special permit to allow a second floor patio projection into the rear yard setback for an

Additional Information:
The applicant is requesting a special permit to allow a proposed
attached accessory structure to encroach into the required 15 foot rear yard setback. The
applicant is proposing a 36 foot long by 11 foot wide (540 square feet) second story patio/deck
addition that will be attached to the existing apartment building as part of a complete remodel
of the owner/managers apartment. The patio area will be reached by a six foot wide and nine
foot long bridge from the main building. The area under the patio will become a driveway for the
building to provide two on-site parking spaces. The patio will have a decorative wrought iron
railing that is consistent with the architecture of the building. The addition and the existing
footprint of the building covers 55 percent of the lot and is within the maximum allowed 70
percent lot coverage. The Zoning Code stipulates that attached accessory structures meet the
required residential setback requirements. The Zoning Ordinance requires a Zoning
Administrator special permit for any accessory structure that does not meet the setback
requirements. The applicant is requesting the special permit under those provisions.
The site is located within the Central City Design Review area. The proposed addition has been
approved by Design Review (DR01-210). The project was noticed and staff received no calls.
Environmental Determination:
This project will not have a significant effect on the
environment and is exempt from environmental review pursuant to State EIR Guidelines
{California Environmental Quality Act, Sections 15305(a)}.
Conditions of Approval
1.
The proposed addition shall conform to submitted plans unless required to be revised by
Design Review. The rear setback (from rear property lines to columns) shall be 7.5 feet
or greater.
2.
The applicant shall obtain a building permit for the addition. On the south wall of the
apartment, the occupancy separation shall be provided between the apartments and the
carport per UBC Section 302.2 and UBC Table 3-B (to the satisfaction of the Building
Division).

3.
There shall be no further expansion of the apartment building, porch, patio covers or any
other structure into the rear yard setback area.
4.
The applicant shall comply with all Design Review conditions.
5.
All new driveway(s) shall be constructed to City Standards to the satisfaction of the
Department of Public Works.
6.
The width of the proposed new driveway with one-way exit shall be a minimum of 12 feet
(City Code 18.08.050); the said driveway shall be striped and painted 'ONE WAY'.
7.
ADVISORY NOTE:
The proposed project is located in the 100-year floodplain,
designated as an A99 zone on the Federal Emergency Management Agency (FEMA)
Federal Insurance Rate Maps (FIRMs) that have been revised by a Letter of Map
Revision effective May 22, 2000. Within the A99 zone, there are no requirements to
elevate or flood proof.
Findings of Fact:
1. The proposed project, as conditioned, is based upon sound principles of land use in that:
a.
the proposed second floor patio will not substantially alter the characteristics of the site
or the surrounding neighborhood; and
b.
the proposed structure is compatible in architecture with the existing building.
2. Granting the request will not be injurious to public health, safety, or welfare nor result in a
nuisance in that:
a.
there is circulation on the site;
b.
the patio will give the manager's unit a usable outside area; and
b. the proposed patio will not substantially alter the characteristics of the site or the
surrounding neighborhood.
3. The project is consistent with the General Plan and the Central City Community Plan which
designates the subject site as Special Planning District and Residential Mixed Use
respectively.

A use for which a Special Permit is granted must be established within two years after such permit is approved. If such
use is not so established the Special Permit shall be deemed to have expired and shall be null and void. A Special
Permit which requires a Building Permit shall be deemed established whenV such Building Permit is secured and
construction thereunder physically commenced. If no building permit is required, the use shall be deemed established
when the activity permitted has been commenced.
The decision of the Zoning Administrator may be appealed to the Planning Commission. An appeal must be filed within
10 days of the Zoning Administrators hearing. If an appeal is not filed, the action of the Zoning Administrator is final.
