A. T he commissioner of agricul ture and forestry shal l be the chairman of the commission. T he chairman shal l

§3803. D e f i n i t i o n s
As used in this C hap ter, the fol l ow ing terms shal l have the fol l ow ing meanings ascribed to them:
(1 )
" C hairman" means the chairman of the commission.
(2 )
" C ommission" means the H orticul ture C ommission of L ouisiana.
(3 )
" C ommissioner" means the commissioner of agricul ture and forestry .
(4 )
" D irect sup ervision" means giving direction or instruction to and accep ting resp onsibil ity for the w ork
p roduct of the p erson being sup ervised.
(5 )
" L andscap e irrigation contractor" means a p erson w ho is l icensed to construct, instal l , connect, rep air,
maintain, imp rove, or al ter any p ortion of a l andscap e irrigation sy stem.
(6 )
" L andscap e irrigation sy stem" means any assembl age of comp onent material s or sp ecial eq uip ment
that p rovides and distributes a control l ed disp ersion of w ater to l andscap ed areas for the p urp oses of
irrigating vegetation or control l ing dust and erosion.
(7 )
" L icense" means a document issued by the commissioner authoriz ing the hol der to engage in the
p rofession indicated thereon.
(8 )
" M obil e unit" means a container or means of convey ance from w hich cut fl ow ers or nursery stock are
sol d.
(9 )
" N ursery " means any farm, grounds, or p remises on w hich nursery stock is p rop agated, grow n, or
k ep t for sal e or distribution.

(5 )
T he provisions of this S ub section shall not apply to persons w ho arrange or sell floral designs
composed entirely of artificial materials, or dried plant materials, or b oth.
(6 )
I ndividuals licensed to operate vending machines shall not operate them outside of the parish more
than tw enty -five miles b ey ond their place of b usiness.
C . A w holesale florist' s license authoriz es the holder thereof to prepare and sell cut flow ers, plant materials, and
ornamental plants in pots normally and customarily used b y retail florists to persons w ho hold a retail florist' s
license and to prepare and sell cut flow ers to persons w ho hold a cut flow er dealer' s permit. A w holesale
florist' s license shall not authoriz e the holder thereof to arrange or sell floral designs.
D . A landscape horticulturist' s license authoriz es the holder to do the follow ing:
(1 )
I mplement plans, studies, survey s, specifications, and designs prepared b y a licensed landscape
architect.
(2 )
R ecommend and implement measures for interior and ex terior b eautification and development
through the use of nursery stock .
(3 )
S ell or lease nursery stock and to recommend and ex ecute measures for the maintenance of nursery
stock . E ach landscape horticulturist may use his license for the sale or lease of nursery stock from only
one place of b usiness. T he license shall b e on display at all times during the hours nursery stock is sold.
(4 )
P repare draw ings to indicate the placement of nursery stock . E ach draw ing shall include the name
and license numb er of the landscape horticulturist w ho prepared the draw ing. N o fee shall b e charged
for preparing a draw ing. A landscape horticulturist may use a draw ing prepared b y him in connection
w ith the sub mission of a b id proposal. A draw ing shall not b e used b y any person to solicit b ids for the
sale of materials or rendering of services regulated b y the C ommission.
E . L andscape architects shall b e sub j ect to the follow ing provisions:
(1 )
A landscape architect' s license authoriz es the holder thereof to perform professional services such as
consultation, investigation, research, preparation of general development and detailed landscape design
plans, studies, specifications, and responsib le supervision in connection w ith the development of
landscape areas w here, and to the ex tent that, the principal purpose of the service is to arrange and
modify the effects of natural scenery for aesthetic effect, considering the intended use of the land. S uch
services concern the arrangement of natural forms, features, and plantings, including the ground and
w ater forms, vegetation, circulation, w alk s, and other landscape features to fulfill aesthetic and practical
req uirements.
(2 )
I n order to accomplish the duties describ ed in P aragraph ( 1 ) of this S ub section, the landscape
architect may prepare feasib ility studies; formulate graphic and w ritten criteria to govern the aesthetic
and practical planning and design of land construction programs; prepare, review , and analy z e plans for
aesthetic and practical land use and development; produce landscape plans, landscape grading and
landscape drainage plans, landscape irrigation plans, planting plans, and related landscape construction
details, specifications, estimates of prob ab le costs, and reports for aesthetic and practical land use;
collab orate in the design of pleasing and practical settings and approaches for vehicular and pedestrian
circulation sy stems, b ridges, and nonhab itab le structures, all w ith respect to the practical and aesthetic
req uirements of the areas on w hich they are to b e placed; negotiate and arrange for ex ecution of
landscape proj ects; and conduct field ob servation of landscape construction, restoration, and
maintenance.
(3 )
N othing in this S ub section shall permit any person licensed under this S ub section to perform
professional services w hich are defined as the practice of architecture in R . S . 3 7 : 1 4 1 et seq . , or the
practice of engineering or land surveying in R.S. 37:681 et seq., and which are not included in the
practice of landscape architecture under this Sub section. N othing in this Sub section shall prohib it the
practice of engineering or land surveying or the practice of architecture b y any person who is licensed as
a professional engineer or land surveyor under R.S. 37:681 et seq., or as an architect under R.S. 37:14 1
et seq.

