondaryEducation. IV.ReportsofBullying,Cyber-BullyingorRetaliation Anystudentwhoisthetargetofbullyingorcyber-bullyingisstronglyencouragedtopromptlyreportthe matterorallyorinwritingtotheHeadofSchoolorDeanofStudentsortoanyfacultyorstaffmember withwhomthestudentiscomfortablespeaking. Anystudentwhohaswitnessedanincidentofbullyingorcyber-bullyingorotherwisehasrelevant informationaboutbullyingorcyber-bullyingprohibitedbythispolicyisexpectedtopromptlyreportthe matterorallyorinwritingtotheHeadofSchoolorDeanofStudentsortoanyfacultyorstaffmember withwhomthestudentiscomfortablespeaking. Theparentofastudentwhoisthetargetofbullyingorcyber-bullyingorofastudentwhohaswitnessed orhasrelevantinformationaboutbullyingisstronglyurgedtonotifytheHeadofSchoolorDeanof Students.AparentshouldalsoreportanyincidentofretaliationinviolationofthispolicytotheHeadof SchoolortheDeanofStudents. Anyparent,guardianorstudentmaymakereportsofbullyingorretaliationanonymously,ifdesired. Anymemberofthefacultyandstaffwhohaswitnessedincidentsofbullyingorcyber-bullying,orhas beentoldofsuchanincident,isrequiredbylawtoreportthemtotheHeadofSchoolorDeanof Students.Amemberofthefacultyorstaffmaynotmakepromisesofconfidentialitytoastudentor parentwhoinformshim/herofanallegationofbullying,cyber-bullyingorretaliation.Facultyandstaff areexplicitlydirectedNOTtotrytofacilitatemediationbetweentargetandaggressor;onlytheHeadof SchoolortheDeanofStudentsshouldbedealingwithfollow-up.Similarly,onceaninvestigationhas begun,onlythepersonconductingtheinvestigationshouldbeincontactwiththestudentsandparents involveduntiltheinvestigationiscomplete. 45 FacultyandStaffmaynotmakereportsunderthispolicyanonymously.WhiletheSchoolcannot promisestrictconfidentiality,becauseinformationmustbesharedinordertoconductaneffective investigation,theSchoolreleasesinformationconcerningcomplaintsofbullying,cyber-bullyingand retaliationonlyonalegitimateneed-to-knowbasis. V. RespondingtoaReportofBullying,Cyber-bullying,orRetaliation A. PreliminaryConsiderations:Whenacomplaintofbullying,cyber-bullyingand/orretaliationis broughttotheattentionoftheHeadofSchool,theDeanofStudentsoranyothermemberoftheSchool community,anassessmentismadeastowhetheranyinitialstepsneedtobetakentoprotectthewellbeingofstudentsandtopreventdisruptionoftheirlearningenvironmentwhiletheinvestigationis beingconducted.Whenappropriate,increasedsupervisionmaybeimplementedtopreventfurther bullying,cyber-bullyingorretaliationduringaninvestigation. B. ObligationtoNotifyParents:ItisthepolicyofStoneleigh-BurnhamSchooltonotifytheparentsof anystudentwhoisanallegedtargetofbullying,cyber-bullying,orretaliationandtheparentsofany studentwhomayhavebeenaccusedofengaginginsuchbehaviorpromptlyafteracomplainthasbeen made.Further,theSchoolwillinformtheparentsoftheDepartmentofElementaryandSecondary Education’sproblemresolutionsystemandtheprocessforaccessingthatsystem,regardlessofthe outcomeofthebullyingdetermination: Anyparentwishingtofileaclaim/concernorseekingassistanceoutsidetheSchoolmaydosowith theMassachusettsDepartmentofElementaryandSecondaryEducationProgramResolutionSystem (PRS).Thatinformationmaybefoundathttp://www.doe.mass.edu/pga,emailsmaybesentto compliance@doe.mass.eduorindividualsmaycall781-338-3700.Ahardcopyofthisinformationmay beobtainedintheDeanofStudentsorHeadofSchooloffice. C. Investigation:Thefollowingisaguidelineofproceduresusedonceacomplainthasbeenbroughtto theattentionoftheHeadofSchoolortheDeanofStudents: TheHeadofSchooland/ortheDeanofStudentsconductanimpartialinvestigationofthecomplaint. Thatinvestigationmayinclude(butwillnotnecessarilybelimitedto)interviewswiththepersonwho