AND ORDINANCES; RESTRICTING APPLICABILITY TO UNINCORPORATED
AREAS OF COUNTY; REQUIRING A CERTIFIED COPY TO BE SENT TO THE
DEPARTMENT OF NATURAL RESOURCES; STATING STATUTORY PENALTIES
FOR VIOLATION; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, this Board has made the following determinations of fact:
1.
Pursuant to Sections 1 and 6, Article VIII, CON-
STITUTION OF THE STATE OF FLORIDA, and Chapter 125, FLORIDA
STATUTES, this Board has the power to enact ordinances;
2.
Pursuant to Section i25.01
(1) (h), FLORIDA
STATUTES, this Board has the power to establish, co-ordinate
and enforce business regulations;
3.
By virtue of Section 125.01
(i), FLORIDA STATUTES,
and of Section 1 (1), Chapter 61-2466, LAWS OF FLORIDA, this
Board has the power to "adopt by reference or in full, and enforce building, housing and related technical codes and regulations;"
4.
In Part I1 of Chapter 553, FLORIDA STATUTES, the
FLORIDA LEGISLATURE has established the Florida Electrical Code
as a mandatory state-wide minimum standard, but delegated enforcement and administration of such code to local governments;
5.
It is necessary and proper for this Board to en-
force and administer the Florida Electrical Code in the unincorporated areas of the county as well as more stringent local
requirements;
6.
In Part VII, Chapter 468, FLORIDA STATUTES, the
FLORIDA LEGISLATURe set up state-wide certification requirements for electrical contractors, but provided for local licensing of electrical contractors not certified by the state;
7.
It is necessary and proper for the county to li-
cense electrical contractors not certified by the state and to
license journeyman electricians; and
8.

The public, health, safety and welfare require
the adoption of this ordinance;
NOW THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF MARTIN COUNTY, FLORIDA, THAT:

ARTICLE I.
SECTION 11-1.
IN GENERAL.
DEFINITIONS.
Unless specifically defined in this chapter,
electrical and technical words and phrases are used in their
normal meaning within the electrical trade, legal words and
phrases are used in the normal meaning within the legal profession, and other words or phrases are used in their ordinary meaning in common usage in the United States.
The fol-
lowing terms are specifically defined as follows:
ELECTRICAL WORK shall include all electrical
construction, and all materials and appliances used in connection with the installation, maintenance, and operation of
electrical wiring, apparatus, or equipment for light, heat or
power ;
JOURNEYMAN ELECTRICIAN is an electrician qualified to supervise and/or perform electrical installations;
MASTER ELECTRICIAN means the same as EMPLOYING
ELECTRICIAN and ELECTRICAL CONTRACTOR and used in this chapter
as defined in Section 468.181
(5), FLORIDA STATUTES, which is
incorporated herein by reference.
The term also means any per-
son who holds a currently-valid county master electrician's
license.
SECTION 11-2.
ELECTRICAL ENFORCEMENT DISTRICT CREATED.
For the purpose of enforcing and administering
the provisions of this chapter, the unincorporated areas of
the county shall constitute an electrical enforcement district
pursuant to Section 553.21, FLORIDA STATUTES.
SECTION 11-3.
BUILDING DEPARTMENT AND BUILDING DIRECTOR TO
ENFORCE AND ADMINISTER PROVISIONS OF THIS CHAPTER.
Subject to the direction and supervision of the
Board of County Commissioners and the County Administrator, the

ARTICLE 11.
SECTION 11-15.
ELECTRICAL BOARD.
ESTABLISHED; COMPOSITION; APPOINTMENT OF MEMBERS.
There shall be a county board known as the
Electrical Board of Martin County, Florida, which shall consist
of five members appointed by the Board of County Commissioners.
SECTION 11-16.
QUALIFICATION OF MEMBERS.
Each member shall be a registered voter in the
county and shall be a county licensed master electrician or a
state certified electrical contractor.
No member shall hold
elective public office or be a public employee of public official, except in his capacity as a member of such board.
SECTION 11-17.
TERMS OF MEMBERS.
The term of a member shall expire on November
30 each year, or earlier at the pleasure of the Board of County
Commissioners, or automatically if the member ceases to be a
registered voter in the county or ceases to be a county licensed
master electrician or a state certified electrical contractor.
SECTION 11-18.
SALARY AND EXPENSES OF MEMBERS.

the Board of County Commissioners from time to time by resolution or ordinance and may be reimbursed for their actual expenses
incurred in the performance of their duties in accordance with
procedures established by the Board of County Commissioners and

