Attached is the road improvement summary agreed upon by both NCDOT and the Village Traffic
Engineer. In addition staff has attached email exchanges since February that led up to the final list
of traffic improvements.
Kimley-Horn, the applicant’s traffic engineer, is in the process of updating the land uses in the
TIA to match the plan/uses that Regency Centers has for the project. This will include one fastfood restaurant. It was recommended by the Village’s traffic engineer that the Board place a
condition on the plan requiring the uses on the plan match the TIA and that the amount of trips
being generated by the current land uses will not go higher. If they do, the applicant will need to
revise the TIA at that time to include the increase in trips and any additional improvements based
on the new TIA.

Providence Road and New Town Road
 Construction of an eastbound right-turn lane with the storage length beginning at the previous
RIRO driveway with the taper being prior to this driveway.
 Construction of a southbound right-turn lane with the storage length beginning at the south side of
the previous driveway with the taper being prior to this driveway.
 Lengthen the existing eastbound left-turn lane storage on New Town Road to provide 300 feet of
storage and appropriate taper.
 Lengthen the existing westbound left-turn lane storage on New Town Road to provide a minimum
of 275 feet of storage and appropriate taper.
 Provide for 375 feet of northbound left-turn lane storage on NC 16 within the current three lane
section.
 Lengthen the existing southbound left-turn lane storage on NC 16 to provide for 300 feet of storage

 Coordinate with the Village of Marvin and Town of Waxhaw regarding the planned improvements
at the subject intersection and provide a monetary contribution towards the construction of the
improvements planned at the intersection.
Providence Road and Driveway #1
 Signalization of the intersection, as agreed upon by NCDOT
 Construction of a site driveway with three travel lanes:
o One ingress lane.
o A westbound left-turn lane with appropriate storage and taper.
o A westbound right-turn lane.
 Construction of a southbound left-turn lane with 325 feet of storage within the current three lane
section.
 Construction of a northbound right-turn lane that maximizes the available storage and an
appropriate taper.
 Provide for 200 feet of internal protected storage along Driveway #1.
 The proposed signal will be connected to the existing signal at New Town Road and NC 16 via a
fiber optic connection. Coordinated signal timing plans will also be prepared for both intersections.
Providence Road and Driveway #2
 Construction of a concrete island along NC 16 to physically restrict the inbound and outbound
left-turn movements of Driveway #2.
 Construction of an appropriate taper and large radius to accommodate ingress and egress into the
development.
 Provide for 100 feet of internal protected storage along Driveway #2.
New Town Road and Driveway #3
 Construction of a westbound left-turn lane with 150 feet of storage and appropriate taper.
 Construction of concrete channelizing islands on New Town Road to physically restrict the leftout movement from the site.
 Construction of an eastbound right-turn lane with 25 feet of storage and appropriate taper.
 Provide for 100 feet of internal protected storage along Driveway #3.

NCDOT COMMENTS FROM 2/9/2015 Below are my comments on this TIA. If you do not have any additional comments
than these can be sent to Jonathon Guy with Kimley Horn. I talked with Scott and
Louis about this and they want to be sure that the approved driveway permit (in
addition to approved TIA) clearly indicate that the signal on NC 16 at Access 1 will
be removed when NC 16 is widened.
Lisa – Can the Village get the plat to also clearly state that the signal on NC 16 at
Access 1 will be removed when NC 16 is widened?

turn and a traffic signal in the 2017 build and 2017 build with improvements
conditions. The NCDOT does not currently have a funded project to make any
of these improvements nor are they currently required improvements by any
development. As such it can’t be assumed these improvements will be in place
for the 2017 conditions. This intersection will need to be relooked at not
assuming these improvements have been made.
New Town Rd at Crane Rd
 Analysis done this intersection shows there being a westbound right turn lane
existing at intersection. This right turn lane does not exist today. Analysis
should be redone removing this from existing conditions. All comments below
are based on existing analysis and may change once analysis is redone
removing this lane from existing conditions unless it becomes a developer
recommended improvement.
 AM Peak LOS - The following drops in LOS or increases in delay are not
mitigated for with recommended improvements. These drops still occur even
after a longer cycle length was used in 2017 build with improvement
conditions. The other two approaches saw in an increase in LOS. Likely due
to longer cycle length.
o EB Approach drops in LOS from B to C
o WB Approach drops in LOS from C to D
 Storage Lengths – The following turn lanes see an increase in storage needed
from 2017 background to 2017 build and currently are not recommended to be
increased.

