Bradley A. Marcus represents corporate and individual clients in complex civil litigation,
class action litigation, individual actions, qui tams, and government enforcement actions
and investigations, with a particular focus on white collar criminal defense matters.
As Counsel in the Washington, DC office of Buckley Sandler LLP, he has represented
clients in cases involving the Foreign Corrupt Practices Act (FCPA), False Claims Act
(FCA), Financial Institutions Reform, Recovery and Enforcement Act (FIRREA),
securities and mortgage fraud, unfair and deceptive trade practices, government loan
programs, mortgage lending, servicing, and securitization practices, among other areas.
In the past few years, Mr. Marcus has been involved in a number of cutting-edge cases
in the FCPA arena, including:
Representation of a Japanese gaming company in FCPA litigation and
related parallel matters. The case is currently in discovery and involves one
of the first examples of a private party alleging FCPA violations to gain an
upper hand in a contract dispute
Representation of a former senior executive at an international bank’s Asian
office in connection with Securities and Exchange Commission (SEC) and
Department of Justice (DOJ) “Sons and Daughters” FCPA investigation,
which concern the bank’s hiring of interns who were family members of
foreign government officials and bank customers. The “Sons and
Daughters” investigation is one of the highest profile FCPA enforcement
priorities
Mr. Marcus also counsels clients in responding to subpoenas from federal and state
investigative bodies and conducts corporate internal investigations. Among Mr. Marcus’
representations are those initiated by the DOJ, various U.S. Attorneys’ Offices, the
Federal Housing Finance Agency (FHFA), SEC, Office of the Inspector General of the
U.S. Department of Housing and Urban Development (HUD-OIG), the Consumer
Financial Protection Bureau (CFPB), federal banking regulatory agencies, and state
attorneys general.

His recent representations include the following:
Confidential representation of individuals in a variety of matters, including
FCPA investigations, wire fraud investigations, and accounting fraud
investigations
Confidential representation of an Federal Housing Administration (FHA)
mortgage lender in a civil fraud investigation by the DOJ and HUD-OIG
Representation of a major mortgage servicer in investigation initiated by
FHFA as conservator for Fannie Mae and Freddie Mac
Representation of a student loan servicer in a CFPB investigation
Successful representation of lender in trial court and on appeal in
connection with qui tam action brought under the Florida False Claims Act
against a lender, securitization trust, and MERS for the recovery of allegedly
unpaid documentary stamp taxes associated with certain assignments of
mortgage notes. Stevens v. State of Florida, No. 1D13-1206, 127 So.3d 668,
2013 WL 6097312 (Fla. App. 1 Dist. November 20, 2013)
Successful dismissal of HAMP-related litigation brought by individual
borrower against lender alleging fraud and unfair and deceptive trade
practices
Prior to joining Buckley Sandler, Mr. Marcus was an Associate at Skadden, Arps, Slate,
Meagher and Flom, LLP. He received his J.D. from the University of Baltimore School of
Law (summa cum laude), where he graduated first in his class, and his B.A. from the
University of Maryland, College Park. From 1999 to 2002, Mr. Marcus covered Navy
football and men’s college lacrosse for the Washington Times.