madethecomplaint,withthestudentwhowasthetargetofthereportedbullying,cyber-bullying,or retaliation,withthepersonorpersonsagainstwhomthecomplaintwasmadeandwithanystudents, faculty,stafforotherpersonswhowitnessedorwhomayotherwisehaverelevantinformationabout thereportedincident. Dependingonthecircumstances,thepersonconductingtheinvestigationalsomaychoosetoconsult withotherteachersand/ortheSchoolCounselor.Concreteformsofevidence,suchascopiesof electroniccommentary,mayalsobebroughtintoconsideration. D. Resolution,NotificationandFollowUp Followinginterviewsandanyotherinvestigationundertaken,theHeadofSchooland/ortheDeanof Studentswilldeterminewhetherandtowhatextenttheallegationofbullying,cyber-bullingor retaliationhasbeensubstantiated.IfitisdeterminedthatthepolicysetforthinthisPlanhasbeen violated,theHeadofSchooland/ortheDeanofStudentswilldeterminewhatdisciplinaryactionand/or otherremedialactionisappropriateandhowitwillbeimplemented. 46 Thegoalofaninvestigationandanysubsequentdisciplinaryorremedialprocessistocorrectthe situationtotheextentitisreasonablypossibleandtotakesuchstepsascanbetakentopreventthere beingarepetitionoftheincidentandtopreventthestudentorstudentstargetedandotherswho participatedintheinvestigationfrombeingsubjecttoretaliation.Thisincludessupportforthealleged ordisciplinedaggressorwhoremainsintheSchoolcommunity. Consequencesresultingfromadeterminationthatthispolicyhasbeenviolatedmayincludeany responsedeemedappropriate,uptoandincludingdismissalfromschool.Inappropriatecircumstances, suchaswhenacrimemayhavebeencommittedorachildmayhavebeensubjecttoabuseorneglectof thetypethatisreportableunderSection51AoftheMassachusettslaws,lawenforcementoranother appropriategovernmentagencymaybenotified. Uponcompletionoftheinvestigation,theHeadofSchooland/ortheDeanofStudentswhoconducted theinvestigationwillmeetindividuallywiththestudentorstudentswhowerethetargetofthealleged incidentandthestudentorstudentsagainstwhomthecomplaintwasmadeandtheirparentstoreport theresultsoftheinvestigationand,wheredisciplinaryorothercorrectiveactionisdeterminedtobe appropriate,toinformthepartiesofthestepsthatwillbetakentocorrectthesituation.Confidentiality lawsprotectingstudentrecordsmaylimittheamountofinformationprovidedinthesemeetings. Follow-upconversationswillbemadewithanystudentfoundtohavebeentargetedandherparentsto inquireastowhethertherehavebeenanyfurtherincidentsinviolationofthispolicy. VI. Conclusion Thisplanisintendedto(1)preventbullyingandcyber-bullyingamongourcommunitymembers,(2)to encouragecommunitymemberstohaveconfidenceintheSchool’sproceduresandtocomeforward promptlywheneverastudentissubjecttoconductthatisprohibitedbythisoranyotherSchoolpolicy; and(3)toimplementappropriatedisciplineandothercorrectivemeasureswhentheyarefoundtobe warranted. Section18.FailuretoReportHazing Whoeverknowsthatanotherpersonisthevictimofhazingasdefinedinsectionseventeenandisatthe sceneofsuchcrimeshall,totheextentthatsuchpersoncandosowithoutdangerorperiltohimselfor others,reportsuchcrimetoanappropriatelawenforcementofficialassoonasreasonablypracticable. Whoeverfailstoreportsuchcrimeshallbepunishedbyafineofnotmorethanonethousanddollars. DisciplinaryPolicies WhenastudentisinviolationofoneormoreMajorCommunityRules,orifsheshowsrepeated difficultieswiththetypesofminortransgressionshandledbythePrivilegeSystem,sheisreferredfor disciplinaryaction. IntheeventthatastudenthasbeendisciplinedfortheviolationofaMajorCommunityRule,high prioritywillbegiventorespectthedignityofthatstudent.TheDeanofStudentsortheHeadofSchool may,however,announcepubliclythenatureofthedisciplinarycaseandrelatedresults;astudent’s