I n order to qualify to tak e the ex am ination for the landscape architect' s license, the applicant shall
m eet one of the qualifications set forth in this P aragraph. T he applicant shall sub m it evidence of
qualification in the form required b y the com m ission b y rule. T he applicant shall indicate on the
application which qualification the applicant m eets. T he qualifications are:
( a)
T he applicant is the holder of a professional degree from a school whose curriculum has
b een accredited b y the accrediting entity approved b y the A m erican Society of L andscape
A rchitects or is the holder of a degree which the com m ission b y rule has declared to b e the
educational equivalent of that degree and has com pleted a m inim um of one year internship under
the direct supervision of a licensed landscape architect, or landscape horticulturist, or design
professional in a related profession.
(b )
T he applicant has com pleted six years of practical landscape architectural ex perience under
the direct supervision of a licensed landscape architect or landscape horticulturist, or design
professional in a related profession.
( c)
T he applicant possesses a com b ination of education and ex perience which the com m ission,
b y rule, has determ ined to b e the equivalent of the qualifications in Sub paragraphs ( a) and ( b ) of
this P aragraph.
T he com m ission shall issue each licensed landscape architect a perm anent registration num b er.
( 6)
E ach landscape architect shall affix his seal to all drawings or specifications prepared b y or under the
direct supervision of the landscape architect.
( 7)
T he seals used b y landscape architects shall m eet the specifications determ ined b y rule b y the
com m ission.

G . E ach person licensed under the provisions of this C hapter shall m eet the professional standards determ ined b y
the com m ission for each profession and shall notify the com m ission of each change in the address of the
residence or place of b usiness of the license holder.
H . A nursery stock dealer' s perm it authoriz es the holder thereof to sell nursery stock . A nursery stock dealer' s
perm it shall not authoriz e the holder thereof to install nursery stock .
I . A cut flower dealer' s perm it authoriz es the holder to do any of the following:
( 1)
Sell cut flowers either singly or in b unches, or b oth. H owever, the holder of a cut flower perm it m ay
not sell cut flowers within three hundred feet of the place of b usiness of another person engaged in the
profession of retail florist.
(2 )
O perate under that perm it a vending m achine for the sale of cut flowers and floral design in
accordance with the provisions of this C hapter and the rules and regulations adopted pursuant to this
C hapter, if the holder is engaged in the profession of retail florist.
J . E ach person issued a perm it under the provisions of this C hapter shall m eet the occupational standards
determ ined b y the com m ission for each occupation and shall notify the com m ission of each change in the
address of the perm it holder.
K . E ach person who holds a valid L ouisiana N ursery C ertificate P erm it m ay use that perm it in lieu of a nursery
stock dealer's permit, or a cut flower dealer's permit, or both, at any one outlet.
L . E ach nursery stock dealer and cut flower dealer shall secure an appropriate permit for each outlet operated by
the dealer.
M . E ach license and permit issued under the prov isions of this C hapter shall ex pire on J anuary thirty-first of each
year and may be renewed in accordance with rules adopted by the commission.
N . E ach holder of a license or permit issued under the prov isions of this C hapter shall present such license or
permit upon demand of any authoriz ed ag ent of the horticulture commission.
O . U tility arborists shall be subj ect to the following prov isions:
(1 )
A utility arborist's license authoriz es the holder thereof to recommend or ex ecute the remov al of trees
or portions of trees along utility rig hts of way.
(2 )
F or license renewal, each utility arborist is req uired to attend a continuing training seminar as
determined by rule by the commission.
P . L andscape irrig ation contractors shall be subj ect to the following prov isions:
(1 )
N otwithstanding any other law to the contrary, a landscape irrig ation contractor's license authoriz es
the holder to construct, install, connect, repair, maintain, improv e, or alter any portion of a landscape
irrig ation system, including the req uired wiring within that system, and to install and connect the
landscape irrig ation system to the req uired power supply and to a public or priv ate water supply system.
(2 )
F or license renewal, each landscape irrig ation contractor shall obtain continuing training as
determined by rule of the commission.
(3 )
H e shall req uest and be issued any necessary permits from any g ov erning authority.
(4 )
P rior to connecting to a public or priv ate water supply system, a licensed landscape irrig ation
contractor shall obtain a water supply protection specialist endorsement from the S tate P lumbing B oard.
T he S tate P lumbing B oard shall issue a special endorsement of a water supply protection specialist to
any licensed landscape irrig ation contractor who completes the training req uired by the S tate P lumbing
B oard as prov ided for in R .S . 3 7 : 1 3 6 8 ( H ) ( 1 ) ; howev er, neither a j ourneyman plumber's license nor a
master plumber's license shall be req uired.
(5 )
B ackflow prev ention dev ices shall be installed in accordance with the prov isions of P art X I V of the
L ouisiana S tate S anitary C ode by a person holding a water supply protection specialist endorsement.
(6 )
N othing in this S ubsection shall permit any licensed landscape irrig ation contractor to perform any
electrical or plumbing serv ices not prov ided for in this S ubsection, for which a license is req uired from
any other reg ulatory board. N othing in this S ubsection shall prohibit a licensed electrician or plumber
from prov iding electrical or plumbing serv ices necessary to make or keep an irrig ation system
operational.

