What Triggers an OSHA Inspection… Bernie Hauber, CSP 444 Regency Parkway Drive, Suite 303 Omaha, NE 68114 402.553.0171 800.642.8963 [email protected] History of OSHA OSHA stands for the Occupational Safety and Health Administration, an agency of the U.S. Department of Labor OSHA’s responsibility is worker safety and health protection On December 29, 1970, President Nixon signed the OSH Act This Act created OSHA, the agency, which formally came into being on April 28, 1971 OSHA’s Mission The mission of OSHA is to save lives, prevent injuries and protect the health of America’s workers. Some of the things OSHA does to carry out its mission are: developing job safety and health standards and enforcing them through worksite inspections, maintaining a reporting and recordkeeping system to keep track of job-related injuries and illnesses, and providing training programs to increase knowledge about occupational safety and health. Priority 1st Category of Inspection Imminent Danger: Reasonable certainty an immediate danger exists 2nd Fatality/Catastrophe: Reported to OSHA; inspected ASAP 3rd 4th Complaints/Referrals: Worker or worker representative can file a complaint about a safety or health hazard (Including employer referrals as per 1904.39) Programmed Inspections: Cover industries and employers with high injury and illness rates, specific hazards, or other exposures. 4 1904.39 – Reporting fatalities, hospitalizations, amputations… (newly revised rule) As of January 1, 2015, all employers must report: All work-related fatalities within 8 hours. All work-related inpatient hospitalizations, all losses of an eye and all amputations within 24 hours. You can report to OSHA by: Contacting closest OSHA AO, calling 800-321OSHA, or using the new online form (soon) http://www.osha.gov/recordkeeping2014 1904.39 – Reporting fatalities, hospitalizations, amputations… What if the fatality, in-patient hospitalization, amputation, or loss of an eye does not occur during or right after the work-related incident?__________ You must only report a fatality to OSHA if the fatality occurs within thirty (30) days of the work-related incident. For an in-patient hospitalization, amputation, or loss of an eye, you must only report the event to OSHA if it occurs within twenty-four (24) hours of the work-related incident. However, the fatality, in- patient hospitalization, amputation, or loss of an eye must be recorded on your OSHA injury and 15 illness records, if you are required to keep such records. 6 1904.39 – Reporting fatalities, hospitalizations, amputations… (definitions) 15 An amputation is the traumatic loss of a limb or other external body part…Amputations do not include avulsions, enucleations, deglovings, scalpings, severed ears, or broken or chipped teeth.