namewillneverbeattachedtothatannouncement.Insomecases,itwillnotbeappropriatetoreveal anythingmorethanthefactthatsomethinghappenedofanaturethatcannotbefurtherdiscussed.In allcases,communitymemberswillbeaskedtorespecttheprivacyoftheindividual(s)involved.We makesuchannouncementstodeteridlegossipandinaccurateassumptions. DisciplinaryReviewBoard TheDisciplinaryReviewBoardexiststoreviewasituationinwhichastudentisfoundtobeseriouslyout ofcompliancewiththeexpectationsandvaluesofthecommunity.Reasonswhyastudentmightbe requestedtoappearinfrontoftheDisciplinaryReviewBoardinclude,butarenotlimitedto:violationof oneormoreMajorCommunityRules,repeatedviolationofoneormoreminorcommunityrules,accrual 48 ofasignificantnumberofpointswithinthePrivilegeSystemorotheractionsthatdemonstratea student’sdifficultylivingwithintheboundariesoftheSchoolprogram. TheReviewBoardconsistsoftheDeanofStudents,atleastthreefacultymembersandfourstudents. Thestudent’sadvisorattendstheReviewBoardandactsasaresourceandadvocateforthestudent.In theeventthattheadvisorisunavailable,thestudentmaychooseanotheradultoncampusto accompanyher.Thestudentisgiventheopportunitytoprovideastatementaboutthesituationleading uptotheReviewBoardandisaskedtoprovidesomeexplanationofheractions.Honestyisalwaysthe bestpolicywheninaReviewBoardmeeting.Afterconsideringthefactsaspresented,theReviewBoard thenmakesrecommendationsforaresponsetotheHeadofSchool.TheHeadofSchoolmay,when deemednecessary,imposewhateversanctionsshefeelsareappropriateatanytime. Allrecordsofdisciplinaryactionsand/orDisciplinaryReviewBoardmeetingsbecomepartofastudent’s permanentrecordandwillbereportedtoauthorizededucationalinstitutions,ifrequested. ProbationaryStatus AstudentplacedonprobationrisksherpositionattheSchoolifshechoosestocontinuetoviolate communityrules.Makingaconcertedandvisibleefforttomeetcommunitystandardsmustbehergoal atthatpoint. In-SchoolSuspensionWeekend Insomecases,theDeanofStudentswillassignaboardingstudentanin-schoolsuspensionweekend. StudentsmayreceivethisiftheyhaveaccumulatedalargenumberofpointsunderthePrivilegeSystem, iftheyhavenotrespectedtheHonorCode,orwhenanout-of-schoolsuspensionisnotwarranted. Parentswillbenotifiedwhenastudenthasbeenplacedonanin-schoolsuspensionweekend,although thiswillnotberecordedinthestudent’spermanentfile.Astudentwillnotbeallowedtoleavecampus atanytimeduringthisweekend. Suspension Onrareoccasion,astudentmaybeseparatedfromtheSchoolforaperiodoftimeduetoaserious violationofaSchoolpolicyorrule.Intheeventastudentissuspended,shewillberesponsibleforall workdueduringandimmediatelyfollowinghersuspension.Shemustbeindailycontactwithher teachersbyemailandmustsubmitallworkwhenitisdueandintheformatdeterminedbyher teachers.Lateworkwillnotbeaccepted.Anyworkthatisimpossibletocompletewhileonsuspension (labs,presentations,etc.)willreceivenocredit.Thisisadirectconsequenceofthesuspensionandthe behaviorwhichgarneredtheseparationfromtheSchool.Parentswillberesponsibleforany transportationcostsassociatedwiththeseparation.Ifitisnotfeasibleforastudenttogohomeon suspension,theSchoolwillarrangeforaplace,atanadditionalcost. Expulsion WhiletheSchooliscommittedtohelpingstudentslearnfromtheirmistakesandcontinuelivinginthe community,expulsionmaybethebestlessonforcertainegregiousorrepeatedbehaviors.Insucha 49 case,theSchoolwillmakeeveryefforttosupportthestudentandherfamilyintakingthenextsteps. ThestudentwillnotbeallowedtoreturntoStoneleigh-BurnhamSchoolforatleastoneacademicyear. Upondemonstratedredressoftheissuesthatledtoexpulsion,thestudentmayreapplydirectlytothe HeadofSchoolforreadmission. Withdrawal IntheeventthatastudentwithdrawsfromtheSchoolmid-year,writtennotificationisrequiredfrom