A . E ach person who holds a professional license issued under the prov isions of this C hapter may employ
personnel to work under the direct superv ision of the license holder in the profession indicated on the license.
T he license holder shall g iv e direction and instruction to such personnel and shall be responsible for insuring
that the work product of such personnel meets the appropriate professional standards determined by the
commission.

describ ing w ith particularity the violative action and ordering the immediate cessation of said violative action.

Q u a lific a tio n s fo r E x a m in a tio n a n d L ic e n s u r e o r P e r m ittin g
A. All applicants for ex amination and licensure or permitting under the provisions of R .S . 3 : 3 8 0 1 et seq ., must have
attained their eighteenth b irthday b efore tak ing an ex amination and b efore b eing issued a license or permit. P rovided,
how ever, that an applicant for ex amination w ho is 1 7 years of age, b ut w ho w ill attain his or her eighteenth b irthday
b etw een regularly scheduled ex aminations may apply for and tak e the ex amination immediately prior to his or her
eighteenth b irthday. N o applicant w ho q ualifies to tak e an ex amination b efore his or her eighteenth b irthday shall b e
issued a license or permit b efore attaining his or her eighteenth b irthday.
B . All applicants for the landscape architect ex amination must meet one of the follow ing q ualifications:

6 hours in L andscape D raw ing or G raphics;

architect, landscape horticulturist, engineer, architect, or a licensed professional w ith a design or contracting
firm;
has completed the eq uivalent of six years of practical ex perience under the direct supervision of a licensed
landscape architect, landscape horticulturist, or environmental designer. M ust present a minimum of six ex amples
of w ork in at least three of the follow ing areas:

stak ing or layout plan;
grading plan;
irrigation plan;
construction details;
planting plan w ith a plant list;
specifications;

retail florist for more than a total of 9 0 days in any 1 2 -month period that follow s the first day of operation
w ithout a regularly employed licensed retail florist.

R etail florists may rent potted ornamental plants for special events such as w eddings, conventions, trade show s,
etc., if such plants are normally and customarily sold by florists and such plants do not req uire maintenance, other
than normal w atering. P lants rented by retail florists for a special event shall be rented only for the duration of
that special event.
B . L andscape A rchitect
1 .
W ithout good cause, all designs must mak e use of plant materials commonly found grow ing in L ouisiana or w hich
are suitable for grow th in L ouisiana' s grow ing conditions.
2 .
L icensees must meet the standards established by the C ouncil of L andscape A rchitects R egistration B oard.
3 .
E ach landscape architect must obtain a seal of the design authoriz ed by the commission. T he seal shall be placed on
all professional documents, including contracts, maps, plans, designs, draw ings, specifications, estimates and
reports, issued by a licensed landscape architect for use in this state.

T he seal req uired shall be circular and 1 5 / 8 inches in diameter. T he w ords "S tate of L ouisiana" shall be
along the top circumference and the w ords "L icensed L andscape A rchitect" shall be along the bottom
circumference. T he individual' s name shall be placed horiz ontally in the center of the field w ith his
registration number below . L etters and figures shall be as show n on the ex ample printed herein to insure
uniformity.

A rubber stamp facsimile, w hich conforms to the official design of the seal described in § 1 1 7 .B .3 .a, may be
obtained and used in place of the seal by a licensed landscape architect.

T he licensee shall sign his or her legal name on each document and shall then affix his or her seal over that
signature. T he presence of one' s seal over the signature on any document constitutes proof that he or she accepts
all legal and professional responsibility for the w ork accomplished. T he seal shall be used only by the licensee
responsible to this commission for authorship of the documents thus identified. N o person other than the licensee
represented shall use or attempt to use the prescribed seal, and no unlicensed person shall be authoriz ed to use
the prescribed seal. A uthoriz ed use of the prescribed seal is an individual act w hereby the licensee must
personally inscribe the seal over his or her signature. T he licensee is responsible for the security of the seal w hen
not in use.

and accompanied by the sod classification form specified by the commission.

C ontinuing E ducation R eq uirements
C ompliance w ith these continuing education req uirements is necessary for a landscape architect, ( "licensee") , to
maintain a landscape architect license in this state.
T he commission shall administer the continuing education req uirements through a standing continuing education
