1. Lucky Draw
1.1. #MYCYBERSALE 2016 Lucky Draw Contest is organised by the Malaysia Digital
Economy Corporation Sdn Bhd (MDEC).
1.2. The Lucky Draw is governed by these terms and conditions and
accompanying details and/or guidelines (if any) as may be issued and
specified by MDEC. By submitting an entry, the Participant agrees that he/she
has read and understood these terms and conditions and agrees to be bound
by the same.
2. Eligibility
2.1. The Lucky Draw is open to any individual who fulfils the following criteria:
(a)
A citizen or permanent resident of Malaysia, Singapore, Brunei or
Indonesia, over the age of 18 years old;
(b)
Made a minimum purchase of at least RM50.00 from any of the eTailers
of #MYCYBERSALE 2016 during the period from 26 September 2016 to 30
September 2016 (Purchase Period); and
(c)
NOT an employee, officer or director of MDEC.
(hereinafter individually referred to as “Participant” and collectively referred
to as the “Participants”).
2.2. MDEC reserves the right at any time to verify the eligibility of any of the
Participants and to disqualify any Participants who do not meet the above
eligibility criteria.
3. Submission Period
3.1
Only purchases made during the Purchase Period are entitled to participate
in the Lucky Draw provided that such purchases are submitted during the
period starting 26 September 2016 until 7 October 2016 (Submission Period).
MDEC reserves the right at its sole and absolute discretion to suspend or
extend the Submission Period for any reason at any time and without any
liability. Any changes in dates will be communicated through
www.mycybersale.my.
4. Submission of Entry
4.1
All entries in the Lucky Draw are to be submitted online at
www.mycybersale.my during the Submission Period specified in Item 3.1
hereinabove, by completing the Lucky Draw form (Lucky Draw Form)
available at www.mycybersale.my together with the proof of payment
evidencing the purchase of at least RM50.00 from any of the eTailers of
#MYCYBERSALE 2016 during the Purchase Period.

4.2
All eligible and complete entries shall be entered in the Main Draw as
specified in Item 6.1 below. In addition entries paid with VISA credit, debit or
pre-paid cards which includes purchases made using VISA Checkout shall be
entitled to participate in the “VISA Spend & Win” contest sponsored by VISA
as specified in Item 6.2 below.
4.3
MDEC has the right at its sole and absolute discretion to reject any entries if
incomplete, illegible, damaged, mutilated, tampered with, falsified, irregular
in any way or otherwise not in compliance with these terms and conditions.
4.4
There is no restriction in the number of entries that a Participant may submit,
provided that a Participant may only submit 1 entry with receipt(s) of at least
RM50.00 of purchase made during each of the five days of the Purchase
Period.
4.5
Proof of an entry does not constitute proof or evidence that MDEC has
received the entry by or before the Submission Period or that it is otherwise
eligible for the Lucky Draw.
5. Notification to Winner
5.1. Winners will be notified no later than 15 October 2016, through the contact
details stated by the Participant in the Lucky Draw Form.
5.2. In the event that MDEC is unable to contact any of the winners within 3
working days for whatever reasons, the prize of that particular winner will be
forfeited at the sole discretion of MDEC. No alternatives will be offered.
6. Prize
6.1. Main Draw: The list of prizes is as follows, and each winner will only be entitled

6.2 VISA Spend & Win: For Participants who made payment using VISA credit, debit
or pre-paid cards, each of the highest top twenty five (25) spenders shall be

6.3 Subject to Item 4.4, a Participant with multiple entries shall only be entitled to
only 1 prize in the main draw.
6.4 Prizes are non-refundable, non-exchangeable, not redeemable for cash, and
non-transferable. MDEC makes no representation, warranty or undertaking
whatsoever as to any implied terms and conditions with respect to the prizes,
including, without limitation, relating to quality, merchantability or fitness for a
particular purpose. MDEC assumes no liability or responsibility whatsoever in
respect to defect or deficiency of the prizes and will not entertain any
correspondence in this regard. All winners shall accept the prizes on an “as is”
basis.

6.5 Any prize not claimed within 30 days of notification will be forfeited. No
alternatives will be offered. For the avoidance of doubt, if a winner fails to claim
the prize within the stipulated duration, MDEC shall have the right at its own
discretion to re-draw.
7. Exclusion of Liability
7.1
MDEC, its employees, agents and representatives hereby disclaim any and all
liabilities that may arise in connection with the Lucky Draw and any materials
produced in relation thereto.
7.2
Further, MDEC, its employees, agents and representatives shall not be held
responsible for any entries that are lost or damaged in transit.
8. Miscellaneous
8.1. Submission of an entry constitutes the Participant’s unconditional agreement
to and acceptance of these terms and conditions. Each Participant therefore
agrees to be bound by and abide to these terms and conditions including
any amendments, modifications and/or interpretation thereof.
8.2. Each of the Participants hereby agrees to release and hold harmless MDEC,
its employees, agents and representatives against any and/or all losses,
damages, rights, claims and actions of any kind in connection with the Lucky
Draw (including resulting from acceptance, possession, use or misuse of any
prizes, or travel to or from any prize-related activity).
8.3. No representation, warranty or undertaking is given that any entry submitted
by the Participants will be received or held in confidence.
8.4. MDEC reserves the right to cancel, terminate or modify the Lucky Draw or
these terms and conditions without prior notice, at its sole and absolute
discretion.
8.5. MDEC reserves the right to publish and display the names, address,
photographs, audio and visual recordings of the winners, in any mass media
or marketing materials for advertising and publicity purposes without payment
or compensation.
8.6. MDEC’s failure to enforce any of these terms and conditions shall not
constitute a waiver of that provision.
8.7. The decision of MDEC on all matters relating to or in connection with the Lucky
Draw (including selection of the winners) is final and binding on all parties
concerned.
8.8. If any of these terms and conditions shall be found by any court or
administrative body of competent jurisdiction to be invalid or unenforceable,

the invalidity or unenforceability of such terms and conditions shall not affect
the other provisions and all provisions not affected by such invalidity or
unenforceability shall remain in full force and effect.
8.9. MDEC is committed to the handle all personal data in relation to the Lucky
Draw in compliance with applicable personal data protection laws and
regulations in Malaysia. The “Personal Data Protection Statement” published
by MDEC is available at www.mdec.my/pdp. By participating in the Lucky
Draw, each of the Participants is deemed to have read, understood and
agreed to the aforesaid Personal Data Protection Statement.
8.10. The Lucky Draw, these terms and conditions and accompanying details
and/or guidelines (if any) as may be issued and specified by MDEC and all
disputes and differences arising therefrom shall be governed by and
construed in accordance with the laws of Malaysia. The Participants agree
that all disputes shall be resolved amicably, failing which the courts of
Malaysia shall have exclusive jurisdiction to settle any dispute.
