Leisure Plus Card Terms and Conditions Leisure Plus card 1. Leisure Plus cards are non-transferable and remain the property of Chelmsford City Council. 2. The cards may not be used by the individual after the expiry date unless they have been renewed. 3. A Leisure Plus card is specific to that individual and can only be used by them. Prices are based on an individual's Leisure Plus card category and only apply to the person booking the activity and not to additional users, such as friends or family (unless they hold the same Leisure Plus card). If a card holder participates with a non-card holder on an activity, the non-card holder price will apply (e.g. for court bookings). 4. Both residents of the City of Chelmsford and non-residents are entitled to the special "Leisure Plus card holder prices" as long as they hold one of these cards. 5. The Leisure Plus card must be produced on every occasion to obtain these special charges. 6. Customers who do not have one of the Leisure Plus cards will be charged either the junior (0-15 years) or adult (16 years+) non-card holder price for that activity. 7. To receive concessionary prices, you must be a LC6 (Senior), LC7 (Access) or LC8 (Access Plus) Leisure Plus card holder. Proof of eligibility must be provided on joining the scheme and at any additional specified periods. 8. Certain activities may have additional terms and conditions. Please refer to the price leaflet for your Leisure Plus card category. 9. The giving of incorrect information with the intent on defrauding the Council, improper use or unacceptable behaviour, will result in cancellation of the card and any other appropriate action deemed necessary. 10. Customers will be charged £1 to replace damaged, defaced or lost cards. 11. The administration of this scheme is computerised. All information provided will remain confidential to Chelmsford City Council and will be used in accordance to the provisions of the Data Protection Act. This information will not be passed onto third parties. 12. In compliance with the Data Protection Act 1998, information collected on this form will be added to the Leisure Plus database. Chelmsford City Council may also use this information for administrative and service communication purposes. All information will be treated confidentially and will not be shared with other organisations. We may contact you via email, telephone, mobile or post to make you aware of various offers, activities and benefits related to the Leisure Plus card. You are entitled however to opt out of receiving promotional information from us at any stage via emailing [email protected] General Terms & Conditions 1. Pricing Both residents of the City of Chelmsford and non-residents are entitled to the special Chelmsford Leisure Card holder casual pay and play prices as long as they hold one of these cards (LC1-9). Customers who do not have one of the Chelmsford Leisure Cards will be charged either the junior (0-15 years) or adult (16 years+) non-leisure card holder price for that activity. To receive concessionary prices on casual pay & play and monthly memberships, you must be a LC6 (Senior), LC7 (Access) or LC8 (Access Plus) Chelmsford Leisure Card holder. The prices listed only apply to the person booking the activity and not to additional users, such as friends or family (unless they hold the same Chelmsford Leisure Card). 2. Session Times Some activities operate peak & off-peak pricing. For more information please check the session times for that activity and/or centre. 3. Excel Health and Fitness The gyms and exercise classes are available to those aged 14 years and over at RILC and 16 years and over for CSAC, DSC & SWFLC. An induction must be completed prior to using the gym. Customers completing an induction at the gym other than RILC/CSAC must purchase a TGS (Technogym) key if they want to use RILC/CSAC as an additional site to their main gym. Sports Hall Sports hall activities available may differ between leisure centres - please ask at reception for details. These sports halls are multi-use facilities so activities available may be dependent on other bookings taking place at the same time in the same facility. Whole Hall is four courts at SWFLC (South Woodham Ferrers Leisure Centre) & CSAC (Chelmsford Sport & Athletics Centre), 5 courts at DSC (Dovedale Sports Centre) & six courts at RILC (Riverside Ice & Leisure Centre). Chelmsford City Council reserves the right to relocate court bookings to an alternative court to the one booked online for operational purposes. 5. Crèche & Kool Kids (Soft Play) Please refer to Riverside Ice and Leisure 'Child's play' leaflet for more information including terms and conditions. Please note that the crèche is for under-fives only. 6. Group Bookings: To obtain the group rate at Riverside Ice and Leisure for specific swimming and ice-skating sessions, you need to have a minimum of 12 people and have booked the session at least 7 days in advance. Additional ice session discounts may be available for sessions where skate hire is not included. Normal spectator charges apply to groups. 7. Booking Privilege Chelmsford Leisure Card holders can book up to seven days in advance. Non leisure card holders are able to book up to a maximum of two days in advance in person or by telephone only. 8. Loyalty Points Refer to specific terms and conditions below. 9. Online Booking Cancellation / Refund Policy A minimum of 24 hours’ notice is required for cancellation of any activity booked online, except for fitness classes and crèche bookings where a minimum of two hours’ notice is required. Failure to do so will result in the card holder being liable for the full cost of the session. Arrears payments must be made within seven days, or the card holder will be unable to book any further activities and any existing bookings cancelled. Refunds or credit notes can only be made via contacting the relevant centre direct and providing sufficient notification to cancel has been given. No refunds can be made online. Cancellations cannot be made online unless you are a direct debit member and the activity is included in your membership. All other customers must contact the relevant centre direct. A customer must be a Leisure Plus card holder to receive sports loyalty points. 15. Loyalty 'points' can only be gained for and used as 'credit' against specified activities. 