FIRST AMENDMENT TO INTERLOCAL
AGREEMENT TRANSFER OF “JIMS” MUNICIPAL
COURT HARDWARE AND SOFTWARE TO THE
CITY
This FIRST AMENDMENT TO INTERLOCAL AGREEMENT TRANSFER OF
“JIMS” MUNICIPAL COURT HARDWARE AND SOFTWARE TO THE CITY (this “First
Amendment”) is executed effective for all purposes as of this _____ day of December, 2015, by
and between the City of El Paso, a Texas home rule municipal corporation (the “City”), and the
County of El Paso (the “County”).
RECITALS
WHEREAS, the City uses the JIMS Municipal Court System which was owned and
maintained by the County;
WHEREAS, on or about October 31, 2013, the City and Contractor entered into an
interlocal agreement (the “Original Interlocal”) pursuant to the Texas Government Code,
section 791.003(4) to transfer the ownership and maintenance responsibilities for the JIMS
hardware and software from the County and the City and to enter into related agreements for the
ongoing location and support of the equipment and software until the City purchases its
replacement system; and
WHEREAS, the City purchased the JIMS hardware for $33,050.00 and entered into
related license and maintenance agreement; and
WHEREAS, the County allowed the JIMS Municipal Court System to reside on the
County’s domain and within the County’s Datacenter until December 31, 2015 for $78,000.00;
and
WHEREAS, the parties desire to extend the term for the JIMS Municipal Court System
to reside on the County’s domain and within the County’s Datacenter under the same terms and
conditions set in the Original Interlocal.

AGREEMENT:
NOW THEREFORE, in consideration of the mutual promises set forth in this First
Amendment, and for other good and valuable consideration, the receipt and sufficiency of which
are hereby acknowledged, the parties hereto agree as follows:
1. The parties have agreed, as of the effective date of this First Amendment, to extend
the term that the JIMS Municipal Court System will reside on the County’s domain and within
the County’s Datacenter through December 31, 2016 under the same terms and conditions set in
the Original Interlocal. The parties may agree to extend the term for an additional year through
December 31, 2017 under the same terms and conditions set in the Original Interlocal.
2. Except as set forth herein, all terms and conditions of the Original Interlocal and all
subsequent Amendments thereto shall remain in full force and effect.
IN WITNESS WHEREOF, the parties hereto execute this First Amendment in El Paso,
Texas, effective as of the date first written above.