SECTION 11-19.
MEETINGS.
The Electrical Board shall meet at least once
a month or more frequently as directed by the Board of County
Commissioners.
The chairman of the Electrical Board or the
Building Director may call special meetings as they deem necessary.
Each meeting shall be held in the county courthouse
or such other place as may be designated by the Board of County
Commissioners and shall be open to the public.
SECTION 11-20.
OFFICERS.
The officers of the Electrical Board shall be
the chairman and the vice-chairman and ex officio the building
director, the secretary and the attorney.
SECTION 11-21.
QUALIFICATIONS AND DUTIES OF CHAIRMAN AND VICECHAIRMAN.
The chairman and vice-chairman shall be mem-
bers of the Electrical Board and shall be elected by the members at the first meeting in December each year and shall serve
one year or until their successors are elected.
The chairman
shall preside at the meetings, may administer.oaths and may
compel the attendance of witnesses.
The vice-chairman shall
act in the absence of the chairman and may exercise any and all
powers of the chairman during such absence.
SECTION 11-22.
BUILDING DIRECTOR.
The Building Director shall advise the Electri-
cal Board on matters of a nonlegal nature and shall make a
recommendation or report to the board on each matter considered
by it.
SECTION 11-23.
SECRETARY.
The secretary shall be a county employee desig-
nated by the Building Director, or shall be such other person
as the Board of County Commissioners shall designate.
The see-
retary shall record all meetings of the Electrical Board by
tape recorder or such other means as may be designated by the
Board of County Commissioners.
The secretary shall also prepare
minutes of each meeting, which minutes shall show the vote of
each member upon each question or indicate if a member were
absent or failed to vote.
Such minutes may be in a summary
or outline form, so long as they accurately reflect the deliberations of the Electrical Board.
SECTION 11-24.
ATTORNEY.
The attorney shall be the county attorney or
an assistant county attorney and shall advise the board on
matters of a legal nature.
SECTION 11-25.
RECORDING OF MINUTES.
The minutes and tapes of the Electrical Board
shall be public records and shall be kept in the offices of
the Building Department or such other place as the Board of
County Commissioners shall designate.
The Clerk of the Circuit
Court as Ex Officio Clerk of the Board of County Commissioners
shall record such minutes in the official records of the county,
or in the official minutes of the Board of County Commissioners
or such other proper place as may be approved by the Board of
County Commissioners.
Such recording may be by microfilming or
other photographic process.
SECTION 11-26.
RULES OF PROCEDURE.
Three (3) members of the Electrical Board shall

SECTION 11-27.
POWERS AND DUTIES.
The Electrical Board shall have the following

1.
REVIEWING COUNTY ELECTRICAL CODE.
To advise the Board of County Commissioners
concerning the county electrical code, its adoption, its amendment, and the revision of the
Florida Electrical Code or any standard published
code of technical regulation which constitutes all
or part of said code;
2.
ADVICE TO BOARD OF COUNTY COMMISSIONERS.
On its own initiative or whenever requested
to do so by the Board of County Commissioners, to
give advice to the Board of County Commissioners
and to other public officials or employees with
reference to any matter affecting electricians
or electrical contracting within the county;
3.
EXAMINATION OF ELECTRICIAN'S LICENSE HOLDERS
AND APPLICANTS THEREFOR.
To examine or cause to be examined holders
of electrician's licenses within the county or
applicants for such license, in accordance with
the requirements of this chapter;
4.
LICENSING OF ELECTRICIANS.
To license electricians pursuant to the re-
quirements of this chapter;
5.
REVIEW OF VIOLATIONS OF CHAPTER BY LICENSE
HOLDERS,
To investigate and review any and all vio-
lations or alleged violations of this chapter
by an electrician licensed in this county or
certified by the state or by any other person,
firm or corporation and if it determines that
there has been a violation of this chapter to
report the same to the Board of County Commissioners for its consideration pursuant to Article IV of this chapter,

SECTION 11-30.
BOARD OF ELECTRICAL ADJUSTMENTS AND APPEALS.
The Board of County Commissioners s h a l l con-
s t i t u t e t h e Board of E l e c t r i c a l Adjustments and Appeals under
t h i s c h a p t e r and may u t i l i z e t h e s e r v i c e s of a l i c e n s e d master
e l e c t r i c i a n t o h e l p it t o i n t e r p r e t any t e c h n i c a l p o i n t s involved.
Such Board s h a l l have t h e power, when appealed t o and
a f t e r a he.aring, t o vary t h e a p p l i c a t i o n of. any p r o v i s i o n of
t h i s c h a p t e r t o any p a r t i c u l a r c a s e when, i n i t s opinion, t h e
enforcement thereof would do manifest i n j u s t i c e and would be
c o n t r a r y t o t h e s p i r i t and purpose of t h i s c h a p t e r o r t o t h e
p u b l i c i n t e r e s t o r , when i n i t s opinion, t h e i n t e r p r e t a t i o n of
the E l e c t r i c a l Board o r of t h e Building D i r e c t o r a c t i n g i n h i s
c a p a c i t y a s E l e c t r i c a l O f f i c i a l under t h i s c h a p t e r should be
modified o r reversed.
SECTION 11-31.
I N S T I T U T I N G APPEALS.
Any person, f i r m o r c o r p o r a t i o n aggrieved by
any d e c i s i o n o r a c t i o n of t h e E l e c t r i c a l Board o r by any dec i s i o n o r a c t i o n of t h e Building D i r e c t o r a c t i n g i n h i s capac i t y a s E l e c t r i c a l O f f i c i a l under . t h i s c h a p t e r may appeal such
d e c i s i o n o r a c t i o n t o t h e Board 'of County Commissioners a s t h e
Board of E l e c t r i c a l Adjustments and Appeals by f i l i n g a w r i t t e n
n o t i c e of appeal with t h e County Administrator w i t h i n t h i r t y
days of such d e c i s i o n o r a c t i o n .
Such n o t i c e s h a l l s t a t e t h e
f u l l p a r t i c u l a r s of t h e d e c i s i o n o r a c t i o n being appealed from
and s h a l l s t a t e t h e grounds o r reasons f o r such appeal.
SECTION 11-32.
HEARING APPEALS.
Upon r e c e i v i n g a n o t i c e of a p p e a l , t h e County
Administrator s h a l l schedule a hearing thereon a t a r e g u l a r o r
s p e c i a l meeting of t h e Board of County Commissioners t o be h e l d
w i t h i n t h i r t y days of such r e c e i p t and s h a l l n o t i f y t h e a p p e l l a n t
thereof in writing at least five days prior thereto, but the
appellant may waive such notice,

