VISA RIO 2016 OLYMPIC GAMES LUCKY DRAW PROMOTION TERMS AND CONDITION
Definitions










"Account" means a personal Singapore issued Maybank Visa credit and/or debit card account
maintained by the Maybank Cardmember which has not been terminated and in the sole discretion of
Maybank is in good standing.
"Card" means either a Maybank Visa credit or debit card.
"Chance" means one opportunity to win the Draw.
"Draw" means the lucky draw to be conducted by Maybank in accordance with these terms and
conditions.
"Maybank" means Malayan Banking Berhad, Singapore branch.
"Maybank Cardmember" means a person who is a principal cardmember to whom Maybank has
issued a Card.
"Prize" means one (1) pair of tickets to catch the Rio 2016 Olympic Games in Rio de Janeiro, Brazil
from 3-7 August 2016, including economy flight tickets with airport and hotel transfer and four (4)
nights deluxe hotel accommodation.
1. There will be one (1) Prize to be given away in this Draw where one (1) Winner will be
randomly selected for the same Prize.
2. The Winner shall accept the Prize “as is”. Maybank makes no representation or warranty
whatsoever as to the quality or fitness for purpose or any other implied terms or conditions
with respect to the Prize. Maybank assumes no responsibility or liability for the acts or
defects of the merchant(s), or for any delay, postponement, non-delivery, non-performance
or defects in the Prize. Maybank is not an agent of the merchant(s) supplying the Prize. Any
dispute about the quality or performance of the Prize must be resolved directly with the
respective merchant(s).
3. The use of the Prize is also subject to such other terms and conditions as may be imposed by
the respective merchant(s) supplying the Prize.
4. The “Prize” does not include the following (such list is not exhaustive):
a) Travel visa and other travel related expenses;
b) Long distance phone calls, room service, laundry, mini bar items, room service, loss of
hotel property, damage to hotel property, or any other expenses incurred in the hotel;
c) Personal expenses unrelated to the Prize (shopping, transportation during free time,
food expenses aside from scheduled meals);
d) Transportation during Winner’s and guest’s free time;
e) Any personal tax that may be levied on guests with respect to their receipt of the Prize or
any part thereof.
"Qualifying Period" means the period from 1 April 2016 and 22 May 2016 (both dates inclusive).
"Retail Transaction" means an approved retail payment made by the Maybank Cardmember using
his/her Card. A Retail Transaction excludes 0% Instalment Payment Plan transactions, EZ-Link
transactions, Transitlink transactions, cash advances, fund transfers, reversals, money transfers,
annual fees and finance charges, any form of online payment gateway transactions such as Paypal
transactions, BidPay transactions, gambling transactions and Skrill transactions, are also excluded and
will not be taken into consideration for the purpose of the Draw.
"Winner" means the Maybank Cardmember who is the winner of the Prize.
Definitions importing the singular shall include the plural and vice versa.
Eligibility
1) All Maybank Cardmembers whose Accounts are open and in good standing during the Qualifying
Period are eligible to participate in the Draw except for:
a) Holders of other Maybank issued credit and debit cards other than Maybank Visa credit and
debit cards;
b) Holders of Business Cards, Prepaid Cards and ATM Cards;
c) Supplementary cardmembers. For avoidance of doubt, the benefit of all charges incurred by
a supplementary cardmember in respect of the Draw shall accrue to the eligible Maybank
Cardmember. Termination of a supplementary cardmember’s account will not by itself
disqualify the eligible Maybank Cardmember from the Draw;
d) Maybank employees (and their immediate families) and employees of its advertising
agencies or sponsors;
e) Maybank Cardmembers whose Accounts are terminated between 1 April and 13 June 2016
(both dates inclusive);
f) Any other accounts that are deemed to be delinquent or unsatisfactorily conducted by
Maybank at its sole and absolute discretion.
2) To be eligible for the Draw, the eligible Maybank Cardmembers must send an SMS to Maybank to
register their participation in this promotion. If Maybank receives an eligible SMS in the correct
format within the Qualifying Period, the Maybank Cardmember will receive an auto-reply SMS from
Maybank.
3) Proof of charge slips is not proof of eligible spending. Retail Transactions as reflected in the monthly
statement of Account shall constitute proof of eligible spending for purposes of the Draw.
4) By participating in the Draw and/or by accepting the Prize, participants agree to abide by the terms
and conditions stated herein.
Awarding of Chances
During the Qualifying Period, each eligible Maybank Cardmember will receive the Chances as set out below:
1) One (1) Chance to participate in the Draw shall be awarded for every S$50 accumulated in eligible
Retail Transactions posted to the Maybank Cardmember’s Account and his/her supplementary
cardmember’s account (if any) during the Qualifying Period. The Chances shall be awarded to the
Maybank Cardmember’s Account only.
2) 50 bonus Chances shall be posted to the Maybank Cardmember’s Account for every S$5,000
accumulated spending in eligible Retail Transactions by such Maybank Cardmember and his/her
supplementary cardmember (if any) during the Qualifying Period. Such bonus Chances shall be
awarded to the Maybank Cardmember’s Account only.
3) Only Retail Transactions charged during the Qualifying Period and posted to the Maybank
Cardmember’s monthly statement of Account shall constitute proof of eligible spending for purposes
of the Draw. Eligible Retail Transactions must be posted to the Account by 28 May 2016 .