 Traffic volumes for intersection have been shown to meet warrants. TIA
should indicate that this signal is temporary and will be removed once NC 16
has been widened to multilane divided roadway.
 Fiber interconnect shall be installed between this signal and the signal at New
Town Rd. Coordinated timings plans shall be developed and ready to
implement before this signal is put into full operation.
 Span and ground mounted signs shall be installed for this signal on the side
street approaches indicating that this is a temporary signal.
 Though the traffic signal will be removed from this intersection when NC 16 is
widened there has already been talk about a 4th leg being added for additional
development. Should this occur it will be preferable that the lane configuration



on each side street approach be a left only and a thru/right. It is currently
being proposed that the westbound approach be built with a pocket right turn
lane. To accommodate a possible future 4th leg the westbound approach should
be built with a pocket left turn lane with 250’ of storage.
250’ of internal protected storage should be provided (measured from the
existing ROW line) since this will be a signalized access point.
A right turn lane will be required on northbound NC 16. Storage length to be
determined by Synchro/Sim Traffic analysis.
The westbound approach is shown that it will be operating at a LOS F during
the AM and PM peaks. Required northbound right turn lane may increase this
LOS or at least decrease delay.
NC 16 (Providence Rd) @ Site Access 2
 A median is recommended in the TIA on NC 16 to make this access point
RI/RO. There is an existing full movement drive almost directly across the
street from this access point. This will make installing the concrete median on
NC 16 a challenge if the idea is to leave this access full movement.
 100’ of internal protected storage should be provided (measured from the
future ROW line).
New Town @ Site Access 3
 Storage Lengths – The westbound left turn 95th queue is 77’ and Max Queue is
149’. Only 50’ of storage is recommended for this left turn lane. This turn lane
should be built with a minimum of 150’ of storage.
 100’ of internal protected storage should be provided (measured from the ROW
line).
 Concrete median on New Town Rd should be installed from NC 16 through
Site Access 3 and to Site Access 4.
New Town Rd @ Site Access 4
 Storage Lengths – The westbound left turn 95th queue is 52’ and Max Queue is
148’. Only 50’ of storage is recommended for this left turn lane. This turn lane
should be built with a minimum of 150’ of storage.

UPDATED NCDOT COMMENTS FROM 5/18/2015 NC 16 @ Bonds Grove Church
 I would like to get how much they will be contributing to this intersection
nailed down before we approve the TIA. We also need to work out who will be
taking this money. Marvin or Waxhaw.
NC 16 @ Driveway 1
 The TIA states a westbound right turn lane should be constructed. However,
we have asked that a westbound left turn lane be constructed so that when a
4th leg is added the right most lane can be converted to a thru/right.