A.
WHO REQUIRES A LICENSE.
Unless exempted from t h e p r o v i s i o n s of t h i s
a r t i c l e , any person engaged i n o r working a t t h e b u s i n e s s of
e l e c t r i c a l c o n t r a c t i n g o r the occupation of e l e c t r i c i a n i n t h e
e l e c t r i c a l enforcement d i s t r i c t c r e a t e d by t h i s c h a p t e r , e i t h e r
as an e l e c t r i c a l c o n t r a c t o r , master e l e c t r i c i a n o r employing
e l e c t r i c i a n , o r a s a journeyman e l e c t r i c i a n s h a l l be r e q u i r e d
t o h o l d a c u r r e n t l y v a l i d county e l e c t r i c i a n ' s l i c e n s e of t h e
a p p r o p r i a t e c l a s s i n accordance w i t h t h e p r o v i s i o n s of t h i s
article.
B.
UNLAWFUL FOR PERSON TO WORK AS ELECTRICIAN

ALL ELECTRICAL WORK TO BE IN CHARGE
LICENSE OR CERTIFICATE HOLDERS.
Whenever any electrical work is being done
in the electrical enforcement district created by this chapter,
a county-licensed master electrician or a county-licensed journeyman electrician shall at all times be present on the job and
in actual control and in charge of the work being done, except
when such work is being done by a person, firm or corporation
exempt from the requirements of this article.
SECTION 11-36.
EXEMPTIONS.
A.
licensing
The following are exempted from the/provi-
sions of this article:
(1) Public electric utility companies and
public telephone utility companies, on construction, maintenance,
and development work performed by their forces and incidental to
their business;
(2)
Cable television companies on work up
to sixty (60) volts performed by their forces and incidental to
their business;
(3) Any work involving thirty (30) or less
volts, or any person, firm or corporation performing such work;
(4) An owner of property making application
for permit, supervising and doing the work in connection with
the construction, maintenance, repair, and alteration of and addition to a single-family house for his own use and. occupancy
and not intended for sale;
(5) Any person, firm or corporation hold-
ing a currently valid certificate of competency issued by the
Florida Electrical Contractors Licensing Board pursuant to Part
VII, Chapter 468, FLORIDA STATUTES.
B.
Exemption from this article shall not ex-
empt anyone from the occupational licensing requirements of
Section 13-17 of this County Code.
SECTION 11-37.
I
ELECTRICIAN'S LICENSES - ISSUANCE AND QUALIFICATIONS THEREFOR; CLASSES; EXPIRATION DATE;
RENEWAL; FEES; REVOCATION AND SUSPENSION; PERSONAL NATURE OF LICENSES WITH CERTAIN EXCEPTIONS.
A.
ISSUANCE.
Electrician's licenses shall be issued by
the Electrical Board to all persons who apply for such licenses,
establish their qualifications pursuant to this article, pay
the necessary fees, and pass the required examination; provided,
however, that no examination or requalification shall be required of those persons holding currently valid county electrician's licenses on the effective date of this article, nor shall
an examination be required of new applicants for a journeyman
electrician's license who apply within ninety days of such effective date and who otherwise meet the licensing requirements.
No license shall be issued to any person whose electrician's
license is under suspension in any jurisdiction or whose electrician's license has been revoked by any jurisdiction within
the previous five (5) years.
B.
CLASSES OF ELECTRICIAN'S LICENSES.
There shall be two classes of electrician's
licenses, as follows:
(1) MASTER ELECTRICIANIS LICENSE for electrical contractors, master electricians or employing electricians.
Three or more years of practical experience as a journeyman
electrician shall be required for such license, but up to one
half of such experience may be college-level or equivalent
electrical or related engineering courses on the basis of three
semester hours of such courses being equal to three months of
practical experience.
Master electricians are required to carry
property damage, public liability and workmen's compensation
insurance and to provide certificates of such insurance to the
Building

