Animal Cruelty and Freedom of Speech

Program Description:
Balancing animal rights with the First Amendment is a double-edged
sword. The right to freedom of speech is fundamental to our society
and to protect virtually every other right we have as citizens. However,
the right is not absolute, and the Supreme Court has repeatedly found
that some speech is so injurious to society that certain narrowly tailored
limitations are permissible. This program will look at these issues as
they relate to animal cruelty. This is particularly timely as the Supreme
Court in US v. Stevens recently explored whether an individual has the
right to sell depictions of animal cruelty in interstate commerce, or
whether the sale of such depictions lie outside first amendment
protections, as in the case of obscenity or child pornography.