theparent/guardian(s)beforethewithdrawalwillbeconsideredofficial. SearchandSeizurePolicy Inordertoprotectthesafety,healthandwelfareoftheStoneleigh-Burnhamcommunity,studentsshall notpossessanyillegalsubstance,objectorothercontrabandincluding,butnotlimitedto:tobacco, drugs,alcohol,guns,knivesandincendiarydevices.IncaseswheretheSchoolhasreasontosuspectthat thecommunitymaybejeopardizedinthisway,asearchwillbeconductedbytheDeanofStudentsor theHeadofSchoolwithanotheradultpresent.ThefamiliesandstudentsofStoneleigh-BurnhamSchool acknowledgethattheSchoolreservestherighttoperformsearchesandtoseizeanyillegalsubstance, contrabandorobject.Inaddition,theSchoolmaypursueinvestigationofasuspectedtheftwitha searchofastudent’sroom. Searchesmaybeconductedwithorwithoutnoticetothestudentandherfamilyandwithoutthe consentofthestudent.Whileadheringtoprinciplesoffundamentalfairness,searchesmaybe conductedwithorwithoutprobablecauseandmayincluderandomunannouncedsearchesthatmaybe conductedatanytime.Astudent’sroom,deskandcomputersuppliedbytheSchoolandanyother propertysuppliedbytheSchoolarethepropertyoftheSchoolandareatalltimesdeemedtobethe propertyof,andunderthecontrolof,theSchoolandmaybesearched.Astudent’spersonaleffects, including,butnotlimitedto:cars,backpacks,purses,pockets,bookbags,computerbagsandpersonal computersmaybesearchedbytheSchool.Allsearcheswillbeperformedintheleastintrusivemanner possibleandwillbeconductedinthepresenceofanadultwitness. PlagiarismorAcademicDishonesty Stoneleigh-BurnhamSchoolconsidersacademichonestytobeanimportantpartofastudent’slife.Asa memberofourcommunity,eachstudentmustdoherownwork.Facultywillhelpeachstudentdevelop scholarlyhabits,bothofmindandpractice,thatwillprotectherfromunwittingacademicdishonesty. Thefacultyandadministrationwilltreatanybreachofacademichonestyseriously(whetheritinvolves copyingahomeworkassignment,cheatingonatest,orplagiarizingatermpaper.)Inordertoinform students,weofferthefollowingdescriptionsofoccasionsofacademicdishonesty.TheSchoolexpects studentstounderstandandmasterthesedefinitions,thusavoidinganyinadvertentviolationof academichonesty. 50 Plagiarism Plagiarismisthedeliberateorunintentionalappropriationofsomeoneelse’swords,images,orideas withouttheuseofparentheticalreferences/footnotesandalistofworkscited.Theexceptionis informationwhichisconsideredcommonknowledge.Specificdata,facts,orinformationotherwisenot knownbyawideaudience,however,mustbecitedusingtheMLAformat,unlessotherwisespecifiedby theteacher. Allstudentsinthegroupshareequallyintheworkload. Thereissomewrittenacknowledgementofwhodidwhat. Whenhelpinganotherstudentwithanassignment,astudentmayidentifyanerror,butnotofferthe solutionorcorrecttheerror.Representingsomeoneelse’ssolutionastheirownworkisplagiarismanda violationoftheacademichonestypolicy. 51 ElectronicDevices Studentsmaynotuseelectronicdevices,programs,oroutsideresourcesonanassignmentunless otherwisespecifiedbytheteacher.Inparticular: • • • • Studentsmaynotusecalculatorsorothertechnologyinthesolutionofaproblemthatthey havebeenspecificallyinstructedtosolvebyhand. Violations ViolationsoftheAcademicHonestyPolicyoverthestudent’scareeratSBSwillresultinthefollowing penalties: • FirstOccasion o Azeroontheassignment. o Athoroughreviewoftheparticularsituationofacademicdishonestyincluding,but notlimitedto,acompleterewriteoftheassignmentinquestion(notforcredit); o NotificationoftheAdvisorandtheAcademicDean. • SecondOccasion o Afailinggrade(59,unlessthestudent’saverageislower)intheacademicclassfor thetrimesterinwhichtheoffenseoccurred.Thestudentisexpectedtocontinueto