Master electricians shall also be required to show
proof of having a currently valid county occupational license.
A master electrician shall subcontract the work of any other
craft for which an examination for certificate of competency
or registration or license is required in the electrical enforcement district created by this chapter, unless such master
electrician holds such a certificate, registration or license
which is valid within such district.
(2) JOURNEYMAN ELECTRICIAN ' S LICENSE for
journeyman electricians.
Five years of practical electrical
experience shall be required, but up to one half of such experience may be college-level or equivalent
electrical

engineering courses on the basis of three semester hours
of such courses being equal to three months of practical experience.
C.
EXPIRATION DATE OF LICENSES.
~1~ licenses, regardless of when issued,
shall expire on the following September 30.
D.
RENEWAL OF LICENSES.
All licenses shall be renewed on or before
September 30 each year.
Upon payment of a delinquent fee, li-
censes may be renewed at any time before December 31.
After
December 31, no renewals shall be made and a new license will
have to be applied for.
E.
LICENSE FEES shall be the following or such

REVOCATION AND SUSPENSION OF LICENSES.
Any license issued hereunder may be revoked
or suspended only by the Board of County Commissioners for cause
after holding a public hearing thereon at which the licenseholder shall have been afforded an opportunity to show cause why
his license should not be revoked.
Notice of such hearing shall
be sent by certified mail, return receipt requested, to the license holder or served upon him by a sheriff of this state at
least ten days prior thereto.
Cause for revocation of suspension
shall be any of the following:
(1) Fraudulent or materially misleading
statements in the license application;
(2) Cheating on the examination required
by this article; or
I
(3) Material violation of any part of the
county electrical code or any other provision of this chapter.
A criminal conviction shall not be necessary to prove a violation.
G.
PERSONAL AND NON-TRANSFERABLE NATURE OF
.LICENSES WITH CERTAIN EXCEPTIONS.
Licenses issued under this article are per-
sonal in nature, can only be issued to natural persons, and
cannot be assigned or transferred to any other person, firm or
corporation; provided, however, that a county-licensed master
electrician owning at least forty per cent interest in a firm
or corporation may have his license issued in the name of such
firm or corporation; and provided, further that two or more
county-licensed master electricians owning in the aggregate at
least sixty'per cent interest in a firm or corporation may have
their licenses issued in the same manner.
SECTION 11-38.
APPLICATION FOR LICENSES.
Any person desiring to engage in or work at
the business of electrical contracting or the occupation of
electrician either as a master electrician or employing electrician or as a journeyman electrician in the electrical enforcement district created by this chapter shall make application for the appropriate class electrician's license to the
~lectricalBoard on forms provided by the Building Director.
Such application shall include the applicant's full name, residence address, mailing address if different, telephone number, date of birth, social security number, a recent photograph for identification purposes, a full resume of the applicant's electrical experience and formal education, complete
details concerning suspension or revocation of any electrician's
license held by the applicant in this or any other jurisdiction,
and authorization to verify any and all statements contained in
the application, shall be signed and sworn to by the applicant,
and shall be accompanied by a check or money order payable to
"Martin County" for the appropriate license fee.
The applica-
tion shall constitute a public record, shall be appended to the
minutes of the Electrical Board, and may not be returned to the
applicant under any circumstances.
SECTION 11- 39.
EXAMINATIONS.
A.
EXAMINATIONS REQUIRED.
Unless otherwise exempted in this article,
every applicant for an electrician's license shall stand and
pass with a grade of 75 per cent or higher a standardized examination appropriate for the class license applied for.
Such
examination shall be available at least quarterly and shall be
conducted by an independent testing agency approved by the
Electrical Board or the Board of County Commissioners.
B.
EXEMPTION FOR EQUIVALENT EXAMINATIONS.
An applicant who has elsewhere stood and
passed with a grade of 75 per cent or higher an equivalent
standardized examination appropriate for the class license applied for shall be exempted from this requirement.
SECTION 11-40.
UNLAWFUL TO LEND NAME OR LICENSE TO UNLICENSED
PERSONS.
It shall be unlawful for any person, firm or
c~rporationholding a county electrician's license to allow,
permit or condone the use of his, her, its or their name or
license by any unlicensed person, firm or corporation, directly
or indirectly, to obtain a permit for electrical work in the
electrical enforcement district created by this chapter or to
do any electrical work in such areas.

ARTICLE V.
PERMITS, INSPECTIONS AND
MIsCELL~N~OUSADMINISTRATIVE PROVISIONS.
SECTION 11-45.
PERMITS
A.
WHEN REQUIRED.

D.
PERMIT APPLICATION PROCEDURE.
(1) FORM.
A l l a p p l i c a t i o n s f o r an e l e c t r i c a l per-
m i t s h a l l be made on forms s u p p l i e d by t h e B u i l d i n g Department
and s h a l l c o n t a i n a g e n e r a l d e s c r i p t i o n o f t h e work t o be done,
i t s location including a l e g a l description thereof, the e x i s t i n g
uses of the property involved, and any proposed or intended
uses for said property.
(2) WHERE FILED; FEE REQUIRED.
All applications for an electrical
permit shall be filed in the Building Department upon payment
of the required fee.
No such application shall be accepted
by the Building Department until such fee has been paid.
(3) PROCESSING AND ISSUANCE.
Upon receipt of a filed application
for an electrical permit, the Building Director shall within
a reasonable period of time review the application or cause
it to be reviewed and if he finds that the permit application
complies with the requirements of this chapter and any other
applicable provisions of the County Code or state law, he
shall issue a permit therefor forthwith.
E.
PERMIT FEES.
(1) EXEMPTION FOR GOVERNMENTAL BODIES.
No permit fee shall be charged for
any work done by or for any federal, state or local governmental body or agency, but this exemption shall not exempt
such body or agency from having to comply with all other provisions of this chapter unless specifically exempted therefrom.
(2)- FEES REFUNDABLE ONLY BY COUNTY
COMMISSION.
Permit fees shall not be refundable
except by action of the Board of County Commission upon a finding of good cause for such refund.
(3) SCHEDULE OF FEES.
Permit fees shall be the following

