EMERGENCY ORDER
The Application of Newfield Exploration Mid-Continent, Inc . for an
emergency order to commence a well at an off-pattern location came on for hearing
before the Administrative Law Judge of the Corporation Commission this 20th day of
October, 2008, in the Commission Courtroom, Eastern Regional Office, 440 South
Houston, Tulsa, Oklahoma, with notice of hearing being given.
Ron M. Barnes, Attorney, appeared for the Applicant ; and Sally Shipley,
Deputy General Counsel for Conservation filed Notice of Appearance .
FINDINGS
1 . That this is an application of Newfield Exploration MidContinent, Inc . for an Order allowing it to commence an off-pattern well from the Booch,
Harts horne, Atoka, Wapanucka, Cromwell, Jefferson, Mississ ippian , Woodford,
Hunton, Sylvan and Viola Lime common sources of supply and designating Applicant
as operator. Applicant requests that it be allowed to locate said well at a location of :

3. That Section 31, Township 4 North, Range 12 East, Pittsburg
County, Oklahoma constitutes a single drilling and spacing unit for the production of
hydrocarbons from the Booch, Hartshorne, Atoka, Wapanucka, Cromwell, Jefferson,
Mississippian, Woodford, Hunton, Sylvan and Viola Lime common sources of supply
by virtue of Order Nos. 64077/67777, 123354 and 516601 . Under the rules of the
Commission, the well is to be located not less than 1,320 feet from the unit boundary .
That Applicant has filed herein an application requesting the right to locate the unit well
at the location described in paragraph 1 above.
4. That an emergency exists because of the contractual
commitments of the Applicant . A rig is available and will be lost if the emergency
location exception is not granted prior to the hearing date on the merits . Additionally, a
stand-by fee of $25,000 per day would be incurred to hold the rig .
5 . That the Applicant should be allowed to drill, test, complete
and produce said well prior to the date of the hearing on its application for location
exception.
ORDER
IT IS THEREFORE ORDERED by the Corporation Commission of the
State of Oklahoma:
That Newfield Exploration Mid-Continent, Inc. be and is by this Order,
granted authority to commence a well from the Booch, Hart shorne, Atoka,
Wapanucka, Cromwell, Jefferson, Mississippian, Woodford , Hunton , Sylvan and
Viola Lime common sources of supply at a location of:

That if said well is productive, Applicant can drill, test, complete and
produce same from any formation covered hereby and that this Order is temporary and is
subject to the final determination of the Commission in this cause .
This Emergency Order shall expire on the earlier of 90 days upon issuance
or upon issuance of the Final Order.
