Important Facts You Need To Know Regarding the Syngenta MDL Law Suit.
It’s alleged corn producers suffered an economic blow due to exporting limitations imposed
on all American corn due to the presence of Viptera in U.S. corn shipments. Damages are
preliminarily estimated to the market between $1 and $2.9 Billion U.S. dollars (11 cents to over $1 per bushel).
Economists will determine at a later date the cost per bushel/acre losses for each farmer.
This is an injury to the market theory of litigation. You need not have planted Syngenta’s Viptera to have been
economically harmed. You need to have only sold corn in the open grain market. China banned all U.S. corn
shipments in 2013. Damages are allegedly ongoing with the loss of the entire Chinese corn export market.
This is not a class action. It is an MDL (multi-district litigation). Some plaintiffs’ may try and claim a putative class
within the MDL, but each corn farmer has the right to contract with his/her own attorney, and claim damages against
Syngenta on their own behalf. Over 30,000 lawsuits are now on file by individual farmers.
China began denying U.S. shipments of corn due to the Viptera GM trait in November 2013, if not earlier. Certain
statute of limitations apply. Farmers should be aware that Syngenta will likely argue that Midwest farmers knew or
should have known that they had claims against Syngenta, yet failed to file individually within applicable statute of
limitations. Midwest farmers should act NOW to protect their individual interests in this national litigation.
