CITY OF LAKESIDE PARK, KENTUCKY ORDINANCE NO. OI-20I7 The City of Lakeside Park, Kentucky at a special meeting held on January 14,2017 had a second reading of Ordinance 0l-2017 and same was adopted by the Lakeside Park, Kentucky City Council, a Summary of which is set forth below: AN ORDINANCE OF THE CITY OF LAKESIDE PARK, KENTUCKYAMENDING CERTAIN SECTIONS OF THE LAKESIDE PARK, KENTUCKY CODE OF ZONING ORDINANCES NO"' THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LAKESIDE PARK, KEKNTACKYAS FOLLOWS: Lakeside Park, Kentucky needed to amend certain sections of its Zoning Ordinances and has complied with the requirements of KRS 100.211. As such, the City Council amended certain sections of its Zoning Ordinances by adding a definition for Block Front, amended Front Yard Variance, Access Control Regulations, and expended the Fence and Wbll Regulations. This Summary Ordinance was prepared by Greg D. Voss, Esq., 2131 Chamber Center Drive, Lakeside Park, Kentucky 47017, an attorney licensed to practice law in the Commonwealth of Kentucky. I-20I7 AN ORDINANCE OF THE CITY OF LAKESIDE PARK, KENTUCKYAMENDING CERTAIN SECTIONS OF THE LAKESIDE PARK, KENTUCKY CODE OF'ZONING ORDINANCES WHEREAS, Lakeside Park, Kentucky desires to amend certain sections of its Zoning Ordinances; and WHEREAS, upon application of the City of Lakeside Park, the Kenton County Planning Commission held a public hearing on January 5,2017 regarding the application; and IFHEREAS, the Kenton County Planning Commission issued its Findings of Fact and made a recommendation of approval on the text amendments as required by K.R.S. 100.211 (3); and WHEREAS, Lakeside Park, Kentucky has complied with the requirements of K.R.S. 100.211; NO'I' THEREFORE, BE IT ORDAINED BY THE CITY COANCIL OF THE CITY OF LAKESIDE PARK, KENTUCKII AS FOLLOIIS: SECTION I Article VII, Definitions, Section 7.0 of the City of Lakeside Park Zoning Ordinances shall be amended by adding the following definition: Section 7.0 uWords and Phruses".'For the purposes of this Ordinance, certain terms, phrases, words, and their derivatives are herewith defined as follows: BLOCK FRONT: All the property located along one side of a street between two intersecting streets or between any combination of intersectine streets. railroad right-of-ways. watercourses or other features or natural barriers which permanently intemrpt the continuity of development. SECTION II Article IX, Exceptions and Modifications Section 9.11, C. shall be amended as follows: C. FRONT YARD VARIANCE 1. Where the average depth of existing front yards within three hundred (300) feet of the lot in question and within the same block front, is greater than the minimum front yard depth required by this ordinance, the minimum required front yard depth on such lot shall be modified to be the average depth of said existing front yards. a. For the purposes of determining front yard setbacks in Section 9.1 1.C.1 a proposed new road _ shall not be considered an interruotion in the existing block front. 2. lnany residential zone, no front yard shall be required to exceed the average depth of existing front yards on the same side of the street within the same block, when fifty-one (51) percent or more of the lots within that block are improved with residential buildings, provided that in no case shall a front yard depth be less than twelve (12) feet. SECTION III Article XI, Section 11.3 (G) shall be amended by adding the following sub-section: Section 11.3 ACCESS CONTROL REGULATIONS G. LOCATION OF I]NSIGNALIZED ACCESS POINTS 3. Local a. Streets tracts of land located along local streets shall be permitted to have one access point. However. if a tract of land located along a local street contains road frontage that is greater than or equal to 100 feet. an additional access point malz be permitted. Furthermore. the minimum spacing between adjacent access points on this tlipe of facility shall be 60 feet. measured from point of curb return to point of curb return. In no case shall the impervious surface ratio exceed the requirements of Section 1 1.0.C.1.a (1). SECTION VI Effective Date: This Ordinance shall be effective when read, passed and published according to law. SECTION VII Publication This Ordinance may be published in summary pursuant to KRS 183A.060(9).