fulfillallclassrequirementsorrisklosingtheacademiccreditfortheyear. o Meetingwiththeteacher,Advisor,andtheAcademicDean. o Notificationofthestudent’sfamily. • ThirdOccasion o ExpulsionfromtheSchool Attendance StudentsareexpectedtoattendallSchoolcommitments.Theseinclude,butarenotlimitedto:classes, athleticgamesandpractices,studyhalls,extrahelpsessions,skillssessions,specialevents,formal dinners,advisorandclassmeetingswhetherscheduledbytheSchool,afacultymemberorbythe studentherself.Absencesaredesignatedaseitherexcusedorunexcused.TheSchoolreservestheright todeterminewhetheranabsenceisexcusedorunexcused.Anystudentwhohasthreeormore unexcusedabsencesinasingletermissubjecttoaDisciplinaryReviewBoardhearing.Failuretomeet one’sowncommitmentsisconsideredaseriouslackofconsiderationforcommunityexpectations. 52 Astudentwhohasbeenabsentisexpectedtoturninhermissedworkthedayshereturnsfromher absenceormeetwiththeAcademicDeantodetermineappropriatedeadlines.Homework,assignments andquizzesmissedduringanunexcusedabsencewillreceiveazero.Anystudentanticipatingan absenceisresponsiblefornotifyingherteachersinadvanceoftheabsenceandforcollectingall necessaryassignmentstodowhileaway. Studentswhomiss20%ormoreofclasstimeduringatrimester,excusedorunexcused,arein jeopardyofreceivingafailure(F)forthatmarkingperiod.TheAcademicDeanandDeanofStudents, withtheinputoftheteacher,willassesswhetherthestudentshouldreceivecreditforthecourse. UpperSchoolPrivilegeSystem TheStoneleigh-BurnhamSchoolPrivilegeSystemisdesignedtohelpstudentsunderstandthe importanceoftheircontributionstoourSchoolcommunity.Thissystemrespondstotransgressionswith consequencesthatarebotheducationalandrestorative.Thesystemdoesnotaddressviolationsof majorschoolrules;thosearedealtwithbytheDisciplinaryReviewBoard. ThePrivilegeSystemisnotdesignedtopenalizestudentsundulyforminortransgressions,butratherto provideabenchmarkforstudentstodeterminehowwellandhowregularlytheyarefulfillingthe standardexpectationsofaStoneleigh-Burnhamstudent.Transgressionswithinthecommunity– “infractions”–eachcarryacertainpointvalue.Studentsmayreceiveinfractionsandbechargedpoints foravarietyofoffensesandmayhavepointsforgivenforactionsthatdemonstratetheirpositive contributionstothecommunity. Whenastudentreceivesaninfraction,shewillbenotifiedoftheinfractionandthepointsassigned withinafewdaysoftheoffense.Inthecaseofsomethinglikeadresscodeviolationoraninfraction givenforinappropriatelanguage,thefacultymembergivingtheinfractionwillinformthestudent immediately.Iftheinfractionisforamissedclassorothermissedobligation,thefacultymembergiving theinfractionwillinformtheAttendanceoffice.Withinoneworkingdayoftheoffense,thestudentand heradvisorwillreceiveane-mailfromtheDean’sofficenotingtheinfraction,thepointsassignedand advisingthestudentthatshehas48hourstoobtainanexcuseiftherehasbeenamisunderstanding. ItisunderstoodthatallstudentsatStoneleigh-BurnhamSchoolareexpectedtoregularlymeettheir requiredobligations,andintheeventthatanobligationismissed,thestudentbearsresponsibilityfor producingavalidexcuse.Wherethereisnovalidexcuse,pointswillbeassignedaccordingly.Reasons suchasoversleeping,nothearinganalarmclockorbellormisreadingtheschedulearenotvalidexcuses formissingobligations. PointsaccumulatedwithinthePrivilegeSystemaretotaledeverytwoorthreeweeksbytheDeanof Studentsofficeandarecumulativethroughouttheterm.Eachstudentbeginsafreshatthebasiclevelat thebeginningofeachterm;however,theDeanofStudentsreservestherighttocarryoverpointsfrom theprevioustermifastudentaccumulatesalargenumberofpointsinthefinalweeksoftheterm.At anytime,students,familiesoradvisorscancheckwiththeDean’sofficeforinformationonastudent’s