4) Maybank shall not be responsible for any failure or delay in the transmission of evidence of Retail
Transactions by merchant establishments, postal or telecommunication authorities or any other party
which may result in a charge incurred by the eligible Maybank Cardmember and/or his/her
supplementary credit cardmember(s) as being omitted from the allocation of Draw chances by
Maybank during the Qualifying Period.
5) Chances accumulated are not transferable and will be cancelled by Maybank, without incurring any
liability, upon the suspension, cancellation and/or termination of any Account.
6) Chances cannot be transferred to or combined with Chances awarded to any other Maybank
Cardmember’s Account.
7) In the event that an Account is closed and a new Account is opened, Chances from the closed Account
will not be transferred to the new Account.
8) For Retail Transactions for which Chances are awarded and are subsequently cancelled or reversed,
Chances awarded will be automatically deducted.
9) Maybank reserves the right at any time to withdraw, cancel or invalidate the number of Chances
assigned to any Account without notice or reason.
10) Maybank’s transaction records and the total number of Chances allocated to a Maybank Cardmember
shall be final and conclusive. No correspondence will be entertained.
Draw
1) The Draw will be conducted on 13 June 2016 or such other date as Maybank may determine at its sole
discretion at Maybank Tower Level 1, 2 Battery Road, Singapore 049907 or such other venue as may
be determined by Maybank via a manual draw.
2) The Prize will only be awarded to the Winner.
3) Maybank reserves the right to draw a reserve winner to substitute the Winner subsequently found to
be disqualified. Maybank’s determination of the Winner shall be final, conclusive and binding. No
correspondence or claims will be entertained.
4) The Winner shall be notified by ordinary post and/or contacted via telephone at his/her last known
contact on record with Maybank. Except for notification to the Winner, Maybank is not obliged to
enter into any correspondence with any person on any matter concerning the Draw.
5) Results will be announced on Maybank’s website at www.maybank2u.com.sg within seven (7)
working days after the Draw date.
6) Maybank reserves the right to claim the full cost of the Prize from the Winner in the event that: a) an
eligible card Retail Transaction is cancelled or reversed after the Prize has been awarded; b) the
Winner’s Account is closed/terminated for whatever reason (whether by the Maybank Cardmember,
Maybank or otherwise) within six (6) months from the date the Winner receives the Prize; or c) it is
determined by Maybank that the Winner has breached one of the terms stated herein. In such cases,
the Winner authorises Maybank to debit his/her Account for the full cost of the Prize prior to the
closure or termination of his/her Account or deduct it from any other account the Winner holds with
Maybank.
7) Any unclaimed Prize will be forfeited. Any Winner whose Prize has been forfeited shall not be entitled
to any payment or compensation notwithstanding non-receipt of notification.
8) The Prize is neither transferable nor exchangeable for cash, credit or otherwise. Maybank may, at any
time without notice in its sole and absolute discretion, substitute the Prize with another prize of
similar value without notice and liability to any person.
9) Maybank shall not be responsible for any other consequences including but not limited to loss of life,
injury to person and/or damage to property arising from or in connection with the Draw and/or use of
the Prize, lost, late, misdirected, damaged, incomplete, illegible or postage-due mail, or transactions
that are processed late, incorrectly or lost due to computer or other electronic breakdown or
malfunction or any other reason.
General
1) Maybank Cardmembers hereby authorise Maybank to disclose and publish their names and other
particulars in accordance with applicable law, in the event that he/she wins the Prize.
2) The Winner consents to attend a Prize presentation and/or participate in publicity programmes. All
expenses and/or costs incurred for such attendance shall be borne by the Winner and Maybank
reserves the right to use the name, address, photographs, information, particulars and/or documents
of the Winner in any advertisement or other forms of publicity from time to time.
3) Maybank shall have the sole and absolute discretion to exclude any person from participating in the
Draw without any obligation to furnish any notice and/or reason.
4) Maybank reserves the right in its sole and absolute discretion to vary, delete or add to any of these
terms and conditions from time to time or terminate the Draw at any time without notice or liability
to any person.
5) Maybank, its related corporations, employees and/or independent contractors shall not be liable to
any person for any loss, damage and/or injury whatsoever or howsoever caused arising from the
Draw or the use of the Prize.
6) Maybank’s decision on all matters relating to the Draw (including without limitation the Chances
awarded to the Maybank Cardmembers and the selection of the Winner of the Draw) shall be final,
conclusive and binding on all participants.
7) Maybank may at any time waive either unconditionally or on such terms and conditions as Maybank
deems fit in its discretion any right it has under these terms and conditions, however any such waiver
shall not preclude Maybank from exercising such rights in the future.
8) In the event of any inconsistency between these terms and conditions and any brochure, marketing
or promotional material relating to the promotion, these terms and conditions shall prevail.
9) These terms and conditions shall be governed by the laws of Singapore and the participants of the
Draw irrevocably submit to the non-exclusive jurisdiction of the courts of Singapore.
10) A person who is not a party to any agreement governed by these terms and conditions shall have no
right under the Contracts (Rights of Third Parties) Act (Cap 53B) to enforce any of these terms and
conditions.