The TIA needs to indicate that this signal shall be connected to the signal at
New Town through fiber and that the developer will be responsible for the
development of coordinated timings plans for these two signals.
Since this is a temporary signal and we are requiring them to install signs that
say as much this should be indicated in the TIA. A general sentence that states
that the developer is aware that this signal will be removed when NC 16 is
widened and that signs indicating this is a temporary signal shall be installed
alerting motorists of this.
New Town Rd
 The median island mentioned in reference to Driveway 3 should extend
between NC 16 and Driveway 4.
New Town @ Crane Rd
 The wording for this improvement should read “Install protected/permitted
phasing for the northbound and westbound left turn movements at the existing
signalized intersection.”
VILLAGE OF MARVIN TRAFFIC ENGINEER COMMENTS FROM 5/28/15 General:
The Right Turn on Red function at signalized intersections is typically not
recommended to be activated per NCDOT Congestion Management review
standards.
The “Lost Time” factor at the signalized intersections appears to be adjusted to 4.0
seconds per phase. The Lost Time is recommended to be adjusted to 5.0 seconds per
phase per NCDOT Congestion Management review standards.
According to the CRTPO Transportation Plan, Providence Road (NC 16) is
considered a boulevard and New Town Road is considered a major thoroughfare.
These roads were both considered major thoroughfares in the most recent CRTPO
Thoroughfare Plan. The typical section for both roadways will be, at a minimum, four‐
lane divided roadways with wide outside lanes and sidewalks. This development
should construct an additional lane along the frontage of the site on both Providence
Road and New Town Road to be used as right‐turn lanes at all entrances.
Trip Generation:
According to the trip generation manual and NCDOT, the weighted average of the
Peak Hour of Generator should be used to develop trips generated by a HighTurnover Sit-Down Restaurant (ITE 932). The study used the rates associated with
the peak hour of the adjacent street traffic. Therefore, the trips expected to be
generated by this land use were under counted.
Trip generation should be revisited and adjusted to include specific uses for all of
the outparcels. If the use of the outparcel is unknown, then the most intense use that
can fit within that space must be used. This will ensure that the highest intensity use
is studied to cover all possible uses. Typically, the most intense use for outparcels is
a fast food restaurant, bank, or convenience store with fueling positions. Please
supply a new trip generation table to be reviewed by the Village staff before
completing any additional traffic analyses.
Intersection of Providence Road (NC 16) & New Town Road:
Consider installing overlap phases to the existing signal to serve the southbound
and eastbound right turning vehicles. This will lower the delay expected to be
experienced on these approaches.
Intersection of Providence Road (NC 16) & Site Driveway #1:
Consider installing overlap phases to the proposed signal to serve the northbound
and westbound right turning vehicles. This will lower the delay expected to be
experienced on these approaches.
Due to the potential future widening of NC 16 as called for in Highway Program
U-5769, consider designing the westbound approach of Site Driveway #1 to
accommodate dual left turn lanes exiting the site when the road is widened. This
would allow more green time to be given to NC 16 and reduce future queueing and
delay. The driveway can be marked to allow only one exclusive left turn lane until
NC 16 is widened.
Intersection of Providence Road (NC 16) & Site Driveway #2:
According to the standards set in the Policy of Street and Driveway Access to North
Carolina Highways, an exclusive right turn lane is warranted on the northbound
approach of NC 16.
Intersection of New Town Road & Site Driveway #3:
According to the standards set in the Policy of Street and Driveway Access to North
Carolina Highways, an exclusive right turn lane is warranted on the eastbound
approach of New Town Road.
Intersection of New Town Road & Site Driveway #4:
According to the standards set in the Policy of Street and Driveway Access to North
Carolina Highways, an exclusive right turn lane is warranted on the eastbound
approach of New Town Road.
All of the other conclusions and recommendations made by the study are reasonable.
It should be noted that the North Carolina STIP U-5769 which calls for Provenance
Road (NC 16) to be widened to a multi-lane facility from SR 1316 (Rea Road
Extension) to SR 1321 (Cuthbertson Road) is scheduled to begin Right-of-Way and
Utility work in 2022 and Construction in 2024.
Updated VOM Traffic Engineer Comments from 5/29/2015 Jonathan Guy from Kimley-Horn just called our office and talked to Jonathan Cate
about the TIA for Marvin Gardens. They wanted to respond to some of the comments
we made about the TIA. Here are the details of the conversation:
1) Trip Generation: they were worrisome about our comment to develop a new
trip generation table for more intense uses. They believe that they cover the
possible uses for the outparcels in the TIA and is reflected on the rezoning plan.
We said that we would agree with their trip generation if they made the uses
a condition of the rezoning. Therefore, we would be placing a trip cap on their
overall site. If they eventually place uses on the site that are more intensive,
they would have to update the TIA and could open themselves up to more
improvements. If you would like for us to write that condition for the rezoning,
we can do that.
2) Right turn on red and lost time for the signals: Jonathan from Kimley-Horn
said that he worked out these details with the Division 10 office (Sean
Epperson) since the Division does not typically send the TIA’s onto Congestion
Management in Raleigh. It sounds like they worked out the details, but we
have no documentation of any conversations or e-mails between Kimley-Horn
and the Division.
3) They generally agreed with all of the other comments.
UPDATED VOM Traffic Engineer Comments from 6/1/2015 1) We reviewed the traffic impact analysis (TIA) and rezoning plan. We indicated
to the developer and traffic engineer that we wanted to see more intense uses
in the TIA and rezoning plan and that they both needed to match each other.
Our reasoning was that we wanted to be prepared for future conditions in case
the uses on the site changed.
2) We had a discussion with the Traffic Engineer on Friday where he indicated
that the uses on site are fixed and are reflected in the TIA. The discussion
centered around the outparcels, as those are typically the unknown uses
during a rezoning of a property. Those four uses for the four outparcels are as
noted in the TIA:
a. Bank with 3 drive-in lanes
b. 2,000 SF Coffee Shop with drive-thru
c. Convenience store with 8 fueling positions
d. 5,000 SF High-turnover sit down restaurant
Since the Traffic Engineer noted that these uses are fixed and match the
rezoning plan, that we were acceptable of these uses IF AND ONLY IF they
include these uses verbatim on the plan and commit to these uses as a
condition of the rezoning. If the developer does commit to these uses, if they
change any of these uses to a more intense use (i.e. a fast-food restaurant),
then they would have to complete a brand new TIA before moving on with any
planning (or design or construction) and be subject to further recommendations
for improvements either on-site or off-site. If they commit to these conditions,
then in our opinion, they are satisfying our concerns over the land uses.
While they will be satisfying our review, because this is a rezoning, it is within your
right to ask for what you believe. If you want them to include a fast-food restaurant
in their TIA as a condition of the rezoning, you can ask. I believe that creating these
conditions as we discussed on Wednesday in both text and pictures on the plan should
cover all of the Village’s concerns for this rezoning.
NCDOT’S REVIEW OF VOM Traffic Engineer Comments from 5/28 ‐ received 6/1/2015 General - The first two will have minimal impact on recommended improvements. In
addition the allowance of right turns on red is something I allowed as it will be
allowed in the field. For the 3rd comment I see no issue with this happening provided
the pavement markings installed create pocket right turn lanes at all intersections.
Trip Generation - These numbers have been approved by us. I have no issues with
these comments being made now but would have been best had they been made when
first draft of TIA was submitted last year.
NC 16 @ New Town – These overlap phases will be required when signal design is
done.
NC 16 @ Site Driveway #1 – Again overlap phases will be required when signal design
is done. Since this full movement signalized intersection will be removed when NC
16 is widened the NCDOT is not going to require this driveway to have the ability to
go to dual lefts in the future.
NC 16 @ Site Driveway #2 – No issues with this requirement of a right turn lane on
NC 16. Page 30 of the TIA already recommends a 75’ right turn lane here however
that recommendation did not make it to final recommendations on page 34. This
should be corrected in revised TIA. I did not catch that this recommendation did not
transfer to final recommendations in my earlier review.
New Town Rd @ Site Driveway #3 – No issues with this requirement of a right turn
lane on NC 16. Page 30 of the TIA already recommends a 100’ right turn lane here
however that recommendation did not make it to final recommendations on page