PERMIT CONDITIONS.
Any electrical permit issued shall be con-
strued to be a license to proceed with the work and shall not
be construed as authority to violate, cancel, alter or set aside
any of the provisions of this chapter, nor shall issuance of a
permit prevent the Building Director from thereafter requiring
correction of errors in plans or in construction or correction
of any violation of the provisions of this chapter.
G.
TIME LIMITS ON PERMITS.
Any electrical permit issued shall become
null and void if the work authorized by it is not begun within
ninety days after its issuance, or i f the work authorized by
it has been begun but is suspended or abandoned for a period
of six months; provided, however, that upon a showing of good
cause, and payment of an additional permit fee equal to onehalf of the original permit fee, a permit-holder may obtain
one permit extension of ninety days.
No other extensions shall
be granted.
H.
TEMPORARY PERMITS.
The Building Director may issue permits
for the installation and use of approved systems of temporary
systems, of temporary wiring, for light, heat or power, or for
decorative lighting, when proper application is made for the
samer and there exists a reasonable necessity for such use;
provided, however, that no such temporary wiring shall be allowed to remain in service for a period longer than-thirty days
after the date of the permit, and that such temporary wiring

shall not be.dangerous to the safety of life or property.
The
Building Director may renew this permit if he determines that
a reasonable necessity exists for such extension.
I.
REVOCATION OF PERMITS.
Any electrical permit issued hereunder may
be revoked only by the Board of County Commissioners for cause
after holding a public hearing thereon at which the permitholder shall have been afforded an opportunity to show cause
why his permit should not be revoked.
Notice of such hearing
shall be sent by certified mail, return receipt requested, to
the license holder or served upon him by a sheriff of this

ADDITIONAL REQUIREMENTS FOR LARGE
INSTALLATIONS.
The certificate of a Registered Electrical
Engineer shall be required before issuance of a permit for any
electrical installation requiring a total load of 144KW or more.
SECTION 11-46.
INSPECTIONS.
A.
OPTIONAL INSPECTIONS.
(1) PRE-PERMIT INSPECTION.
Before issuance of a permit, the Build-
ing Director may inspect or cause to be inspected any building
or site at or in which the work set forth in the permit application is to be done.
(2) INTERIM INSPECTIONS.
After issuance of a permit and during

work thereon, the Building Director may inspect or cause to
be inspected any and all work being done.