16. Customers will not gain points when paying for the following: group bookings; individual, club, school and contract hire of facilities and staff; league registrations and match fees; special events; catering facilities on site and vending machines; resale items; lessons with ice professionals. 17. Points will only be collected if a customer swipes their card (or provides their customer / card number on booking) every time they use the sites included within the scheme. 18. Points are specific to each leisure centre (e.g. points gained at Riverside Ice & Leisure can only be redeemed as credit against activities at this centre). If a customer uses more than one leisure centre, their account will hold all of their points 'credit' separately with each relevant centre. The contract between you and us As a member you agree to follow the rules of membership relating to using our centres and your behaviour within Chelmsford City Council centres. 2. How long will my membership last? Your membership commitment period is for a minimum of 6 months at the agreed monthly rate (Excluding any freeze months). (Unless you have purchased a temporary Student membership, where the expiry date will be written on your application). After this, your membership will automatically renew on a month to month basis unless you or we end your membership in accordance with section 3 or 6. Regardless of what day in a month your membership starts it will count as a full month in relation to your sixth month commitment period. You will be given a least 30 days written notice of any future increase in fees. 3. What happens if I change my mind and want to cancel my membership? As long as you have not used your membership and you inform us in writing within seven days of signing these terms and conditions we will refund any membership fees you have paid to us. 4. How can I suspend or freeze my membership? If you wish to put your membership on freeze you must do so by requesting a form from reception, no later than the 17th day of the previous month that you wish your freeze period to start. You may freeze for a maximum of 3 months at a time in whole calendar months only. If you are within your initial 6 months commitment period a freeze fee charge of £5 per freeze month applies. Freeze months do not count towards your commitment period. When you’re agreed freeze period ends your monthly direct debit membership will automatically return to the agreed monthly amount. 5. Late Payments If you fail to make payments due under this contract, we may contact an external agency or other organisation to help us collect payment from you. We will only do this after we have written to you (at the postal address we have on our records, it is your responsibility to advise us to any changes in your details). We also have the right to suspend your membership and refuse you entry to all of our leisure centres until you have paid the full amount you owe. If you are in your 6 month commitment period when you fall behind with paying your membership fees, we will continue to add your fees for the rest of that period to the amount you owe. 6. How can I end my membership? You may not end your membership within your initial 6 month commitment period unless you qualify under the following reasons: a. You are unable to use our centres due to serious illness or injury that is likely to mean you cannot use a centre for at least two calendar months. You must provide reasonable professional evidence of this such as a doctor’s certificate or letter. b. You are made redundant and provide us with reasonable evidence, such as a letter from your employer or proof of job seekers allowance. c. You move out of the Chelmsford Borough and provide sufficient evidence of this, such as a council tax bill. Please note we will not back date cancellations and will only cancel memberships in accordance with the conditions above once the relevant proof has been received. If you have completed your minimum 6 months contract period you may cancel your membership by giving us notice in writing no later than the 17th day of the previous month that you wish to cancel. Once this is received by us you are free to cancel your direct debit with your bank. You may only downgrade your membership once you have completed your six months commitment period. Data Protection Chelmsford City Council collects information on its leisure centre customers through their Leisure Cards and Memberships. The details are kept in electronic format /on file by Chelmsford City Council and encrypted where appropriate. These are kept for ‘operational purposes’ to provide an efficient and effective level of service for customers on booking or using its services. These details are also utilised for ‘promotional purposes’ to keep customers informed about changes to existing and new activities, courses, events and services that might be of interest. Details on the system are not disclosed to third parties outside of services operated by Chelmsford City Council. If you do not wish to receive information distributed for ‘promotional purposes’, please fill in the relevant exclusion forms available at the leisure centre receptions. 8. Chelmsford City Council reserves the right to change the conditions (including the range of activities and times when these are applicable) of the Memberships. All members affected by any changes to their Membership packages will be notified in advance and shall be entitled to terminate their Membership with effect from the date of the amended conditions. 9. Chelmsford City Council reserves the right to terminate a Members Membership Agreement if the Member breaches this contract and/or breaches the rules of any other Chelmsford City Council leisure facility or for any other reason that Chelmsford City Council deems appropriate. Leisure facility rules are displayed throughout the premises in the individual areas of use. 10. Use of the gym equipment at any of Chelmsford City Council’s four gyms is only permitted once an induction has been completed. If an induction was booked prior to taking up a Membership, the induction cost will be refunded only if a monthly gym membership is taken up on the day of that booked induction. A Technogym key is not included in the inductions at Riverside Ice and Leisure and Chelmsford Sport & Athletics Centre and must be purchased separately for use at these sites. 11. The gym equipment varies between all four gyms operated by the Council. It is up to the Member to request an induction ‘top up’ when using new or different equipment at a gym other than their main site where they had their original gym induction. This will be provided free of charge to all those on a monthly Membership package but may be subject to staff availability. 