then the Village should probably follow suit. My opinion is that the trip generation

If the TIA had an scoping MOU, this would have been decided before any TIA was
submitted. Hence, the value of the MOU.
NC 16 @ New Town – These overlap phases will be required when signal design is
done. OK
NC 16 @ Site Driveway #1 – Again overlap phases will be required when signal design
is done. Since this full movement signalized intersection will be removed when NC
16 is widened the NCDOT is not going to require this driveway to have the ability to
go to dual lefts in the future. As long as the developer knows this, we are OK with
this. The driveway should have separate right and left turn lanes for egress as
dictated in the TIA, but those two egress lanes are not yet shown on the plan.
NC 16 @ Site Driveway #2 – No issues with this requirement of a right turn lane on
NC 16. Page 30 of the TIA already recommends a 75’ right turn lane here however
that recommendation did not make it to final recommendations on page 34. This
should be corrected in revised TIA. I did not catch that this recommendation did not
transfer to final recommendations in my earlier review. His last three sentences is
the reason why we made the comment. The TIA said the turn lane was needed, but
didn’t show the improvement in figure 9 that showed all of the recommended
improvements. We agree that this needs to be corrected in the TIA. Also, if they show
adding the additional lane on NC 16, this will be taken care of anyway.
New Town Rd @ Site Driveway #3 – No issues with this requirement of a right turn
lane on NC 16. Page 30 of the TIA already recommends a 100’ right turn lane here
however that recommendation did not make it to final recommendations on page
34. This should be corrected in revised TIA. Again did not catch this recommendation
not transferring to final recommendations. See site driveway #2 response.