B.
REQUIRED INSPECTIONS.
(1) FIRST. INSPECTION.
After all the wiring has been run and
the panel has been installed and made up, but before it has
been covered, other than required mechanical protection, and
before the outlets, wall switches, fixtures, appliances and
apparatus, have been installed, the Building Director shall
examine same, making such observations and measurements, together with testing as may be required to determine whether
the work complies with this chapter.
( 2)
FINAL INSPECTION.
The Building Director shall make, or
cause to be made, a final inspection of all electrical work
upon completion thereof and prior to the issuance of the certificate of occupancy or completion required in this article.
This inspection shall consist of an examination, and necessary
test, of the entire electrical systems, including the fixtures,
apparatus and equipment, after the work is completed, to determine that the system, together with the apparatus, equipment
and fixtures are in good working order in accordance with this
chapter.
C.
EXCEPTIONS.
Inspection shall not be required on factory
installed electrical wiring that is certified to meet the requirements of the Florida Electrical Code.
D.
RECORDS REQUIRED.
The Building Director shall keep or cause
to be kept a record of each inspection made pursuant to this
section.
E.
NOTICE MAY BE REQUIRED.
The Building Director may require that
mandatory i n s p e c t i o n s be r e q u e s t e d a t l e a s t 24 h o u r s i n advance.
SECTION 11-47.
STOP-WORK ORDERS.
A.
HOW AND WHEN ISSUED.
Upon f i n d i n g t h a t e l e c t r i c a l work covered
by t h i s c h a p t e r h a s been o r i s b e i n g i n s t a l l e d m a t e r i a l l y cont r a r y t o t h e p r o v i s i o n s o f t h i s c h a p t e r o r i n a dangerous o r
u n s a f e manner o r w i t h m a t e r i a l l y shoddy o r i n f e r i o r m a t e r i a l s
o r workmanship, t h e B u i l d i n g D i r e c t o r s h a l l i s s u e a stop-work
o r d e r and d e l i v e r o r cause it t o be d e l i v e r e d t o t h e s i t e of
such work and t h e r e g i v e it t o t h e person i n c h a r g e o r p o s t
it i n a conspicuous p l a c e .
Upon such d e l i v e r y o r p o s t i n g , a l l
e l e c t r i c a l work on such s i t e s h a l l c e a s e and s h a l l n o t be r e sumed e x c e p t w i t h c o n s e n t of t h e B u i l d i n g D i r e c t o r o r t h e Board
of County Commissioners.
Any person a g g r i e v e d by such s t o p -
work o r d e r may a p p e a l t o t h e Board o f County Commissioners a s
provided i n A r t i c l e I11 of t h i s c h a p t e r .
B.
UNLAWFUL TO IGNORE STOP-WORK ORDER.
A f t e r a stop-work o r d e r p u r s u a n t t o t h i s
a r t i c l e h a s been d e l i v e r e d t o any s i t e o f e l e c t r i c a l work i n
t h e e l e c t r i c a l enforcement d i s t r i c t c r e a t e d ' i n t h i s c h a p t e r ,
it shall be unlawful for any person, firm or corporation to
continue with such work without the consent of the Building
Director or the Board of County Commissioners, except for
such emergency actions which are necessary to prevent probable injury to life, limb or property.
SECTION 11-48.
TESTS.
The Building Director may require reasonable
tests or test reports of compliance.
Tests, when required,
shall be made at the expense of the owner, his agent, or the
permit holder.
Tests on the job may be made in the presence
of the Building Director or an employee of the Building Department.
Tests of questionable materials, apparatus or
equipment, may be made on the job in the presence of the Building Director or an employee of the Building Department, or may
be made by approved testing laboratories or other approved
agencies, as prescribed by the Building Director.
Copies of
such tests reports or the results of all such tests shall be
kept on file in the office of the Building Director.
SECTION 11-49.
TEMPORARY AND FINAL HOOK-UP.
COMPLETION OR OCCUPANCY.
A.
CERTIFICATES OF
TEMPORARY HOOK-UP.
Application may be made for a temporary
electrical hook-up prior to the completion of all building
construction for the purpose of test and checkout of equipment.
This temporary hook-up permit is time-dated by agreement between the contractor and the Building Director, usually for a
period of 30 days after which time the temporary hook-up will
be revoked or a certificate of occupancy or completion will be
issued to verify project completion.
B.

FINAL HOOK-UP.
OR COMPLETION.
CERTIFICATES OF OCCUPANCY
No final hook-up shall be made unless and
until a certificate of occupancy has been issued for the building if a building is involved or a certificate of completion

SECTION 11-55.
COUNTY ELECTRICAL CODE
APPLICABILITY OF FLORIDA ELECTRICAL CODE;
INTENT.
THE FLORIDA ELECTRICAL CODE contained in Part
11, Chapter 553, FLORIDA STATUTES, is applicable in the electrical enforcement district created by this chapter and constitutes the minimum electrical standards in such district.
It is the intent of this article to adopt and enforce additional or more stringent standards or administrative procedures
and requirements than those prescribed in THE FLORIDA ELECTRI-
CAL CODE, including but not limited to fees, and that the
standards or administrative procedures and requirements of this
article shall be in conformity with standards set forth in
Section 553.19, FLORIDA STATUTES.
SECTION 11-56.
ADOPTION OF COUNTY ELECTRICAL CODE.
THE FLORIDA ELECTRICAL CODE contained in Part
11, Chapter 553, FLORIDA STATUTES, including all of the standards adopted in Section 553.19, FLORIDA STATUTES, as amended
by the additional or more stringent standards or administrative
procedures and requirements of the LOCAL AMENDMENTS to said
FLORIDA ELECTRICAL CODE contained in Section 11-57 of this
chapter, be and hereby is adopted as the COUNTY ELECTRICAL CODE.

Access to panels shall not be hampered by
any equipment or appliance located under or in front of panels.
Electrical panels shall not be mounted in clothes clo-
sets or bathrooms.
NEC Section 110-16.
(4) FEEDER SIZE.
a.
Minimum size of feeder wires to
lighting sub-panel on single phase 110-220 volt system shall
be as follows (wire sizes based on copper conductors):
One to six circuits, 40 amps;
Eight to ten circuits, 55 amps;

Twelve to sixteen circuits, 70 amps;
Eighteen to twenty-four circuits,
110 amps;

Twenty-six to thirty-four circuits,
125 amps;
Thirty-six to forty-two circuits,
145.amps.

If at any time it is found that feeder conductors are or will
be overloaded, the feeder conductors size shall be increased
in capacity to accommodate the actual load served.
b.
All multiphase circuits 208 volt
and above shall have overcurrent protection in each phase capable of interrupting the entire circuit in a single switching
action.
NEC Section 240-11.
(5) PERMISSIBLE LOADS.
a.
The maximum number of outlets per
20 ampere branch circuits shall be as follows:
(1) On commercial buildings, six

light outlets, or four receptacle outlets, or five combination,
but not to exceed three receptacle outlets;
(2) On apartment buildings or
residential buildings, ten light outlets, or six receptacle
outlets, or eight combination, but not to exceed four receptacle outlets.
b.
In stores, office buildings, pub-
lic assembly halls, and commercial buildings, all 20 ampere
circuits, receptacle circuits, receptacle circuit outlets and
general lighting circuits shall be rated at a minimum of 2.5
amperes for each outlet.
(6) RANGES, WATER HEATERS, AIR CONDITIONERS
AND SIMILAR EQUIPMENT.