12. Children must be 14 years or over to use the Gym and Exercise Classes at Riverside Ice and Leisure Centre (exclusions apply, see class brochure) and 16 years or over at Chelmsford Sport & Athletics Centre (CSAC), Dovedale Sports Centre (Dovedale) & South Woodham Ferrers Leisure Centre (SWF Leisure Centre). 13. Where a court is booked by a Member, the Member must be one of those playing on any court booked. Only one ‘free of charge session’ can be booked per day. Members booking courts outside the hours included in their Membership will have to pay the standard or applicable activity charge for that centre. 14. A Member can only book a child into the crèche at Riverside if they are the parent or legal guardian of that child and the child is aged from six weeks up until the child’s 5th birthday. The Member must remain within the Centre during the crèche booking. Sessions for the crèche are one hour in length and either start on the hour or at half past the hour. Children will not be allowed into the crèche before their booking starts. Only one 'free of charge' session can be booked per day. Any additional time (maximum of two hours total per day) must be paid for at reception. This applies to one child only. Additional children must be paid for. 15. External facilities included in the Memberships (e.g. casual athletics and MUGA) do not include the use of floodlights. If these are required, they must be paid for separately . Car parking is subject to availability and cannot be guaranteed. Certain Membership packages include a parking permit for Riverside-Victoria Road car park, where the Membership is taken out at Riverside Ice and Leisure centre. This allows free parking whilst the customer is using the centre as long as the correct permit is displayed. A maximum of 3 hours of parking is permitted per day. Please refer to the Riverside car park permit terms and conditions. 17. Chelmsford City Council reserves the right to adjust the opening and/or closing hours of any of its leisure centres or to close off areas to the public for the purpose of cleaning, decorating and repairs for specific functions and holidays. Customers will be kept informed of these changes in advance (where possible) through notices at the centre and on its website/s. 18. The Membership agreement is specific to the individual. Partners or children of the Member must obtain their own Membership. All bookings made as part of the Membership are purely for the Member. The Membership card must not be passed to another person for use. Regular checks will be carried out to ensure this is adhered to. 19. An individual will be required to have their photograph taken as part of the Membership registration process, (unless one has been taken within the last 12 months as part of the individual’s leisure card application). This will be used for identification purposes and will be held electronically on the Council’s computer system. Anyone found to be misusing their card may result in their membership being terminated and any membership fees already paid will be lost. 20. Membership fees are reviewed annually. Written notification will be given to each member at least one month before any changes are implemented. You may give notice to cancel within 45 days of the price increase regardless of your commitment period. 21. Members must produce their card at reception desk upon each visit to the centre. They will be issued with a ticket at reception for activities even though no payment is required. This is an important health and safety requirement should an evacuation in the event of an emergency take place. The ticket is valid from the start until the end of the session time only. At Riverside you may use the fast tracker barrier and kiosk. 22. Booking (up to 10 days in advance for members) on all applicable activities (such as exercise classes, squash, climbing wall, MUGA and crèche) is strongly recommended. All sessions are subject to availability and cannot be guaranteed. When facilities are full to capacity you may be asked to wait until space is available. 23. If a booked activity session is overrun, or the member is late in collecting their child from the crèche (Riverside only), and a new session time has started, the member will be charged for the additional session that was not booked. This will be added to the computer system and no new booking can be made until this has been paid for. 24. Members are required to give a minimum of 24 hours’ notice of cancellation of a booked activity (2 hrs for fitness classes and crèche bookings). Failure to do so will result in the member being liable for the full cost of the session. Any arrears must be paid within 7 days or the member will be unable to book any further activities and all those already pre booked will be cancelled until this payment has been made. 25. Monthly Members are excluded from the loyalty point scheme and will not gain points for their direct debit payments; however any points accumulated prior to April 2014 or accumulated before joining on a monthly membership may still be used against activities not included within the membership. 26. Certain sessions are defined as “public sessions” within the swimming pool and ice rink timetables. These exclude ‘special sessions’ such as ‘School Holiday Disco Skate’ and all ice “disco” sessions which are already at a promotional discounted rate. 27. “Anytime” allows use by the Member at any time within the centre and/or facilities’ opening / closing hours or when that activity is available. This covers both peak and off peak hours where applicable. “Daytime” exercise classes are those run before 5.00pm from Monday Friday inclusive. The birthday child will receive sports loyalty points on booking a party at one of the Council’s four leisure centres where included in their membership. Only one party per child per annum will receive these points. The child’s Membership number must be quoted on booking to ensure that points are allocated to their account. 30. Car parking at Riverside – Car parking permits at Riverside must be returned by the last day of your membership. Failure to return will result in your membership continuing on a monthly basis until this has been returned. Failure to display a valid permit may result in a fine. It is the member’s responsibility to renew their permit within the centre each year. Renewal date is the first of April each year.
