In most cases, yes. Depending on the activity and location
a licence may be required.
Using public space is a great way to connect with
your target audience and promote your business
or cause. It is also very important to respect
others when using public space so you don’t
intentionally or unintentionally harass, obstruct
or aggravate members of the public.

“Why is a licence required for distributing promotional
goods?”
Auckland Council has a responsibility to ensure public
space is free from obstruction, commercial harassment
and is kept clean and tidy. Licencing these activities means
we can control what goes on in public space and keep the
public’s best interest first.
“I want to promote my brand by distributing samples to
the public. Do I need a licence?”
Yes. If you are using public space for the intention of
commercial promotion you will require a licence. Some
promotional activities may not be approved as they may
be unsuitable for the proposed environment.
“I want to distribute flyers to pedestrians on a main road.
Do I need a licence?”
Yes, flyer distribution is considered a promotional activity.
Handing out flyers can be seen by the public as invasive
and often causes issues with litter. As part of an
application we would expect you to plan control methods
to eliminate any breach to the Litter Act. Where applicable,
permission must first be sought from the local business
association to ensure the promotion fits the needs of
the local business district.
“I want to promote a religion which I won’t see any
financial return for. Do I need a licence?”
In most cases, no. You must first notify council of your
intentions if you will be using public space for promotion.
There are some key factors to consider when choosing a
location. Members of the public must not be harassed or
have their walking line obstructed. Please contact us so we
can give you some advice.
I want to do a sale promotion outside my shop by having
an outdoor display. Do I need council approval?”
No. All outdoor displays must meet the outdoor displays
criteria, see our website for more details. No goods are
to be sold on public land, the transaction must take place
within the premises. A licence must be obtained for any
distribution of flyers, vouchers or samples.
“Is there a fee for this licence?”

“How do I apply?”
Apply online at aucklandcouncil.govt.nz/streettrading or
pick up an application form from your local service centre.
“Can my licence be renewed or transferred?”
No. A new application is required for each new proposed
activity.