All electrical appliances or electrical
machinery shall be connected to the proper-voltage as specified
by the manufacturer

shall be located within three (3) feet of the equipment and

the receptacle by means of a proper detachable plug and cord.
The outlets for ranges, ovens, and dryers shall be controlled
by a separately fused approved disconnect or breaker at the
panel.

RANGE:

Where the above consists of two
separate and distinct units, each unit shall be protected by
a separate fuse.
No conductor shall be smaller than #10 AWG.

LAUNDRY DRYERS:
For dryers up to 30 amp. load,
No. #10 wire shall be used.
From 30 to 40 amp. load, No. 8
and over 50 amp shall be sized accordingly.

APPLIANCES:
(1) For small applicance loads
in kitchens, laundries, pantries, dining rooms, utility rooms,
and breakfast rooms of dwellings, as outlined above, not more
than four (4) outlets shall be connected to a circuit (clock
outlets excepted).

(2)
All air conditioners of one-
half ton or more to be installed on a separate circuit.

(3) All dishwashers, garbage
disposals or combination dishwasher disposals, water pump or
any other appliance consuming over 750 watts or over 1/6 H.P.
to be installed on separate circuit.
No smaller than #12 Amer-
ican Wire Gauge.
(4) All space heaters 1 KW or
more shall be on a separate circuit properly fused.

(7) GENERAL.
a.
In every kitchen, dining room,
breakfast room, living room, parlor, library, den, sunroom,
recreation room, bedroom, one receptacle outlet shall be provided for every 12 lineal feet or major fraction thereof of
the total (gross) distance around the room as measured horizontally along the wall at the floor line.
None of the above
rooms shall contain less than four receptacles.
b.
No more than one wire shall be
attached to any terminal screw in any convenience outlet,
switch, circuit breaker, or terminal box.
c.
In all one and two family dwel-
lings, there shall be a minimum,of two extra fuse holders or
breakers for future use and one empty raceway terminating in
an accessible attic.
d.
Any sub-panel over four (4) circuits
shall be served with not less than No. 8 Ga. wire.

When apartments are not individu-
ally metered, each apartment shall have a fuse panel in it.
Feeder sizes shall be determined in accordance with section
entitled "FEEDER, " (Section 310-16 NEC

All residential units over two (2)
shall be in rigid conduit or Electric Metallic Tubing (EMT).
g.
Any building to be used for ware-
housing purposes shall have receptacles installed along each
twenty feet of wall space.
h.
All receptacles shall be installed
at accessible locations and this accessibility shall be retained
regardless of wall fixtures or other modifications required by
tenant.
(8) CONDUIT, FITTINGS AND WIRING.
a.
Metal conduits and fittings, unless
of corrosion resistant metal, shall be galvanized, sherardized,
or shall have an equivalent coating of corrosion resistant metal.
b.
NON-METALLIC SHEATHED CABLE.
In
addition to the requirements of NEC Article 336, non-metallic
sheathed cable or UF cable must be used in all 4-inch block walls.
c.
Non-metallic sheathed cable (ROMEX)
shall not be embedded in masonry.
If run on furring strips,
there shall be a minimum of 3/4 inch of air space.
In case of
using sleeves, the Electric Metallic Tubing shall extend up the
wall, have 90° bend and-extend horizontally at least six inches.
Not more than 1 #12/3 shall be placed in 1/2" Electric Metallic
Tubing.
All exposed wire on inside wall
shall be in approved
duct.
d.
Non-metallic sheathed cable of
aluminum or copper clad aluminum conductors under size 6 AWG
shall not be used.
e.
Armored Cable (BX) shall not be
used.
EMT shall not be used on any exterior work.
f.
Recessed lighting outlet shall
be complete with flexible conduit leads installed, wire properly connected, and approved covers placed on the outlet box
before rough-in inspection is made.

lowed for each circuit.

All metallic conduit shall be
painted with asphaltum base paint 4 inches above and below the
slab.
(9) COMMERCIAL AND PUBLIC STRUCTURES.
a.
Standards for Commercial and
Public Structures.
(1) The rating of service equipment and size of service conductor for commercial or public
structures shall be in accordance with the National Electric
Code.
Occupancy shall be wired in rigid conduit or electri-
cal metallic tubing.
(2) Hazardous locations shall
use rigid metal conduit.
(3) A l l buildings with occupancies of Group "B", Business, or "D" Institutional, or "E"
Assembly,
"C" Schools,
"F" Storage for
construc-
tion or better, or rental apartment houses, or motels shall
be wired in rigid conduit or electric metallic tubing.
(4)
Rigid PVC Conduit shall be
used in corrosive atmospheres such as pool clorinator equipment rooms, undercover auto parking areas, citrus processing
plants, exterior use near seacoast, etc., except where prohibited by the National Electric Code for explosive areas.