currentpointtotal.Studentswhosepointtotalattheendofatwo-weekperiodplacethemina consequencecategorywillreceiveanemailfromtheDeanofStudentsofficenotifyingthemandtheir advisoroftheirchangeinstatus.Advisorswillcommunicatethisinformationtothestudents’parents. Justasstudentsaccruepointsforinfractions,pointsareforgivenforpositivecontributionswithinthe community.Generally,eachhourofservicetothecommunitywillresultinthesubtractionofonepoint 54 fromastudent’spointtotal.Largerormorefrequentservicemayresultinlargerreductions,andsmaller servicemaybegivenasmallerreduction.Studentswishingtoreducetheirpointtotalshouldspeakto theDeanofStudents. Allstudentsmustsignoutwiththehouseparentondutybeforeleavingcampusfortheweekend,and theymustsigninwiththehouseparentupontheirreturn.Failuretodoeitherofthesewillresultin disciplinaryaction. Failuretocomplywillresultindisciplinaryaction/unlesstheyhavepermissionfromtheHealthCare Center.TheHealthCareCenteriswellstockedwithmanyover-the-countermedications.Ifitis necessaryforparentstomailmedicationstoastudent,theymustbesenttotheattentionoftheHealth CareCenterandnottothestudentdirectly.Studentsareremindedthattheyshouldnevershare medication. Heatingpadsareavailableforstudentuse.Students’SmartCardaccountswillbechargedforany unreturnedheatingpads. Tanning,TattoosandPiercings Allstudentsmusthavewrittenpermissionfromaparent/guardiantogotanning.Massachusetts’law prohibitstattoosforchildrenunder18,andparent/guardiansmustaccompanystudents17andunderto acquirepiercings.Studentswithbodypiercingsarenotallowedtowearaccompanyingjewelry(except forearringsorsmallnosestuds)oncampusoronSchooltrips. MedicalLeave Anystudentmight,duringthecourseoftheacademicyear,faceaseriouspsychologicalormedical situationrequiringanextendedabsence(beyondthreedays)fromtheSchool.Thedeterminationofthe medicalleavewillbemadebytheStudentServicesteamandhealthprofessionals.Studentswhotakea medicalleavemustbeunderadoctor’s,psychologist’sortherapist’scarewhileonmedicalleave.Ifthe 60 studentisplacedonneworadjustedmedications,thestudentmustremainathomeunderaphysician’s careuntilstabilized. StudentsmaynotreturnuntilclearedbyhealthprofessionalsandtheSBSStudentServicesteam.All reportsfromthestudent’sdoctor,psychologistand/ortherapistshouldbemadeavailableinwritingand shouldbereceivedinadvanceofanydecision-makingprocess.SuchreportsallowtheSchooltojudge theadvisabilityofthestudent’sreturnaswellastooutlineanycontinuingtreatmentprograms.ReentrywillbedeterminedaftercommunicationbetweenSBShealthprofessionalsandtheattending physician,reviewofmedicalreportsprovidedandameetingbetweenthestudent,herparentsandSBS personnel. Nothingshouldbeattachedtothesprinklersystemsintherooms.Massachusettsstatefireregulations restrictwallcoveringsaswell.OpenflamesareadangertotheentireSchoolcommunity,and, thereforesmoking,theuseofcandlesorincenseandanyotheropenflameinstudents’roomsare strictlyforbiddenandwillincurseriousdisciplinaryaction.Halogenlamps,coffeemakers,popcorn poppersandothersimilarappliancesarenotallowedinstudentrooms.Possessionofanysuchitem willresultindisciplinaryaction,uptoandincluding,dismissal. StudentsandtheAODshouldevacuatethemainbuildingbythenearestexitandshouldreport totheUpperRidingRing. Houseparentsshouldquicklycheckeverystudentroomandbathroomandproceedtothe UpperRidingRing. TheAODandhouseparentswilldoarollcallofstudentsreportingnamesofmissingstudentsto theDeanofStudentsorAODwhowillinformthefirefightersofanyonemissing. TheAcademicDeananddepartmentheads(Maintenance,Dining,etc.)willtakeattendance, reportingnamesofmissingcommunitymemberstotheAcademicDeanorAODwhowillreport anyonemissingtothefirefighters.
