The Departmentof Buildings has recently grantedpermission for the developers
of 246 Spring Street,the Trump SoHo "Condo-Hote1,'to add an additional floor
to their structure.This is an outrageousdecision, given that this development
should never have been permitted in the first place, as it clearly violates zoning
rules for this area. However, as disturbing as this is, a recent review by the
Greenwich Village Society for Historic Preservationof materials in the file for
this site in the Departmentof Buildings' BusinessInformation System(BIS)
showsthe most recent filings by the diveloper refer to a 44thfloor, one higher
even than the 43'd floor recently approvedby DOB (seeattached).

It is inconceivablethat either the additional floor approvedby DOB or the
further possible additional floor referred to in thesedocumentsare in any way
allowable under zoningregulations. I urge the Departmentof Buildings not to
allow a further additional floor on this building, and to rescind the approvalsit
hasalreadygiven for the 43'dfloor.