b.
BRANCH CIRCUITS.
The minimum
number of branch circuits in commercial and public structures
shall be based on the present connected load as follows:
(1) For two-wire 20 amp. circuits,

the load per circuit shall not exceed 1600 watts.
(2) For Multi-wire, 20 amp. cir-

cuits, the load shall not exceed 1600 watts between each phase
wire and the neutral.
(3) No wire smaller than No. 12
shall be used for any circuits.
(4) The following consideration
in regard to combination of outlets shall apply.
No convenience
outlet shall be supplied by the same branch circuit that supplies
ceiling of show window lighting outlets.
(5) Outlets for show window spot-
lights shall be on separate circuits from general shop window
outlets.
c.
FEEDERS.
The carrying capacity of each
feeder or subfeeder shall be based on the number of separate
circuits which it supplies, computed as follows:
(1). Overhead lighting circuit
assumed as having 1200 watts per circuit for each 20-amp circuit.
(2) Convenience Outlet Circuits
assumed as having 1200 watts per circuit.
(3) Non-itemized and 'heavy duty
circuit
- specified
load for which designed.
To the total of these three, such
demand factors as permitted by the National Electrical Code shall
be applied.
d.

INTERIOR AND EXTERIOR GROUND WIRES.
(1) All ground wires originating
on interior walls shall be built into wall or run in conduit to
floor level and through wall to exterior ground rod.
All ex-
terior ground wires must be run in rigid metal conduit to surface of ground and firmly strapped to avoid mechanical injury.
(2) No aluminum wire shall be
used.
(10) MUSIC BOXES AND SIMILAR EQUIPMENT;
SIGNS.
a.
Portable cords attached to music
boxes, pinball machines, soft drink dispensers, and other similar equipment shall not exceed six (6) feet in length, measured from the equipment to the outlet supplying the current.
Cords shall not be nailed down, tacked, stapled or held with
strings, or other supports, but shall be left free and clear.
b.
Where an electric sign is to be
used, a separate sign circuit shall be installed in stores and
public buildings (new or remodeled).
This sign circuit shall
be installed in a separate raceway from distribution enclosure,
and from the circuit protecting device in the panel.
A dis-
connect, safety switch, circuit breaker, shall be installed at
the sign.
In an outdoor sign, the safety switch or circuit
breaker shall be of the weatherproof type if exposed to the
weather.
All sign installations requiring electricity must
have a permit and be installed according to the National Electrical Code.
(11) LOCATION OF TRANSFORMERS.
Low voltage transformers shall be
located at readily accessible places, and the secondary wiring
shall not enter the same box with the primary wiring unless the
secondary w i r i n g i s s i x hundred (600) v o l t i n s u l a t e d ,

UNLAWFUL TO FAIL TO COMPLY WITH CODE AND

It shall be unlawful for any person, firm
or corporation to do, install, construct, maintain, extend,
alter, or cause to be installed, constructed, maintained, extended or altered any electrical work, or electrical construction within the electrical enforcement district created by
this chapter in violation of any provision of the county electrical code and the rest of this chapter.

PART TWO:
REPEAL.
Special acts of the Floxida Legislature applicable
only to unincorporated areas of Martin County, county ordinances
and county resolutions, or parts thereof, in conflict with this
ordinance are hereby abolished and repealed to the extent of
such conflict.
PART THREE:
SEVERABILITY.
If any section, sentence, clause, phrase or word
of this ordinance is for any reason held or declared to be
unconstitutional, inoperative or void, such holding or invalidity shall not affect the remaining portions of this ordinance, and it shall be construed to have been the intent of
the Board of County Commissioners to adopt this ordinance
without such unconstitutional, invalid, or inoperative part
therein, and the remainder of this ordinance after the exclusion of such part or parts, shall be deemed and held to be
valid as if such part or parts had not been included herein.
If this ordinance or any provision thereof shall be held to
be inapplicable to any person, groups of persons, property,
kind of property, circumstances, or set of circumstances,
such holding shall not affect its applicability to any other
person, property, or circumstances.
PART FOUR:
CODIFICATION.
Provisions of this ordinance shall be incorporated
in the County Code and the word "ordinance" may be changed to
nsection,n "article," or other appropriate word, and the sections of this ordinance may be renumbered or relettered to accomplish such intention; provided, however, that Parts Two
through Eight shall not be codified.
PART FIVE:
APPLICABILITY.
This ordinance shall be applicable only in the un-
incorporated areas of the county.
PART SIX:
FILING WITH DEPARTMENT OF NATURAL RESOURCES.
In order to comply with Section 373.023, FLORIDA
STATUTES, the county attorney shall send a certified copy of
this ordinance to the Bureau of Water Resources, Department
of Natural Resources, Larson Building, Tallahassee, Florida,
PART SEVEN:
PENALTIES.
Violation of this ordinance is a misdemeanor pur-
suant to Section 125.69, FLORIDA STATUTES, and is punishable
under said section by imprisonment for up to sixty (60) days,
or a fine of up to $500.00, or both such imprisonment and fine.
PART EIGHT:
-
EFFECTIVE DATE.
This ordinance shall take effect upon receipt of
official acknowledgment from the Office of Secretary of State
that this ordinance has been filed in that office.
