OVERVIEW
Senator Adolpho B. Palacios, Sr., convened the public hearing on May 20, 2011 at 9:05
a.m. in I Liheslatura's Public Hearing Room. Among the items on the agenda was the
consideration of Reso1ution No. 85-31 (COR) - "Relative to encouraging the members of
the Guam Chamber of Commerce and the Islandwide Business Community to provide
their employees with the opportunity for work site assignment preference, wherever
practical and without adversely affecting the operations of the busineSSi in an effort to
assist the employees in the escalation price of gasoline, to minimizing travel time to and
from work, and to encourage car pooling," sponsored by Senator Adolpho B. Palacios,
Sr.
Public Hearing Requirements:
Notices of the hearing were disseminated via facsimile and email to all senators and all
main media broadcasting outlets on May 12, 2011 (5-day Notice) and on May 17, 2011
(48-Hour notice) pursuant to meeting the requirements of the Open Government Law.
Notice of the hearing was also posted on the Guam Legislatu re's website.

SUMMARY OF TESTIMONIES
Senator Adolpho B. Palacios, Sr. convened the public hearing at 9:05 a.m., read the title
of Resolution 85-31 (COR) and summarized the contents thereof.
recognized the presence of Senator Mana Silva Taijeron.
The Senator
Senator Palacios stated that arranging work assignments at private businesses can make
work more convenient and make transportation to work less expensive. He explained
that it is intended to apply to those businesses with multiple locations. The business
would solicit requests from its employees for assignment to work sites close to their
home, so that they can save time and gasoline.
Senator Palacios stated that Bill 169-31 (COR) would address a similar issue for the
government of Guam, where there may be multiple worksites and employees could be
assigned closer to their homes, saving time and gasoline. He stated that the high cost of
gasoline is affecting employees and that when it is achievable without adversely
affecting operations of agencies or businesses, there is a gain for the community.
Senator Palacios announced the public hearing of Bill 169-31 (COR). Resolution 85-31
(COR) is not a mandate, but a recommendation for local businesses to employ a policy
that will help their employees save gasoline, travel time and encourage car pooling.
Senator Palacios called Ivan Carbullido to testify.
Ivan Carbullido supports the resolution. He stated that businesses and workers can
help each other by communicating about transportation issues. He said that with
proper communication between the employer and employee can result in the
convenient assignment of employees to locations which are relatively close to their
home, saving gas and time. He believes that the resolution is simple and practical for
businesses. He stated that this resolution is good for employers on Guam. Mr.
Carbullido thanked the Senator for offering the resolution.
Senator Mana Silva Taijeron stated that she agrees with the intent of the resolution. She
said that it can help employers and employees.
Senator Adolpho B. Palacios, Sr., declared that Res. No. 85-31 (COR) is duly heard. The
Senator concluded the hearing and requested that written testimony be submitted. He
adjourned the hearing at 9:20 a.m.

MINIMIZING TRAVEL TIME TO AND FROM WORK, AND TO
ENCOURAGE CAR POOLING.
BE IT RESOLVED BY I MINA'TRENTAI UNO NA LIHESLATURAN GuAHAN:
WHEREAS, I Liheslaturan Guahan recognizes that the price of gasoline and fuel over

the past few years have continued to increase, directly affecting the cost of operating
3
businesses and has also affected the pocketbooks of Guam residents; and
4
WHEREAS, The business community has truly exemplified its leadership
5
throughout the island community by implementing cost reduction measures and
6
encouraging efficiencies as a result of these escalating costs and the need to remain
7
competitive within the business environment on Guam; and
8
WHEREAS, Local business owners and managers in different ways exhibit support
9
for their employees through assisting in co-financing medical and dental insurance
1
expenses, and further provide assistance to many of the employee's family members
2
during their extreme time of need; and
3
WHEREAS, 1 Liheslaturan Guahan has recently introduced several pieces of
4
legislation that acknowledges the ever-increasing costs in gasoline and fuel, and which
5
provide for various alternatives for government of Guam agencies and entities to identify
6
and implement necessary measures to realize cost reduction in the area of fuel and gasoline
7
consumption; and
8
WHEREAS, a critical piece of legislation that was recently introduced into I Mina
9
Trentai Uno Na Liheslaturan Guahan, and if passed into law, would provide for government

of Guam agency heads to implement the practice of work site preference for public
11
employees, thereby allowing for employees to work, whenever practical and with no
12
negative impact to agency operations, at a location closest to their respective homes or the
13
work of their spouses; and
14
WHEREAS, the implementation of work site preference would allow for the
15
following: reduce the amount of gasoline usage by the employees, minimize the distance
16
required for the employees to travel to their work sites, reduce the traffic congestion on
17
Guam's roads, serve as an incentive to encourage car pooling, and provide added
18
convenience for employees and family members; now, therefore, be it
19
RESOLVED, that I Mina'Trentai Uno na Liheslaturan Guahan does hereby, on behalf
20
of the people of Guam, encourage the members of the Guam Chamber of Commerce and
2
the business community to implement, to the greatest extent possible and without
2
adversely affecting the operations of their respective businesses, a work site preference
3
program for their employees, allowing the employees to work at a location closest to the
4
employee's home or the spouse's work site; an approach that could provide mutual
5
benefits to the business and its employees, through lessening the travel time to and from
6
work, reducing the amount of gasoline usage by the employees, reducing the traffic
7
congestion on Guam's roadways, encouraging car pooling amongst family members, and
8
improving employee and management morale within the business; and be it further
9
RESOLVED, that the Speaker certify and the Secretary of the Legislature attest to,

the adoption hereof, and that copies of the same be thereafter transmitted to the Honorable
11
Kaleo S. Moylan (former Lt. Governor of Guam), Chairman of the Guam Chamber of
12
Commerce; Chairman of the Chinese Chamber of Commerce; Chairpersons, Rotary Clubs
13
of Guam; Chairpersons, Guam Contractors Association; Chairperson, Guam Visitors
14
Bureau; and to the Honorable Edward J.B. Calvo, I Maga'lahen Guahan.
